HomeMy WebLinkAbout1964 05-11 CCM Regular Session r 251 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of Minnesota May 11, 1964 The Village Council met in Regular Session and was called to order by Mayor Gordon Erickson, at 7 :30 P. M. Roll Call: Present were Mayor Gordon Erickson, Howard Heck, John Leary, Phil Cohen and Henry Dorff. Rev. LeVang gave the invocation for the meeting. Motion by Phil Cohen and seconded by John Leary to approve the minutes of the Council meeting of May 4, 1964 as recorded, Members Cohen, Leary, Erickson and Heck voted for the motion. Member Henry Dorff abstained from voting since he was absent from the meeting. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to approve the minutes of the Canvass Board meeting on N.Ay S. 1964 as recorded. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck to uphold the action of the Planning Commission and approve application #64040 submitted by the Assemblies of God Church to subdivide Lot 1, Aud. Sub. ,LC218 by metes and bounds and grant permission to combine the South 41.58 of the 'Nest 161.42' of the East 327.84' of the West 655.69' except the West 25' thereof Lot I. Aud. Sub. 0218 with Outlot 3 Hipps 4th Addition and thereby create a 75' x 136.4' lot to be used for a church parsonage site, provided that a SO' street extending to the North line of the property is dedicated to the Village and a turn around area is provided North of the said street extension. Motion carried unanimously. Member Phil Cohen introduced the following resolution and moved Its adoption: RESOLUTION REGARDING EASEMENT ACQUISITION FR ©M BROOKLYN CENTER ASSEMBLIES OF GOD CHURCH WHEREAS, the Village Engineer has advised of the necessity of acquiring a utility easement from the Brooklyn Center Assemblies of God Church, said easement described as the north 35 feet of the east 600.68 feet of the west 655.69 feet of Lot 1, Auditor's Subdivision No. 218, Section 2, T 118, R21, and WHEREAS, the Brooklyn Center Assemblies of God Church has agreed to convey said easement to the Village of Brooklyn Center for a consideration of $95.00 and other considerations, NOON, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center to offer $95.00 to the Brooklyn Center Assemblies of God Church in exchange for a utility easement grant described as the north 35 feet of the east 600.68 feet of the Iflest 655.69 feet of Lot 1, Auditor's Subdivision No. 218, Section 2, T 118, R 21, and BE IT FURTHER RESOLVED that said $95.00 be charged against Projects 1964 -22 and 1964 -23. Motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson,, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -1- 253 Member Howard Heck introduced the following resolution and moved Its adoption: RESOLUTION ACCEPTING BID FOR VOTING MACHINES WHEREAS, the Village Administrator and Assistant Administrator have reported that on May 11, 1964 at 2:00 P. M. they opened and tabulated bids for the furnishing of Six (6) automatic voting machines and that said bids were as follows: Bidder Bid Price Automatic Voting Machine Co. $ 9,930.00 NOW, THEREFORE BE IT RESOLVED by the Village of Brooklyn Center Minnesota that the bid of Automatic Voting Machine Co. in the amount of $9,930. 00 for the furnishing of six automatic voting machines in accordance with specifications is deemed to be the best bid submitted by a responsible bidder and said bid is hereby accepted. BE IT FURTHER RESOLVED, that the Village Administrator investigate alternate methods of financing the six (6) voting machines and report such investigation at the time of the budget meetings. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the wing voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Henry Dorff and seconded by John Leary to set the time and date of the Board of Review for Wednesday 8 :00 P. M., June 24, 1964. Motion carried unanimously. Motion by John Leary and seconded by Howard Heck to approve the final plat of Farmes Addition and authorize the Mayor and the Clerk to sign the same. Motion carried unanimously. Motion by Phil Cohen and seconded by John Leary to approve the final plat of Adeline Hokanson Addition and authorize the Mayor and Clerk to sign the same. Motion carried unanimously. Member John Leary introduced the following resolution and moved Its adoption: RESOLUTION DIRECTING° ACQUISITION OF OBTAIN INTERESTS IN I&=_ WHEREAS, the Village of Brooklyn Center has determined the necessity of constructing an elevated storage tank to serve the municipal water system, and WHEREAS, engineering studies indicate that the tank structure should be located in the vicinity of the intersection of Trunk Highway 100 and Trunk Highway 152, and WHEREAS, the Village Engineer has advised the Village Council that the purchase of the following described land is required to provide a site for and an access to the proposed elevated tank, and WHEREAS, it appears that the purchase of such land is necessary and desirable in the public interests, and WHEREAS, it appears that the following described property is owned in fee simple absolute by the State of Minnesota by virtue of a final decree in a condemnation proceeding which is filed and of record in the Office of the Register of Deeds, Hennepin County, Minnesota, in Book No. 483 of Miscellaneous, Page 583; _2_ _Parcel No. 1 Legal Description: The east 40' of that part of Lot 16, Auditor's Subdivision No. 218, Hennepin County, Minnesota,, according to the plat thereof not on file and of record in the Office of Register of Deeds in and for Hennepin County,, lying southerly of the North 165.0 feet thereof and west of the northerly extension of the west line of Lot 19, Auditor's Subdivision No. 218. Containing .32 acres, more or less. � Parcel No. Z Legal Description: All that part of the two following described lots: 1. Lot 15, Auditor's Subdivision No. 218,, Hennepin County,, itl M nesota according to the plat thereof now on file and of record In the office of the Register of Deeds in and for Hennepin County, lying westerly of the northerly extension of the west line of Lo t 19, Auditor`s Subdivision No. 218, 2. That the Village Engineer is requested to ask the appropriate authorities of the State of Minnesota to designate a selling price for the above - described property. Motion for the adoption of the foregoing resolution was duly seconded by Member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Cordon Erickson, Henry Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Clerk shall advertise for bids for such improvements by publication at least once in the official newspaper and in the Construction Bulletin, the day of first publication not less than three weeks prior to the day of receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond cashiers check or certified check p ayable to the Clerk in the amount of : p Y not less than 5 per cent (5%) of the bid. 3. Motion by Henry Dorff and seconded by John Leary to appoint Lyle Pedler as a Police Clerk at a salary of $375 per mo. to begin May 18, 1964. Motion carried unanimously. The bills having been audited motion was made by Henry Dorff and seconded by Howard Heck to order paid the bills set forth inthe schedule attached to these minutes and made a part thereof. Motion carried unanimously. The Village Council discussed policy concerning sidewalk construction and instructed the Engineer to complete a resolution stating such policy. The Village Council discussed the proposed Administrative Code and directed its presentation for adoption at the next meeting. Motion by Phil Cohen and seconded by Henry Dorff to adjourn.
