Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
March 23, 1964
The Village Council met in Regular Session and was called to order
by Mayor Gordon Erickson at 7 :30 P.M.
Roll Call: Mayor Gordon Erickson, Phil Cohen, Henry Dorff, Howard
Heck and John Leary were present.
The invocation for the Council meeting was given by Rev. Amos
LeVang.
Motion by Howard Heck and seconded by John Leary to approve the
minutes of the Council meeting of March 16, 1964 as recorded. Motion
carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to approve the
first reading of an ordinance amendment to Chapter 35 of the Village Ordinances
rezoning Lot 1, Block 1, Brookdale 1st Addition from I -1 to B -3 and to
schedule the second reading of the ordinance amendment for April 6, 1964.
Motion carried unanimously.
Member John Leary introduced the following resolution and moved its
adoption:
A RESOLUTION APPROVING AN AGREEMENT WITH HENNEPIN COUNW
BE IT RESOLVED, That the Village of Brooklyn Center enter into an
agreement with Hennepin County:
To share the construction, engineering and operating costs of a traffi,
control signal at the intersection of County State Aid Highway No. 10 and
Trunk Highway No. 152 in accordance with the terms and conditions of the
agreement for Participation in the Construction and Operation of said Traffic
Control Signal, a copy of which is before the Council; and
BE IT FURTHER RESOLVED, That the Mayor and Clerk be and hereby
are authorized to execute said agreement and thereby assume for and on
behalf of the Village all of the contractural obligations contained therein.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, Henry Dorff, John Leary , Howard Deck
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
X Motion by Phil Cohext and seconded by John Leary to uphold the action
of the Planning Commission and approve application #64019' submitted by
Phillips Petroleum Company for a Special Use Permit for a gasoline service
station at 6850 Osseo Road, said Special Use Permit to be approved with the
following conditions:
1. The front yard setbacks shall be 20 feet measured from the
extreme projection of the canopy.
2'. A variance of 2 feet in height be granted to permit one free
standing sign not to exceed. 18 feet in height and no part of the
sign to be located within 5. feet of the property line.
3. The most westerly drive way on 69th Avenue shall be 35` East
of the North Westerly property corner.
Notion carried unanimously.

Member John Leary introduced the following resolution and moved
its adoption:
A RESOLUTION VACATING A PORTION OF 57TH AVENUE
LYING BETVfEEN STATE HIGHVITAY 152 AND STATE
HIGHWAY 100
WHEREAS, a petition has been filed with the Village Council of the
Village of Brooklyn Center, Minnesota for the vacation of that portion of
57th Avenue between the East right -of -way line of State Highway 152 and the
West right -of -way line of Xerxes Avenue North and between the East right -of-
way line of Xerxes Avenue North and the West right -of -way Trunk Highway
100, by a majority of the owners of property abutting on said street, and
WHEREAS, a notice of public hearing on said proposed vacation to be
held on March 23, 1964, was duly published on March S, 1964 and March.
12, 1964 in the Brooklyn Center Press, and three copies of said notice were
posted on Mawh 4, 1964, in conspicuous places within the Village -, and
WHEREAS, all parties having been heard and no one appearing in
opposition thereto,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center as follows:
1. It is deemed to be in the best public interest to, and the Village
Council does hereby vacate that portion of 57th Avenue between the East right -
of -way line of State Highway 152 and V�iest right -of -way line of Xerxes Avenue
North and between the East right -of -way line of Xerxes Avenue forth and the
West right -of -way line of trunk Highway 100.
2. The Council proposes to proceed with said vacation under authority
granted by Minnesota Statutes Section 412.851.
3. The Village Clerk is authorized herewith to certify a copy of this
resolution and cause said resolution to be recorded at the Register of Deeds
in and for Hennepin County, Minnesota.
The motion for the adoption of the foregoing resaWtion was duly seconded by
member Howard Heck, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.

