Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Mgmes
July 20 1964
The Village Council met in special session and was called to order
by Mayor Gordon Erickson at 7;30 P. M.
Roll Call: Present were Mayor Gordon Erickson, Phil Cohen, ate' sward
Heck. john Leary and Henry Dorff were absent.
Mr. Johnson gave the invocation.
The Administrator was instructed to complete the background research
on Planning Commission application #64061 submitted by Verner Lundgren as
soon as possible.
Motion by Howard Heck and seconded by Phil Cohen to approve the
minutes of the July 13, 1964 Council meeting. Motion carried unanimously.
Clerk Henry Dorff arrived at the meeting at 8:00 P.
Member Phil Cohen introduced the following resolution and moved

AND PUBLIC UTILITIES SERVICE EXTENSIONS IMPROVMENT

WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Sanitary Sewer Project No. 1964 -28 in Queen Ave. from 54th Ave. to
380' south; gazer Project No. 1964 -31 in T.H. 152 from 195' south
Of 51st Ave. to 49th Ave. , 49th Ave. from Beard Ave. to T. H. 152, 50th
Ave. from Beard Ave. to Abbott Ave.,, Beard Ave. from 49th Ave. 1b
50th Ave., Abbott Ave. from 49th Ave. to 350 north of 50th Ave.,
Zenith Ave. from 49th Ave. to 350' north of 50th Ave., Dusharme Drive
under Soo Line tracks to 49th Ave.; `$ rater Project No. 196432 in
Northport Drive from 53rd Ave. to S3rd Place, 53rd Place from Northport
Drive to Salior Lane, 'Arater Project 150. 1964 -33 in 53rd Place from

WHEREAS, the Village Engineer has made a preliminary report advising
that said proposed improvements are feasible and can be constructed at an
estimated cost of $221, 021.16.
NOW, THERFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, rtinnesota as follows;
1. The Council proposes to proceed under authority granted by Chapter
398, Laws of Minnesota, 1953, as amended.

2. A public hearing on the proposed improvements shall be held at
the Village Hall in the Village on Monday, the 10th day of August, 1964
at 8 :00 o'clock P.M., and the Clerk shall publish notice of the time and
place of hearing by two weeks publication in the official newspaper of
the Village.
3. The area proposed to be assessed for said improvement is as follows:

THE PROJECT IS TO BE CONSTRUCTED.
4. This proposed improvement shall be designated Sanitary Sewer
Improvement No. 1964 -28, Water Main Inprovement No's 1964 -31, 32, 33,
35, 36, 37, 38, 39, and Public Utilities Service Extensions Improvement
No. 1964 -44.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Deck, and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, Henry Dorff, Howard Heck and Phil
Cohen and the following voted against the same: None; whereupon said
resolution was declared duly passed and adopted.

BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota as follows:
The plans and specifications for the following improvements,
prepared by the Village Engineer, are hereby approved and ordered filed with
the Clerk; Sanitary Sewer improvement No, 1964 -28, Water Main Improvement
No. 1963 -31, Vlater TAdin Improvement No, 1964 -32, Water Main Improvement No,
1964 - 33, Water Main Improvement No. 1964 -35, Water Main Improvement No.
1964 -36, Water Main Improvement No. 1964 -38, Water Main Improvement
No. 1964 -39, ` "zater Main Improvement ITO. 1964 -37 and Public 6tilities Serv-Sce
Estensions Improvement No. 1964 -44.
2. The Clerk shall advertise for bids for such improvements by
publication at least once in the official newspaper and in the Construction
Bulletin, the day of first publication not less than three weeks prior to
the day of receipt of bids. Said notice shall state that no bids will be consid-
considered unless sealed and filed and accompanied b a

bond, cashiers check or certified check payable to the Clerk in the amount of
not less than 5 per cent (5%) of the bid.
3. Bid date is set for Monday, August 10, 1964, at 11 :00A. . D.,S.T.
4. The Village Administrator and Village Engineer `shall be authorized to
open and tabulate the bids.
Motion for the adoption of the foregoing resolution was duly seconded by
member Phil Cohen, and upon vote being taken thereon, the following voted
in favor thereof: Gordon Erickson, Henry Dorff, Howard Heck and Fhil Cohen
and the following voted against the same: Hone,* whereupon said resolution
was declared duly passed and adopted.

Motion by Phil Cohen and seconded by Howard Heck to uphold the
recommendation of the Planning Commission on application #64065 submitted
by the Brooklyn Center State Bank and grant the applicant a variance to Section
35- 330 -2a(3) of the Village Ordinances thus allowing a second free standing
sign to project more than two feet across the side yard setback such variance
to be granted with the understanding that the total number of signs permitted
for this establishment under any future sign ordinance is not waived by virtue
of this action, and that the sign area involved will be in lieu of comparable
area of a wall sign if only one free standing sign is permitted by such future
ordinance. Motion carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to uphold the
recommendation of the Planning Commission on application #64066 submitted by
Atlas Manufacturing Company and deny permission to build a 60' x 40' addition
to the front of the building located at 3401 - 48th Avenue North. Motion carried
unanimously.
Motion by Howard Heck and seconded by Phil Cohen to uphold the
recommendation of the Planning Commission on application #64067 submitted
by Atlas Manufacturing Company and;
1. Deny the applicant's request for a variance to Section 35 -401 of
the Village Ordinances requesting a variance on the floor area to
lot area ratio,
2. Deny the request for a variance to Section 35 -704 of the Village
Ordinances regarding off street parking requirements.
3. Grant a variance to Section 35 -401 of the Village Ordinances and
allow a rear yard setback of 10 feet rather than the required 25 feet :.
on the condition that the land to the rear of the building is not used for
outside storage.
Motion carried unanimously.
Motion by Henry Dorff and seconded by Phil Cohen to declare completed
the fir reading of an amendment to Section 35 -830 of the Village Ordinances.

Motion carried unanimously.
Motion by Henry Dorff and seconded by Howard Heck to authorize
Suburban Engineering to complete plans and specifications in line with the
concept set out in alternative #1 in their letter to the Village dated J y ul 7 1964
concerning the Ernst Twin Lake Oaks plat, special emphasis to be given to
Insuring the Village of Brooklyn Center against any liability for damages arising
out of the project, especially regarding the Fontenalla property, V+otion
carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to approve the
following licenses;
Electrical License

Plumber's License
Statewide Plumbing & Heating Co. 6636 Penn. Ave. So.
Motion carried unanimously.

Motion by Phil Cohen and seconded by Henry Dorff to appoint Willaim
Mullins as Police Clerk at the salary of $375.00 per month effective August
2, 1964. Voting in favor of the motion: Erickson, Cohen, Dorff, Not voting:
Heck. Motion Carried,
Mayor Gordon Erickson left the meeting at 11:00 P. M. Uftw pro tem
took the chair.
The Council discussed programs for the 1965 budget and Village
financial practices.
Motion by Henry Dorff and seconded by Phil Cohen to adjourn. Motion
carried unanimously. The Village Council adjourned at 12 :05 A.M.
