Council of the Village of Brooklyn Center
In the County of Hennepin and State of
Minnesota
November 2, 1964
The Village Council met in special session and was called to order
by Mayor Gordon Erickson at 7;30 P. M.
Roll Call: Present were Mayor Gordon Erickson, Phil Cohen, john
Leary., Henry Dorff and Toward Heck.
Rev. li alt:er of Saint Alphonsus Church gave the invocation.
Motion by Phil Cohen and seconded by Howard Heck to approve the
minutes of the October 26, 1964 Council meeting. Motion carried unanimously.
Motion by Howard Neck and seconded by john Leary to uphold the recom-
WMAMIGn of tie Planning Commission on application #64098 submitted by Richard
Sybrant and:
1. Grant a variance to Section 35- 601.(1) of the Village Ordinances and
Permit the construction of a four unit apartment building on a lot which is
substandard in width.
2. Approve plot plan, parking arrangement and building plans. T�dotion
carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to uphold the recommend-
anion of the Planning Commission on application $64102 submitted by Trach
Properties Inc. and grant permission for the construction of 3,923 sq. ft. office
building on Tract A of Registered Land Survey 1114 provided that the building
is connected to sanitary sewer prior to occupancy and subject to the requirements
Of the Village Building and Zoning Ordinances, Uotion carried unanimously.
The Mayor announced that the meeting was open for the consideratiOn
of proposed Sanitary Sewer Improvement N o. 1964 -58.
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks publication thereof in the official
newspaper, the last publication being on October 28, 1964, which affidavit
was examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of
said improvement, member John Leary introduced the following resolution
and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF SANITARY
SEWER IMPROVEa�,,Z1 NO. 1964 -58
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, as follows;
1. It is hereby determined that it is necessary and for the best interests
of the Village and the owners of property specially benefitted thereby, that the
following improvement shall be constructed:
Sanitary Sewer Improvement No. 1964 -58,
2. The improvement shall be constructed in accordance with plans and
specifications prepared by the Village Engineer.

The motion for the adoption of the foregoing resolution was. duly seconded
by, member Phil Cohen, and upon vote being taken thereon, the following voted in
favor thereof: Gordon Erickson, Henry Dorff,, john Leary, Howard Heck and
Phil Cohen and the following voted against the same: None, whereupon said
resolution was declared duly passed and adopted. _
Member Henry Dorff introduced the following resolution and - moved its
adoption:
RESOLUTION ACCEPTING BID AND APPROVING
CONTRACT FORivi
WHEREAS, the Village Administrator and the Village Engineer have reported
that on November 2, 1964, at 10:00 A. Al. , they opened and tabulated bids
received for Sanitary Sewer Improvement No. 1964 -58 and that said bids
were as follows:
Knutson- Seurer, Inc. $ 11,909.50
Horace Montgomery Const. 12, 563.50
Barbarossa & Sons 14:
Petrowske & Ross 14, 984.30
NOVA', THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the bid Knutson- Seurer, Inc. in the amount
Of $11,909.50 as to furnishing of all work, labor, and material in connection with
Sanitary Sewer Improvement No. 1964-S8 according to the plans and specifications
therefor now on file in the office of the Village Clerk is deemed to be the lowest
and best bid submitted for said work by a responsible bidder, and said bid is
hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon, the following voted

and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by Henry Dorff and seconded by john Leary to appoint „enneth
Livingston as the Village Representative, and A. J. Lee as alternate, to the
Salary Adjustment Panel requested by Local 49 of the International Union of
Operatin5 Engineers. Motion carried unanimously.
Motion by John Leary and seconded by Phil Cohen to uphold the recommend-
ation of t Ite Planning Commission on application *64089 submitted by Shopper's
City Inc' and grant a variance to Section 35 -320 (2a) of the Village Ordinances
and perm a roof type identification sign to be constructed provided that the
construction complies with the following limitations:
1. The sign shall be composed of individual letters placed upon one
surface of separate boxes, the dimension of such surfaces to be
six feet wide and eight feet high.
2. The boxes shall be erected on the south parpet wall of the building
with open spaces between the individual boxes.
3. The sign shall be illuminated by an interior light source which
sha 1 remain constant in intensity when the lighting is in operation.

