M. Roll Call: Mayor Gordon Erickson, Howard Heck, Henry Dorff, John Leary, Carl Carlson were present. Motion by Henry Dorff and seconded by Howard Heck to approve the minutes of September 17, 1962 as recorded. Member Cart Carlson abstained from voting since he was not present at the meeting. Motion by John Leary and seconded by Howard Hack to approve the minutes of September 19, 1962 as recorded. Member Carl Carlson abstained from voting since he was not present at the meeting* Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: A RESOLUTION RELATING TO PARTICIPATING IN THE RURAL HENNEPIN g OUk= NMINg DI TR WHEREAS, pursuant to Minnesota Statutes, Section 145.48 and 145.12 provision has been made for a public health nursing district in that portion of Hennepin County outside the City of Minneapolis, and WHEREAS, pursuant to such authority such a public health nursing district has been organized and has been in operation for several years, and WHEREAS, it is deemed necessary to continue the operation of such l nursing district and to provide it with adequate funds for its proper operations. NOW, THEREFORE, BE IT RESOLVED by the govering body of the Village of Brooklyn Center s Y that this political subdivision continue to be included in the , public health nursing district of rural Hennepin County organized on January 4, 1952: that it participate in the benefits thereof and that it agrees to s u pport on an apportionment basis its pro rata share of the cost of the administration of such district provided, however, that for the period January 1, 1963 through December 31, 1963, this cost shall not exceed $.25 per capita on the basis of the official 1964 Federal Census. BE IT FURTHER RESOLVED, th at th is reso lu tion shall be deemed an agreement to continue to p articip ate in such nursing district on the basis hereinbefore specified with all other political subdivisions adopting similar resolutions. The motion for the adoption of the foregoing resolution was duly seconded by R member Henry Dorff, and u pon vote being taken thereon the following voted in favor thereof: Gordon Erickson,, Henry Dorff, Carl Carlson, John Leary and Howard Heck and the following voted against the same: None whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Carl Carlson to approve the Investment of $24, 044 by the Fire Dep artment Relief Association in the certificates of deposit. Motion carried. The bills having been audited, motion was made by Henry Dorff and seconded by John Leary to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION PLACING ON FILE AND OPENING TO PUBLIC INSPECTION PROPOSED NT BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, Minnesota, to order placed on file in the Clerk's office and opened to public inspection the proposed assessments on the' following improvements: STREET IMPROVEMENT NOS. 1962 -9 1962 -11 1962 -12 1962 -14 1962 -27 AND STORM SEWER NO. 1961 -49 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon the following voted In favor thereof: Gordon Erickson, Howard Heck, john Leary, Carl Carlson and Henry Dorff and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Henry Dorff to hold a hearing on Special Assessments at the Village Hall on October 15, 1962, at 8 :00 o' clock P. M. on the following Improvement projects: STREET IMPROVEMENT NOS. 1962 -9 1962 -11 1962 -12 1962 -14 1962 -27 �_ -2- 59 and STORM SEWER NO. 1961 -49 Motion carried. Motion by John Leary and seconded by Howard Heck to approve the Justice report for the month of August. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to uphold the action of the Planning Commission and approve the application of Mark Z. Jones to construct a nursing home on the east side of Orchard Avenue between 69th Avenue and 68th Avenue on the condition, that George Hanson deed to the Village of Brooklyn Center a 60' street right -of -way for Noble Avenue between 68th Avenue and 69th Avenue. Motion carried. Member john Leary introduced the following ordinance and moved its adoption: AN ORDINANCE AMENDING CHAPTER 3 OF THE ORDINANCES OF THE VILLAGE OF BROOKLYN CENTER TO PROVIDE NEW REQUIRE- MENTS LE&TAIMM 10 FAITS F OM P B S The Village Council of the Village of Brooklyn Center do ordain: Ste. Section 3 -302, paragraph 5 is hereby amended to read as follows: S. a* Buildings classified in Group I occupancy shall have not less than two exits located in remote parts of the building and leading directly to a street, alley, court or yard. Stairs shall be wholly enclosed and shall, together with the exit door, comply with the requirements of Chapter 33 of the Uniform Building Code. b. Apartment buildings classified in Group H occupany shall have not less than two exits adequately separated so that if one becomes unusable for any reason, the