The Village Council discussed with interested residents of Brooklyn
Center the merits of a Sunday Closing Ordinance.. Both comments for and
against a Sunday Closing ordinance were heard by the Village Council.
Mayor Gordon Erickson left the meeting at 9 :10 P. M. and Mayor
Pro Tem Howard Heck presided over the remainder of the Council Meeting.
Member Phil Cohen reported to the Council the proposal of a committee
from Civic Organizations of the Village,to promote a 4th of July celebration
in Brooklyn Center.
Motion by John Leary and seconded by Henry Dorff that the Village
Council of Brooklyn Center endorses the proposal of the Civic Organizations
to organize a 4th of July Celebration. Motion carried unanimously.
Member Henry Dorff introduced the following resolution and moved
its adoption:
RESOLUTION REFUNDING OVER PAYDiXNT OF SPECIAL ASSESSMENTS
FOR STREET SURFACING ON PROPERTY DESCRIBED AS THAT PART
OF N 43.55 FEET OF W 1/4 OF M;! 1/4 OF SIN 1/4 LYING S OF
BUSSE- ERICKSON ADDITION AND E OF W 173 1/2 FEET OF NW 1/4
OF .T!! 1/4 EX. ROAD
WHEREAS the 1961/62 installment of Levy 2535, Street Surfacing

61 A & B was collected by the County Treasurer on the 1961/22 tax rolls
and again, in error, on the 1962/63 tax rolls on the above listed property,,,
and
WHEREAS, a refund in the amount of $30.37 is due the property owner,
Bert G. Raue, 5637 Girard Avenue North
NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the
Village of Brooklyn Center to refund the over payment of $30.37 to the
property owner of the above listed property.
The motion for the adoption of the foregoing resolution was duly seconded
by member Phil Cohen., and upon vote being taken thereon the following
voted in favor thereof: Phil Cohen, Henry Dorff. John Leary and Howard
Heck and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.
Member Phil Cohen introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED WATER TRUNK KS SY,ST&M tJLm ROVER ENT NO. 1964 -1
WHEREAS, it is proposed that there be constructed an improvement
consisting of water main in the following streets:
51st Ave. from T. H. 152 to 170' East
Southeast interchange ramp and T. H. 152 from North Lilac Drive
to 175` South of 51st Ave.
Trunk Highway 152 from Xerses Ave. and T. H. 100 to 260' South
of 63rd
67th Ave. from France Ave. to T. H. 152
T. H. 152 from 67th Ave. to 380' South of 69th Ave.
T. H. 152 from 69th Ave. to Noble Ave.
T. H. 152 from 71st Ave. to zMingard Lane
WHEREAS, the Village Engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed at an
estimated cost of $200,608.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota as follows:
1 The Council proposes to proceed under authority granted by
Ch*pter 398, Laws of IvAnnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on April, the 6th day of 1964, at 8:00 o'clock
P. M. , and the Clerk shall publish notice of the time and place of hearing
by two weeks' publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improvement is as
follows:
All lots and parcels which abut the above names streets.
4. This proposed improvement shall be designated Water Trunk

The motion for the adoption of the foregoing resolution was duly seconded by
member John Leary, and upon vote being taken thereon the following voted
In favor thereof: John Leary, Phil Cohen, Henry Dorff and Howard Heck
and the following voted against the same: None; whereupon said resolution

