M. Roll Call: Present were Howard Heck, john Leary and Henry, Dorff. Absent; Mayor Gordon Erickson and Phil Cohen. Motion by john Leary and seconded by Henry Dorff to approve the minutes of the Council meeting held November 2, 1964. Motion carried unanimously. Motion by Henry Dorfff and seconded by John Leary to approve the minutes of the special council meeting held .November 3, 1964. Motion carried unanimously. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID FOR OINTE (1) 281600 G. V et. ALL WI-MEL DRIVE TRUCK Y HEREAS, the Village Administrator and the Director of Public Works have reported that on lNovember 9, 1964 at 2 :00 P. M, they opened and tabulated bids received for one (1) 28,000 G.V.W. All IA'heel Drive Truck and that said bids were as follows: Itasca Equipment Co. 17,716.48 Oshkosh Model M -4316 Tradeiri __1, 83$.48 W/%ving plow (1) 1952 F.w.D. D. 151 960.00 Less deduction for conventional Cab 4 95.00 $ 1S, 465.0 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village Of Brooklyn Center that the bid of Itasca Equipment Company in the amount of 87 $15, 3.00 for said truck with a custom cab in accordance with the specifications therefor now on file in the office of the Village Clerk is deemed to be the lowest and best bid Submitted by a responsible bidder, and said bid is hereby* accepters. The motion for the adoption of the foregoing resolution,was duly seconded by member John Leary, and upon'the'vote being taken thereon the following voted in favor thereof: Howard Heck, John Leary, and henry Dorff, and the following voted agaim t the same; None, whereupon said resolution was declared daily passed and adopted. SO Ford Tradein (1) 1964 Chevrolet ` 950.00 3,841.56 Bucket Seats (2) cars @ $50.00 ea. 100.00 $3,941 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of Osseo Motors in the amount of $3,860.00 for two police cars which meet the specifications therefor now on file in the office of the Village Clark is deemed to be the lowest and best bid submitted by a responsible bidder, said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff and upon vote being taken thereon the following voted in favor thereof: Howard Heck, john Leary, and Henry Dorff and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Phil Cohen came into the meeting at 7 :SS P. M. Member john Leary introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING AND APPROVING CORRECTION TO NORTHLAND ESTATES 2F.D PLAT WHEREAS, action was taken at the November 18, 1963, meeting of the Brooklyn Center Village Council to unanimously approve the final plat of Northland Estates 2nd, and WHEREAS, Village Council has been advised that the township and range designations were omitted from the plat, and WHEREAS, the surveyor and platting agent of Northland Estates 2nd., E.A. Rathbun, has submitted a certification that all portions of the - premises described in Northland Estates 2nd is part of the northwest quarter (NW 1 /4).of the southwest quarter (SVtr 1/4) of Section 25, Township 119, Range 21, Hennep:;n County, Minnesota. NOW, THEREFORE, BE IT RESOLVED by the Vil Council of the Village of Brooklyn Center to accept and approve a certified correction to Northland Estates 2nd, said correction consisting of the addition of the township and range designation to the plat. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof; Phil Cohen, Howard Heck, john Leary and Henry Dorff and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -2- 97 Member Phil Cohen introduced the following resolution and moved its adoption: RESOLUTION BE IT RESOLVED that the Village enter into an agreement with the State Of Minnesota, Department of Highways for the following purposes, to -wit, To install a traffic control signal on Trunk Highway No. 152 at its intersection with 69th Avenue North (County Highway No, 130) in accordance with the terms and conditions set forth and contained in Agreement No. 54367, a copy of which was before the Council. BE IT FURTHER RESOLVED, that the ii ayor and Clerk be and they are hereby authorized to execute such agreement, and thereby assume for and on behalf of the Village all of the contractual obligations contained therein. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff and upon vote being taken thereon the following voted in favor thereof: Howard Heck, John Leary, Phil Cohen and Henry Dorff and the following voted against the same: i.Ione; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Phil Cohen to declare held the first reading of the - proposed ordinance regarding the , use of folding school stop signs at school crossing intersections. Motion carried unanimously. Motion by John Leary and seconded by Phil Cohen to uphold the recommendation of the Planning Commission on application #64104 submitted by American Legion Post 4%30 and: 1. Grant a variance to Section 35 -410 (4) to permit a 10 foot buffer on the East instead of the required 25 feet. 2. Grant a variance to Section 35 -120 (1) to permit a 20' 24' building for use as a storage area; provided the ordinance requirements for surfacing the parking lot and screening from the abutting R -1 district shall be met,, said screening to consist of a solid fence or wall as provided in Section 3S -710 of the Village Ordinances. Motion carried unanimously. Motion by Henry Dorff and seconded by john Leary to uphold the recommendation of the Planning Commission on application #64096 and approve the revised preliminary plat of Northtown Plaza, lst Addition. !!lotion carried unanimously. Motion by Phil Cohen and seconded by John