other will be available and usable. One-fifth of the perimeter of the building shall be considered adequate separation between entrances to exits or between termination of exits. Said apartment buildings shall in all other respects conform to the requirements pertaining to stairs, exits, and smokeproof enclosures as specified in Chapter 33 of the Uniform Building Code. c. Apartment buildings classified in Group H occupancy of type S or Sn construction shall have not less than two exits from each apartment unit opening directly upon a street or alley or upon a yard or courtyard not less than four feet in width and connected to a street or alley or into an approved passageway not less in width than the stairway opening into such passageway and not less than seven feet in width. Section 2 . This ordinance shall be effective from and after its passage and legal publication. Passed by the Village Council this 24th day of September 1962. The motion for the adoption of the foregoing ordinance: was duly seconded by member Carl Carlson and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, john Leary and Howard Heck , and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. -3- 261 The Mayor announced that the meeting was open for the Consideration of proposed Bituminous Stabilized Surfacing Improvement No. 1962 -35. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on September 20, 1962, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member John Leary introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF BITUMINOUS STABILIZED SURFACING IMPROVEMENT NO. 1962 -35 AND ORDERINQ PREPARA ION OE PLANS AX2 §EZC1FQA BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby, that the following improvement shall be constructed: Bituminous Stabilized Surfacing on France Avenue North from Janet Lane to the north line of Wangstad's Brooklyn Terrace Addition 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. 3. Each property benefited by this improvement shall be assessed $61.38. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, Howard Heck, Carl Carlson, Henry Dorff and John Leary and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the ineeting was open for consideration of objections to any assessments for the following improvements: Sanitary Sewer Projects 1961 -19, 1961 -26, 1961 -46, 1962 -17, 1961 -18, 1962 -21, Water Improvement Projects 1961 -25, 196132, 1961 -41, 1961 -47, 1962 -2, 1962 -3, 1962 -19, 1962 -25, Storm Sewer Projects 1961 -27, 1961 -48. Street Surfacing Projects 1960 -62 1961 -4, 1961 -51, 1962 -10, 1962 --29. The Clerk produced an Affidavit of Publication of Notice of Hearing on the assessments showing one weeks' publication thereof in the official newspaper, and the publication being on September 6, 1962 which affidavit was examined and found satisfactory and ordered placed on file. The aerk produced an Affidavit of mailing notices for special assessment hearing to benefited property owners and affidavits of diligent search upon those properties to be assessed for which no mailing addresses could be disclosed which affidavits were examined and found satisfactory and ordered placed on file. -4- L 263 The Mayor then called upon all owners present to present their objections to the above assessments. .After all persons desiring to speak thereon had been heard it was determined to act on the hearing on certain assessments as Indicated in the following Motions: Motion by Carl Carlson and seconded by John Leary to close the hearing on the special assessments for Sanitary Sewer Project No. 1961 -19 In the amount of $529.18 pet` building site. Motion carried. Motion by John Leary and seconded by Howard Heck to close the hearing of the special assessments for Sanitary Sewer Project No. 196126 in the amount of $376.11 per building site. Motion carried. Motion by Howard Heck and seconded by Carl Carlson to close the hearing on the special assessment for Sanitary Sewer Project No, 1961 -»46 in the amount of $345 per building site. Motion: carried. Motion by Carl Carlson and seconded by Henry Dorff to close the hearing on special assessments for Sanitary Sewer Project No. 1962 -17 In the amount of $375.00 per building site. Motion carried. Motion by John Leary and seconded by Howard Heck to close the hearing on special assessments for Sanitary Sewer Project No. 1962 -18 in the amount of $375 per building site. Motion carried, Motion by Henry Dorff and seconded by Carl Carlson to close the hearing on special assessments for Sanitary Sewer Project No. 1962- the amount of $484.39 per building site. Motion .carried. Motion by Howard Heck and seconded by Henry Dorff to close the hearing on special assessments for Water improvement Project No, 1961 -25 in the amount of $490 per building site. Motion carried. Motion by Carl Carlson and seconded by John Leary to close the . hearing on special assessment for Water Improvement Project No. 1961 -32 in the amount of $490.00 per building site. Motion carried. Motion by Howard Heck and seconded by John Leary to close the hearing on special assessments for Water Improvement Project No. 1961 -47 in the amount of $490.00 per building site. Motion carried. Motion by John Leary and seconded by Carl Carlson to close the hearing on special assessments for Water Improvement Project No. 196141 in the amount of $490 per building site. