Roll Call: Mayor William Super, Carl Carlson, Henry Qorff, Howard Heck and Clifford Wellman were present. Motion by Howard Heck and seconded by Henry Dorff to approve the Minutes of the Regular meeting of December 26, 1961, as recorded. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson to adjourn tha meeting of the 1961 Council. Motion carried. The following newly elected officials were sworn into office: Mayor Gordon M. Erickson, Trustee John W. Leary, Treasurer Theodore Willard, and Justice of Peace Raymond Benson. Gordon Erickson assumed the mayoralty at 8:00 P.M. Motion carried. Motion by John Leary and seconded by Carl Carlson to uphold the recommendation of the Planning Commission on Application No. 61260 and grant a. Special Use Permit to Robert-BWAetter to construct one (1) multiple dwelling, of four units on property located at 5328 4th Street North. Motion carried.. The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1962 -4. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in -the official newspaper,. the last publication being on January 4, 1962, which affidavit was examined and found - satisfactory and ordered placed on file.. The Mayor then ealled upon all property owners present to present arguments either for or against the improvement. After hearing and considering all objections, and the property owners appearing in favor of said= improvement, member Howard'.8eck inroduced the.following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF MATER MAIN IMPROVEMENT NO. 1962 -4 --AND ORDERING PREPARATION PLANS MD SPECIFI I . BE IT RESOLVED by the Villages Council of the Village of Brookl,ye Center as follows 1. It is .hereby determined that it is necessary and Iar the hest interests of the Village and the owners of property specially benefited thereby., that the following improvement shall be constructed. WATER MAIN ON WILLOW CANE FROM 70TR AVOUE TO A POINT 800 FEET SOUTH OF 70TH AVENUE 119 2. The plans- and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption, of the foregoin+ resolution was duly seconded by member" Carl Carlson, and upon vote being taken thereon the following voted In favor thereof: Henry Dorff, Gordon - Erickson, John Lary, Carl Carlson and Howard Heck; and the following voted against the same; None; whereupon said resolution was declared duly- passed and adopted. Member Carl Carlsoir introduced the following resolution and moved its adoption: RESOLUTION APPROVING PLANS AND SPECIFICA-, TIONE FOR WATER MAIN IMPROVEMENT NO. 1962 -4 AND IIRECPING VILLAGE ENGINEER TO E OrIATE MRA,C PRICE, BE IT RESOLVED by the Village Counail of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for the following improvement ftepared by the Village Engineer are hereby approved and ordered f ledwith the Clerk Water Main on Willow Lane from 70th Avenue North to a point QW feet south of 70th Avenue North. 4 The Village Engineer shall- nregotlete a contract price for said improvement with:the Farr Plumbing Company. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, Howard Heck,,Gordon Erickson, Carl Carlson and John Leary and the following voted against the same; None; whereupon -said resolution was duly passed `and adopted. Member John Leary introduced the following resolution and moved its adoptions: RESOLUTION APPROVING CONTRACT PRICE AND APPROVING CONTRACT FORM WHEREAS. the Village Engineer reports that he has negotiated a I' contract price of $3,251.75 with-Farr Plumbing for the construction of seater Main Improvement No. 1%2 -4 NOW THEREFORE, BE IT RESOL.VED`by the Village Council of the Village of Brooklyn Center that-the proposal of Farr Plumbing Company in the amount of $3,251.75 as to furnishing all work, labor and material in connection with Water Main Improvement Project No, 1982- 4, "bccording -to the plans and specifications therefor now on file in the office of the-. Motion by Henry Dorff and seconded by Carl Carlson to employ`Oavid Lissner as Public A.dnginistration Intern on a half -time basis for 9 months of the year and on a full -time basis for 3 months. Motion carried. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION REQUESTING,CONSIDERATION OF JOINT CONTRACT`''FOR PURCHASE OF MINNEAPOLIS t ATER THOM V114&E GF &W VALLE M -3- 121 WHEREAS, it is imperative that the Village of Brooklyn Center deterttize.its ultimate source of water supply for the expansion of its water works system, and WHEREAS, it has been recommended by Black G Veatch, Consulting Engineers,.that first consideration be given to a Minneapolis source of supply, and F 11HEREAS, Black & Veatch further recommend that the Village of Brooklyn Center enter into a joint contract with neighboring municipalities for the purchase of Minneapolis water. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center to request that the Village of Golden Valley, Minnesota, give consideration to entering into a ,point Minneapolis water purchase agreement with Brooklyn Center. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon; the following voted in favor thereof: Henry Dorff, Gordon Erickson, John Leary, Carl Carlson and Howard Heck and the following voted against the same; bone; whereupon said resolution was declared duly passed and adopted. Member John Leary introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK iCONTRACTED BX VIi.[.AGEI_ WHEREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesotan C. S. McCrossan, Inc. have satis- factortly completed the following improvement in accordance with said contract: Street Sitfacing Project Nos. 1960-62, 1%1 -36, 38 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center C 1. The work completed under said contract is hereby accepted and approved upon, recommendation of the Village Engineer, 2. The value of work. performed exceeded the original contract amount.by $I, 464.45 because the original contract was revised by reducing the number of protects thereby increasing the amount of grading for this contract. h 3.. The Village Officials are.hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt In full. The total amount paid-for ,said : improvement project being $17,287.40. