Minnesota April 9, 1962 The Village Council met in regular session and was called to order by Mayor Gordon Erickson at 7 :35 P. M. Roll Call: Mayor Gordon Erickson, Carl Carlson, Henry Dorff, Howard Heck, and John Leary were present. Motion by Howard Heck and seconded by John Leary to approve the minutes of the special council meeting of April 2, 1962 after deleting the words "in inverse numerical order" from paragraph 5 of the RESOLUTION DETERMINING TOTAL COST OF CERTAIN IMPROVEMENTS AND AUTHORIZING THE ISSUANCE AND SALE OF $595,000 IMPROVEMENT BOND. Members John Leary, Gordon Erickson, Henry Dorff, and Howard Heck voting for the motion. Member Carl Carlson abstaining from voting on the motion since he was absent from the meeting of April 2, 1962. Motion by Carl Carlson and seconded by Howard Heck to return Planning Commission Application 61270 to the Planning Commission, as requested by the petitioner, without any council consideration having been given to the matter. Motion carried. Member Carl Carlson introduced the following ordinance and moved its adoption: AN ORDINANCE AMENDING SECTION 35 -815 AND SECTION 35 -850 OF THE VILLAGE ORDINANCES TO REZONE CERTAIN PROPERTY THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER TO ORDAIN: Section 1: Section 35 -815 of the Village Ordinances is hereby amended by deleting the following description: The Westerly 910' of that part of Section 10, Township 118, Range 21, described as follows: The South 300' of that part of the North 1/2 of the Southeast 1/4 lying West of a line running from a point in the South line of the North 1/2 of the Southeast 1/4, a distance of 997 71' West from the Southeast corner thereof, to a point in the Southerly line of railroad right -of -way, a distance of 1044.16' Northwesterly along the same from the east line of the North 1/2 of the Southeast 1/4 except road. and adding the following thereto; All of Ryan Lake Addition. Member Howard Heck introduced the following Ordinance and moved Its adoption: AN ORDINANCE AMENDING SECTION 35 -815 AND SECTION 35 -850 OF THE VILLAGE ORDINANCES TO REZONE CERTAIN PR F THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN: Section 1; Section 35 -815 of the Village Ordinances is hereby amended by adding the following thereto: Lot 16, Block 2, Twin Lake Woods Second Addition. Section 2; Section 35 -850 of the Village Ordinances is hereby amended by adding to the end of paragraph 1 the following sentence: Also excepting Lot 16, Block 2, Twin Lake Woods Second Addition. Section 3. This ordinance shall be effective from and after its publication. Passed by the Village Council of the Village of Brooklyn Center this 9th day of April, 1962. Mayor Attest: Clerk SEAL The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson; and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, John Leary, Henry Dorff, Carl Carlson -2- and Howard Heck, and the following voted against the same: None; where- 165 upon said ordinance was declared duly passed and adopted. Motion by Howard Heck and seconded by Carl Carlson to recommend to the Planning Commission that a study be made of the proposal to rezone from I-1 to R-B, 5000 France Avenue North and 3614 and 16, 50th Avenue No. Motion carried. Motion by ,John Leary and seconded by Howard Heck to uphold the action of the Planning Commission and approve the application for a special use permit by Albert Iacarella to construct a seven unit apartment building at 7018 Osseo Road North as oulined on application No. 62009, on the condition that the building be limited to 1 and if 2 stories in heigth and that the building be constructed in accordance with the plans approved by the Planning Commission on April 5, 1962. Motion carried. Motion by Henry Dorff and seconded by Carl Carlson to uphold the action of the Planning Commission and deny petition No. 62003 submitted by Neagle Advertising Company for variances to construct a 28' high sign in the front yard set back of the Brooklyn Center State Sank. Motion carried. Member Howard Heck introduced the following ordinance and moved its adoption: _ AN ORDINANCE AMENDING CHAPTER i OF THE ORDINANCES B&QOUM C THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS AS FOLLOWS: Sec ion 1: Section 1 -102 of the Village Ordinances is hereby amended to read as follows: Section 1 -102 LICENSE FEES. bog licenses shall be issued upon presentation.ofthe Village Clerk of proper proof of vaccination for rabies within the eighteen (18) months previous to issuance of the license with Rabies Vaccine, Modified Live Virus type, or within three (3) months previous to issue of the license with Rabies Vaccine, Killed Virus type, and payment to the Village Clerk of the following annual fees: Male Dog: $3.00 Female Dog $5.00 SpAyed Female Dog, upon presentation of proper proof thereof; $3.00 Dogs confined to dog kennels need not be licensed, provided that the dog kennel is licensed as hereafter provided. All licenses expire on December 