Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
March 16, 1964
The Village Council met in Special Session and was called to order by
Mayor Gordon Erickson at 7 :30 P.M.
Roll Call: Mayor Gordon Erickson, Phil Cohen, Henry Dorff, Howard
Heck and John Leary were present.
Motion by John Leary and seconded by Henry Dorff to approve the
minutes of the Council meeting of March 9th as ameed, Motion carried
unanimously.
Motion by John Leary and seconded by Howard Heck to grant the
request of the Dayton Development Company regarding special assessments
on their property and the cost be assessed on the same basis as in the
past (15 years). Motion carried unanimously.
Motion by Phil Cohen and seconded by John Leary to approve action
of Planning Commission on application #64011 submitted by Bridgemens
Creamery for a Special Use Permit for a Drive -In Ice Cream Store and the
approval granted PPro gr February 17, 1964 by the Village Council, be amended to
permit one (1) free standing advertising sign 21 feet in height to be located
54 feet from the Osseo Road. The approval of the sign shall become a part
of the Special Use Permit and shall conform to the design on file. Motion
carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to table action
on application 64014 pending receipt of letter from applicant withdrawing
application. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen to uphold the action
of the Planning Commission and approve application #64016 submitted by

and sales office at 6214 Fremont Avenue North be extended for a period of
1 year from April 1, 1964 to April 1, 1965 provided: There shall be no
outdoor display of fences, patio blocks, building materials or building
accessories. The sole purpose of the permit is for the sale of garages, and
the Village Council shall reserve the right to refuse any subsequent application
for renewal of the permit. Motion carried unanimously.
Motion by Henry Dorff and seconded by Howard Heck to uphold the
action of the Planning Commission and approve application #64017 submitted
by C.E. Sellars and that permission be granted to divide the West 126' of
the East 156' of lot #57 lying North of the South 465.2' Auditors Subdivision
#218 into two lots with the southerly lot being 75' x 126' and the Northerly
lot being 7$.5 x 126 with a variance on the idth

Motion by Howard Heck and seconded by Henry Dorff to uphold the
action of the Planning Commission and approve application #64022 submitted
by Clyde Scanlon and grant a Special Use Permit to store and rent trailers
at the Pure Oil Station,, 6901 Osseo Road. Motion carried unanimously,
Motion by Phil Cohen and seconded by John Lary to uphold the
action of the Planning Commission and deny application #64024 submitted
by Mary Simmons for a Special Use Permit for a duplex in an R -1 district
and the dwelling at 5530 Camden Avenue North be made to conform to the
zoning regulations not later than July 31, 1964. Motion carried unanimously.

Motion by John Leary and seconded by Howard Heck to uphold the
action of the Planning Commission and approve application #64023
submitted by Wayne Copeland and grant a variance to permit construction
of a single family dwelling on a 50' x 135' substandard lot at 5206 Ewing
Avenue North. Motion carried unanimously„
Motion by Howard Heck and seconded by Phil Cohen to uphold the
action of the Planning Commission and approve application #64025
submitted by A. J. Spanjers Company as follows:
1. Variance on West side yard setback from 25' to 20'.
2. Variance on front yard setback from 30 feet to 14.7 feet:.
3. A properly drawn legal instrument, executed by A.J. Spanjers
Company and Lynbrook Bowl providing 25 car spaces for joint
use of off street parking facilities on the Lynbrook Bowl property
shall be filed with the Village Clerk.
Motion carried unanimously.
Motion by John Leary and seconded by Howard Heck to uphold the
action of the Planning Commission and approve application #64015 submitted
by Carl E. Bennett Construction Company and grant a variance on the sign
requirements to permit a 8' x 5' sign having a total height of 8' to be erected
and maintained at 4100 - 69th Avenue for a period of 1 year from April 1, 1964
to April 1, 1965 or until the houses in the project are sold whichever is
sooner. Motion carried unanimously.
Motion by Henry Dorff and seconded by Phil Cohen to uphold the
action of the Planning Commission and approve application #64018 submitted
by William J. West and grant a Special Use Permit to store and rent trailers
at the Pure Oil Station, 5700 North Lilac Drive provided the parking of said
trailers is confined to the East side of the property and no closer than 15
feet to the South property line. Motion carried unanimously.
Motion by Phil Cohen and seconded by John Leary to uphold the action
of the Planning Commission and approve application #64020 as submitted by
the Dayton Development Company for the preliminary plat of Brookdale 1 st
Addition subject to the requirements of the platting ordinance. Motion
carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to uphold the
action of the Planning Commission and approve application #64021 as
submitted by the Dayton Development Company that Lot 1, Block 1, Brookdale
lst Addition be rezoned from I -1 to B -3. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen to table action on
application #64021 for one week regarding plot plan, parking layout and
building plans. Motion carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to authorize the
Mayor and the Clerk to sign the final plat of Brookdale First Addition .
Motion carried unanimously.
Motion by Henry Dorff and seconded by Phil Cohen to table action
for one week on application #64019 submitted by the Phillips Petroleum
Company for a Special Use Permit to construct a gasoline service station
at 6850 Osseo Road. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen that the Administrator
take action to issue certificates of indebtedness necessary to retire voting
machine debt. Motion carried unanimously.
Motion by Heiuy Dorff and seconded by Howard Heck that the
Administrator direct the Finance Director to furnish weekly cash balances
in all funds to the Village Treasurer. Motion carried unanimously.

