Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
November 23, 1964
The Village Council met in regular session and was called to order
by Mayor Gordon Erickson 7,30 P. M.
Roll Call: Present were Mayor Cordon Erickson, Phil Cohen, John Lary,
Hemy Dorff and Howard Heck.
Rev. Swedberg gave the invocation.
Motion by Howard Heck and seconded by John Lary to approve the
minutes of the November 16, Council meeting as corrected. Motion carried
unanimously.
Motion by John Leary and seconded by Henry Doff to approve the
minutes of the special council meeting held Novembs r 1$. Motion carried
unanimously,
Motion by Phil Cohen and seconded by John Leary to uphold the
recommendation of the Planning Commission on application #64099 ,submitted
by Boutell`s Furniture Co. and grant a variance to Section 35 -704 of the
V111e9e Ordinances to permit an off street parking ratio of two car spaces
for each 1000 square feet of gross floor area, said variance to be constructed
as applying only to the Boutell's furniture store in Brookdale Center and not
to furniture stores or retail businesses in any other area of the Village. Motion
carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to uphold the
recommendation of the Planning Commission on application #64105 submitted
by ll0utell's Furniture Co. and permit the applicant to construct a furniture
store on Xerxes Avenue North and County Road #10 subject to final approval
of construction plans by the Building Inspector, however this approval shall
not apply to any signs that may be erected on the property. Motion carried
unanimously.
The Council discussed the Capital Improvement Program for Parks with
members of the Park Board and the Park and Recreation Director.
Trustee Phil Cohen left the meeting at 10 :05 P. M.
Member John Leary introduced the following resolud6n'and moved
its adoption:
REM?LUTION
WHEREAS, application #64095 has, been made to the Village Council
of the Village of Brooklyn Center for subdivision of Parcel 3210 in Auditor's
Subdivision #309; and
WHEREAS, the Council desires to approve the subdivision without
waiving any of the platting and zoning regulations > which would be applicable
should the remainder of Parcel 3210 be developed;
NOW, THEREFORE, BE IT RESOLVED By THE VILLAGE COUNCIL OF THE
VILLAGE OF BROOKLYN CENTER, MINNESOTA:
1. That application for the subdivision of Parcel 3210 in Auditor`s
Subdivision #309 be approved;
2. That this approval specifically is not intended to waive any of
the requirements of the Platting, Building, or zoning Ordinances of the Village
of Brooklyn Center which apply to the development of that part lying 1,Y a st

of the East 300 feet of the South 80 feet of Lot 28, Auditor's Subdivision
#309, Hennepin County, Minnesota;
3. That the Clerk is instructed to send a certified copy of this
Resolution to the applicant by certified mgt , and place the receipt and
copy of the letter on file.

Motion by Henry Dorff and seconded by Howard Heck to approve the
dedication as a public street and accept a quit claim deed for the West 30
feet

Hennepin County, said dedication made and deed executed by Bernard Rlwk
and his wife Mary Ellen Black. motion carried unanimously.
Trustee Phil Cohen returned to the meeting at 10 :20 P. M.
Member Howard Heck introduced the following resolution and moved

RESOLUTION DECLINING TO REVIEW VARIANCE
APPLICATION NO, 64098
WHEIMM, the Council by Resolution of November 2, 1964,
granted variance application #64098 submitted by Richard Sybrant requesting
a variance to the 75 ft. lot width requirement for a multiple dwelling in an
R -B District; and
WHEREAS Maurice Britt, an adjoining property owner has appeared
before the Council and has requested the Council to review the granting of
application #64098 and to revoke the variance granted on the ground that the
applicant did, not snake a reasonable attempt to purchase enough land to meet
the 75 ft. lot:width requirement; and
VVHEREAS, the Council has heard 1\.4r. Britt and the applicant and finds:
1. That the applicant did not personally attempt to purchase sufficient
land to conform to the 75 ft. width requirement;
2. A Mr. Peterson, either at the request of the applicant or for himself,
did attempt #o purchase property for the applicant's site;
3. The adjoining property owner, lzx. Britt, offered to sell all of his
Property but refused to sell the minimum number of feet requested by Mr.
Peterson;
4. That h6r. Peterson informed the applicant of his unsuccessful
negotiations with th Nar. Britt
S. Mr. Britt still refuses to sell merely the number of feet needed
by
the applicant, to conform to the 75 ft. width requirement;
6. The applicant, relying upon the Council's grant of a variance
has completed the foundation of multiple ,dwelling on the .subject lot; and
WHRYUS the Council concludes:
1. That it was informed with substantial accuracy of all of the
facts pertinent to the application, including the applicant's attempt to secure
enough additional real property.

