October 26, 1%4 The Village Council met in regular session and was called to order by Mayor Gordon Erickson at 7:30 P.M. Roll Call: Present were Mayor Gordon Erickson, Phil Cohen, John Leary, Henry Dorff and Howard Heck. Reverend Budna gave the invocation. Notion by Phil Cohen and seconded by Howard.Heck to approve the minutes of the Council meeting held October 19, 1964. Voting in favor of the motion: Erickson, Heck, Cohen, Leary. Abstaining: Dorff. Motion by Phil Cohen and seconded by John Leary to instruct the Administrator to prepare a draft of a resolution supporting the efforts of Mr. Robert Koltes in attempting to.have a traffic control signal installed at 71st Avenue North and Osseo Road, said resolution to be submitted to the Council for consideration.at the November 2 meeting. Motion carried unanimously. Motion by Howard Heck and seconded by Henry Dorff to uphold the recommendation of the Planning Commission on application #64100 submitted by the Symsack Development Corporation and: 1 Grant a variance to Section 35-401 (2) to permit a building setback of 80 feet from the center line of Xerxes ,Avenue instead of 90 feet required by the ordinance. 2. Grant a variance to Section 15 -104 (1) to permit part of Lots 46, 47 and 48, Auditors Subdivision No. 216 to be subdivided by metes and bounds description with -the understanding that the property will be part of the Registered Land Survey proposed for the area. 3. Appxovalof site plan, parking arrangement and building plans. Notion carried unanimously.. Notion by Henry Dorff and seconded by John Leary to approve the action of the Planning Commission to request an extension of the "701" Planning Study for a periodof six months. Motion carried unanimously. The Mayor announced that the meeting was convened for the purpose of considering bids for the purchase ' of = $ 636,000 Improvement Bonds of 1964 as advertised for sale. The bid of IALMAN & COMPANY OF MINNEAPOLIS AND ASSOCIATES to purchase $636,000 Improvement Bonds of 1964 of the Village described in the notice of sale thereof is hereby found and determined to be the highest and best bid received pursuant to duly advertised notice of sale and shall be and is hereby accepted, said bid being to purchase bonds bearing interest as follows: 1966/1975 - 3.2096 1976/1978 -3.40% Plus additional interest of 2.00% per 1979/1981 -3.50% annum from 1/1/65 to 7/1/65. 1982/1985 -3.60% at a price of $636,000. The Village Treasurer is directed to retain the good faith check of the successful bidder pending completion of the sale and -2- 67 delivery of the bonds, and the Village Clerk is directed to return the checks of the unsuccessful bidders forthwith. 2. The village shall forthwith issue its negotiable coupon Improve- ment Bonds of 1964 in the principal amount of $636,000, dated October I, 1964, being 128 in number and numbered 2 to 128, both inclusive, in the denomination of $5,000* each, bearing interest payable July 1, 1965, and semiannually thereafter on January 1 and July 1 in each year, and maturing serially on January 1 in the years and amounts as follows. Fifty -one Thousand Dollars 1 ors ( 51 Ofl $ 0) in • 1966, Fifty Thousand Dollars 4 (1 in 1%7; Forty -five Thousand Dollars ($45,000) in each of the years 1968 through 1970 inclusive; Thirty -five Thousand Dollars ($35 in 1971; Thirty Thousand Dollars ($30,000) in each of the years 1972 through 1980 inclusive; Twenty Thousand Dollars ($20,000) in each of the years 1981 through 1984 inclusive, and Fifteen Thousand Dollars ($15,000) in 1985, all bonds maturing on January 1, 1980 and thereafter being subject to redemption on,January 1, 1979, and any interest payment date thereafter, in inverse numerical order at par and accrued interest. 3. The bonds shall be payable at the First National Bank of Saint Paul, in St. Paul Minnesota, n rota, as designated by the purchaser and the reasonable charges of said bank for services as paying agent shall be paid by the Village Treasurer as an expense of the improvement. 4. The Village Clerk shall obtain a copy of the proposed approving legal opinion of Nes.srs. Howard, Peterson, LeFevere, Lefler and Hamilton, Minneapolis, Minnesota, which shall be complete except as_te'dating thereof, and shall cause said opinion to be- printed on each bond, together with a certificate to be signed by the facsimile signature of the Clerk in substantially the following form: I hereby certify that the foregoing is a full, true and correct copy of the legal opinion executed by the above named attorneys,, except as to the dating thereof, which opinion has been handed to me for filing in my office prior to the time of bond delivery. (facsimile sigpatur_ e� Village Clerk -4- The Clerk shall obtain a copy of the opinion at the time of bond delivery and execute a separate certificate as to such opinion upon receipt of such opinion and shall file the opinion in his office. 