HomeMy WebLinkAbout1961 12-26 CCM Regular Session Minutes of the proceedings of the Village Council of the .Village of Brooklyn Center In the County of Hennepin and State of Minnesota December 26, 1961 The Village Council met in Regular session and was called to order°f3y°` Mayor William Super at 7 :45 P. M. Roll Call: Mayor William Super, Henry Dorff and Howard Heck were present. Trustees Carl Carlson and Clifford Wellman were absent. Motion by Howard Heck and seconded by Henry Dorff to approve the Minutes of the Special meeting of December 18, 1961, as recorded. Motion carried. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION AMENDING THE RESOLUTION OF JULY 31, 1956 ESTABLISHING THE POSITION OF ADMINISTRATIVE OFFICER. TO MODIFY THE ADMINISTRATIVE OFFICER'S PURCHASING AUTHORITY AND PROVIDE STANDARDS THEREFOR AND RESCINDING THE RESOLUTION OF NOVEMBER 4, 1961 PERTAINING TO THE SAME BE IT RESOLVED by the Village Council of the Village of Brooklyn Center` as follows: 1. The Village Administrative Officer may order service, equipment and supplies for all departments of the Village provided said orders meet the following standards: a. The Department Head of the department for which the service, I equipment or supplies. are ordered must recommend that the order be placed.. b. The service, equipment or suppls must be necessary to the operation of the department. c. Where equipment is ordered to replace. obsolete, damaged, or ! worn-out equipimnt, the new equipment shall as nearly as possible equal that which U replaces in design, function, and brand name. d. Where there is more than one possible source of supply for any Item having a cost of $10.00 or more, the Administrative Officer shall request price quotations from at least two sources and shall place the order at the lowest price, provided the items are of comparable quality, unless the Village Council otherwise directs.. e. The cost of service, equipment or supplies ordered must not exceed one thousand dollars ($1, 000.00). f. The expenditure must be within the limits established. by the department budget. g. All claims resulting from orders ple±ced by the Administrative Officer shall be audited and approved by the Village Council. h. The Village Council expressly retains its paver to disaffirm any order or contract entered into by the Village Administrative Off1par on behalf of the Village in the same manner and to the same extent ghat swh power existed prior to the adoption of this resolution. -1- The motion for the adoption of the foregoing resolution 4� " seconded by member Henry Dorff, and upon vote being taken thereon, , , � Following voted in favor thereof: William Super, Henry Dorff and Howard Heck, and the following voted against the same: None; whereupon said resolution was declared duly Passed and adopted. Motion by Howard Heck and seconded by Henry Dorff to accept the report of the Arbitration Panel, dated December 26, 1961, and instruct the Administrator and Finance Officer to prepare the necessary resolutions amending the 1962 budget; and, further, to prepare the necessary amendments to Chapter 17 of the Village ordinances. The cost of the additional appropriation shall be borne by unappropriated surplus in the General Fund. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to extend the Council's appreciation to Wayne Gageby for his work on the Arbitration Panel. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to uphold the recommendation of the Planning Commission and DENY the request of John Thompson on Application #61231 for a special use permit for a service station at 73d and Lyndale Avenue. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION APPROVING APPOINTMENT OF FOUR PATROLMEN TO THE POLICE DEPARTMENT OF THE VILLAGE OF BROO YN CENTER l WHEREAS, written and oral tests have been administered to applicants for the position of Police Patrolman, and WHEREAS, those applicants having a satisfactory test score have been investigated and screened, and -2- 8 0T WHEREAS, the Village ,Administrator recommends the appointment of certain qualifying individuals to fill the four positions of patrolman created in the Police Department, NOW, THEREFORE, BE IT RESOLVED that the following then be appointed as patrolmen in the Police Department of the Village of Brooklyn Center effective January 8, 1962: Raymond E. Beach Russell G. Iverson Richard T. Handy Roland K. Kersten The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: William Super, Henry Dorff and Howard Heck, and the following voted against the same: None; whereupon said resolution was declared duly passes and adopted. Member Henry Dorff introduced the following ordinance and moved Its adoption: AN ORDINANCE LICENSING AND REGULATING THE OPERATION OF COIN - OPERATED AND SELF- SERVICE DRY CLEANING MACHINES AND AMENDING CHAPTER 23 OF THE VILLAGORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DOES ORDAIN AS FOLLOWS: Section 1. Chapter 23 of the Village Ordinances is hereby amended by adding thereto the following new sections: Section 23 -1001 No person, firm or corporation shall manage, conduct, operate or carry on the business of a self - service or coin- operated dry- cleaning establishment without first having made an application and obtained a license therefor from the Village Council. Section 23 -1002 APPLICATION. Application for a license for con- ducting, operating or managing a dry - cleaning establishment shall be made to the Clerk and shall specify the location and premises on which it is to carry on said business, the number of machines, the manufacturer's name, the approval of the fire marshal, health department and building inspector. Section 23 -1003 LICENSE FEE. The annual fee for each license shall be $25.00 per each calendar year and shall expire on the 31st day of December following date of issue. Section, 23 -1004 TRANSFER OF LICENSE. No license granted here- under shall be assigned to or transferred to any other person, firm or corporation, nor shall any such license authorize doing any business on any other premises other than those designated in the application for such license. Section 23-1005 BUILDING REQUIREMENTS. Buildings housing coin- opereted -or self - service dry - cleaning equipment shall meet the following require - ments 1. Coin - "operated or self- service dry - cleaning equipment shall not be installed in buildings occupied in part as a dwelling. 