HomeMy WebLinkAbout1964 04-13 CCM Regular Session 235 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota April 13, 1964 The Village Council met in Regular Session and was called to order by Mayor Gordon Erickson at 7;34 P. M. Roll Call: Mayor Gordon Erickson, Howard Heck, john Leary, Phil Cohen and Henry Dorff were present. Rev. StodgehUl gave the invocation for the Council Meeting.: Motion by John Leary and seconded by Howard Heck to approve the minutes of the Special Meeting of April 6, 1964 as recorded. Motion carried unanimously, Motion by Phil Cohen and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application 64026 submitted by Ericon Inc. and approve the proposed Registered Land Survey to subdivide Lot 1, Block 1 of Ryden's 1st addition, Motion carried unanimously. Motion by Howard Heck and seconded by John Leary to uphold the action of the Planning Commission and approve application 64027 submitted by Victor Clasen and grant permission to subdivide parcel 1210 of Section + #26 and to sell by metes and bounds description the North 85 feet of the West 133 feet of said parcel 1210, provided that a 33 foot wide right -of -way is Provided for Logan Avenue and is dedicated to the Village of Brooklyn Center and that the front yard set back on the North 85 feet of the "Vest 133 feet of parcel 1210 shall be not less than 40 feet. Motion carried unanimously. Motion by Phil Cohen and seconded by John Leary to uphold the action of the Planning Commission and approve application 64028 submitted by Robert Zakeriasen and grant permission to erect a 4' x 6' unlighted free standings business sign at 6139 Osseo Road. The sign to be mounted on a single pipe column 6 inches in diameter and set back 20 feet from the front property line. The height of the sign not to exceed 15 feet above the lot: Made. Motion by Howard Heck and seconded by John Leary to amend the foregoing motion by adding thereto the statement that the Village Council considers the permission to erect a business sign an accessory use to a non- conforming use of the property as of this date. Motion carried unanimously. In voting on the amended motion, all members voted for the motion aaA0 it carried unanimously, Motion by Henry Dorff and seconded by Phil Cohen to uphold the action of the Planning Commission and approve application 64029 submitted by R. J.. Cameron and grant permission to build a 25' x 42' single farhily dwelling on a 51.5 x 118' substandard lot at 5318 Morgan Avenue No, Motion carried unanimously. Motion by John Leary and seconded by Phil Cohen to approve application #64030 submitted by Minneapolis Star & Tribune and grant a Special Use Permit for the operation of a newspaper carrier station at 6830 Osseo Road for a period of 2 yrs.. Motion carried unanimously. Motion by Howard Heck and seconded by Phil Cohen to uphold the recommendation of the Planning Commission and approve application #64032 submitted by Robert Hillstrom and grant permission to erect and maintain a 12' x 8' building development advertising sign at 7100 Lyndale Avenue North for a period of one year or until the development is 9016 sold, whichever occurs first, Motion carried unanimously. !1- 215 Motion by Henry Dorff and seconded by john Leary to uphold the action of the Planning Commission and approve application 64031 submitted by Richard Kauffman and approve the preliminary plat of Hokanson Addition, subject to the requirements of the platting ordinance. Motion carried unanimously, Motion by John Leary and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application 64021 submitted by the Dayton Development Company and approve the plot plan, parking layout and building plans provided 1. The curb on the south service drive shall be 8' from the property line, 2. The driveway entrance from County Rd, #10 shall be approved by the State and County Highway Department, Motion carried unanimously. Mr. Ernee McArthur and Earl Rydberg presented an annual report for the Industrial Development Commission. John Leary announced the appointment of Dr. Adrian C. Dorenfeld of 5337 Sailor Lane to the Industrial Development Commission. The Village Council discussed the procedure to facilitate the construction of sanitary sewer on 51st Avenue as it would serve the proposed plat of Richard Ernst. It was agreed by the Village Council and Mr. Ernst that the Procedure outlined in the memo included with the agenda should be followed to effect the construction of the sanitary sewer. Member Howard Heck introduced the following resolution and moved Its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENT NO. 1964 -12 WHEREAS, it is proposed that there be constructed an improvement consisting of a sanitary sewer lift station and force main to serve the following area: Beginning at a point on 51st Avenue North at the southeast corner of Tract A, R. L. S. #235, thence