6. The bonds shall be prepared under the direction of the Village Clerk and shall be executed on behalf of the village by the facsimile signature of the Mayor and the manual, signature of the Village Clerk and the corporate seal of the village shall be affixed to each thereof, and the interest coupons shall be executed and authenticated by the printed facsimile signatures of said Mayor and Clerk. The said bonds, when so executed, shall be delivered by the Treasurer to the pur- chaser thereof upon receipt of the purchase price and the purchaser shall not be obligated to see to the proper application thereof. 7. The bonds issued hereunder shall be payable from the Improvement Bond of 1964 Fund as hereby created. There is hereby pledged to said fund all receipts from special assessments to be hereafter levied for the local improvements. If any payment of principal or interest on said bonds shall become due when there is not sufficient money in said fund to pay the same, the Treasurer shall pay such principal or interest from the general fund of the village and such fund shall be reimbursed for such advances out of proceeds of assessments for said improvements. 8,. It is hereby determined that the estimated collection of special assessments will produce at least five percent in excess of the amount needed to meet, when due, the principal and interest payments on the bonds, and no tax levies are presently required. The Clerk shall deliver a certified copy of this resolution to the County Auditor of Hennepin County and obtain his certificate as required by Section 475.63, Minnesota Statutes. 9. It is hereby determined that the improvement to be financed by the issuance of bonds hereunder will benefit the entire village and the village hereby covenants with the holders from time to time of said bonds as follows: (a) The village will cause the assessments for said improvement to be promptly levied so that the first installment will be collectible no later than 1965 and will take all steps necessary to assure prompt collection. (b) The village will keep complete and accurate books and records showing all receipts and disbursements in connection with each improvement, the assessments levied therefor and n other funds a ro pp - priated for their payment and all collections thereof and disbursements therefrom, moneys on hand and balance of unpaid assessments. (c) The village will cause its said books and records to be audited at least annually by qualified public accountants and will furnish copies of such audit reports to any interested person upon request, 10. The officers of the village and the County Auditor of Hennepin County are hereby authorized and directed to prepare and furnish to the purchaser of said bonds and to the attorneys approving the legality of the issuance thereof, certified copies of all proceedings and records relating to said bons and to the financial affairs of said village, and such other affidavits, certificates and information as may be required to show the facts relating to the legality and marketability of said bonds as the same.appear from the books and records under their custody and control or as otherwise known to them,. and such certificates. certified copses and affidavits, including any heretofore furnished, shall be deemed representations of the village as to the correctness of all statements contained thereon. The motion for the adoption of the foregoing resolution was seconded by Trustee Cohen and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson- Henry Dorff, John Leary, Howard Heck and Phil Cohen; and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. -5- 73 Motion by Phil Cohen and seconded by John Leary to approve in principal the purchase of a back -hoe attachment to be financed through the sale of five year Certificates of Indebtedness and to direct the Administrator to have plans ando specifications for such equipment prepared. Notion carried unanimously. The Council discussed policy regarding the replacement of sod on Project 1963 -1. Notion by John Leary and seconded by Howard Heck to approve the building rental policy proposed and recommended by the Village Administrator, and as expanded by the Council. Motion carried unanimously. The bills having been audited motion was made by Henry Dorff, and seconded by Phil Cohen to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried unanimously. Member Jpbn Leary introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING CONVEYANCE OF L&W INTERESTS TO ANNIE Hat e WHEREAS, on the 5th day of September, 1962, a deed was conveyed to the Village of Brooklyn Center described as a Tract of land 60' in width of Lot 16, Guilford's outlots, Section 36, T 119 north, R 21 west, center line of which connects a point on the south line of said lot 16, 296.42' east of the southwest corner as measured along the south line of said lox and a point on the north line of said Lot 16, 296.44' east of the northwest worrier as treasured along the north side of said lot, and WHEREAS, It was the intention of the Village of Brooklyn Center that the above described property would constitute the normal extension of Girard Avenue North and WHEREAS, it has been