2. Sanitary facilities shall be provided for according to the building ordinance, including a minimum of one toilet and one lavatory for each sex. 3. Buildings housing such dry - cleaning equipment shall be of one story construction with concrete floor ^r equal impervious to the cleaning solvents. 4. Complete plans of building, plumbing, electrical, heating, and ventilation plans must be approved by the building department. S. In buildings of mixed occupancy, that portion occupied for dry - cleaning machines shall have a minimum of one hour fire separation and shall conform in all respects to the requirements of the Uniform 5ullding Code, 90T Section 23 -1005 continued 6. The equipment shall be in an enclosed room properly vented and protected by a partition with self- closing and positive - locking access door to the equipment room with only front machines and coin slots exposed to customer side. 7. The equipment room shall have a leak -proof dike around the peri- phery of the base of the machines of sufficient capacity to hold the entire solvent content of the equipment. Gravity drains shall be installed to transfer any spillage to a properly vent - holding tank. Section 23- 1F106 VENTILATION REQUIREMENTS. Self- service and coin - operated dry - cleaning machines shall be ventilated in the following mWor: 1. The machines, customer area and the room housing the machines shall be ventilated with a mechanical -ventilation system. 2. The ventilation system shall be in continuous operation at all - tunes when the machines are available for customer use. An interlock shall be provided to make the machines inoperative in event of failure of ventilation system 3. The customer area shall have an air minimum.' volume of 500 C. F. Ni, per machine withdrawn through louvres located near front base of machines to prevent a build up of perceptible solvent vapor. 4. Each machine shall have an exhaust system with a minimum face locity of 100 F. P. M. through the open loading door. The duct system shall l! soldered tight joints extended to a minimum height of 5' above :roof line, 5. A general ventilation fan shall be installed in the equipment or maintenance room with a minimum capacity of 1000 C. F. M. per machine. 6. A supply of tempered make -up air equal to or greater than the total volume of air exhausted from the plant shall be provided in order to eliminate any negative pressure conditions which may otherwise develop. 7. The air discharge from the ventilation system shall extend to the outside a minimum of five feet above the room ceiling and so located as .to prevent effluent air from gaining access to adjacent buildings, heating equipment, air conditioning units or other ventilating systems. 8. There shall be -no direct inter - connection between waste water discharge lines and the sanitary sewer. Such connections .shall be vented with a gap equal to 1.1/2 times the diameter of the discharge line.. 9. Filter pressure relief or safety valves shall be vented to the out- side and above the roof line. Section 23 -1007 .OPERATION. The following rules : shall govern the operation of coin- operated or self - service dry-cleaning machines: 1. A step -by- step, self -- explanatory, ; instruction list, including an emergency telephone number, shall be conspicuously posted near the machine or machines for customer use. 2. If a malfunction or mis -use interferes with the normal cycle of the machine, and vapor -laden garments are removed, they shall be re --run through the drying cycles of an alternate machine or placed in an exhaust ventilated dryin_ cabinet prior to being released to the customer. 3. The machine or machines shall be checked daily and maintained in a state of good repair free of solvent leaks. 4. Closed metal containers shall be provided for the temporary storage of sludge and lint removed from sludge tanks, filters, and lint strainers. Such containers shall be kept outside of the building or in a ventilated room inaccessible to customers and persons not familiar with the hazards of the solvent. 5. Only the solvent specified by the equipment manufacturer shall be used in coin - operated equipment, 6. The solvent shall be stored in closed containers in a ventilated room not accessible to the customers, and in accordance with the requirements of the Fire Department. 7. The attendant and maintenance personnel shall be provided with approved protective respiratory equipment, and gloves imOervloas to the solvent being used. 8. A utility fire extinguisher of either the _ or dry chemical type shall be provided as protection against a s. -4- Section 23 -1 r NALTY. Any person, firm or corporation violatioc any of the provisions of this ordinance or the ordinances of the Village of Brooklyn Center# $hall upon conviction thereof be fined not more than $100.00 or imprisoned not to exceed ninety days for each offense and every day that such violation shall occur shall constitute a separate and distinct offense. Section 2. This ordinance shall be in full force and effect from and after its legal publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Howard Heck,. and upon vote being taken thereon, the following voted in favor thereof Henry Dorff, Howard Heck, and William Super, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Mayor Super presented the name of Bob Osborn, c/o Lakedale Realty, 556 Prior Avenue North, St. Paul 4, Minnesota, as a member of the Industrial Study Committee. The bills having been audited, motion was made by Henry Dorff and seconded by Howard Heck to order paid the bills set forth on the schedule attache to these Minutes and made a part hereof. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to adjourn. Motion carried.
