Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
February 5, 1962
The Village Council met in regular session and was called to order
by Mayor Gordon Erickson at 7 :35 P M.
Roll Call: Mayor Gordon Erickson, Henry Dorff, Howard Heck, and
John Leary were present. . Trustee Carl Carlson was absent.
Motion by John Leary and seconded by Howard Heck to approve the
minutes of the Regular meeting of January 22, 1962, as recorded. Motion
carried.
Motion by Howard Heck and seconded by John Leary to uphold the
action of the Planning Commission to approve the petition of Jahn F. Rowland
to extend the special use permit for a period of one year from the expiration
date of April 1, 1962, for the use of a display garage and sales office on the
condition that the display of fences, patio block, and other items be
discontinued immediately. The Administrator shall give written notice of
the conditions of this special use permit. Motion carried.

Motion by Howard Heck and seconded by Henry Dorff to uphold the
action of the Planning Commission to deny Application 62002 which is o
petition for a special use permit by J. E. Sandahl to construct a duo - I&X on
Lot 2 Block 1, Sandahl Addition. Motion carried.
I - ,Motion by John Leary and seconded by Henry Dorff to uphold the
action of the Planning Commission to approve Petition 62001 which is a
petition for a variance by Bruce Hebbe, 5541 Emerson Avenue North to
divide Lot 2, Block 1 , Reidhead Addition into one 60' lot and one 66' lot.
Motion carried.
Motion by John Leary and seconded by Howard Heck to uphold the
action of the Planning Commission to deny toe approval of application
61246 which is a petition by Project 34 Corporation, 110 Times Bldg., to
rezone to 8 -1, for a neighborhood shopping center, Lot 48 Auditor Subdivision
309. MotiQ;i carried.
Motion by Howard Heck and seconded by Jt�,,Learr to return the
proposed amendment to Section 35 -310 and, 35 -320 and proposed new
Section 35 -325 to the Planning Commission for further study. Motion
carried.
Motion by John Leary end seconded by Howard Heck to accept the
amended report on water improuents prepared by Black and Veatch as
submitted by Mr. Scott. Motion carried.
Member Henry Dorff introduced the following resolution and moved
its adoption:

WHEREAS, the Village Administrator and Assistant Administrator
have reported that on February 5, 1962, at 10:00 A. M. they opened
and tabulated bids received for furnishing of a 2 1/2 ton dump truck and
that said bids were as follows:

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the

at Crystal, Minnesota in the amount of $5572.00, for the furnishing of a
1962 International Model B 184 dump truck in accordance with the specifications
therefor is deemed to be the best bid submitted by a responsible bidder and
said bid is hereby accepted.
The motion for the forgoing resolution was duly seconded by member
John Leary and upon vote taken thereof, the following voted in favor thereof:
Henry Dorff, Gordon Erickson, Howard Heck, and John Leary, and the
following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
Member Howard Heck introduced the following resolution and moved

of a Chevrolet Pick up Truck in accordance with the specifications therefor,
is deemed to be the best bid submitted by a responsible bidder and said
bid is hereby accepted.
The motion for the adoption of the forgoing resolution was duly
seconded by member John Leary and upon vote taken thereof", the following
voted in favor thereof: Henry Dorff, Gordon Erickson, Howard Deck, and
John Leary, and the following voted against the same: None; whereupon

Village of Brooklyn Center that the low bid of Minnesota Toro, Inc. , in the
amount of $5726.00 , for the furnishing of a Toro Tractor Series 5 specifications
therefor, is deemed to be the best bid submitted by a responsible bidder and
said bid is hereby accepted.
The motion for the adoption of the forgoing resolution was duly seconded
by Member Henry Dorff and upon vote being taken thereof, the following voted
in favor thereof: Henry Dorff, Gordon Erickson, Howard Heck, and john Leary,
and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.

