HomeMy WebLinkAbout1962 12-03 CCM Special Session 85 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota December 3, 1962 The Village Council met in Special Session and was called to order by Mayor Gordon Erickson at 7 :40 P. M. Roll Call: Mayor Gordon Erickson, Henry Dorff, John Leary, Howard Heck, and Carl Carlson were present. The Rev. Paul Budna offered the invocation for the Council meeting. Motion by Howard Heck and seconded by Carl Carlson to accept the minutes of the November 26, 1962 meeting as recorded. Motion carried. Motion by john Leary and seconded by Carl Carlson to approve the appointments of the following personnel for the Recreation Department; Jacqueline Berglund Figure Skating Instruction $ 4.00 /hr. Patricia Shobe Figure Skating Instructor $ 4.50 /hr. Joan Luger Ballet & Figure Skating $ 6.00 /hr. Instructor LeRoy Humbert Figure Skating Instructor $ 7.50/hr. joy Shockley Baton & Tap Instructor $ 7.50/hr. Herbert Parker Hockey Supervisor $ 2.50 /hr. Paul Bouchard Hockey Supervisor $ 2.501hr. Motion carried. Member Howard Heck introduced the following ordinance and moved its adoption: AN ORDINANCE DEFINING VAGRANCY AND PROHIBITING AND EUNISHING THE SAME The Village Council of the Village of Brooklyn Center do ordain: Section 1. Chapter 19 of the Ordinances of the Village of Brooklyn Center are hereby amended by adding thereto the following new sections; Section 19 -213. Vagrancy Defined Any person who shall have no visible means of support, and live idly without employment or settled place of abode, or loiter about the streets, pool halls, restaurants, or other such places, or who shall be found trespass- ing on private property and not able to account for his or her presence, shall be deemed a vagrant. Section 19 -214. Vagrancy. Prohibited No vagrant shall be permitted on the streets or in any public place or elsewhere in this municipality. Section 19 -215. Penalty. Any vagrant found within the limits of this municipality shall be subject to arrest and upon conviction thereof shall be punished by a fine or not more than one hundred dollars ($100.00) or be imprisoned for not more than ninety (9 0) days. Section 2. This ordinance shall be in full force and effect from and after its legal publication. -1- r _ 87 The motion for the adoption of the foregoing ordinance was duly seconded by Henry Dorff and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, John Leary, and Howard Heck and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion by Henry Dorff and seconded by Howard Heck to accept the supplementary justice of the Peace report for the month of Septernbe', Motion carried. The Village Council discussed the proposed Minneapolis Gas Company Franchise with representatives of the Gas Company, The Suburban Gas Agency, and others. Member Carl Carlson introduced the following resolution and moved its adoption; RESOLUTION PROVIDING FOR PUBLIC HEARING FOR THE VACATION OF 53rd AVENUE LYING WEST OF EAST TWIN LAKE BOULEVARD AS A PUBLIC STREET WHEREAS, Harry C. and Harriet B. Buechner have petitioned that 53rd Avenue North from East Twin Lake Boulevard to Upper Twin Lake be I vacated, and WHEREAS, Harry C. and Harriet B. Buechner own all the land abutting 53rd Avenue North from East Twin Boulevard to Upper Twin Lake, and WHEREAS, Harry C. and Harriet B. Buechner have executed a quit claim deed in favor of the Village of Brooklyn Center providing 30 feet of right -of -way from East Twin Lake Boulevard to Upper Twin Lake abutting the north line of their property, NOW, THEREFORE, BE IT RESOLVED that a public hearing shall be held at the Village Hall in the Village on 1" onday the 14th day of January, 1963 at 8 :00 P. M. to hear objections, if any, to the vacation of the above described road, and the clerk shall publish notice of the `time and place of the hearing by two weeks publication in the official newspaper of the Village. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, Howard Heck, and john Leary and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Carl Carlson to approve the investment of $14, 000 by the Fire Department Relief Association in Certificates of Deposit at the Brooklyn Center State Bank. Motion tarried. Motion by John Leary and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application 62046 as submitted by Jerry Harrington for the construction of a ten unit apartment building at 5242 Drew Avenue North. Motion carried. Motion by Howard Heck and seconded by John Leary to uphold the action of the Planning Commission and approve application 62064 submitted by Foote Lumber Company for the construction of a frame building to house a lumber resaw. Motion carried. Motion by Howard Heck and seconded by Carl Carlson to adjourn. Motion carried. The meeting adjourned at I 30 P.