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to close the hearing of speciall assessments for water Improvement Project No. 1962 -2 in the amount of $490 per building site. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to close the hearing on special assessments for Storm Sewer Project No. 1961 -48 in the amount of $1.1766 per 100 square feet. ' . Motion carried. Motion by Carl Carlson and seconded by Henry DdM to close the hearing on special assessments for Water Improvement Project No. 1962.3 in the amount of $490 per building site. Motion carried. Motion by Henry Dorff and seconded by John Lary to close the hearing on special assessments for Water Improvement Project No. 1962 -19 in the amount of $490 per building site or $380 plus the cost of service were applicable and it being further determined that the assessments on the east side of Willow Lane shall be deferred for a period of 5 years or until prior hook up, since the improvement was contracted primarily to permit the construction of the apart- ment house complex. Motion carried Motion by John Leary and seconded by Carl Carlson to close the hearing on special assessments for Street Surfacing Project No. 1961 -4 in the amount of $61.38 per building site. Motion carried. Motion by Howard Heck and seconded by John Leary to close the hearing on special assessments for Street Surfacing Project No. 1961 -51 in the amount of $ .6695 cents per front foot. Motion carried. Motion by Carl Carlson to close the hearing' on special assessments for Street Surfacing Project No. 1962-10 in the amount of $112.61 per building site if being assessed according to established procedure. The motion died for a lack of a second. Motion by Henry Dorff and seconded by Howard Heck to adjourn the hearing on the spedial assessments for Street Surfacing Project No, 1962 -10 until October 1, 1962 at 8:00 pm at the Village Hall. Members John Leary, Gordon Erickson, Howard Heck and Henry Dorff foting for the motion and member Carl Carlson voting against the motion. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to close the hearing on Special Assessments for Storm Sewer Project No. 1961 -27 in the amount of $1.8983 per 100 square feet. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to close the hearing on Special Assessments for Street Surfacing Project No. 1962 -29 in the amount of $89.41 per building site. Motion carried. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION ORGANIZING A MUNICIPAL COURT IN AND FOR THE VILLAGE OF BROOKLYN CENTER PROVIDING A SUITABLE PLACE FOR THE COURT SESSIONS, THE NUMBER OF JUDGES, AND MAKING APPROPR?ATION T, HEREFOR BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, as follows: 1. A Municipal Court to be known as "The Municipal Court of the Village of Brooklyn Center, Hennepin County, Minnesota, " is hereby organized and established under and pursuant to the Municipal Court Act, Minnesota Statutes, Chapter 488, and acts supplementary thereto and amendatory theireof. 2. Said Municipal Court shall have two (2) judges, one of whom shall be designated the "Municipal judge, " and the other, the "Special Municipal judge." The Municipal judge shall receive a salary of $4200.00 per annum, payable in equal monthly installments commencing in January, 1963. The Special Municipal Judge shall receive compensation at the rate of $25.00 per day for each day or portion thereof in which he presides over said Court while in session, payable at the end of each month upon presentation by said Special Municipal judge of a verified claim. 3. The sessions of said Court shall be held in the Chambers at the Municipal Building located at 6445 Lyndale Avenue North. The place of holding Court may be changed from time to time by resolution of the Council. 4. There is hereby appropriated to said Court the sum of $5,000 for the fiscal year ending December 31, 1963. Obligations may be incurred from such appropriation in the same manner as in the case of appropriations to other departments. -6- S. The first General Term of said Municipal Court shall commence on the second day of January 1963, and said Court shall be. organized and establish- ed from and after said date.