Leary to uphold the recommendation of the Planning Commission on application #64097 submitted by George E. Hanson and grant a special use permit to construct a nursing home at 6720 Orchard Avenue North, and approve the 'building plans, plot layout, and parking arrangement, provided the parking area in the front of the building is sufficiently screened so as winhibit headlights from shining on homes in the surrounding residential- areas. Motion carried unanimously. Motion by Phil Cohen and seconded by Henry Dorff to approve the uniform change and clothing allowance plan for the. Police Department proposed by the Village Administrator except for the clothing - allowance for plain - clothes -` men, the latter allowance to be further researched and reported upon at the next meeting., Motion carried unanimously. Member John Leary introduced the following resolution and moved its adoption: COUNCIL POLICY PERTAINING T4 EMPLOYEE TRAIITTINtC -3- 99 WFIEREAS, the problems related to municipal inaMgement and operations have increased in scale and complexity over the pakt few years;and V-40REAS, new techniques are constantly becoming available to :meet these problems; and WHEREAS awareness and proficiency in the application, of these techniques is mandatory if employees are to perform their functions more effectively and be able to qualify for positions of increasing difficulty and respond ly. and WHEREAS, such increased proficiency is in the best interests .of the community; NOW, THEREFOR, BE IT RESOLVED by the Village Council of the Village Of Brooklyn Center that a policy of promoting and encouraging employees of the Village of Brooklyn Center to persue further education and training fs hereby adopted, In support of this policy the following program is adopted: 1. Vtai unary The Village of Brooklyn Center will reimburse to Village employees attending job related coursea 60% of the Cost incurred by the employee for the payment of tuition and fees and purchases of textbooks required for such courses, provided the following dons have been met: a. The course has been approved by the Administrator prior to remotion for, or participation in, the course. b. The employee attains a grade of "C" or better in the course, or In those cases where grades are not assigned the employee must show proof of satisfactory completion of the course, c. The employee has submitted, on forms to be provided by the Administrator, a written critique of the course,_ stated the value of the training to his position,, and made such suggestions as may be pertinent for the conduct of future training sessions. d. The attendance of the employee at course sessions has been satisfactory. 2. Reuuired Tra jni, nQ In those instances where the Village Administrator deems it necessary or advisable that an employee attend training sessions, the Village shall pally all costs for fees, tuition, and textbooks. The employee shall attend such courses of training sessions on his or her regular work time, or if such courseat are offered only after regular work hours, compensatory time shall be granted to the employee. In the case of police officers such off duty time shall be accumulated and applied to the basic work year of 2080 hours. Upon completion of the training the employee shall submit a critique of the course as required in paragraph 1c. above. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen and upon vote being taken thereon the following voted In favor thereof: Howard Heck, Phil Cohen, Henry Dorff and John Leary and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Henry Dos#f introduced the following resolution and moved Its adoption: RESOLUTION VACATING NORT T LILAC DRIVE BETWEEN ' LOGAN AVENNUE NORTFI AND i;r;ORGAN AVENUE NORTH AS A PU§= STREET UTHEREAS, a petition has been duly filed with the Village Council of the Ville of Brooklyn Center, Minnesota, for the vacation of North Lilac Drive between Logan Avenue North and the centerline of Morgan venue North, by the Futterman Corporation, owner of all land abutting said streaV sbuth of Staft Highw4y 4`100, and IffHEREAS, a notice of Public Hearing on said proposed vacation to be held on November 9, 1964, was duly published on October 28, 1964 in the Brooklyn Center Press, and three copies of said notice were posted on October 23, 1964, in places within the Villager and ` I- MREAS, all parties having been heard and no one appearing in opposition thereto, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is deemed to be in the best public interest to, and the Village Council does hereby vacate all of North Lilac Drive between Logan Avenue Borth and the centerline of Morgan Avenue North. 2. The Council proposes to proceed with said vacation under authority granted by Minnesota Statutes, Section - : 12.851. 3. The Village Clerk is authorized herewith to certify a copy of this resolution and cause said resolution to be recorded with the Register of Deeds in and for Hennepin County, Minnesota. The motion for the adoption of the foregoing resolution was duly seconded by member john Leary and upon vote being taken thereon the following voted in favor thereof: Howard Heck, john Leary, Henry Dorff and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Stone Plumbing Company 2 j -j est 67th St. South, i pls. 23 Motion carried unanimously. Mayor Gordon Erickson came into the meeting at 10:65 P. The bills having been audited motion was made by Henry Dorff, and seconded by john Leary to order paid the bills set forth in the schedule attached to these minutes and made a part thereof.
