Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
In the County of Hennepin and State of
Minnesota
September 21, 1964
The Village Council met in special session and was called to order
by Mayor Gordon Erickson at 7 :30 P. M.
Roll Call: Present were Mayor Gordon Erickson, Phil Cohen, Henry
Dorff, and Howard Heck. Absent: john Leary.
Rev. LeVang gave the invocation.
John Leary arrived at the meeting at 7 :35 P. M.
Motion by Phil Cohen and seconded by Howard Heckto approve the
minutes of the Council meeting held on September 14, 1964. Motion carried
unanimously.

Mr. J. M. Bush of 5925 Halifax Place was appointed to membership on
the Industrial Development Commission by Phil Cohen.
Mr. Vfilliam R. Williams Jr. of 4018 6Sth Avenue North was appointed
to membership on the Industrial Development Commission by Howard Heck.
Motion by Phil Cohen and seconded by Henry Dorff to equalize the fee
to be charged for use of Village owned meeting facilities and set the fee for
each instance of use by non-municip gr oups at $2.00. Motion carried

unanimously.
Motion by Howard Heck and seconded by john Leary to continue the
public hearing on Sanitary Sewer Improvement Project 1964 -30 until 8 :00 P.M.,
October 5, 1964 and instruct the Village Engineer to investigate the possibilities of
the realignment of the proposed sewer. • Motion carried unanimously.
The Mayor announced that the meeting was open for the consideration
of proposed Street Surfacing Improvement No. 1964 -47.
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks publication in the official
newspaper, the last publication being on September 9, 1964, which affidavit
was examined and found satisfactory and order placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing
and considering all objections, and the property owners appearing in favor of
said improvement, member Henry Dorff introduced the following resolution
and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF STREET
SURFACING IMPROVEMENT NO. 1964 -47 AND

BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota as follows:
1. It is hereby determined that it is necessary and for the best
interests of the Village and the owners of property specially benefitted thereby,
that the following improvement shall be constructed;

unanimously.
Motion by John Leary and seconded by Howard Heck to declare favor-
able the assessment hearing on improvement Project 1961 -60. Motion
carried unanimously.
Motion by Henry Dorff and seconded by Phil Cohen to declare favorable
the assessment hearing on Improvement Project 1961 -44. Motion carried
unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to continue the
Public hearing on the assessment of costs for Improvement Project 1963 -17
until the September 28, 1964 Council meeting. Motion °carried unanimously.
Motion by Howard Heck and seconded by John Leary to declare
favorable the assessment hearing on Improvement Project `1953 -18. Motion
carried unanimously.
Motion by Henry Dorff and seconded by John Leary to declare favorable
the assessment hearing oil ' Improvement Project 1963 -19. Motion carried
unanimously.
Motion by Phil Cohen and seconded by Howard Heck to declare
favorable the assessment hearing on Improvement Project 1953 -20. Motion
carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to declare
favorable the assessment hearing on Improvement Project 1963 -21.. Motion
carried unanimously.
Motion by john Leary and seconded by Phil Cohen to declare favorable
the assessment hearing on improvement Project 1963 -3. Motion carried
unanimously..
Motion by Henry Dorff and seconded by john Leary to declare favorable
the assessment hearing on Improvement Project 1963 -26. Motion carried
unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to declare favorable
the assessment hearing on improvement Project 1963 -4. Motion carried
unanimously.
Motion by Phil Cohen and seconded by Howard. Heck to instruct the
Village Engineer to have stop signs installed Olt the intersection of Ericon
Drive and Brookview Drive thus causing traffic on Brookview Drive to stop,
such signs being required because of the poor visibility at that intersection)
Motion carried unanimously. -2-