Member john Leary introduced the following resolution and moved
its adoption;
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
SANITARY SEWER IMPROVEMENT NO. 1964 -3 AND PROPOSED
PUBLIC UTILITIES SERVICE EXTENSIONS IMPROVEMENT NO.
1964 -5
WHEREAS, it is proposed that there be constructed an improvement
consisting of sanitary sewer on the following streets:
51st Ave. from Xerxes Ave. to T. H. 152,
T. H. 152 from 295' South of 51st Ave. to 615t North of 51st Ave..
T. H. 152 from 625' south of Northport Dr. to 180' South of
58th Ave.
T. H. 152 from 59th Ave. to Admiral Lane.
T. H. 152 from 65th Ave. to 522' North of 65th Ave.
T. H. 152 from 69th Ave. to 1180' South of 69th Ave.
T. H. 152 from Wingard Lane to 425' South of Wingard Lane
62nd Ave. from T. H. 152 to West.
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Hydrant relocations, sanitary sewer and water service extensions,
and installation of sewer and water services from inplace mains,
all in T. H. 352 from 51st Ave. to Shingle Creek.
WHEREAS, the Village Engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed at
an estimated cost of $96,,448.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at the
Village Hall in the Village on April, the 6th day of 1964, at 8 :00 o'clock P. M. ,
and the Clerk shall publish notice of the time and place of hearing by two weeks'
Publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improvement is as folls:
All lots and parcels which abut the above named streets and all lots and parcels
benefitted by the above described construction.
4. This proposed improvement shall be designated Sanitary Sewer
Improvement No. 1964 -3 and Public Utilities Service Extensions Improvement
No. 1964 -S.
The motion for the adoption of the foregoing resolution was duly seconded by
member Henry Dorff, and upon tote being taken thereon the following voted
in favor thereof: Henry Dorff, john Leary, Howard Heck and Phil Cohen and
the following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
Member Henry Dorff introduced the following resolution and moved its
adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
STORM SEINER 1kilPROVEMENT NO. 1964 -4
WHEREAS, it is proposed that there be constructed an improvement
consisting of storm sewer on the following street:
62nd Ave. (Viest) from T. H. 152 to 90 feet Vest

WHEREAS, the Village Engineer has made a preliminary report 17 7
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $1, 335.00.
Now, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota as follows;
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on April, the 6th day of 1964, at 8 :00 o'clock
P. M. , and the Clerk shall publish notice of the time and place of hearing
by two weeks` publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improvement is as
follows:
The south 375 feet of proposed Ewing Lane Addition lying
easterly of the west line of proposed Ewing Lane.
4. This proposed improvement shall be designated Storm Sewer
Improvement No. 1964 -4.
The motion for the adoption of the foregoing resolution was duly seconded by
member john Leary, and upon vote being taken thereon the following voted in
favor thereof; john Leary, Henry Dorff, Howard Heck , and Phil Cohen
and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.
Member john Leary introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED CURB AND GUTTER IMPROVEM �NT NO 1964 -6
WHEREAS, it is proposed that there be constructed an improvement
consisting of curb and gutter on the following streets:
Trunk Highway 152 from Trunk Highway 100 to North Village limits
WHEREAS, the Village Engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed
at an estimated cost of $22, 500.00.
NOVI, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota as follows;
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on April, the 6th day of 1964, at 8;00 o'clock
P. M. , and the Clerk shall publish notice of the time and place of hearing
by two weeks' publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improvement is as
follows;
All lots and parcels which abut the above roamed streets.
4. This proposed improvement shall be designated Curb and Gutter
Improvement No. 1964 -6.
The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and.. upon vote being taken thereon the following voted
In favor thereof: Henry Dorff, Howard Heck, Phil Cohen and john Leary
and the following voted against the same; None; whereupon said resolution
was declared duly passed and adopted.

The bills having been audited motion was made by Henry Dorff and
seconded by Phil Cohen to order paid the bills set forth in the schedule attached
to these minutes and mane a part thereof. Riotion carried unanimously.
Motion by john Leary and seconded by Phil Cohen to approve the
purchase of an M -B Corporation Traffic Line Striper at a cost of $853.00
from Road Machinery, Inc. Motion carried unanimously.
Motion by Phil Cohen and seconded by john Leary to approve the
appointment of Cliff Eugene Petrick as a Special Police Officer for Brookdale
Center, subject to the posting of the proper bond and payment of the required
fees. Motion carried unanimously.
Motion by Henry DOW and seconded by john Leary to ad$otu
the Village Council adjourned at 12:05 A. M.
