M. Ro U Cali: Mayor Gordon Erickson, john Leary, Carl Carlson, Henry Dorff and Howard Heck were present. The Invocation for the Council meeting was offered by Reverend A. Huber of Brook Park Baptist church. Motion by Howard Heck and seconded by Henry Dorff to approve the minutes of December 17, 1962 as recorded. Voting for the motion John Leary, Gordon Erickson, Henry Dorff and Howard Heck. Member Carl Carlson abstained from voting since he was absent from the meeting. Member john Leary introduced the following resolution and moved Its adoption: RESOLUTION SETTING WAGES AND SALARIES FOR THE YEAR 1963 WHEREAS, the Village Council of the Village of Brooklyn Center has considered salaries for Village Employees for the year 1963. BE IT HEREBY RESOLVED that the Village Council adopt the following salary schedules for the year 1963, which are to be made a part of the Wage and Salary Plan of Brooklyn Center. Member Howard Heck introduced the following Resolution and moved its adoption: RESOLUTION AMENDING RESOLUTION ORGANIZING A MUNICIPAL COURT IN AND FOR THE VILLAGE OF BROOKLYN CENTER, PROVIDING A SUITABLE PLACE FOR THE COURT SESSIONS, THE NUMBER OF JUDGES NG APR R I WHEREAS, it has been determined that it will facilitate the providing of suitable Chambers for court sessions and office facilities for the Clerk of Court locatin the and the lark of the at the Village by C Court e V Hall, g Court C g 7100 Osseo Road. -2- 139 THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, as follows: Sessions of the Municipal Court at the Village of Brooklyn Center shall be held in the Council -Court Chambers at the Village Hall located at 7100 Osseo Road North. The motion for the adoption of the foregoing resolution was duly seconded by John Leary, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Carl Carlson, and Howard Heck, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by John Leary and seconded by Carl Carlson to authorize a salary of $424 for the Clerk of Court, Motion carried. Member Carl Carlson introduced the following Ordinance and moved Its adoption: AN ORDINANCE PRO M121KQ FOR A =rLQ YL0WTIQKS_ B U The Village Council of the Village of Brooklyn Center do ordain: Section 1. Chapter 27 of the Ordinances of the Village of Brooklyn Center are hereby amended by adding thereto the following new sections; Section 27 -501 .Traffic Violations Bureau Autho lzed. The Municipal Court of the Village of Brooklyn Center may by rule adopted in accordance with laws 1953, Chapter 527, and acts supplementary thereto and amendatory thereof, establish a Traffic Violations Bureau to assist such Court in disposing of violations of traffic laws or ordinances as provided in such law and court rule. The Traffic Violations Bureau hereinafter referred to as the "Bureau" will occupy an office of the Village Hall located at 7100 Osseo Road North, or such other space as may be set aside for such purpose by resolution of the Council. Section Bureau Director and Personnel. The Court shall designate the Director of the Bureau, who may be a municipal officer or employee, and shall designate the hours when the Bureau is to be open. The person so designated shall perform the duties of Director of the Bureau as prescribed by law and by court rule. He may, subject to the approval of the Council employ such additional help as may be needed to staff the Bureau. The Director of the Bureau and the additional help may be compensated in such manner as provided by resolution of the Council. Sectio 2n 7-503 RRgg g MW Rer,Qrts. The Bureau shall keep a record of all cases of violation brought before it, including their final disposition, and also a record of collection and disposition of all fines. The Bureau shall submit summarized monthly reports to the Court and the Village Clerk of all traffic complaints processed by the Bureau, of all fines collected by it, and of the final disposition or present status of every case under its jurisdiction. Such records shall be so maintained as to show all types of violations and the total of each and shall be public records. Fines and other receipts of the Bureau shall be disposed of in the same manner as similar receipts of the Court not resulting I� in Bureau operations. Section-. Appropriation. There is hereby appropriated to the Bureau the sum of $100.40 for die fiscal ear ending December 31 196 Y 9 e . 