2.. The plans and specifications for said improvement shall be
prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was. duly seconded
by member Phil Cohen, and upon vote being taken thereon, the following
voted in favor thereof: Cordon Erickson, henry Dorff, John Leary, Howard
Heck, and Phil Cohen and the following voted against the same; Tone;
whereupon said resolution was declared duly passed and adopted.
The Mayor announced that the meeting was open for the consideration
of objections to any of the assessments for the following improvements;
Street Grading and Surfacing Projects 1961-42
Curb and Gutter Projects - 1961-43 SO
Storm Sewer Project 1961 -44
Street Improvement Projects 19 63- 17,18,19, 2Q, 2
Water Projects 1963-3,26
Sanitary Sewer Project 1963 -4
The Clerk produced an Affidavit of Publication of notice of hearing on
the above mentioned assessments showing one weeks publication thereof in
the official newspaper, the publication being on September 2, 1964, and the
aforementioned affidavit having been examined and found satisfactory was
ordered placed on file.
The Mayor them called upon all owners present to present any objections .
they may have regarding the above mentioned assessments.. After all persons
desiring to speak thereon had been heard it was determined to act on the
hearing on ce,ftain assessments as Indicated it the following motions:

The Village Engineer was instructed to determine whether or not the
pine tree located on the Southeast corner of the intersection of Hillsview
Road and Lilac Drive is located upon Village right -of -way. Motion carried
unanimously.
Member John Leary introduced the following resolution and moved

RESOLUTION REJECTING BIDS FOR PROJECT 1964 -45
WHEREAS, the Village Council at its meeting of March 2, 1964, granted
approval of the preliminary plan of Twin Lake Oaks Addition subject to a number of
conditions, among which was the stipulation that sanitary sewer shall be installed
before building permits will be issued, and
WHEREAS, the Village Council at its meeting of April 13, 19 64, determined
to follow the procedure outlined in a memorandum submitted by the Village
Engineer as a means of effecting the construction of the sanitary sewer, and
WHEREAS, the memorandum submitted by the Village Engineer contained
a stipulation to the effect that the developer of the proposed Twin Lake Oaks
Addition must post a cash escrow in the amount of the estimated cost of
construction of the subject sanitary sever lateral prior to award of construction
contracts, and
WHEREAS, the Village Administrator and the Village Engineer have
reported that on September 14, 1964, at 10 :00 A. M. they opened and tabulated
bids received for the Sanitary Sewer Project No. 1964 -45 and that said bids
were as fpllows: McDonald -Lubin Construction, $17,5:51,6.0; Earbarossa
Sons, Inc. $18,705.30; Petrowske & ross Construction
$18, 782,10; C.S. iv cCrossan, $20,817.50; and F.D. Chapman, $21 and
WHEREAS, the developer of Twin Lake Oaks Addition has not posted
the necessary cash escrow to guarantee construction cosh of the sanitary
sewer lateral Project No. 1964 -45, and
WHEREAS, the submitted low bid exceeds the estimated cost of
$13,018.00,
NOW THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that all bids as to furnishing of all work, labor,
and material in connection with Project No. 1964 -45 be rejected.
Motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck and upon vote being taken thereon, the following voted
in favor thereof: Gordon Erickson, henry Dorff, john Leary, Howard Heck
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by John Leary and seconded by Phil Cohen to authorize the
Mayor and Clerk to execute an injunction bond obligating the Village of
Brooklyn Center as principal, with the Charles Sexton Company as surety, in
favor of Richard Ernst in the amount of two hundred and fifty dollars. Motion
carried unanimously.
Motion by Phil Cohen and seconded by John Leary to instruct the
Village Attorney to continue the legal action against the Mound Cemetary
Association for violation of the Village Ordinances, but to dismiss the
complaint when the fence surrounding the cemetary property is brought into
conformance with the provisions of the Village Ordinances. Motion carried
unanimously.
Motion by Howard Heck and seconded by Henry Dorff to appoint the
following persons as temporary employees in the Recreation Department for
the positions and at the salaries set out below:

Motion carried unanimously.
Motion by john Leary and seconded by Howard Heck to authorize the
Administrator to take bids for the supply of salt on October 13, 1964. Motion
carried unanimously.
Motion by Howard Heck and seconded by Phil Cohen to authorize the
Mayor and Clerk to sign the final plat of Helisted's Addition to Hennepin
County. Motion carried unanimously.
Motion by john Leary and seconded by Howard Heck to authorize
Payment to Charles Holm of 1609 Lagoon Avenue, Minneapolis, and C. R.
Gustafson of 3706 69th Avenue, Brooklyn Center, in the sum of $100.0.0
each as payment for easements granted to the Village of Brooklyn Center for
Improvement Project 1964 - Motion carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to adjourn.
Motion carried unanimously. The Village Council adjourned at 12:20 A. M.