determined by the Village Engineer that the above description was in error and does not describe the normal extension of Girard Avenue North, and CJHEREAS, the above description conveys to the Village of Brooklyn Center an interest across Lots 1, 2, 3, and 4, Block 2 in Halek's 4th Addition, and WHE 11HEREAS, the erroneous conveyance constitutes a cloud on the titles of Lots 1, 2 3, and 4, Block 2 of Halek's 4th Addition -6- 75 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center to convey through quit claim deed to Anna Halek, also known as Annie Halek the easterly 31' of Lots 1, 2, 3, 4, Block 2, Halek's 4th Addition according to the recorded plat thereof, and the Mayor and Village Clerk are hereby authorized to execute such a quit claim deed. Motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Erickson, Dorff, Leary, Heck, Cohen; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Howard Heck and seconded by Phil Cohen to instruct the Administrator to prepare a resolution for consideration by the Council requesting the County Board to cause a fence to be constructed along Shingle Creek at 69th Avenue North. Motion carried unanimously. Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION CORRECTING THE MINUTES OF THE FOL1.0WING COUNCIL MINUTES FOR THE VILLAGE OF BROOKLYN CENTER, MINNESOTA: AUGUST 28, 1961; AUGUST 5, 1963; MAY 18, 1964; JULY 20, 1964; AND _SEPTEMBER 28. 1964,, Minutes of August 2$ 1961- 1 the resolution approving plans and specifications for Projects No. 196145, 1961 -49 and 1961 -50 on page 5 of the Minutes of August 28, 1961, inadvertently omit the language "are hereby approved and ordered filed with the Clerk "; and 1 11HEREAS, said plans and specifications were resolved to be approved and filed with the Clerk by the Council on August 28, 1961 and that the omission was a clerical error; NO4'1, THEREFORE, BE IT 2ESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER, MINNESOTA, AS FOLLOWS: 1. Paragraph 1. of the Resolution Approving Plans and Specifications for Street Improvement Project No. 1961 -45, Storm Sewer Improvement Project No. 196149, and Curb and Gutter Improvement Project No. 1961 -50 shall be amended to read as follows: "1. The plans and specifications for the following improvements prepared by Egil 1efald & Associates are hereby approved and ordered filed with the Clerk:. . . It 2. The Clerk is authorized and directed to make the necessary corrections in the Minutes of the meeting of August 28, 1961. Minutes of August 5. 1963: t'dHEREAS, the resolution for public hearing on proposed street surfacing improvement No. 1963 -18 on pages I and 2 of the Minutes of ,August 5, 1963 inadvertently stated that the estimate of the Engineer's Preliminary Report was $14,163; and "+IHEAEAS, the actual estimate of the Engineer's Preliminary Report was $18,756; and !WHEREAS, the failure to the Minutes to state the actual Engineer's estimate was a clerical error; NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VIIIAGE OF BROOKLYN CENTER, MINNESOTA, AS FOLLOINS: -7- 77 1. The Clerk is authorized and directed to make the necessary corrections in the Minutes of the meeting of 1 5 1%3, Wig, f May 18,___ 1 the resolution providing for public hearing on proposed storm sewer improvement No. 1964 -13 on pages 8 and 9 of the Council Minutes for May 18, 1964 contains a clerical error in the description of property contained in the second paragraph on page 9 of said minutes: NVI, THEREFORE, BE IT RESOLVED BY THE VILLpBE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER, MINNESOTA, AS FOLLO''S: 1. Minutes of July, 20. 1964• WHEREAS, the resolution approving the plans and specifications for 'later Main Improvement No. 1964 -31 and other improvements on page 2 of the Council Minutes for July 20, 1964 contains a clerical error inadvertently describing the said water main improvement as "1963 -31" in paragraph 1. of said resolution. -8- 79 NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER, MINNESOTA, AS FOLLGIVIS: 1. That paragraph 1 of the said resolution be amended to read as follows: "1. The plans and specifications for the following improvements, prepared by the Village Engineer, are hereby approved and ordered filed with the Clerk: Sanitary Seiner Improvement No. 1964 -28; tester Main Improvement No. 1964 »31; !Dater brain Improvement No, 1964 -32; dater Main Improvement No. 1964 -33; 'dater Main Improvement No. 1964 -3d `Water Main Improvement No. 1964 -36; ''Water Main Improvement Noy 1964 -38; Water biain Improvement No 1964 -39; Uater Main Improvement No. 1964 -37; and Public Utilities Service Extensions Improvement No. 196444." 2. The Clerk is authorized and directed to make the necessary corrections in the Minutes of the Meeting of July 20, 1964, Motion for the adoption of the foregoing resolution was duly seconded by Howard Heck, and upon vote being taken thereon, the following Voted in favor thereof: Erickson, Cohen, Dorff, Leary, Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Howard Heck to adjourn. Motion carried unanimously.