2. The applicant has obtained vested rights in the variance
granted by the Council pursuant to application #64098; and
WHEREAS the Council has concluded as set forth in the next
preceding paragraph, the Council believes that it would be improper to
review application #64095; and
WHEREAS, the applicant meets every area and space requirement of
the ordinance except p the width requirement, and since the multiple dwelling use
would not change the character of the area, and since the strict enforcement of
width requirement would prevent any multiple dwelling use of the subject
property whatsoever, the Council concludes that the width requirement creates
a practical difficulty and unnecessary hardship and that :therefore the applicant
Is entitled to a variance;

Following its second reading as a proposed ordinance member Phil
Cohen introduced the following ordinance and moved its adoption:
AN ORDINANCE PROVIDING FOR THE MAINTENANCE
OF THROUGH STOP SIGNS AT SCHOOL CROSSING
INTERSECTIOITS
Section 27 -701. DEFINITIONS:
I. Stop sign -- the word stop sign refers to a sign octagonal in
shape which has a red background and carried the word "Stop" .in white
letters and otherwise conforms to the "manual of uniform traffic control
devices for streets and highways u

Section 27 -703. HOURS OF OPERATION.
All school stop signs shall be placed in operation in accordance with
the following schedule on school days.

Section 27 -704, i ITMNANCE OF SCHOOL STOP SIGNS
School stop signs shall be maintained ,and manned in the following
manner:
I. The adult representatives designated in Section 27 -702 shall
supervise the operation of the school stop signs.
2. Members of the school patrol shall be assigned to each intersection
protected by school stop signs.
3. At the first morning hour designated in Section 27-703 the adult
representative shall unlock the school stop sign and place it in operation.
4. The school patrol patrolling each school stop intersection shall
fold the school stop sign at the second morning hour designated above, unfold
It at the first noon hour designated, fold at the second noon hour designated,
and unfold the sign at the first afternoon hour designated.
S. At 4 :00 P. f: , . the adult representative shall fold and padlock the
school stop sign and it shall remain locked until the following school day
morning and the time designated for placing the sign in operation.
The motion for the adoption of the foregoing ordinance was duly seconded
by member John Leary and upon vote being taken thereon the following
voted in favor thereof: Gordon Erickson, Howard Heck, Henry Dorff. John
Leary and Phil Cohen and the following voted against the Same: None;

Motion by john Leary and seconded by Howard Heck to adopt the
Policy proposed b

school stop signs and direct that the policy be entered in the the Council
Policy manual presently being prepared. Motion carried unanimously.
Motion by Howard Heck and seconded by Henry Dorff to instruct the
Administrator to advertise the following items for bid, said bids to be received
at 2;00 P. M. , December 7, 1964:
1. Box Sander 3. 1 - Ton Dump Truck
2. Carry -All Type Vehicle 4. Police Uniforms

Member Henry Dorff introduced the following resolution and moved

RESOLUTIO
WHEREAS, the Village of Brooklyn Center has been served faithfully
and diligently by GEORGE W. NASSIG since October 23, 1961; and
WHER£AS GEORGE W. NASSIG, will reach the manditory retirement
age of sixty -five years on November 28, 1964 and has notified the Village
Council of his plans to retire on November 27, 1964:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that GEORGE W . HASSIG be commended for his
contribution to the improvement and betterment of the Village of Brooklyn
Curter, and that this resolution stand as an indication to all who read it
of the sincere appreciation of the people of Brooklyn Center for the service of
GEORGE W. NASSIG.

Motion by john Leary and seconded by Howard Heck to appoint
LaVerne Dingley as custodian in the Fire Station and Liquor Store at the
wage of 5365.00 per month effective November 24, 1964. Motion carried
unanimously.
Motion by Phil Cohen ad seconded by Henry Dorif to terminate the employ-
meat of the following temporary Street Department employees due to lack of
work in that Department, said termination to be effective November 27, 1964:

Motion carried unanimously.
Motion by Henry Dorff and seconded by john Leary to accept the verbal
resignation of James Bergstrom as an employee of the Municipal Liquor Store.
Motion carried unanimously.
Motion by Phil Cohen and seconded by john Leary to instruct the
Administrator to advertise for bids for a full size car for the Chief of Police..
Voting for the motion: John Leary, Phil Cohen, and Gordon Erickson. Voting
against the motion.- Henry Dorff, aW Howard Heck. Motion carried.
Motion by john Leary and seconded by Phil Cohen to approve
the following licenses:
