M. Roll Call: Mayor Cordon Erickson, Henry Dorff, john Leary, Howard Heck and Carl Carlson were present. Motion by Henry Dorff and seconded by Howard Heck to approve the minutes of October 1, 1962 as corrected. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to approve the minutes of October 3, 1962 as recorded. Motion carried. The bills having been audited, motion was made by Henry Dorff and seconded by john Leary to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried. Motion by john Leary and seconded by Howard Heck to approve the following licenses: ) Cigarette License Lyles Cafe & Dairy Store 3701 - 50th Ave. No. Electrical License Hillcrest Electric Company 2050 White Bear Ave. St. Paul, Minnesota "Off Sale" License (Non Intoxicating Malt Liquors) Lyles Cafe & Dairy Store 3701 - 50th Ave. No. Plumbers License New Brighton Plumbing & Heating Inc. 939 _ 5th Ave. New Brighton, Minnesota Stein's Inc. Shakopee, Minnesota §ingo License Duoos Bros. American Legion 4307 70th Ave. No. Motion carried. Motion b J ohn L and sec b Carl y j eery seconded y Carlson to remove the C C hold order on the issuing of building permits on Registered Land Survey 838 which was issued on October 1, 1962. Motion carried. Motion by john Leary and seconded by Howard Heck to instruct the building inspector to observe the land area ratio requirements of the zoning ordinance as it pertains to lots B. C. , D. E. , H. I. , and j of Registered Land Survey 838. Before building permits are issued on lots D.E. H. & I. Lot j is to be deeded to the Village as a street. Members john Leary, Gordon Erickson, Henry Dorff and Howard Heck voting for the motion, member Carl Carlson voting against it. Motion carried. The Mayor announced that the meeting is open for consideration of objections to any of the assessments for the following improvements. Street Improvement Project, 1960_62, 1961 -36, 1961 -38 1961 -52 and 1962 -150 Water connections and Sewer connections. -1-- r 27 The Clerk produced an affidavit of publication of notice of hearing on the assessments showing one weeks publication thereof in the official newspaper and publication being on September 20, 1962 which affidavit was examined and found satisfactory and ordered placed on file. The Clerk produced an affidavit of mailing notices for special assessment hearings to benefited property owners and affidavits of diligence search while those properties to be assessed for which no mailing addresses could be dis- closed affidavits were examined and found satisfactory and ordered placed on file. The Mayor then called upon all owners present to present their objections to the above assessments, after all persons desiring to speak thereon had been heard it was determined to act on the hearing of certain assessments as indicated' In the following motions: Motion by John Leary and seconded by Henry Dorff to close the hearing on the special assessments for Street Improvement Project No. 1960 -62 in the amount of $2.7246 per adjusted assessable foot. Motion carried. Motion by Howard Heck and seconded by Carl Carlson to close the hearing on special assessments for Street Improvement Project No. 1961 -36 in the amount of $1.921 per front foot. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to close the hearing on special assessments for Street Improvement Project No. 1961 -38 in the amounts of $3.03 and $3.71 per front foot. Motion carried. Motion by Henry Dorff and seconded by John Leary to close the hearing on special assessments for Street Improvement Project No. 1961 -52 in the amount of $1.966 per front foot. Motion by Howard Heck and seconded by Henry Dorff to close the hearing on special assessments for Street Improvement Project No. 1962 -15 in the amount of $2.7521 per adjusted assessable foot. Motion carried. Motion by Carl Carlson and seconded by John Leary to close the hearing on special assessments for Sewer Connections to the interceptor line on the West side of the Village at a rate of $374.93 per connection. Motion by Howard Heck and seconded by John Leary to close the hearing on special assessments for Water Connections at a rate of $490 per building site. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to close the hearing on special assessments for SeTr,rer Connections to the Intemeptor on the East side of the Village in the amount of $388.29 per connection, Motion carried. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID AND APPROVING CONTRACT FORM WHEREAS, the Village Administrator, Assistant Administrator and the Village Engineer have reported that on October 1, 1962, at 10 :00 A. M. , they opened and tabulated bids received for Sanitary Sewer Improvement No. 1962 -33 and Water Main Improvement No. 1962 -34 and that said bids were as follows: Crystal Excavating Cd. $16,577.80 Barbarossa & Sons,. 