of over -sized material to prevent the jamming of the equipment.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota that the bid of Road Machinery &
Supply Company in the amount of $1774.00, for the furnishing of a Good
Roads Spreader in accordance with the specifications therefor, is deemed
to --be the best bid submitted by a responsible bidder and said bid is hereby
accepted.
Motion for adoption for the forgoing resolution was duly seconded by
member Henry Dorff and upon vote being taken thereof the following voted

is deemed to be the best bid submitted by a responsible bidder and said bid

The motion for the adoption of the forgoing resolution was duly seconded
by member Henry Dorff and upon vote taken thereof, the following voted in
favor thereof; Henry Dorff, Gordon Erickson, Howard Heck, and john Leary,
and the following voted against the same; None: whereupon said resolution
was declared duly passed and adopted.
Member Howard Heck introduced the following resolution and moved
its adoption:
RESOLUTION ESTABLISHING A BROOKLYN CENTER

WHEREAS, Mayor Gordon Erickson has ptroposed that a Government
Study Committee be established, and
WHEREAS, Mayor Erickson has proposed that the committee consist
of one member appointed by the League of Women Voters, one member
appointed by the Citizen Committee for Better Government, and ten members
to be appointed by Council Members (two by each member of the Council)
and the Chairman to be appointed by the Mayor, and
WHEREAS, the purpose of this committee shall be to study the various
forms of Municipal Government available to the Citizens of Brooklyn Center
and submit a report of their findings to the Village Council,
BE IT HEREBY RESOLVED, by the Village Council of the Village of
Brooklyn Center that a Government Study Committee be established and that
the members of the Committee be appointed in the manner proposed by the
Mayor.
and
BE IT FURTHER BE RESOLVED, that the Village Council request that the
League of Women Voters and the Citizen Committee for Better Government be
asked to name members of this committee,

BE IT FURTHER RESOLVED, that the membership of the Government
Study Committee shall be appointed at the first meeting of the Village
Council in March 1962.
Motion for the adoption of the forgoing resolution was duly seconded
r by member Henry Dorff and upon vote being taken thereof, the following voted

and the following voted against the same; None: whereupon said resolution

Motion by John Leary and seconded by Howard Heck that the Law
! Firm of Lindquist, Frazer, and lw::agnusonbe appointed Village Attorneys
for the Village of Brooklyn' Center. Motion carried.
Member Howard Heck introduced the following resolution and moved
its adoption:
RESOLUTION AUTHORIZING THE ACCEPTANCE

WHERE-AS, the owner of Block 3, Twin Lake Woods Addition, Brooklyn
Center, Minnesota, Mr. K. O. Sandum, agreed to deed said property
to the Village of Brooklyn Center for park purposes, and
WHEREAS, Mr. K. O. Sandum is now deceased , and
WHEREAS, the executors of the K. O. Sandum estate have indicated
that this property will be conveyed to the Village of Brooklyn
Center for park purposes if the Village so desires.
NOW, THEREFORE, BE IT RESOLVED bey the Village Council of the
Village of Brooklyn Center:
1. That the acquisition of said property for park purposes
is in the public interest.
2. That the Village Council of the Village of Brooklyn Center
will accept a deed to Block 3, Twin Lake Woods Addition
and that the land shall be used for park purposes if the
executors of the K. O. Sandum estate will convey the
property to the Village of Brooklyn Center without cost to
the Village of Brooklyn Center.

