Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
April 27, 1964
The Village Council met in Regular Session and was called to order
by Mayo r Gordon Erickson at 7 :30 P. M.
Roll Call; Mayor Gordon Erickson, Howard Heck, John Leary, Phu
Cohen and Henry Dorff were present,
Rev. Bubna gave the invocation for the meeting
Motion by Henry Dorff and seconded by Phil Cohen to approve the
minutes of April 20, 1964 as recorded. Motion carried unanimously,
RESOLUTION
At a regular meeting of the Village Council of the Village of Brooklyn
Center duly held on the 27th day of April, 1964, the following Resolution
was offered by member Howard Heck; seconded by member Phil Cohen; to -wit;
WHEREAS the Commissioner of Highways has prepared plans, special
provisions and specifications for the improvement of a part of Trunk Highway
Number 129 renumbered as Trunk Highway slumber 152 within the corporate
limits of the 0.1 mile southwest of 50th Ave. North to 0.2 mile Northeast of
Shingle Creek & from 0.1 mile northwest of Le. E. B. T. H. 100 to North Corporate
limits; and
WHEREAS said plans are on file in the office of the Department of
Highways', Saint Paul, sinnesota, being marked, labeled, and identified as
S.P. 2755 -27 (T, H. 100 =212); 2742 -02 (T. H. 152 =129); and
WHEREAS said special provisions are on file in the office of the
Department of Highways, Saint Paul, Minnesota being marked, labeled, and
identified as S. P. 2755 -27`' (T. H. 100 =212) Minn. Proj. U 030 -1 (33)
S. P. 2742 -02 (T. H. 152 =129) Minn. Prof. U 072 -1 (31), which together with
the Minnesota Department of Highways Specifications for Highway Construction
dated Jan. 1, 1964, on file in the office of the Commissioner of Highways con -
stitute the specifications for said imp 4 0 ement of Trunk Highway Number i1 g
renumbered as Trunk Highway Number 152; and
WHEREAS copies of said plans and special provisions as so marked,
labeled and identified are also on file in the office of the Village Clerk; and
WHEREAS the term "said plans and special provisions" as hereinafter
used in the body of this resolution shall be deemed and intended to mean, refer
to, and incorporate the plans and special provisions in the foregoing recitals

NOW, THEN, BE IT RESOLVED that said?,Vns and special provisions
for the improvement of Trunk Highway Number renumbered as

100 52 within the limits of the Village of Brooklyn Center be
and hereby are approved.
BE IT FURTHER RESOLVED that the elevations and grades as shown in
said plans and special provisions be and they are hereby approved and consent
is hereby given to any and all ct nges in grade occasioned by the construction
of said Trunk Highway Number 129 renumbered as Trunk Highway Number 152
plans in accordance with said 1

Upon the call of the roll the following members voted in favor of
the Resolution Gordon Erickson, Howard Heck, John Leary, Phil Cohen,
and Henry Dorff.
The following members voted against its adoption: None,; whereupon
the Mayor and presiding officer declared the Resolution adopted.

Motion by Phil Cohen that the Council minutes record the fact that the
Council considered the protest of the Tri -State Land Co, in the matter of the
action of the Village Council of Brooklyn Center, Minnesota in adopting a
resolution establishing Sanitary Sewer Improvement #1964 -12; the Council
considerd theeontention that the protestors land would not be benefited as a
result of Improvement #1964 -12 and upon thoughtful deliberation and reconsider -
ation of the said assessment in the light of this protest, determined that the
assessed property would be benefited by the proposed improvement and
consequently denied the petition requesting the amendment of the improvement
district for Sanitary Sewer #1964 -12 so as to exclude the petitioners land.
The foregoing motion was seconded by Henry Dorff and all members voted for
the motion. Motion carried unanimously.
The mayor announced that the meeting was open for the consideration
of proposed Sanitary Sewer Improvement No, 1964 -12.
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks publication thereof in the official
newspaper, the last publication being on April 23, 1964, which affidavit was
examined and found satisfactory and ordered placed on file,
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of said
improvement, member John Leary introduced the following resolution and moved
its adoption.
RESOLUTION ORDERING CONSTRUCTION OF
SANITARY SEWER IMPROVEMENT NO. 1964 -12
AND ORDERING PREPARATION OF PLANS AND
SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
MAnnesota, as follows:
1. It is hereby determined that it is necessary and for the best
interests of the Village and the owners of property specially
benef#ted thereby, that the following improvement shall be
cono"cted:
Sanitary Sewer Improvement No. 1964 -12
2. The lans and specifications for said Improvement shall

be prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon, the following voted
in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck
and Phil Cohen and the following voted against the same: None, whereupon
said resolution was declared duly passed and adopted,