Member Hcward Neck introduced the following resolution and moved
its adoption;
RESOLUTION REQUESTING TIETE COUNTY BOARD
TO ORDER FENCES INSTALLED ALONG COUNTY
HIGHRXAY 41 AT THE INURSECTION WITH
SHINGLE CREEK
WHEREAS, the area surrounding the intersection of Shingle Creek and
County Highway 4 is a play area and gathering place of numerous children;
and
WHEREAS, said County Highway #130 carried a high volume of traffic
at speeds of 40 mph and the visibility afforded drivers s at said intersection
Is greatly limited by the curvature of the roadway and bridge abuttments; and
WHEREAS, children playing in the vicinity of this intersection frequently
cross said County Highway $1-130, often without regard for oncoming traffic;
and
WHEREAS, the right-of-way for County Highway # 130 extends at
perpendiculars from the e

feet and
construction of any facility of structure .on said right- by parties
other than the County Board of Commissioners violates the laws of the State
of Minnesota;
NOW THEREFORE,,- BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF BROOKLYN CENTER:
1. That the County Board is hereby requested to install such fences
as may be required to remove the mutual hazard to children and motorists at
the aforementioned intersection.
2. That a copy of this resolution be certified to the Hennepin County
Board of Commissioners.
The motion for the adoption of the foregoing resolution was duly seconded by
member Henry Dorff, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson„ Henry Dorff, john Leary,, Howard Heck
and Phil Cohen and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Member ; Phil Cohen introduced the following resolution and moved its
adoption:

OF A TRAFFIC SIGNAL AT Ts'E INTERSECTION

WHEREAS,, that portion of Minnesota T. H. #152 that passes through the
Village of Brooklyn Center is presently being improved and expanded to a w ith
of six lanes and will soon be open to through :traffic; and
WHEREAS, the present plans of the 1- Unnesota Department of Highnvays
do envisage the future installation of a tra�fic signal at a location practical
for use by children that vralk to school and attend Willow Lane Elementary
School to the west of T. H. #1-152, the Brooklyn junior High School at 7400
Noble Avenue North to the east of T. H. 0152, and Saint Alphonsus Elementary
School at 71st and Halifax Avenues North, also to the east of T. H. 1 j ';15.2;and
WHEREAS, there is great concern for the safety of these children who will
be required to cross without the benefit of a traffic signal of any sort, a six
lane undivided highway which will carry a high volume of .traffic at speeds of
thirty -five to forth -five miles per hour; and

WHEREAS, the Village of Brooklyn Center has developed a park adjacent
to the Willow Lane School which is used extens"ively.,by children: living to the
east of T. H. #152; and
WHEREAS, all of the programmed recreational activities held at the above
mentioned park are scheduled at times other than school hours , and past- experience
indicates that many children will be attempting to cross T. H. #152 in the vicinity
of 71st Avenue North, after dark without supervision, to participate in the
aforementioned scheduled activities as well as unscheduled activities such as
ice skating; and
WHEREAS, although at the present time, the Department of Highways
has not developed wwriews for the signalizations of six lane highways, it is
anticipated that at some time in the near future the vehicular and pedestrian
traffic at the aforementioned intersection will meet or exceed the existing warrants
for the si nalization o
! f ether than six lane highways and thus justifying the
installation of traffic signals;
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF 'THE
VILLAGE OF BROOKLYN CENTER that the 1\jAnnesota Department of Highways
Is urged to cause a traffic signal to be installed immediately at the intersection
of 71st Avenue North and T. H. #152;
BE IT FURTHER RESOLVED AS FOLM'r"S:
1. That the Village of Brooklyn Center is willing to participate in the
cast of the above mentioned signalization under the usual Department of
Highways - Village contract.
2. That the Village Administrator is directed to prepare such supporting
documents for this resolution as may be required.
3. That a copy of this resolution be directed to the Commissioner,
Minnesota Department of Highways.

by member Howard Heck, and upon vote being taken thereon, the following

Motion by john Leary and seconded by Howard Heck to grant a permit to
the Brooklyn Center Jaycees to hold a Turkey Shoat at Shopper's City on
November 20 & 21, 1964 provided that the Village Clerk be provided with a
copy of a liability insurance policy naming the Village of Brooklyn Center
as co-insured. Motion carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to appoint Joyce
Schackor of 6SO1 Brooklyn Drive as an election judge in precinct #6 for the
November 3, 1964 election. Motion carried unanimously.
Motion by Henry Dorff and seconded Howard Heck to
by purchase a hand
operated vibratory tamper for the Public Utilities Division at a -cost of $611.04
with such funds to be drawn from the Public Utilities account. Motion carried

Motion by Phil Cohen and seconded by John Leary to approve the plat of
Hohenstein's 3rd Addition to Hennepin County. Motion carried unanimously.
Motion by Phil Cohen and seconded by Henry Dorff to adjourn. Motion
carried unanimously. The Village Council adjourned at 11 :15 P. M.
