Council of the Village of Brooklyn Center
In the County of Hennepin and State of
Minnesota
April 23, 1962
The Village Council met in regular session and was called to order
by Mayor Gordon Erickson at 7:40 P. M.
Roll Call: Mayor Gordon Erickson, Carl Carlson, Henry Dorff,
Howard Heck, and John Leary were present.
Motion by Howard Heck and seconded by Carl Carlson to approve
the minutes of the regular council meeting of April 9, 1962. Motion carried.
Motion by Carl Carlson and seconded by Howard Heck to approve
the request of the Jaycee's for permission to operate a carnival June 11 thru
the 17th, located at 57th Avenue North and Highway 100. Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to direct and
authorize the Mayor and Village Clerk to sign the agreement with the State
of Minnesota regarding the joint acquisition of property owned by Gust
Anderson and located at the southeast corner of the intersection of proposed
Trunk Highway 152 and proposed County Road No. 10.

RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
SANITARY SEWER IMPROVEMENT NO, 1962 -18
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Sanitary sewer on 69th Avenue North from Toledo Avenue to the
West Village limits.
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $7840.00
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 7th day of May, 1962
at 8:00 o' clock P. M. , and the clerk shall publish notice of the time
and place of hearing by two weeks' publication in the official newspaper
of the Village.
3. The area proposed to be assessed for said improvement is
as follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE NAMED STREET
4. This proposed improvement shall be designated Sanitary Sewer
Improvement No. 1962 -18.
The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and upon vote being taken thereon the following
voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff,
Howard Heck, and John Leary, and the fallowing voted against the
same: None; whereupon said resolution was declared duly passed and
adopted.

Member Howard Heck introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
SANITARY SEWER IMPROVEMENT NO, 1962 -17
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Sanitary Sewer on Lyndale Avenue North from 70th
Avenue to 73rd Avenue
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $20, 515.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 7th day of May,
1962, at 8 :00 o' clock P. M. , and the clerk shall publish notice of
the time and place of hearing by two weeks' publication in the
official newspaper of the Village.
3. The area proposed to be assessed for said improvement is
as follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE NAMED STREET
4. This proposed improvement shall be designated Sanitary Sewer
Improvement No. 1962 -17 .
The motion for the adoption of the foregoing resolution was duly seconded
by member John Leary., and upon vote being taken thereon the foil voted

and John Leary, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Member Henry Dorff introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
SANITARY SEWER IMPROVEMENT NO. 1962 -8
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Sanitary sewer lateral on Aldrich Avenue North from
the N. S. P. easement to 59th Avenue North
WHEREAS, the village engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $8,850.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on Monday, the 7th day of May, 1962
at 8 :00 o' clock P. M. , and the clerk shall publish notice of the time
and place of hearing by two weeks' publication in the official newspaper

3. The area proposed to be assessed for said improvement is as
follows;

4. This proposed improvement shall be designated Sanitary

Member Howard Heck introduced the following resolution and moved

REIMBURSEMENT OF UNASSESSED COST OF WATER IMPROVEMENT
NO, 1960-1 -, -- -
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
6 -inch water main, services, and appurtenances on Fremont
Avenue North from 65th Avenue North to the north right -of -way
of F.A.I. 94.
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $7563.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
the Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes. to-proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 7th day of May, 1962,
at 8 :00 0' clock P. M. , and the clerk shall publish notice of the time and
place of hearing by two weeks' publication in the official newspaper of the
Village.
3. The area proposed to be assessed for said improvement is
as follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE STREET WHERE THE
PROJECT IS TO BE CONSTRUCTED.
4. This proposed improvement shall be designated Water
Improvement No. 1962 -3.
BE IT FURTHER RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, that it is hereby determined that the
properties which will be served by Water Improvement No. 1962 -3 when said
improvement is completed, will also be benefited by Water Improvement
No. 1960-1. which properties were not initially assessed for Water
Improvement No. 1960 -1 and that as to expenditures made for Wer
Improvement No. 1960 -1 from general ad valorem tax levies or other
sources and funds in addition to special assessments heretofore made
for said improvement the Village shall be reimbursed therefor by adding
$4687.00 to the assessments to be levied for -Water Improvement No. 1962 -3
and the Village Clerk shall cause ; nbt 6o -that such additional amounts will
be assessed to be included in the -notice of hearing in the making of said

WHEREAS, it is proposed that there be constructed an improvement
consisting of water mains, services, and appurtanences on the following

