The Village Council met in regular session and was called to order by
Mayor Gordon Erickson at 7 :30 P. M.
Roll Call: Mayor Gordon Erickson, Henry Dorff, john .Leary, Phil
Cohen and Howard Heck were present.
Rev. Breitholtz gave the invocation.
.Motion by Phil Cohen and seconded by Howard Heck to approve the minute:
of the Council meeting of September 21, 1964. as corrected. Motion carried
unanimously.
Motion by john Leary and seconded by Phil Cohen to approve the minutes o
September 23., 1964 as recorded. Motion carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff . to accep t a q u it
claim deed from Fred T. Lane and Pearl Lane for a portion of the street right-
of -way on Bryant Avenue just north of 65th Avenue and to authorize the payment
of $300 for the quit claim deed. Motion carrie d unanimously,
Motion by john Leary and seconded by Ph it Cohe n to u p h old th e
action of the Planning Commission and approve application 6 4093 submitted
by Bridgeman's for the ap proval of the plot p Ian and p arking layout as corrected
and noted on the plot p Ian ap proved by the Planning Commission on Septenift
24, 1964. Motion carried unanimously.
Motion by Howard Heck and seconded by John Leary to declare completed
the first reading of an ordinance amending section 19 -402 of Village ordinances
concerning the definition of a dangerous weapon. Motion carried unanimously.
Member Phil Cohen introduced the following ordinance and moved its
adoption:
AN ORDINANCE AMENDING SECTION
35 Qr THE VILIA GE ORDINANCES
THE VILIAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN
AS FOLLOVIS:
Section 1: Section 35 -413 sub - section 2 is hereby amended to read
as follows:
No service station shall be constructed on a lot abutting a R -1
or R -B district, however, that a service station may be constructed
on such a lot if the abutting lot is occupied by a multiple family
dwelling which is a part of a planned development area together with
the service station, or by a building other than a dwelling or an
accessory thereto. For the p u rp ose of th is p aragraph, a lot
which merely adjoins the use site at one comer will not be
deemed to abut the site.
Section 2: This ordinance shall be effective from a nd after its
publication.
The motion for the hdoption of the foregoing ordinance was du ly seconded
by member Henry Dorff, and upon vote being taken th ereon th a following voted
in favor thereof: Gordon Erickson, Hemry Dorff, john Leary, Howard Heck
and Phil Cohen and the following voted against th a same: None; whereupon
said ord0ance was declared duly passed and adopted.
The Mayor announced that the meeting was .+p en for the consideration
of proposed Street Surfacing Improvement No. 1964 -$7,
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks publication in the official news-
paper, the last publication belting on September 23, 1964, which affidavit was
examined and found satisfactory and ordered placed on file.

The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement . After hearing
and considering all objections, and the property owners appearing in favor of
said improvement, member Henry Dorff introduced the following resolution
and moved its adoption:
RESOLUTION ORDERING COPTSTRUCTION OF STREET
SURFACING IMPROVEMENT NO. 1964 -57 AND ORDERING
PREPARATION OF PLANS AtVM SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota as follows:
1. It is hereby determined that it is necessary and for the best
interests of the Village and the owners of property specially benefitted
thereby, that the following improvement shall be constructed:
Street Surfacing Improvement No. 1964 -57
2. The plans and specifications for said improvement shall be
prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary, and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary Howard
Heck and Phil Cohen and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
The Mayor announced that the meeting was open for the consideration of
Objections to any of the assessments for the following improvements:
Storm Sewer Projects 1964 -7, 8 9.. 13, 22
Water Projects 1964-1, 16, 21, 24,31, 32, 33, 35, 36,
1964- 37,38, 1963 -1
Sanitary Sewer Projects 1964-3,23
Area Interceptor Projects 1964 -10,14
The Clerk produced an Affidavit of Publication of notice of hearing
on the above mentioned assessments showing one weeks publication thereof
in the official newspaper,, the publication being on September 9, 1964, and
the aforementioned affidavit having been examined and found satisfactory
was ordered placed on file.
The Mayor then called upon all owners present to present any objections
they may have regarding the above mentioned assessments. After all persons
desiring to speak thereon had been heard it was determined to act on the hearing
on certain assessments as indicated in the following motions:

