The Village Council met in Regular Session and was called to order
by Mayor Gordon Erickson at 8:00 P. M.
Roll Call: Mayor Gordon Erickson, Howard Heck, Carl Carlson,
Henry Dorff were present. John Leary was absent.
Motion by Carl Carlson and seconded by Henry Dorff to approve the
minutes of August 27, 1962 as recorded. Motion carried.
Motion by Howard Heck and seconded by Carl Carlson to approve the
minutes of September 5, 1962 as recorded. Motion carried.
Trustee John Leary entered the meeting at this point.
Motion by Carl Carlson and seconded by Howard Heck to uphold the
action of the Planning Commission and deny application 62040 for a Special
Use Permit to construct three 24 unit apartment buildings on registered land
survey 838. Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to instruct the
Building Inspector to place a hold order on the issuing of any building permits
on registered land surrey 838 until the Council has completed its investigation
of a change in the street layout and traffic problem connected with construction
of the apartment buildings in this area. Motion carried.
Motion by John Leary and seconded by Carl Carlson to uphold the action
of the Planning Commission and approve application 62046 for a Special Use
Permit to construct a 10 unit apartment building on lots 1, 2, 3, & 4 Linden
Shores Addition subject to the construction plans being approved by the $ uildi ng
Inspector and the Village Engineer and on the condition that the parking lot be to
the east side of the building. Motion carried.
Motion by John Leary and seconded by Howard Heck to deny application
62043 for a Special Use Permit to construct a nursing home on the West side of
Orchard Avenue between 67th Avenue and 68th Avenue. Motion carried.
The Village Council referred this matter back to the Planning Commission
to study alternate locations in this general area.
Motion by Carl Carlson and sec onded by John Leary to uphold the action
of the Planning Commission and approve application 62041 for the construction
of a rental sign during the construction of apartment buildings . The approval
to be for a period of one year. Motion canned.
Motion by John, Leary and seconded by Carl Carlson to uphold the action
of the Pianhing Commission and approve application 62044 by John Christopherso:
for a variance to construct a 32 x 24 building as an accessory building.
Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to uphold the
action of the Planning Commission and approve application 62045 by Lloyd
Brandvold for a variance to construct a 34 x 24 accessory building. Motion
carried..
Member John Leary introduced the following resolution and moved its
adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
BITUMINOUS STABILIZED STREET SURFACING IMPROVEMENT

WHEREAS, It is proposed that there be constructed an improvement
consisting of the following:
Bituminous Stabilized Street Surfacing on France Avenue North
from Janet Lane to the North line of Wangstads Brooklyn Terrace
Addition.
WHEREAS, the village engineer has made a preliminary report advising
that said proposed Improvement is feasible and that it can be constructed at
an estimated cost of $239.00.
f NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at the
Village Mall in the village on Monday, the 24th day of September 1962 at
4 8:00 o'clock P. M.,, and the clerk shall publish notice of the time and place
of hearing by two weeks' publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improvement is as
follows:
All Lots and Parcels Abutting the above named Street
4. This proposed improvement shall be designated Bituminous Stabilized
Street Surfacing Improvement No. 1962 -35.
The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck, and upon vote being taken thereon the following
voted in favor thereof: Gordon Erickson, Henry DOW , Carl Carlson, John Leary,
and Howard Heck, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by Howard Heck and seconded by John Leary to establish Lilac
Drive as a one way street south bound from the south entrance to Malmborg
Garden Center to 50th Avenue North. Motion carried.
Member John Leary introduced the following resolution and moved its
adoption:
RESOLUTION AMENDING JULY 23,196 RESOLUTION' AUTHORIZING
THE EXERCISE OF JOINT POWERS TO PROVIDE SANITARY SEWER.
SERVICE FOR RESIDENTS OF THE VILLAGE OF BROOKLYN PARK AND
CENTER
WHEREAS, the Village Council of the Village of Brooklyn Center did
Propose and on July 23 1962 did adopt a joint resolution authorizing the
exercise of joint powers to provide sanitary sewer service for residents of
the Villages of Brooklyn Park and Brooklyn Center, and
WHEREAS, Item No. 5 of said Resolution proposes that the Village of
Brooklyn Center participate in the construction of the 69th Avenue North and
Lyndale Avenue North sewer mains to the extent of $14,,933.70,, and
WHEREAS, said participation In the amount of $14,933.70 was based

upon six assessment units on 69th Avenue North and th-nine assessment
units on Lyndale Avenue North at the rate of $331.86 per assessment unit,
and
WHEREAS, it has since been determined that there is one less assessment
unit than originally proposed on Lyndale Avenue North,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center that Item No. 5 of the Joint Resolution Authorizing the
Exercise of Joint Powers to Provide Sanitary SeweeService for residents of

the Village of Brooklyn Park and Brooklyn Center be amended by $331.86, such
that the total cost participation by the Village of Brooklyn Center shall be
reduced to $14,601.84, in consideration therefor the Village of Brooklyn Park
may delete construction of one proposed sewer service.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, Carl Carlson,, Henry Dorff, John Leary
and Howard Heck, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Member Howard Heck introduced the following resolution and moved

RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR STORM
SEWER IMPROVEMENT NO. 1962 -20 AND 1962 -28 AND SANITARY
SEWER IMPROVEMENT 1962.8 AND DIRECTING ADVERTISEMENT
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following improvement,
prepared by the Village Engineer, are hereby approved and ordered filed
with the Clerk:
Storm Sewer Improvement Nos. 1962 -20 and 1962 -28
Sanitary Sewer Improvement 1962 -8
2. The Clerk shall advertise for bids for such improvement by
publication at least once in the official newspaper and in the Construction
Bulletin, the date of first publication not less than 10 days',prior to the date
for receipt of bids. Said notice shall state that no bids will be considered
unless sealed and filed and accompanied by a cash deposit, bid bond,
cashier's check or certified check payable to the Clerk in the amount of
not less than five percent of the bid.
3. Bid date is set for October 1, 1962 at 10 :00 o'clock A. M.
4. The Village Administrator and Village E ngineer shall be authorized
to open and tabulate the bids.
The motion for the adoption of the foregoing resolution was duly seconded by
` member Henry Dorff, and upon vote being taken thereon the following voted
In favor thereof: Gordon Erickson, Carl Carlson, Henry. Dorff, John Leary
and Howard Heck, and the following voted against the same: None,
whereupon said resolution was declared duly passed and adopted.
Member Henry Dorff introduced the following resobition and moved

The bills having been audited motion was made by Henry Dorff and seconded
by John Leary to order paid the bills set forth in the schedule attached to
these minutes and made a part thereof. Motion carried.
Motion by John Leary and seconded by Howard Heck to instruct the
Village Attorney to prepare the necessary resolution for establishing a
Municipal Court System* Motion Carried.
Motion by Carl Carlson and seconded by Henry Dorff to appoint
Charles Gerber, 5654 Northport Drive to the Industrial Development Commission.
Motion carried.
Motion By Henry Dorff and seconded by Carl Carlson to adjourn.
Motion carried. The meeting was adjourned at 1 :15 A. M.