Village of Brooklyn Center, Minnesota, as follows:

2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 7th day of May, 1962
at 8:00 o' clock P. M. , and the clerk shall publish notice of the time

of the Village.
3. The area proposed to be assessed for said improvement is

Member John Leary introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED
WATER IMPROVEMENT NO. 1962 -2 AND PROVIDING FOR
REIMBURSEMENT OF UNASSESSED COST OF WATER IMPROVEMENT
NO. 1960 -1.
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:

6 -inch water main, services, and appurtenances on Emerson
Avenue North from 65th Avenue North to the north right -of -way of
F.A.I. 94, and parallel to the north right -of -way of F.A.I. 94
from Emerson Avenue to Fremont Avenue North.
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $8, 335.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 7th day of May, 1962
at 8 :00 o'clock P.M. , and the clerk shall publish notice of the time and
place of hearing by two weeks' publication in the official newspaper of
the village.
3. The area proposed to be assessed for said improvement is as
follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE STREET WHERE
THE PROJECT IS TO BE CONSTRUCTED.
4. This proposed improvement shall be designated Water Improvement
No. 1962 -2.
BE IT FURTHER RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, that it is hereby determined that the properties

The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and upon vote being taken theron the following
voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff,
Howard Heck, and John Leary, and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Motion by Howard Heck seconded by John Leary to approve the
proposal of Tri State Drilling Company for the furnishing and installing a
deep well! pump and reactivating the temporary well on Xerxes Avenue in
the amount of $500.00 for pump and motor rental for a four month period,
$300.00 for installing and removing pipe and motor, and $75.00 for the rental C
of 165 feet of steel collectors pipe. Motion carried.
Motion by John Leary and seconded by Henry Dorff to authorize the
Public Utilities Department to take necessary measures to reactivate the
temporary well on Xerxes Avenue just South of Nash Road. Motion carried.
Motion by John Leary and seconded by Howard Heck to employ Dean
Petree as police secretary at a salary of $447.00 per month. Motion carried.

Motion by Howard Heck and seconded by John Leary to employ
on a temporary basis David Sanborn as Engineer aide at a salary of
$ 2.10 per hour. Motion carried.
Motion by Henry Dorff and seconded by Howard Heck to employ on a
temporary basis Gary Giving as Engineer aide at a salary of $2.10 per hour.
Motion carried.
Motion by Henry Dorff and seconded by John Leary that the following
men be employed as temporary laborers in the street department at a salary of
$2.17 per hour; William Emholtz, Glen Jopp and Delmar Christensen.
Motion carried.
Motion by Henry Dorff and seconded by Howard Heck to accept
the resignation of Rosemary Caye effective April 27, 1962. Motion carried.
Motion by Carl Carlson and seconded by Henry Dorff to authorize the
Mayor to sign a application to the Conservation Department for the
improvement of Shingle Creek. Motion carried.
Motion by Henry Dorff and seconded by Howard Heck to approve the

Member Carl Carlson introduced the following resolution and
moved its adoption:
RESOLUTIQN ESTABLISHING MUNICIPAL AID STREETS
WHEREAS, it appears to the Village Council of the Village of
Brooklyn Center that the streets hereinafter described should be designated
Municipal State Aid streets under the provisions of Minnesota Laws of
1959, Chapter 500
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the streets described as follows, to -wit:

BE IT FURTHER RESOLVED, that the Village Clerk is hereby
authorized and directed to forward two certified copies of this resolution
to the commissioner of Highways for his consideration, and that upon his
approval of the designation of said streets or portion thereof, that same
be constructed, improved and maintained as Municipal State Aid Streets
of the Village of Brooklyn Center, to be numbered and known as Municipal
State Aid Streets as indicated above.

ATION ON 63rd AVENUE NORTH
WHEREAS, 63rd Avenue North from Shingle Creek Parkway to

T. H. 100, Control Section No. 101 is presently designated as a 1 61
Municipal State Aid Street, and
WHEREAS, Community Planning and Design Associates, the planning
consultants for the Village have completed a report for the development
of the area which does not include this segment of 63rd Avenue North,
and
WHEREAS, the Planning Commission and Village Council of the Village
of Brooklyn Center have adopted the above report in principle,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center to hereby revoke the State Aid designation on
63rd Avenue North between Shingle Creek Parkway and Trunk Highway No.
100.
The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and upon vote being taken thereon the following