17, 011.00 Walbon Excavating Co. 20, 415.00 Phelps -Drake Co. Inc. 21, 500.70 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of Crystal Excavating Co. in the amount of $16,,577,,80,, as to furnishing of all work, labor and material -2- r 29 in connection with Sanitary Sewer improvement No. 1962 -33 and Water Main Improvement No. 1962 -34, according to the plans and specifications therefor now on file in the office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, Henry Dorff, Carl Carlson, John Leary and Howard Heck and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. I Motion by Carl Carlson and seconded by John Leary to release the Plat Bond of Kenneth Bergstrom on Lynside Manor 4th addition in the amount of $9,330 in lieu of $100 cash escrow, on the recommendation of the Village Administrator and the Village Engineer. Motion carried. Motion by Howard Heck and seconded by Carl Carlson to authorize the Mayor to execute a release of claim against M. E. Kraft Excavating and Grading Company in the amount of $2,403.72 for damages to the interceptor sewer force main at the point which it crosses new County Road #10. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to authorize the Village Administrator to negotiate the purchase of 200 Arbivita shrubs for screening purposes along the west side and south side of the Village property on which the street department garage is located, at 69th and Dupont. Motion carried. Mo do n by John Leary and seconded by Carl Carlson to authorise the Administrator to negotiate the purchase of 70 Arbivita shrubs for screening purposes of the parking lot at the Village Hall. Motion carried. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION CERTIFYING DELINQUENT SEWER SERVICE ACCOUNTS FOR 1961 TO HENNEPIN COUNTY, TAX ROLLS Whereas, the records of the Public Utilities Billing Department list certain accounts as delinquent for the year 1961, and Whereas, the consumers have been notified of the delinquency according to legal requirements, and Whereas State Statute 443.16 authorizes certification of the delinquent accounts to the County tax rolls for collection, Therefore Be It Resolved by the Council of the Village of Brooklyn Center to order the County Auditor of Hennepin County to place the following delinquent accounts on the 1962 payable in 1963 tax roils: al Descri on unt Leg l�ti Amo ..�._,.�,_,_ Lot 9, Aud. None; whereupon said resolution was declared duly passed and adopted. Motion by Howard Heck and seconded by Henry Dorff to authorize the call for bids on October 22 for the purchase of a 3/4 ton pickup truck and utility box. The call for bids to indicate that either a 1962 or 1963 model will be acceptable. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to uphold the action of the Planning Commission and approve application 62056 by Foote Lumber Company for the construction of a lumber storage building. Motion carried Motion by Henry Dorff and seconded by Howard Heck that the Village of Brooklyn Center adopt a policy that charges on special assessment projects shall be 9% for Engineering and Inspection costs, 1% for Clerical costs and 1% for Legal costs, to be based upon actual construction cost. Motion carried. The Village Council reviewed budget matters for 1963. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION APPROVING 1963 BUDGET AND AUTHORIZING - -_- A LEVY T_ HEMFORE -4- 35 BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. There is hereby appropriated for expenditures in 1963 from general taxes, the following sums for the purpose indicated: Village Operations and Administration $ 451,175.00 Poor Relief 20, 000.00 Firemen's Relief Association 11 Public Employees Retirement Association 23, 650.00 County Parks 4.385.00 $ 510,210.00 The foregoing does not include levies already certified to the County Auditor for the payment of outstanding loans which levies for the year 1963 are as follows: Certificates of indebtedness (Bonds & Interest) 14, 600.00 State Loan 1 Park Bond Redemption 35 51,235.00 Total expenditures for the year 1963 from general taxes $561.445.00 2. There is hereby levied upon all taxable property lying within the Village of Brooklyn Center, in addition to all levies heretofore certified to the County Auditor as indicated in paragraph 1 hereof, the sum of $510,,210. 00" and the Clerk shall cause a copy of this resolution to be certified to the County Auditor, so that said sum shall be spread upon the tax rolls and will be payable in the year 1963. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted In favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, John Leary and Howard Heck and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted.