Member john Leary introduced the following ordinance and moved
its adoption:
AN ORDINANCE AMENDING SECTIONS 23 -503, 23 -504, 23 -505
23 -507 AND 23 -508 OF THE VILLAGE ORDINANCES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN
AS FOLLOWS:
Section 1: Section 23 -503 (a) is hereby amended to read as follows:
Section 2-503 FORM OF LICENSE. (a) The Village Clerk shall
maintain at the Village Hall suitable records of registrations under this
ordinance. On receipt of the license fee herein provided for he shall
provide a suitable identification tag upon which shall be stamped or
printed suitable distinguishing letters or numbers. The owner shall affix
and keep affixed to the bicycle for which the tag is issued, the original
identification tag, and shall keep such tag clean and visible at all times.
The Village Clerk may, in addition cause to be imprinted o stamped on
the bicycle a suitable registration number, and it shall be unlawful to remove
,or deface such number.
Section 2: Section 23 -504 is hereby amended to read as follows:
Section 23 -504. FEE. The biennial license fee is seventy -five PS01
cents, and shall be paid on or before the 1st day of July In each even
numbered year. Upon change of ownership, the license tag shall be registered
in the name of the new owner upon payment by the new owner of a fee of
twenty -five (25�) cents, All receipts from license and transfer applications
shall be remitted by the Village Clerk to the Village Treasurer,
Section 3: Section 23 -505 is hereby amended to read as follows:
Section 23- -50§ -. LOSS OF LICENSE TAGS. Tags shall not be
transferred from one bicycle to another and no person shall attach to any
bicycle a tag which was not issued for such bicycle. Upon the loss of
a license tag, the Village Clerk upon satisfactory evidence of such loss
and payment of a fee of twenty -five (25fi) cents shall Issue and appropriate
new tag. It shall be unlawful for any unauthorized person to remove or
destroy a license tag on a bicycle.
Section 4 Section 23 -507 is hereby amended to read as follows:
Section 23 -507, BICYCLE RENTALS. A rental agency shall not rent
or offer any bicycle for rent unless the bicycle is licensed and a license
tag is attached thereto as provided herein and such bic s

Section 5: is - 4 emended to read as follows,
SWAIQ� 23 -508 PENALTY. Any persons who shall violate the
provisions of this ordinance shall, upon conviction thereof, be punished
by a fine not to exceed one hundred ($100.00) dollars or ninety (90) days
in the County Jail of Hennepin County. The Court may, I also after conviction
remove and detain the license tag from the bicycle owned by the person
convicted for a period not to exceed thirty (30) days or may both remove and
detain said tag for a period not to exceed thirty days and impound said
bicycle for a period not to exceed thirty (30) days.
Section 6: This ordinance shat be effective from and after Its
publication.
The motion for the adoption of the foregoing ordinance was duly seconded
by member Howard Heck,, and upon vote being taken thereon the foUawing
voted In favor thereof: Gordon Iftkaon Henry Dorff t John Leary, Howard
Heck and Phil Cohen and the foll®wing voted against the same: None;
whereupon said ordinance was declared duly passed and adopted:.

Motion by Henry Dorf and seconded by Howard Heck to appoW

Motion carried unanimously. The council meeting adjourned at 12:30 A. -M.
