M. by Mayor Gordon Erickson. Roll Call; Present were Mayor Gordon Erickson, John Leary, Henry Dorff and Howard Heck. Member Phil Cohen was absent, Rev. Vick gave the Invocation. Mr. Cohen came into the meeting at 7;35 P. M. Motion by Howard Heck and seconded by John Leary to approve the minutes of the September 8, 1964 Council meeting. Motion carried unanimously. Motion by Phil Cohen and seconded by Henry Dorff to approve the minutes of the September 9, 1964 Council meeting. Voting In favor of the motion Gordon Erickson, Henry Dorff, Phil Cohen and Howard Heck Abstaining: John Leary. Motion carried. Motion by John Leary and seconded by Phil Cohen to uphold the recommendation of the Planning Commission on application 64081 submitted by Ray Rothstein and grant a variance to Section 35 -401 (4) of the Village Ordinance to permit the applicant to construct a five foot addition to the North side of the existing garage at 5930 Camden Avenue North, thereby reducing the sideyard setback to three feet. Motion carried unanimously. Motion, by Phil Cohen and seconded by John Leary to uphold the action of the Plasming Commission onapplication 64084 submitted by Homedale Builders and grant a variance to Section 35 -310 (2d) of the Village Ordinances to allow the applicant to continue a 12' x 8' sign on the site of the model home located at 6925 lyndale Avenue North, said sign to be permitted for a period of one year from the date of this motion. Motion carried unanimously. Motion by Howard Heck and seconded by Henry Dorff to uphold the ag1on of the Planning Commission on application 64074 submitted by Homedale Builders and grant a special use permit to the applicant for the construction of a temporary sales office and a storage garage to be located at 7000 Humboldt Avenue North„ said special use to be allowed for a period of two years from the date of this motion. Motion carried unanimously. Motion by Henry Dorff and seconded by Phil Cohen to uphold the action of the Planning Commission on application 64083 and approve the preliminary plat of Homedale Second Addition submitted by Homedale Builders. Motion carried unanimously, Motion by John Leary and seconded by Howard Heck to uphold the recommendation of the Planning Commission on application 64077 submitted by Ken Bergstrom for the renewal of a sign variance and grant a variance to Section 3S -310 (2d) for the continued use of the advertising- identification sign now located on the model home site at 6843 Emerson Avenue North for a period of one year:, with the additional authorization for the transfer of said sign to a location at 6842 Emerson Avenue North for the balance of the authorized period should the model home first mentioned above be sold. Motion carried unanimously. Motion by Phil Cohen and seconded by Henry Dorff to uphold the recommendation of the Planning Commission on application 64080 submitted by Shopper's City Inc. and grant a variance to Section 35 -310 of the Village Ordinances to permit the continued use of a 8' x l5' directional sign located upon the property of J. F, Dahinden at Highway #100 and France Avenue North until January 1, 1965. Motion carried unanimously. ..1.. Motion by john Leary and seconded by Howard Heck to uphold the 263 recommendation of the Planning Commission on application 64086 submitted by Steven Thomas and grant a variance to Section 35 -401 (4) of the Village Ordinances to permit the construction of a 3' 6 x 14 kitchen addition and a 19' 2 x 22' garage on the property located at 6413 Indiana Avenue North, said construction to result in a side yard setback of 2' 10 ". Motion carried unanimously. The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1964 -34. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks publication in the official newspaper, the last publication being on September 9, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Henry Dorff introduced the following resolution and moved its adoption; RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN IMPROVEMENT NO. 1964 -34 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center Minnesota, as follows; 1. It is hereby determined that it is necessary and for the best Interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed; Water Main Improvement No. 1964 -34 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorf, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. It is hereby determined that it is necessary and for the best interest of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed. -2- r Water Main Improvement No. 1964 -42 265 2. The plans and specifications for said improvement shall be Prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck., and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: ; None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Howard Heck to continue the Public Pleaaring can Sanitary Sewer Improvement Project 1964 -30 for one week in order to give the Village Engineer sufficient time to review the cost factors relating to the project. Motion carried unanimously. The Mayor announced that the meeting was open for the consideration Of proposed Water Main Improvement No. 1964 -40. The Clerk produce an affidavit of publication of notice of hearing on the proposed improvement showing two weeks publication thereof in the official newspaper, the last publication being on September 9, 1964, which affidavit was examined and found satisfactory and ordered placed on file. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Water Main Improvement No. 1964 -40 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said imprrovement, member John Leary introduced the following resolution and moved its adoption: -3- RESOLUTION ORDERING CONSTRUCTION OF SANITARY ',6 7 Y' SEINER IMPROVEMENT NO. 1964 -25 AND ORDERING PREPARATION OF PIANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Sanitary Sewer Improvement No. 1964 -25 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Phil Cohen, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Henry Dorff and seconded by Howard Heck to continue the public hearing on Street Improvement Project 1964 -47 for one week in order to allow time to explore the possibility of having additional petitions for curb and gutter improvements submitted by residents in the project area._ Motion carried unanimously. The Mayor announced that the meeting was open for the consideration of proposed Street Surfacing Improvement No. 1964 -53. