Minutes of the Proceedings of the
Village Council of the Village of
Brooklyn Center in the County of
Hannepin a nd Stnte of Mingeso
August 17, 1964
The Village Council met in Special Session and was called to order
by Mayor Gordon Erickson at 7:30 P.M.
Roll Call: Present were Mayor Gordon Erickson, Phil Cohen, John
Leary, Henry Dorff and Howard Heck.
Notion by Phil Cohen and seconded by Howard Heck to approve the minutes
of the Council meeting held August 10, 1%4 Motion carried unaniamously. '
Motion by John Leary and seconded by Phil Cohen to reduce the
subdivision bond on George's Terrace, 2nd Addition from the sum of
$5,700 to the sum of $1,600 as recommended by the Village Engineer.
Motion darried unanimously.
Motion by John Leary and seconded by Howard Heck to authorize the
Mayor and Village Clerk to sign a contract engaging the firm of Moen and
Pentilla to conduct the dnnual audit of the Village accounts for the
calendar year 1964. Motion carried unanimously.
Motion by Howard heck and seconded by Henry Dorff to accept the
resignation of the Village Director of Finance Robert Bullock, effective
August 28, 1%4. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen to approve the
following license:

Notion carried unanimously.
The Mayor ahnouhced that the meeting was open for the consideration
of proposed hater Main Improvement No. 196431.
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement, showing two weeks publication thereof in the
official newspaper, the last publication bring on August 12, 1964, which
affidavit was examined and found satisfactory and ordered placed on file.
The Mayor then called upon all,property owners present to present
'arguments either for or against the proposed improvement. After hearing
and considering all objections, and the property owners appearing in
favor of said improvement, member Henry Oorff introduced the following
resolution and moved its adoption:

2. The plans and specifications for said improvement shall be
prepared by the Village Engineer.

The motion for the adoption of the foregoing resolution,was duly seconded
by member Phil Cohen, and upon vote being taken thereon, the following voted in favor thereof: Erickson, Dorff, Cohen] Leary, Heck and the
following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.

2. The plans and specifications for said improvement shall be
prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary, and upon vote being taken thereon, the following
voted in favor thereof: Erickson, Oorff, Cohen, Leary, Heck and the
following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.

The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck, and upon vote being taken thereon, the following
voted in favor thereof: Erickson, Dorff, Cohen, Leary, Heck; and the
following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
The mayor announced that the meeting was open for the consideration of
proposed Sanitary Sewer Improvement No. 1964 -28.
The Clerk produced an affidavit of publication of notice of hearing

The Mayor then called upon all property owners present to present

favor of said Improvement, member Henry Dorff introduced the following
resolution and moved its adoption:

following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.

proposed Water Main Improvement No. 1964 -37.

2. The plans and specifications for said improvement shall be prepared
by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary, and upon vote being taken thereon, the following

following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.

favor of said improvement, member Howard Heck introduced the following
resolution and moved its adoption:

2. The plans and specifications for said improvement shall be pre-

The motion for the adoption of the foregoing resolution was duly seconded
by member Phil Cohen, and upon vote being taken thereon, the following

following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.

interest of the Village and the owners of property specially benefitted
thereby, that the following improvement shall be constructed:

2. The plans and specifications for said improvement shall be pre -
pared by the Village Engineer.
The motion for'the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and upon vote being taken thereon, the following

Member Phil Cohem Introduced the following resolution and moved its
adoption:

AND APPROVING CONTRACT FORM
WHEWSS, the Vii3ege Administrator, Assistant Administrator, and
the Village Engineer boe reported that on August 10, 1964, at 11:00 A.M.
they opened and tabulated bids received for Projects 19664 -28, 1964-31,
1964 -32, 1964. -33,, 1964 -35, 1964 -36, 1%4 -37 1964 -38, 1964 -39 and
1964 -44 and that said bids were as follows;

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the bid of Erwin Montgomery Construction
Company in the amount of $162,444.00, as to furnishing of all work,
labor and material in connection with Projects 1964 - 28,1964 -31, 1964 -32,
1964 -33 1964 -3$ 1964 -36 1964-

. , , according to the plans and specifications therefor now on file in the
office of the Village Clerk is deemed to be the lowest and best bid
submitted for said work by a responsible bidder, and sold bid is hereby
accepted.
The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary, and wpon vote being taken thereon, the
following voted in favor thereof: Erickson, Dorff, Cohen, Leary,
Heck; and the following voted against the some: none; whereupon said
resolution was declared duly passed and adopted.
Member Henry Dorff introduced the following resolution and moved its
adoption:
'RESOLUTION DIRECTING CONWMTION
__ 2E CERTA_N INTEREST IN LAND
WHEREAS, the Village Engineer has advised the Village Council
that certain interests in land are required for municipal'purposes
including permanent easements for the acquisition of certain streets
and it appearing necessary that the acquisition of such interests
In land is necessary and desirable in the public interest and that
the taking will be most fairly and equitably accomplished through

NO11, THEREFORE,, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE
OF BROOKLYN CENTER AS FOLLOM:
The Village Attorney is instructed and directed to file the
necessary petitions to acquire the interests in lands as
set forth below and he shall prosecute such action to a
successful conclusion or til it is abandoned, dismissed, or
terminated by the court.

Motion by Henry Dorff and seconded by John Leary to adjourn,, Motion
carried unanimously. The Village Council adjourned at 12:30 A.M.