northwesterly along the northeasterly line of said Tract A to the shore of Twin Lake, thence westerly along the shore of Twin Lake, to the Minneapolis, St. Paul,, and Soo Line Railroad Co, right of way, thence southeasterly along the northerly line of said railroad right of way to a point 16S' westerly from the center line of France Avenue North, thence northerly, parallel to the center line of France Avenue North to a point 420' south of the north line of government lot 2, Section 10, Township 118, Range 21, thence westerly 400' parallel with the north line of said government lot 2, th%We northerly and parallel with the center line of France Avenue North to the north line of said government lot 2, thence westerly along the north line of said government lot 2 to the east line of R. L. S. #235, thence northerly to point of beginning. WHEREAS, the Village Engineer has made a preliminary report advising that proposed improvement is feasible and it can be constructed at an estimated cost of $10, 000.00. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows: 1. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953 amended. 2, A Public hearing on the proposed improvement shall be held at the Village Hall in the Village of Brooklyn Center on Monday, the 27th day of April 1964, at 8:00 P.M. and the Clerk shall publish notice of time and place of hearing by two weeks publication in the official newspaper of the Village. -2- r 213 3. The area proposed to be assessed for said improvment is as described above, 4. This proposed improvement shall be designated as Sanitary Sewer Improvement No. 1964 -12. Motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorfff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member John Leary, introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID FOR FURNISHING MUMINOUS OIL WHEREAS, the Village Administrator and Assistant Administrator have reported that on April 6, 1964, at 2:00 P. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION REGARDING MINNESOTA HIGHWAY _DEPARTMENT AGREEMENT NO. 54071 BE IT RESOLVED that the Village of Brooklyn Center enter into an agreement with the State of Minnesota, Department of Highways for the following purposes, to -wit: To provide for payment by the State to the Village for relocation of four hydrants and one water service connection and curb stop along Trunk Highway 152 and 100, to be done in connection with the Village's sewer and water distribution facilities construction along said Trunk Highways. BE IT FURTHER RESOLVED that the Mayor and Clerk be and they hereby are authorized to execute such agreement, The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof; Gordon Erickson, Henry Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. W. T. H. 152 to T. H. 94; and WHEREAS said preliminary plans are on file in the office of the Department of w a Minnesota, be marked, label d partm Highways.. Saint Paul, Minn , ing m , e and identified as Layout No. 2F S.P. 2755 -29 (T. H. 100 -212) From 0.5 Mi. W. T. H. 152 to T. H. 94; and WHEREAS, copies of said preliminary plans as so marked, labeled, and identified are also on file in the office of the Village Clerk; and WHEREAS, the term "said preliminary plans" as hereinafter used in the body of this resolution shall be deemed and intended to `mean, refer to, and to incorporate the preliminary plans as in the foregoing recitals particularly identified and described; NOW, THEN, BE IT RESOLVED that said preliminary plans for the improvement of Trunk Highway Number 212 renumbered Trunk Highway Number 100 within the limits of the Village of Brooklyn Center and hereby are approved. Upon the call of the roll the following members voted in favor of the Resolution Gordon Erickson, john Leary, Phil Cohen and Henry Dorff. Dorff Village Clerk RESOLUTION At a regular meeting of the Village Council of the Village of Brooklyn Center duly held on the 13th day of April, 1964 the following Resolution was offered by member John Leary; seconded by member, Phil Cohen; to -wit: WHEREAS, the Commissioner of Highways has prepared preliminary plans for the improvement of a part of Trunk Highway Number 129 renumbered as Trunk Highway Number 152 within the corporate limits of the Village of Brooklyn Center from the T. H. 100 to East corporate limits; and WHEREAS said preliminary plans are on file in the office of the Department of Highways, Saint Paul, Minnesota, being marked, labeled, and identified as Layout No. 1, S. P. 2741 -07 (T. H. 152 -129) 2742 -05 (T. H. 152 - 129), from 44th Ave. No. to T. Motion by John Leary and seconded by Henry Dorff to appoint Glen Jopp as a temporary laborer in the Street Department at a wage of $2.20 per hour. Motion carried unanimously. Motion by Henry Dorff and seconded by John Leary to appoint Patricia Feyo as Girls Gym instructor at $4 /per hour. Motion carried unanimously.