Motion by John Leary and seconded by Phil Cohen to direct the Engineer
to cause water services to be installed on water mains abutting the long side
of corner lots when requested by the property owners. The special assessment
for water mains shall commence in the year in which one of the following occurs;
1. The ten year deferrment for water main assessment has expired.
2 • The property has been hooked up to the water main.
3. Neater main has been constructed on the frontage street,
Corner lots so served shall be considered as in favor of a petition for
water main on the frontage street when such a petition is submitted. The
foregoing policy r a licy shall Apply to Wat�r Improvement Project #1963 -1 and 1964 -1.

Motion by john Leary and seconded by Henry Dorff to determine that the
Civil Defense fire truck is no longer needed for Village purposes and authorize
the disposal of the truck at the best possible price. The funds received from
the sale of the fire truck are to be reappropriated for Civil Defense purposes.
Motion carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to authorize the
Clerk to take bids for six additional voting machines. The method of financing
to be determined later. Motion carried unanimously.
Member Howard Heck introduced the following resolution and moved
Its adoption.
RESOLUTION FOR PUBLIC HEARING FOR THE VACATION
OF A EQRTION OF 51st AVENUE
WHEREAS, the Village Council of Brooklyn Center, Minnesota has
received a petition signed by the majority of the owners of property abutting
on 51 St Avenue North between France Avenue and Twin Lake Boulevard
requesting the vacation of said portion of 51st Avenue.
BE IT THEREFORE RESOLVED, that a public hearing shall be held at
the Village Hail of the Village of Brooklyn Center, Minnesota on Monday the
18th day of May 1964 at 8.00 P. M. to hear objections if any to the vacation
of the above described street and the clerk shall publish and post notice of
the time and place of the hearing by two weeks publication in the official
newspaper of the Village.
Motion for the adoption of the foregoing resolution was duly seconded by
member john Leary, and upon vote being taken thereon, the following voted in
favor thereof; Gordon Erickson, Henry Dorff, john Leary, Howard Heck and
Phil Cohen and the following voted against the same. None; whereupon
said resolution was declared duly passed and adopted.
Motion by john Leary and seconded by Phil Cohen to determine that
two sets of voting booths (5 booths per set) are no longer necessary for Village
purposes and authorize the sale of the voting booths to Saint Paul Park at
a price of $ 70 per set. Motion carried unanimously.
Motion by Phil Cohen and seconded by Howard Heck to correct the
minutes of April 13, 1964 to show that the amount of cash escrow to be refunded
to R. L. Hanson is $ 83 1. 83 instead of $ 83 3.83. Motion carried unanimously.
The bills having been audited, motion was made by Henry Dorff and
seconded by Howard Heck to order paid the bills set forth in the schedule
attached to these minutes and made a part thereof. Motion carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to approve the

Motion carried unanimously.
The license of Acme Plumbing was tabled for one week to allow for an
Investigation of the operation on the premises.
Motion by Phil Cohen and seconded by Howard Heck to authorize the
Mayor and Clerk to execute the final plat for Uesmer's Addition. Motion
carried unanimously.
Member John Leery introduced the following resolution and mowed its
adoption:
RESOLUTION APPROVING AGREEMENT 54126 WITH
THE HIGHWAY DEPARTMENT
BE IT RESOLVED that the Village enter into an agreement with the State
of Minnesota, Department of Highways for the following purposes, to -wit;
To provide for payment by the Village of Brooklyn Center to the State of
part of the cost of curb and gutter construction and part of the cost of storm sewer
construction by the State upon and along Trunk Highway No. 1S2 and No. 100
within the corporate Village limits in accordance with State plans designated
as S. P No. 2742 -02 and 27SS -27
BE IT FURTHER RESOLVED that the Mayor and Clerk be and they hereby
are authorized to execute such agreement.
Motion for the adoption of the foregoing resolution was duly seconded by
member Henry Dorff, and upon vote being taken thereon, the following voted
in favor thereof: Gordon Erickson, John Leary, Henry Dorff, Howard Heels,
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by Henry Dorff and seconded by Howard Rack to adjourn. Motion
carried unanimously. The Village Council adjourned P. M.