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks publication in the official newspaper, the last publication being on September 9, 1964, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Phil Cohen introduced the following resolution and moved its adoption: RESOMITION ORDERING CONSTRUCTION OF STREET SURFACING IMPROVEMENT NO. 1964 -53 AND ORDERING PRE ION OF PL&M AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows: 1. It is hereby determined that it is necessary and for the best Interests of the village and the owners of property specially benefitted thereby, that the following improvement shall be constructed: Street Surfacing improvement No. 1964 -53 2. The grading and laying of the gravel base shall be done by day labor pursuant to Chapter 429 of the Minnesota Statutes. 3. The laying of the bituminous surface shall be done by contract pursuant to Chapter 429 of the Minnesota Statutes. 4. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member John Lary, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henri Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None,whereupon said resolution was declared duly passed and adopted. -4- r 269 The Mayor announced that the meeting was open for the consideration of proposed Street Surfacing Improvement 1 1964 -52. Motion by Phil Cohen and seconded by Howard Heck to uphold the recommendation of the Planning Commission on application 64085 submitted by Homedale Builders and approve the reauestof the applicant for rezoning, and plot layout and site plan approval, and declare the first reading of the amendments to the zoning ordinances of the Village as set out below as completed: 1. Amend Section 35 -815 to include all of Lot 48, Auditor's Subdivision #309 except the South 135 feet of the wrest 150 feet thereof. 2. Amend Section 35- 840 of the Village Ordinances to include the South 135 feet of the V,Test 150 feet of Lot 48, Auditor's Subdivision 4 but to withhold action on the petition for a Special Use Permit for a service station pending submission of plans and specifications to the Planning Commission. Ijotion carried unanimously. Motion by john Leary and seconded by Howard Heck to declare held the first reading of an amendment to Section 35 -413 (2) of the Village ordinances pertaining to the construction of service stations. Motion Carried unanimously, Mr. Iten informed the Council that due to recent developments it was not possible to gain access to the proposed 68th Avenue from his property as had been approved by the Council in the original plot plan submitted by Osseo Motors. Motion by Howard Heck and seconded by Phil Cohen that, since the Proposed access po c ess to 68th Avenue is not now available to the property owned by Osseo Motors, the Council take the revised plans submitted on this date under advisement and submit them to the Planning Commission for that body's consideration and aton. Motion carried unanimously. Motion by john Leary and seconded by Phil Cohen to authorize the Mayor and Clerk to sign a right -of -way crossing, agreement with the Soo Line Railroad. Motion carried unanimously. Motion by john Leary and seconded by Howard Heck to approve the falk wing license Elfectrical , License Weatherly electric Company 547 7th St. "Elk River, Minnesota Motion carried unanimously, The bills , having been audited, the motion eras Mde by Henry Dorff a'd seconded by Howard Heck to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried unanimously, Member Phil Cohen introduced the following resolution and moved it$ adoption: -6- V0T r RESOLUTION PROVIDING FOR PUBLIC HEARING ON . PROPOSED STREET SURFACING IMPROVEMENT MO. WHEREAS, it is proposed that there be constructed an improvement consisting of the following; Street Surfacing on 49th Avenue from Beard Avenue to T. H. 152; 50th Ave. from Beard Ave. to Abbott Ave; Beard Ave. from 49th Ave. to 50th Ave.; Abbott Ave. from 49th Ave, to 350' north of 50th Ave; Zenith Ave. from 49th Ave. to 350' north of 50th�Ave.; Dusharm Drive under Soo Line tracks to 49th Ave. No. WHEREAS, the village engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $23,100.00. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1 . The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota,, 1963, as amended. 2. A public hearing on the pvaymmd, improvement shall be held at the Village Hall in the village on Monday, the 28th day of September 1964, at 8 :00 o'clo ck P. M. , and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: All lots and parcels abutting the above named streets where the project is to be constructed. 4. This Proposed Improvement shall be designated Street Surfacing Improvement No. 1964 -48. The motion for the adoption of the foregoing resolution was :duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, john Leary, Howard Heck and Phil Cohen and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member John Leary introduced the following resolution and moved Its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PRO POSED STREET SURFACING IMPROVEMENT NO. 1964 57 WHEREAS, it is proposed that there be constructed an improvement consisting of the following; Street Surfacing on June Avenue :North from 69th to 74th Avenues and on 70th Avenm from Osseo Road to 150 feet east of June Avenue. WHEREAS, the village engineer has made a preliminary report advising that said p posed improvement is feasible and that it can be constructed at an estimated coast of ,$7152.00. NOW, TEXREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to Proceed under authority granted by Chapter 398, yaws of Minnesota, 1953, as amended. -7- O®T r 2.