Motion by Howard Heck and seconded by Henry Dorff to declare
favorable the assessment hearing on Street Improvement #1963 -17. Motion
carried unanimously.
Motion by Henry Dorff and seconded by Howard Heck that since the
street surfacing constructed under Street Improvement #1963 -17 does not
extend across the entire frontage of the property of L. R. Rakeness, the
Village Council direct the Street Department to construct a driveway from
the cul de sac to within 10 feet of the driveway on Mr. Rakeness property,
after Mr. Rakeness has executed a statement indicating his understanding
that the Village will not maintain the driveway. Motion carried unanimously.
Member John Leary introduced the following resolution and moved its

BE IT RESOLVED, by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The Village Clerk has, with the assistance of the Engineer heretofore
selected by this Council for such purpose, calculated the proper amounts to
be specially assessed for the improvements known as the improvements listed
above of said Village against every assessable lot, piece or parcel of land in
accordance with the Provisions of law, anet has prepared and filed with the Village
Clerk tabulated statements in duplicate showing the proper description of each and
every lot, piece or parcel of land to be specially assessed and the amount calculated
against the same:
2. Notice has been duly published as required by law that this Council wouk
meet in regular session on Monday, September 21,, 1964 and Monday, September 28, 196.
to pass on the proposed assessments.
3. Said proposed assessments have at all times been open to inspection ane .
copying by all persons interested, and opportunity has been given to all interested
persons to present their objections if any, to such proposed assessments, or to any
item thereof.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessments was and is specially benefitted
by said improvement in the amount of said proposed assessment set opposite
the description of each such lot, piece or parcel of land, and that amount
so set out is hereby levied against each of the respective lots, pieces or
parcels of land therein described.
S. Such proposed assessments are adopted and confirmed, and the
sums fixed and named in said proposed assessments are affirmed, adopted
and confirmed as the proper special assessments for each of said lots,, pieces
or parcels of land respectively.
6. Said assessments as adopted and confirmed shall be certified to
by the Village Clerk and filed in his office and shall thereon be and constitute
the special assessments for the payment of the above listed improvements.

7. The Amounts assessed against each lot, piece or parcel of land
shall bear interest from the date hereof until the same have been paid at
the rate of 6 per cent per annum.
8. Such assessments shall be payable in equal installments begining
in the year 1965 payable on the lst day of January in each year and continuing
until all of said installments shall have been paid, each installment to be
collected with taxes collectible during said year by the County Auditor.

1964 -32, 1964 -33, 1964 -35, 1964 -36, 1964 -37 and 1964 -33
in twenty equal annual installments.
T. Sanitary Sewer Laterals No's 1963 -4, 1963 -3 and 1964 -23 in twenty
equal annual installments.
G. Sanitary Sewer Area Interceptor No's. 1964 -10 and 1964 -14 in
twenty equal annual installments.
H. Public Utilities mater Revenue 1To's. 1963 -1 and 1964 -1 in
twenty equal annual installments.
I. Public Utilities Water No's 1963 -3 and 1963 -26 in twenty equal
annual installments.
J. Water Hookups and Sewer Connections in twenty equal annual
installments.
9. The Village Clerk is hereby directed to make up and file in the
office of the County Auditor of Hennepin County a certified statement of the
amount which will be due thereon the 1st day of January in each year.

by member Henry Dorff and upon vote being taken thereon, the folloniring

Village of Brooklyn Center, Minnesota, as follows;
1. The council proposes to proceed under authority granted by
Ch 398, Laws of#nnesota, 1963, as amended.
2. A public hearing on the proposed. improvement shall be hid at
the Village Hall :in the Village on Tuesday, the 13th day of October, 1964,
at 8 -.00 0'cl6gk P. Tri. and -the clerk shall publish notice of the time 'and
Place of hearing by tw o weeks' publication in the offic newspaper of the

3. The area proposed to be assessed for said improvement is as
follows

the project is to be constructed and all lots & parcels abutting

4. This proposed improvement whail be designated Street Surfacing
Improvement No. 1964 -48.
The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck, and upon vote being taken thereon the following
voted in favor thereof; Gordon Erickson, Henry Dorff, john Leary Howard
Heck and Phil. Cohen and the following voted against the same: Tone;
whereupon said resolution was declared duly passed and adopted.