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING PAYMENP OF CONDEMNATION &WARDS WHEREAS, on August 7, 1461 the Village Council of the Village of Brooklyn Center, directed the Village Attorney to commence condemnation action for the acquisition of interests in land as set forth din Exhibit A. and WHEREAS, the Village Attorney reports that the Report of the Commissioners regarding awards was filed on December 22, 1961,. and WHEREAS, the Village Attorney and Village Engineer recommmend that the Village of Brooklyn Center take no appeal from the awards �4- 123 waste by the Commissioners of Condemnation, NOW, THEM'ORE, BE'IT RESOLVED by the Village Council of the Village of Brooklyn Center to authorize payment as follows: William P. and Eleanor E. Member John Leary intkbdueed the following resolution and moved its adoption: RESOLUTION ADDING THE 1962 BUDGET RS- APPROVED OCTOBER 9. 1961 WHEREAS, the Village Council has accepted the findings of an arbitration board regarding 1962 salaries for employees represented by Local 49, Operating Engineers Union,, and; WHEREAS, said findings resulted in increased salaries for union employees,. and WHEREAS, it was felt salaries for non - anion employees should be adjusted accordinglyi; and WHEREAS, the Village Administrator and Director,of Finance have made recommendations which resulted in increased labor costs, NOW, THEREFORE; B& 'IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. Member Henry Dorff introduced the following ordinance and moved its adoption: I � AN ORDINANCE AMENDING CHAPTER; 17 OF THE VILLAGE ORDINANg THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS AS FOLLOWS: Section 1. Section 17 -116, Subsection A shall be amended.to read as follows: Section 17 -116. VACATION LEAVE. A Uo m ldch., Each permanent employee shall earn vacation leave at the" rate of 5/6 of one working day for each calendar month of full -time service or major fraction thereof, Any employee with five years of service shall earn vacation leave at the .rate of one and ones- fourth (1 -1 /4) .working days for each calendar month of full -time service or major fraction thereof. Sectio* 2. Section 17- 116,.Subsection C, s4all -be amended to read as follows: C. AgArW . Section 3. Section 17 -117, Sub"etion a. shall be amended to mead as follows: on.17 -117. SICK LEAVE B. Agglu ,l. A new subsection F shall be added to 5ection:17wll7, subsection to read as follows: E §1velange P ; Severance pay In amount of one- fourth (1/4) the accumulated sick leave an employee has to his credit at the time of resignation or retireoent shall be paid, providing an,employee has been employed for at.least five (5) years. In the event of discharge for cause no severance pay shall be allowed.. Section 5" . Section 17 -121 subsection B, shall be amended to read as follows: Ssctioa 17 -121 BEST PERIOD AND HOLIDAYS A. .. The following legal holidays shall be observed as paid holidays for Village employees: New Year's Dale Gabor Day Lincoln's" Birthday Columbus , Day Washington's Birthday Armistice Day Good Friday Thanksgiving Day Memorial Day- Christmas Day Independence Day When New Year's Day, Memorial Day, Independence Day, or Christmas Day fall on Sunday, the following day shall be observed as a holiday. When they fall on Saturday, the preceding day shall be observed as a holiday. An employee who is absent from work on the day following or the day preceding such a three -day holiday weekend without the express authorization of the Administrative Offieer'shall forfeit his right to holiday pay for that holiday. All employees who are required to be on duty on any holiday shall be paid time and one -half for the hours worked in addition to the holiday pay. Section 6. This ordinance shall be in full force and effect from and after its legal publication.. The motion for the adoption of the foregoing ordinance was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted In favor thereof: Carl Carlson, Henry Dorff, Gordon Erickson, Howard Heck and John Leary, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Motion by John Leary and seconded by Henry Dorff to accept the street deed from the Earle Brown School District for the north half of 65th Avenue from Dupont Avenue to Humboldt Avenue. Motion carried. Motion by Howard and seconded by Carl Carlson..to set the bid date for a new or reconditioned cash register for Liquor•_Store s3 for .January 22,.1962, at 2:00 P. M. Motion carried. Notion by Carl Carlson and seconded by Howard Heck to designate the Camden Northwestern National Bank as the Village's official depository; and the Brooklyn Center Press as the Village's official newspaper. Motion carried. Motion by Henry Dorff and seconded by John Leary to Approve the appointment of Al Lindman as Deputy Treasurer, on the recommendation of Treasurer Theodore Willard. Motion carried. Motion by John Geary and seconded by Howard`Heck to authorize the Mayor and Clerk to sign the contract with Northern States Power Company to furnish electricity to the lift station at, 7160 Willow lane Motion caried. The bills having been audited, motion was made by Carl Carlson and seconded by Howard Heck to order paid the bills set forth on the schedule attached to these Minutes and made a part hereof. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to accept the Justice Report of John Wingard, the month of November 1961. Motion carried. Motion by Howard Heck and seconded by Carl C to adjourn. Motion carried.
