June 1, 1964 The Village Council met in special session and was called to order by Mayor Gordon Erickson at 7:30 P. M. Present were Mayor Gordon Erickson, Phil Cohen„ John Leary, Henry Dorff and Howard Heck. Motion by Howard Heck and seconded by Phil Cohen to approve the minutes of the meeting of May 25, 1964 as recorded. Motlbn carried unanimously. The Mayor directed the Administrator to write a letter to Zahler Plumbing .advising them that all of the stored material on the vacant lot must be removed before a license will be issued. Motion by Phil Cohen and seconded by John Leary to approve the following license: House Mover's License Clarence Landwehr Heavy Moving Inc. 1528 9th Avenue,, St. Cloud Motion carried unanimously. Motion by Phil Cohen and seconded by Howard Heck to accept with regret the resignation of Mr. Harry Johnson from the Industrial Development Commission. Motion carried unanimously. Mayor Erickson announced the appointment of Robert Sidio, 6124 Noble Avenue as a member of the Industrial Development Commission to complete the term of Harry Johnson. Mo tion carried unanimously. Motion by Henry Dorff and seconded by John Leary to appoint Laverne Dingley as a temporary custodian at a wage of $2.00 /per hour. Motion carried unanimously. Motion by John Leary and seconded by Henry Dorff to appoint Edward Malone as a part time clerk at the liquor store at a $1.50 per hour. Motion carried unanimously. Motion by Phil Cohen and seconded by Henry Dorff to appoint Dennis Ross as a clerk in the Police Department at a salary of $375 /per month. Motion carried unanimously. Motion by Howard Heck and seconded by Phil Cohen to appoint Richard Risley to the position of investigator in the Police Department at a salary of $587.00 per month. Motion carried unanimously, Motion by John Leary and seconded by Howard Heck to approve the conduct of a carnival sponsored by the Brooklyn Center Jaycees at the South V. corner of Xerxes Avenue & 56th Avenue North subject to their filing with the Village Clerk a proper certificate of liability insurance. Motion carried unanimously. The Mayor announced that the meeting was open for the consideration of proposed Storm Sewer Improvement No. 1964 -8. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on iviay 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. -1- The Mayor then called upon all property owners present to present arguments `1 either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement member Phil Cohen introduced the following resolution and moves its a :option: RESOLUTION ORDERING CONSTRUCTION OF STORM SEVIER IMPROVEMENT NO. 1964 -8 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Storm Sewer Improvement No, 1964 -8 2. The Plans and Specifications for said improvement shall be Prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff . john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declamd duly passed and adopted. Motion by Phil Cohen and seconded by Howard Heck to instruct the administrative staff and the village attorney to review the status of assessments for storm sewer previously made, which were for benefits which cannot be utilized due to conditions created by the freeway construction. Miotion carried unanimously. The Mayor announced that the meeting was open for the consideration of Proposed Storm Sewer Improvement No. 1964 -7. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on fay 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. After hearing and considering ai; objections, and the property owners appearing in favor of said improvement, member john Leary introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVEMENT NO. 1964 -7 AND ORDERING PREPARATION OF PLANS AND SPECIFICATION'S BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Storm Sewer Improvement No. 1964 -7 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said -2- L Ir _ 213 resolution wasdeclared duly passed and adopted. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said Im provement, member Phil Cohen introduced the following resolution and moved Its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1964 -18 AND ORDERING PREPARATION OF PLANS AND, SPECZICATIONS , - , BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows; 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Sanitary Sewer Improvement No. 1964 -18 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Doarff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1964 -21. The Clerk produced an affidavit of publication of tmice of hearing on the propose Improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, 8nd the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN IMPROVEMENT NO. 1964 -21 AND ORDERING PREPARATION OF PLANS A IDD SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interest of the Village and the owners of property specially benefitted thereby, that the following Improvement shall be constructed.. Water Main Improvement No. 1964 -21 2. The plans and specifications for said improvement shall be Prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted � . -3- 215 In favor thereof; Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Henry Dorff and seconded by john Leary to adjourn the Public Hearing concerning Water Main Improvement #1964 -16 until June 8, 1964. Motion carried unanimously. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1964 -14. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks` publication thereof in the official newspaper, the last publication being on may 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SElt-IER IMPROVEMENT NO. 1964 -14 AND ORDERING PREPARATION OF nA_ff§ AXV SSPECIFICATION_S__,,, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Sanitary Sewer Improvement No. 1964 -14 2 The plans and specifications for said improvement shall be Prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member He my Dorff, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, Tohn Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Storm Sewer Improvement No. 1964 -13, The Clerk produced an affidavit of publication of notice of hearing on the Proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on haay 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member John Leary introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVEkiXNT NO. 1964 -13 AND ORDERING PREPARATION OF PLANS AND SP ECIFIQUON BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Storm Sewer Improvement No. 1964 -13 -4- 2. The plans and specifications for said improvement shall be 217 prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen, and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Storm Sewer Improvement No. 1964 -9. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on Bray 28, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to presaat arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STORM SEWER IMPROVEsIXNT NO. 1964 -9 AND ORDERING PREPARATION OF ELMS AND SPE I OIL BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best Interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Storm Sewer Improvement No. 1964 -9 2. The plans and specifications for said improvement shall be Prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1964 -10. The Clerk produced an affidavit of publication of notice of hearing on the pooposec Improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 28, 1964 which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the Property owners appearing in favor of said improvement, Mba er Henry Dorff introduced the following resoltuion and moved its adoption; RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEfljENT NO. 1964 -10 AND ORDERING PRE P ON OF PLANS AND SPECZ=10 N BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best Interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Sanitary Sewer Improvement No. 1964 -10 -5- r 219 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff.. John Leary, Howard Heck and Phil Cohen and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. Member Phil Cohen introduced the following resolution and moved its aoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator, Assistant Administrator, and the Village Engineer have reported that on June 1, 1964, at 11:00 A. PIS. , they opened and tabulated bids received for Projects 1964 -7 through 11 and 1964 -13 through 21 and that said bids were as follows, Knutson- Seurer, Inc. $ 92 Erwin Montgomery Const. $100 Hurley Const. Co. $104 Barbarossa & Sons $106,397,39 Nodland Const. Co. $109 Erickson Brothers $110, 757.80 Randall Brothers $121, 804.50 Crystal Excavating Co. $130 NOW i THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of Knutson- Seurer, Inc. in the amount of $92,613.80, as to furnishing of all work, labor and material in connection with Projects 1964 -7 through 11 and 1964 -13 through 21 according to the plans and specifications therefor now on file in the office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Henry Dorff to adjourn. Motion carried unanimoud y. The Village Council adjourned at 12 :10 A. M. May k -6-