31, next following the issuance of the license. Section 2, Section 1 -109 of the Village Ordinance is hereby amended to read as follows: Section 1-109 REDEEMING DOGS. Any dog may be redeemed from the pound by the owner or keeper within the time stated in the notice by the payment of the license fee for the current year plus a fifty cent late fee (50) if the dog is then unlicensed with a poundage fee of eight dollars ($8.00) , and one dollar, and twenty -five cants ($1.25) per day for each day said dog is confined in said pound as the cost of feeding. Sec ion 3: This ordinance shall take effect from and after its legal publication. Passed by the Village Council of the Village of Brooklyn Center this 9th day of April, 1962. M. they opened and tabulated bids received for Modification of Sewage Lift Station No. 1, Project No. 1962 -13, and that said bids were as follows: ENE sum 12E -UCT Na BID Metropolitan Electric Co. $13,360.00 $13 Collins Electric Co. $11,734.00 $350.00 $11, 384, 00 Batzli Electric Co. $10,795.00 $10,795.00 Gopher Electric $11,816.00 $300.00 $11,516.00 NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of Batzli Electric Co., in the amount of $10,79S, as to furnishing of all work, labor and material in connection with Modification of Sewage Lift Station No. 1, Project No. 1962 -13 according to the plans and specifications therefor now on file in the office of the Village Clerk is deemed to be the lowest and best bid submitted for said work by a responsible bidder, and said bid is hereby accepted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION DECLARING TAX DELINQUENT LANDS "NON - - CONSERVATION AND FOR SALE" WHEREAS, the Village Council of the Village of .Brooklyn Center, Hennepin County, Minnesota, has received from the County Auditor of Hennepin County, Minnesota, list of lands in said Village which became the property of the State of Minnesota under the provisions of law declaring the forfeiture of land to the state for non - payment of taxes, which said list has been designated as Classification List "528 -C ", and WHEREAS, each parcel of land described in said list has heretofore been classified by the Board of County Commissioners of Hennepin County, -4- Minnesota as non - conservation land and the sale thereof has heretofore 1 been authorized by said Board of County Commissioners: NO'W, THEREFORE, BE IT RESOLVED, by the Village Council, acting pursuant to Minnesota Statutes for 1949, Section 282. 01, Subd. 1, that the said classification by said Board of County Commissioners of each parcel of land described in said list as non-conservation land bed and and the same is hereby approved and that the sale of each such parcel of land be and the same is hereby approved. Member john Leary introduced the following resolution and moved its adoption: RESOLUTION FOR ACQUISTION OF TAX FORFEITED LAND FOR EW EIIRPOUS BE IT RESOLVED by the Village Council of the Village of Brooklyn _ Center, Minnesota, that the Village Attorney be authorized and directed to file "Application by Governmental Subdivision for Conveyance of Tax - 'f Forfeited Lands, " for the following property contained in Hennepin County Auditor.'s List "528 -C said property to be used by the Village of Brooklyn Center for Park Purposes as hereinafter set forth: I f Parcel No. 38216 -1964 - Lot 7, Twin Lake Park, Plat No. 98070. BE IT FURTHER RESOLVED, that the Mayor and Clerk of this Village, be, and hereby are, authorized and directed to sign said application on behalf of the Village of Brooklyn Center. Motion by Henry Dorff and seconded by Carl Carlson to instruct the Village Attorney to advise the property owners along June Avenue of his findings regarding the assessments for street improvements in Pearson "s Northport 3rd Addition, and the Council's decision not to pursue the matter any further. Member Howard Heck introduced the following resolution and moved Its adoption: RESOLUTION DIRECTING CONDEMNATION OF CERTAIN J= EUjj§ N WHEREAS, the Village Engineer has advised the Village Council that certain interests in land are required for municipal purposes including -6- permAent easements for the construction of sewers and the acquisition of 11 certain streets and it appearing necessary that the acquisition of such Interests in land is necessary and desireable in the public interests and that the taking will be most fairly and equitably accomplished through weeding in eihinctt domain. Member John Leary introduced the following resolution and moved Its adoption: RESOLUTION AUTHORIZING PURCHASE OF PROPERTY AND' EMEM ENT WHEREAS, the Village of Brooklyn Center has found it necessary to acquire lands for street and utility purposes described as: 1. The east 25.0 feet of the west 180.0 feet of that part of Lot 6 Auditors Subdivision No. 309 Hennepin County, Minnesota lying east of a line running north at right angles from a paint in the south line distant 1095.5 feet east from the southwest corner of said Lot 6. 2.