Member Henry Dorff, and upon vote being taken thereon the following voted
in favor thereof: John Leary, Gordon Erickson, Henry Dorff, and Howard
Heck, and the following voted against the same: None; whereupon said

Member Henry Dorff introduced the following resolution and moved
its adoption:
RESOLUTION AUTHORIZING ENGINEERING AND
TECHNICAL SERVICES DURING THE YEAR 1962

BE IT RESOLVED that pursuant to statutory authority the Village
Engineer forced on behalf of the Village of Brooklyn Center is hereby
authorized to request and obtain from the Minnesota Department of
Highways needed engineering and technical services during the year
1962 for which payment will be made by the Village of Brooklyn Center
upon receipt of verified claims from the Commissioner of Highways.
The motion for the adoption of the forgoing resolution was duly seconded
by member john Leary, and upon vote being taken thereon the following
Voted in favor thereof: Jahn Leary, Gordon Erickson, Howard Fleck, and

Henry Dorff, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Member Howard Heck introduced the following resolution and moved
its adoption:'
RESOLUTION AUTHORIZING VILLAGE ENGINEER
TO GRANT CONSTRUCTION PERMITS TO MINNESOTA

WHEREAS, the Minnesota Highway Department contemplates the
construction of State Project No. 2781 -50, and interchange complex
located at Trunk FIt$hw4y 100 and Lyndale: Avenue North, and
WHEREAS, it is necessary that the Minnesota State Highway Department
construct a north -south bypass route around the interchange complex,
and
WHEREAS, the Village Engineer recommends that it is practical and
to the best interests of the Village of Brooklyn Center to construct
a portion of the bypass route on North Lilac. Drive between 65th Avenue
North and Camden Avenue North, and,:
WHEREAS, said construction would be accomplished at no cost to the
Village of Brooklyn Center.
NOW, THEREFORE, BE IT RESOLVED that the Village Engineer to
authorized to grant roadway construction permits on North Lilac
Drive between. 65th Avenue North and Camden Avenue North to the
Minnesota Highway Department.
The motion for the adoption of the forgoing resolution was duly seconded by
member john Leary, and upon vote being taken thereon the following voted in
favor thereof: john Leary, Gordon Erickson, Henry Dorff, Howard Heck
and the following voted against the same; None; whereupon said resolution
was duly passed and adopted.
Motion by john Leary and seconded by Howard Heck to delay the
discussion of Flouridation of Water Supply until a decision has been reached
as to the future source of water supply for the Village of Brooklyn Center.
Motion carried.
Member john Leary introduced the following resolution and moved

RESOLUTION AUTHORIZING CONNECTION OF
FAIR OAK ELEMENTARY SCHOOL (DISTRICT
NO. 279) TO THE VILLAGE OF B ROOKLYN
R W R SYSTE
WHEREAS, Independent School District No. 279 has requested permission
to connect the new elementary school known as Fair Oak to the Village
of Brooklyn Center water system, and
WHEREAS, the Fair Oak Elementary School is located in the Village of
Brooklyn Park near 65th Avenue North and west boundary of the Village
of Brooklyn Center, and
WHEREAS, the Village of Brooklyn Park through its Engineer, has
granted written approval of such a connection, and
WHEREAS, the Brooklyn Center gngineer recommends that such a
connection is practical and feas0le,

NOW, THEREFORE, BE IT RESOLVED as follows:
1. Independent School District No 279 is hereby authorized
to connect the Fair Oak Elementary School to the Village
of Brooklyn Center water system at Winchester Lane and
Unity Avenue North.
2. Plans for said connection shall be approved in writing by
the Village of Brooklyn Center Engineer.
3. Independent School District No. 279 shall be responsible
for all construction costs involved in the connection and
all costs of restoration within the Village of Brooklyn
Center boundary.
4. Independent School District No. 279 shall pay to the Village
of Brooklyn Center the sum of $2,854. 00 which sure shall be
considered the Fair Oak Elementary School proportionate share
of wells, elevated storage tanks and large feeder mains which
serve the water system.
The motion for the adoption of the forgoing resolution was duly seconded by
member Henry Dorff , and upon vote being taken thereon the following voted
in favor thereof: john Leary, Gordon Erickson Henry Dorff, Howard Heck,
and the following voted against the same: None; whereupon said resolution
was duly passed and adopted.
Member John Leary introduced the following resolution and moved
its adoption:

Atanasoff as Secretary, to the Administrator. Motion carried.