3. Obligations may be incurred from the appropriation in the same manner as in the case of appropriations to other departments. Section,$. This ordinance shall be in full force and effect from and after its legal publication. Passed by the Village Council this 27th day of December, 1962. The motion for the adoption of the foregoing ordinance was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, John Leary and Howard Heck, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion by Howard Heck and seconded by Carl Carlson to approve the final a pl t of High Crest Square and lace a hold order on building ciu p u d pe rmits on all lots except lot 9 and 10 of Block 1 and lots 7 and 8 of Block 3 until the utilities shall have been installed in the street. Motion carried. -3- r 141 Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota , Horbal Construction Co. has satisfactorily completed the following improvement in accordance with said contract: Water Main Improvements 1962 -2. 3, 5, and 19 Sanitary Sewer Improvements 1962 -21 and 23 NOW,, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved upon the recommendation of the Village Engineer. 2. The value of work performed is less than the original contract amount by $775.40 because of general over estimating of quantities on proposal form. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for such improvement project being $36.406.02. The motion for the adoption of the foregoing resolution was duly seconded by member john Leary, and upon vote being taken thereon the following voted In favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, John Leary, and Howard Heck, and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY VILLAGE) WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Crystal Excavating Co. have satisfactorily completed the following improvement in accordance with said contract: Sanitary Sewer Project No. 1962 -33 Water Main Project No. 1962 -34 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center; 1. The work completed under said contract is hereby accepted and approved upon the recommendation of the Village Engineer. 2. The value of work performed is less than the original contract amount by $3, 575, 92 because the alignment of the sanitary sewer was revisea making street resurfacing unnecessary. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement Project being $13,001.88. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted In favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, john Leary and Howard Heck, and the following voted against the same: None; whereupon said resolution was duly passed and adopted. -4- 143 Member Howard Heck introduced the following resolution and moved Its adoption: RESOLUTION ABATING SPECIAL ASSESSMENTS AND AUTHORIZING REBATE FOR ONE UNIT OF P. U. WATER ON S 7 ACRES OF N 17 ACRES OF W 3/4 OF SE 1/4 OF SE 1/4 OF SECTION 26. (PARCEL 800) WHEREAS the above listed property, together with the N 10 acres of W 3/4 of SE 1/4 of Section 26, (Parcel 600) owned by George Johnson, was assessed a total of nine units of P. U. Water at $490.00 per unit on Project 1960 -59 , based on anticipated development of the combined parcels such that 71st Avenue North extended to Logan Avenue North allowed 30' of said Property for street with 725' remaining for residential development on Logan Avenue. WHEREAS subsequent to certification of the assessment to the Hennepin County Tax Rolls, a master street layout was proposed by the Village for said property such that 71st Avenue North terminated at Knox Avenue North and 70th Avenue North opened from Humboldt Avenue North to Logan Avenue North thereby requiring 60' of said property for street purposes with 695' remaining on Logan Avenue for residential development, and WHEREAS, the Village Council of the Village of Brooklyn Center approved the plat of George's Terrace Addition which was platted in accordance with the proposed master street plan with 7 lots fronting on Logan Avenue North and one lot fronting on proposed 70th Avenue North-, with 125' side on Logan Avenue North. BE IT RESOLVEDby the Village Council of the Village of Brooklyn Center to abate the unpaid balance of one unit of P. U. Water from the Hennepin County Tax Rolls and refund the amount equivalent to the 1961/62 Installment for one unit of P. U. Water to the property owner. THEREFORE, the County Auditor is authorised and directed to abate the amount of $490.00 of the Special Assessment on Parcel 800, Plat 89026 as follows: CHANGE CHANGE ORIGINAL AMOUNT 1962/63 INST. The motion for the adoption of the foregoing resolution was duly seconded by John Leary, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Henry Dorff, John Leary, Carl Carlson and Howard Heck, and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Motion carried. Motion by John Leary and seconded by Henry Dorff to appoint the following persons as warming house attendants at a salary of $1.50 per hour. Motion carried. Motion by John Leary and seconded by Carl Carlson to authorize the purchase of four more infra red heating units and exhast equipment for the Street Department storage garage at a cost of $834. . Motion by Henry Dorff and seconded by Carl Carlson to adjourn. The Village Council adjourned at 10:30 P. M. Motion carried.