It is further determined that of the total cost of such improvements, more
than 20% of the cost of each will be paid from assessments levied or to
be levied against property specially benefited by the construction thereof;
that it is hereby covenanted and agreed with the purchasers and holders of
bonds issued pursuant to this resolution that such assessments have been or
will be made in the manner provided by 3,1innesota statutes, Chapter 429;
and that it is necessary and expedient to finance such improvements, to
the extent financing is necessary by the issuance and sale of $636,000
Improvement Bonds of 1964 of the Village, as herein provided.
2. The Village Clerk is hereby authorized and directed to cause
notice of the sale of such bonds to be published at least 10 days prior to the
date of sale in the official newspaper of the Village and in Commercial vTest,
a financial periodical published in the City of Minneapolis, Minnesota, said
notice to be in substantially the following form:

NOTICE IS HEREBY GIVEN That the Village Council of the Village of
Brooklyn Center, Minnesota, will meet at the Village Hall in said Village
on Monday, the 26th day of October, 1964, at 8:00 o'clock P. M. Central

� Purpose of receivin g and considering sealed bids for the
purchase of $636,000 Improvement Bonds of 1964, dated October 1, 1964.
Such bonds will be general obligation bonds bearing interest at the rate or
rates designated by the successful bidder, payable July 1, 1965, and semi-
annually thereafter on January 1 and July 1 in each year and maturing serially
on January 1 in the amounts and years as follows:

Bonds of this issue maturing on January 1, 1980, and thereafter will be
subject to redemption, in inverse numerical order, on January 1, 1979,

Including a certificate showing absence of litig a Lion, all without expense to
the Purchaser. The text of the legal opinion will be printed on the back of
each bond and certified by th a facsimile signature of th a village clerk.
All bids must be enclosed in a sealed envelop a marked "Bid for
Improvement Bonds" and delivered to the undersigned prior to the above
stated time. Each bid must be unconditional except as provided in this
notice and must be accompanied by a cashier's check, certified check or
bank draft payable to the order of the village treasurer in the amount of
at least $12,720, to be forfeited as liquidated damages in event Ilse bid is
accepted and the bid fails to comp ly therewith.
Bids shall state one basic rate of interest from date of issue to maturity
for all bonds having a common maturity date. Not more, than five such rates shall
be specified for the issue and the maturities may p
be split not more than five
ways for the purpose of designation of such rates, provided that bids may
provide that all or some of the bonds may bear additions 1 interest evidence
by separate supplemental coupons in amount not exceeding $6,360. All rates
must be stated in integral multiples of one - quarter or one -tenth of one percent.
The bid offering the lowest net interest cost (total interest from October 1,
1964, to stated maturities, less any premium offered) will be deemed the most
favorable. No bid of less than par plus accrued interest to the date of delivery
or providing for a total interest rate on any bond for any period exceeding 6%
per annum will be considered. Oral auction bids will not be received. The
right to waive any informality, to reject any and all bids and to adjourn the
sale are reserved.

The motion for the adoption of the foregoing ordinance was duly seconded
by member Phil Cohen, and upon vote being taken thereon the following voted
In favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck
and Phil Cohen and the following voted against the same: None; whereupon
said ordinance was declared duly passed and adopted.
Motion by Henry Dorff and seconded by John Leary to authorize the firm
Of Moen and Penttila to establish the Fire. Department Relief Association
accounts on an accrual basis at an estimated cost of $350 and to authorize
the finance office of the Village to do the accounting work for the Fire
Department Relief Association. Motion carried unanimously.
Motion by John Leary and seconded by Howard Heck to approve the
Investment of $34,000 in bank certificates of deposit by the Fire Department
Relief Association. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen to authorize Donald
J. Oine of 5139 Xerxes Avenue North to connect to sewer and water in the City
of Minneapolis. Motion carried unanimously.
Motion by Howard Heck and seconded by Phil Cohen to approve the
final plat of Lundgrens 2nd Addition. Motion carried unanimously,
The bills having been audited, the motion was made by Henry Dorff
and seconded by Howard Heck to order paid the bulls set forth in the schedule
attached to these minutes and made a part thereof. Motion carried unanimously,
Motion by John Lary and seconded by Howard Heck to authorize the
Mayor and Clerk to sign the stipulation regarding the petition for permanent
junction against R.C. Ernst. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen to adjourn. Motion
carried unanimously. The Village Council adjourned at 12 :30 A. M.
