HomeMy WebLinkAbout1962 12-17 CCM Special Session 65 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota December 17, 1962 The Village Council met in Special Session and was called to order by Mayor Gordon Erickson at 7 :40 P. M. Roll Call: Mayor Gordon Erickson, John Leary, Henry Dorff, Howard Heck were present. Trustee Carl Carlson was absent. The invocation for the Council meeting was offered by Father Morrissy of St. Alphonsus Catholic Church. Motion by Howard Heck and seconded by John Leary to accept the minutes of the December 10, 1962 meeting as recorded. Motion carried. Member John Leary introduced the following resolution and moved its adoption; RESOLUTION CANCELLING SPECIAL ASSESSMENTS ON VILLAGE PARK PROPERTY DESCRIBED AS LOT 1 BOCK 3 MIN LA W WHEREAS, the Village Council of the Village of Brooklyn Center has established the policy of accounting for payment of Special Assessments on Village property through the Village Finance Office; and WHEREAS, the above listed property was acquired through direct purchase In 19&2; BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center to cancel from the Hennepin County Tax Rolls the balance of special assessments for Storm Sewer and Sanitary Sewer improvements. THEREFORE, the County Auditor is authorized and directed to cancel the amounts of the special assessments as follows: I env Improvement Unpaid Balance 1962/63 1939 Main & Area Int. 56 -A $ 217.49 $ 26.45 2133 Storm Sewer 58 -A 333.12 40.86 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof Gordon Erickson, John Leary, Howard Heck and the following voted against the same Henry Dorff, whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING SETTLEMENT OF CONDEMNATION APPEAL OF MERVEL DUCHENE WHEREAS, Mervel Duchene appealed from the award of the Commissioners as to Parcel 4, Condemnation No. 213, instituted by the Village of Brooklyn Center to obtain certain rights; and WHEREAS, said award was in the amount of $600; and WHEREAS, further litigation in connection with said appeal, including the costs of appraisals and expert testimony, attorneys' fees, and other court costs would be substantial, -1- 67 BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center; 1. Upon the recommendation of the Village Attorney, and the Village Council deeming it to be in the public interest, the appeal of Mervel Duchene in connection with Parcel 4, Hennepin County District Court Condemnation file No. 213 from the original award of the Commissioners in the sum of $600.00 , may be settled by payment to said 1 ervei Duchene and other parties in interest of the total sum of $1100.00, which sum shall be payment for all damages arising out of said taking including interest and costs. 2. A draft for said amount shall be issued, and the Village Attorney is authorized to execute all papers and instruments necessary to effectuate said settlement, and to show interest to the necessary interests in said parcel in the name of the Village of Brooklyn Center. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof Gordon Erickson, John Leary, Henry Dorff, Howard Heck and the following voted against the same, None; whereupon said resolution was delcared duly passed and adopted. Trustee john Leary and Finance Director Robert Bullock presented information concerning Quotations for Comprehensive General and Automobile Liability insurance coverage. motion by John Leary and seconded by Howard Heck to accept the quotation of Zurich Insurance . Company for the furnishing of a Comprehensive General and Automobile Liability Policy for an estimated premium of $5244.45 dollars; said policy to provide damage liability limits of $25, 000.00 per occurrence and $100, 000.00 per aggregate and said policy to be written on a three -year fixed rate. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to approve the following licenses; Cigarette Licenses Clymer's Dairy Store 5645 Lyndale Ave. No. Ernies Direct Service 6501 Lyndale Ave. No. Ernie' s Drive Inn 7250 Lyndale Ave. No. Casey's Super Market 1900 57th Ave. No. National Food Stores 6801 Osseo Road Non - Intoxicating Malt Liquor Clymer's Dairy Store 5845 Lyndale Ave. No. Frank J. Casey Casey's Super Market 1900 57th Ave. No. National Food Stores 6801 Osseo Road Rubbish Hauling Robert W. Nixon New Brighton, Minnesota Motion carried. Motion by Howard Heck and seconded by John Leary to appoint LeRoy Christenson as a police patrolman effective January 2, 1963. Notion carried. Motion by Howard Heck and seconded by John Leary to release the street bond on Hjelvik's Second Addition belonging to Ridgeway Home Builders in lieu of a cash escrow of $115.00 for the completion of boulevard sodding and boulevard trees. Motion carried. -2- 69 The Village Council discussed matters pertaining to the expansion of the water system. Motion by john Leary and seconded by Howard Heck Heck to adjourn. Motion carried.
