Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of

March 5, 1962
The Village Council met in special session and was called to order
by Mayor Gordon Erickson at 7:35 P. M.
Roll Call: Mayor Gordon Erickson, Henry Dorff, Carl Carlson, John
Leary, and Howard Heck were present.
Motion by Carl Carlson and seconded by John Leary to uphold the
recommendation of the Planning Commission and approve application #62004
which is a petition of Victor Ehrenberg to sell property by metes and bounds.
Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to uphold the
action of the Planning Commission and approve the preliminary plat of Blocks
1 and 2 of Brooklyn Hi Addition as submitted on March 1, 1962, on the
condition that an application for re- zoning a tract of land to B -1 in accordance
with the North East "bleighbotbood"Study be submitted before the final plat is
approved. (Petition #61196). Motion carried.
Member Carl Carlson introduced the following resolution and moved

RESOLUTION APPROVING PLANS FOR HIGHWAY BRIDGE

WHEREAS the Commissioner of Highways has prepared plans, special
provisions and specifications for the improvement of a part of Trunk Highway
Number 392 renumbered as Trunk Highway Number 94 within the corporate
limits of the Village of Brooklyn Center, Minnesota from Bryant Avenue to
Bridge No. 9321 (Mississippi River); and
WHEREAS sale,, plans and spoical provisions are on file in the office
of the Department of Highways, St. Paul, Minnesota, being marked, labeled,
and identified as S.P. 2981 -50 (T. H. 94 =392); and
II I WHEREAS said specifications are on file in the office of the
Department of Highways, St. Paul, Minnesota, being marked, labeled, and
identified as S. P. 2781 -50 (T. H. 94 =392), Minn. Prof. 1 094 -3 (66) 222,
which together with the Minnesota Department of Highways Specifications
for Highway Construction, dated May 1, 1959, on file in the office of the
Commissioner of Highways, constitute the specifications for said Improvement
of Trunk Highway Number 392 renumbered as Trunk Highway Number 94; and
WHEREAS copies of said plans and special provisions as so marked,
labeled and identified are also on file in the office of the Village Clerk; and

WHEREAS the term "said plans and special provisions" as hereinafter
used in the body of this resolution shall be deemed and intended to mean,
refer to, and incorporate the plans and special provisions in the foregoing
recitals particularly identified and described.
NOW, THEN, BE IT RESOLVED that said plans and special provisions
for the improvement of Trunk Highway Number 392 renumbered as Trunk
Highway Number 94 within the limits of the Village of Brooklyn Center be and
hereby are approved.
BE IT FURTHER RESOLVED that the elevations and grades as shown
in said plans and special provisions be and they are hereby approved and
consent is hereby given to any and all changes in grade occasioned by the
construction of said Trunk Highway Number 392 renumbered as Trunk Highway
Number 94 in accordance with said plans and special provisions.
The motion for the adoption of the foregoing resolution was duly
seconded by member John Leary, and upon vote being taken thereon the
following voted in favor thereof: Gordon Erickson, Howard Heck, John
Leary, Henry Dorff, and Carl Carlson and the following voted against the
same: None; whereupon said resolution was duly passed and adopted.
Member Howard Heck introduced the following resolution and moved
its adoption:
RESOLUTION GIVING ASSURANCE THAT ENCROACHMENTS
OF ANY NATURE OR IQND WILL NOT BE PERMITTED ON
TBIINK HLQMAY NUMBER 94
WHEREAS the Village of Brooklyn Center has approved the plans
and specifications for the improvement of that part of Trunk Highway
Number 392 renumbered as Trunk Highway Number 94 within the corporate
limits of the Village of Brooklyn Center from Bryant Avenue to Bridge No.
9321 (Mississippi River); and
WHEREAS in order to obtain Federal Aid in the construction of said
Trunk Highway Number 392 renumbered as Trunk Highway Number 94 the
Bureau of Public Roads requires the assurance that the Village of Brooklyn
Center will not suffer any encroachment of any nature or kind whatsoever
on the right of way of said Trunk Highway Number 392 renumbered as
Trunk Highway Number 9+4 within the corporate limits of the said Village
of Brooklyn Center.
NOW, THEN, BE IT RESOLVED THAT said Village of Brooklyn Center
does hereby agree and conenant that it will never permit or suffer, within
Its corporate limits, any encroachment of any kind whatsoever, including
curb gas pumps and gas stations, billboards other structures of any kind
whatsoever, upon the right of way of Trunk Highway Number 392 renumbered
as Trunk Highway Number 94 and to the above end said Village of Brooklyn
Center hereby agrees that it will nenver issue any license, permit, or grant
or give any leave or liberty or any other consent of whatever for for the

construction or maintenance of any encroachment whatsoever, including curb
gas pumps and gas stations , billboards or other structures of any kind
whatsoever, upon said right of way; and what said Village of Brooklyn Center
will cooperate insofar as possible to eliminate existing encroachments
constituting traffic hazards and will further take any necessary action to
eliminate any encroachment that may hereafter exist on said trunk highway
right of way.
The 'motion for the adoption of the foregoing resolution was duly
seconded by member Carl Carlson, and upon vote being taken thereon the
following voted in favor thereof: Gordon Erickson, Howard Heck, john
Leary, Henry Dorff, and Carl Carlson; and the following voted against the
same: None; whereupon said resolution was duly passed and adopted.
Member Howard Heck introduced the following resolution and moved
its adoption:
RESOLUTION ESTABLISHING A SCHEDULE OF RATES, FEES, AND
METER DEPOSITS FOR THE USE OF AND CONNECTION TO THE
WATER AND SANITARY SEWER SYSTEMS OF THE VILLAGE OF

WHEREAS a municipal Public Utilities Department has been created
for the purpose of providing and maintaining water and sanitary sewer
facilities for the citizens of the Village of Brooklyn Center, and
WHEREAS it is the intent of the Village Council of the Village
of Brooklyn Center that the Public Utilities Department be a self - , sustaining
entity through revenue provided by a uniform schedule of rates, fees,
and meter deposits, and
WHEREAS Section 4 -201 of the fN'ater and Sewer Ordinance provides
that the Village Council shall adopt by resolution a schedule of water and
sanitary sewer rates, fees, and meter deposits to be known as the Public
Utilities Department Rote 'Sdh6dule.

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the following schedule of water and 'said
sewer rates, fees, and meter deposits for the use of and connections to the
water and sanitary system of the Village of Brooklyn Center is hereby
adopted.
The motion for the adoption of the foregoing resolution was duly
seconded by member Henry Dorff, and upon vote being taken thereon the
following voted in favor thereof: John Leary, Gordon Erickson, Henry Dorff,
Howard Heck, and Carl Carlson, and the following voted against the same:
None; whereupon said resolution was duly passed and adopted.
