Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota March 22, 1965 I � i The Village Council met in regular session and was called to order by Mayor Gordon Erickson at 7 :30 P. M. Roll Call: Present were Mayor Gordon Erickson, Phil Cohen, John Leary, Earl Simons and Howard Heck. Also present were A J. -Lee, Ted Willard, D. G.Poss, P. W. Holmlund, M. R. Hyde, T. L. Hadd and Reverend Breitholtz of the Brooklyn Center Baptist Church. Reverend Breitholtz offered the invocation. Motion by . Phil Cohen and seconded by Howard Heck to approve the minutes of the March 15, Council meeting as recorded. Motion carried unanimously. Motion by john Leary and seconded by Phil Cohen to accept the recommenda- tion of the Planning Commission on application #65009 submitted by Sears, Roebuck and Company and grant a variance to Section 35 -410 of the Village Ordinances to permit a 68' x 71' .fenced storage area on the West side of the applicant's Garden Store from April 1, 1965 to July 1, 1965. Motion carried unanimously. Member Howard Heck introduced the following ordinance and moved its adoption: ORDINANCE AMENDING SECTION 35 OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: Sec tion 1; Section 35 -840 is hereby amended by adding thereto Lot 6, Block 1, Sunset Manor Addition. Section 2_: Section 35 -815 is hereby amended to read as follows: That, area included in the following described boundaries: Beginning at the intersection of the center line of the Osseo Road and the South line of Lot 5, Block 1, Sunset Manor extended; thence South- westerly along the South line of Lot 5 extended a distance of 1€3'; thence Northwesterly parallel to Osseo Road to the South line of Lot 3, Block 1, Center Brook Addition; thence Westerly to the Southwest Corner of said Lot 3; thence Northwesterly to the Northwest Corner of said Lot 3; thence Northeasterly along the North line of said Lot 3 extended to the center line of Osseo Road; thence Northwesterly g alon the center line of Osseo Road to its intersection with the North line of Lot 24, Auditor's Subdivision 07 extended; thence Easterly along said North line of Lot 24 extended to center line of Noble Avenue North; thence North along said center line to its intersection with the North line of Hoppe's 1st Addition extended; thence Easterly to the Northeast corner of Hoppe's ist Addition; thence Southerly along the East line of said Hoppe's lst Addition to a point distant 150 feet at right angles from Osseo Road; thence Southeasterly parallel to., and 150 feet ,distant from Osseo Road to the North line of Lane's Brooklyn Center Addition; thence Westerly along the North line of said Lane's Brooklyn Center Addition extended to the center line of Osseo Road; thence Southeasterly along said centerline to the point of beginning. Section 3; This ordinance shall be effective from and after its publication. -1- 25 ` The motion for the adoption of the foregoing ordinance was duly seconded by i member John Leary, and upon vote being taken thereon the following voted in favor thereof; Gordon Erickson, Howard Heck, Phil Cohen, John Leary and Earl Simons, and the following voted against the same: None; whereupon said ordinance was duly passed and adopted. Member John Leary introduced the following ordinance and moved its adoption: AN ORDINANCE AMENDING CHAPTER 4, SECTION 401 -E OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: Section 1. Section 4 -401E of the Village Ordinances is hereby amended by the addition of the following thereto: All meters shall be set at the nearest practicable location to the point where the service pipe enters the building, and shall be set 'in such a manner as to be easily accessible for reading, removal, and resetting. Whenever a physical condition exists that prevents the convenient reading, removal, or resetting of a water meter, the current owner of the property shall be mailed a notice requiring him to correct the con - dition within 30 days. Section 2 . This ordinance shall take effect from and after its legal publication. F The motion for the adoption of the foregoing ordinance was duly seconded by' member Earl Simons and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Howard Heck, Phil Cohen, John Leary and Earl Simons, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion by Howard Heck and seconded by Phil Cohen to table the request of Automotive Sales and Service, Inc., for a variance to the building code until the Administrator and Fire Marshall have had sufficient time to further research the requirements for sprinkler systems. Motion carried unanimously. Motion by Howard Heck and seconded by John Leary to declare the first reading of an addition to the Village Ordinances pertaining to abondoned cars and place this item on the April 6, 1965 agenda for a second reading. Motion carried unanimously. Motion by Phil Cohen and seconded by Howard Heck to declare the first reading of an addition to the Village Ordinances pertaining to the conduct and regu- lation of parades within the Village, and to place this item on the April 6, 1965 agenda for a second reading. Motion carried unanimously. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION NO. 65 -42 RESOLUTION REVOKING AND ESTABLISHING MUNICIPAL STATE AID STREETS The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Howard Heck, Phil Cohen, John Leary and Earl Simons and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION NO. 65 -43 RESOLUTION ESTABLISHING MUNICIPAL STATE AID STREETS The motion for the adoption of the foregoing resolution was duly seconded by member Earl Simons and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Howard Heck, Phil Cohen, John Leary and Earl Simons and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Phil Cohen and seconded by John Leary to approve the following licenses: Heating License Northern Air Conditioning Company 414 - 6th Avenue North Rubbish Hauling License Raymond Bergstrom S5S8 - Vera Cruz Avenue North Bergstrom Rubbish Haulers Motion carried unanimously. -3- 247 The bills having been audited, Earl Simons moved and Phil Cohen seconded to order paid the bills set forth in the schedule dated March 22, 1965 and filed in the permanent register book. Motion carried unanimously. Motion by Phil Cohen and seconded by John Leary to appoint, upon the recommendation of the Administrator, the following persons for the positions and salaries listed: Carl Swing Temporary Laborer- Street Division $2.20/hour Lester Nielsen Permanent Laborer- Public Utilities $475.00 /month Division Motion carried unanimously.
