HomeMy WebLinkAbout1962 06-11 CCM Regular Session w 2'7 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center In the County of Hennepin and State of Minnesota June 11, 1962 The Village Council met in Regular Session and was called to order by Mayor Gordon Erickson at 7 :35 P. M. Roll Cali: Mayor Gordon Erickson, Carl Carlson, Henry Dorff and John Leary were present. Howard Heck was absent. Motion by Carl Carlson and seconded by John Leary to approve the minutes of May 28, 1962 as recorded. Motion carried. ' . Member John Leary, introduced the following Ordinance and moved its adoption: AN ORDINANCE AMENDING SECTION 35 -310 OF THE VILLAGE ORDINANCES TO ADD AN ADDITIONAL SPECIAL USE IN A RESIDENCE DISTRICT The Village Council of the Village of Brooklyn Center do ordain: Section 1: Section 35 -310 of the Village Ordinances is here by amended by adding the following to the list of Special Uses: k. Public and private golf courses. Section 2 : This ordinance shall be effective from and after its publication. Passed by the Village Council by the Village of Brooklyn Center this 11th Day of June, 1962. Mayor Attest: Clerk SEAL The motion for the adoption of the foregoing ordinance wets duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff and John Leary, and the following voted against the same: None; Whereupon said Ordinance was declared duly passed and adopted. Motion by Carl Carlson and seconded by John Leary to uphold the act. of the Planning Commission in the approval of application #62018 by George Matchett to divide parcel 4900, Auditors Subdivision #216 be approved with a variance on one lot from 9500 to 8800 square feet of area, to maintain the residential character of the area. Motion carried. Motion by Henry Dorff and seconded by Carl Carlson to uphold the action of the Planning Commission in the approval of application #62019 by Paul Radke to divide a 126' x 128' lot into one 62' x 128' lot on the South and one 64' x 128' lot on the North. Motion carried. _L29 Motion by John Leary and seconded by Carl Carlson to uphold the action of the Planning Commission in the approval of application #62028 by Willard Bartos to build a garage three feet from the West property line. Motion carried. Motion by Carl Carlson and seconded by John Leary to uphold the action of the Planning Commission in the approval of application #62027 by Homedale Builders to maintain an existing 12' wide and 8' high sign on the South East Corner of the model home site at 6925 Lyndale Avenue North for a period of two years. Motion carried . Motion by Carl Carlson and seconded by Henry Dorff to approve application #62020 for the proposed plat of the Northland Estates Addition subject to requirement of the platting ordinance and any dwelling that may be built on Lot 2, Block 1, have a 25 foot side yard set back on the West side and 72 1/2 Avenue be named Woodbine Lane. The following voted in favor thereof: Carl Carlson, Henry Dorff and Mayor Erickson, the following voted agianst the same, John Leary. Motion carried. Motion by John Leary and seconded by Carl Carlson to uphold the action of the Planning Commission in approving application #62021 for the proposed Plat of Sunny -Brook Terrace Addition subject to requirements of the lattin ordinance and with changes as noted on the file copy. P g Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to approve Planning Commission app Lication #62.029 to erect a portable tabernacle at 57th t.Jenue and Highway 100 for the purpose of conducting religious services, and to delete the hold harmless clause as recommended by the Planning Commission; the structure is to be removed and the premises are to be cleaned up by September 1, 1962. Motion by John Leary and seconded by Carl Carlson to table action on Planning Commission application #62023 until Mr. Beffa contracts the property owner on the West Half of Camden Avenue and recommends that he dedicate his one half of Camden Avenue to the Village for Street purposes. Motion carried. Motion by Carl Carlson and seconded by John Leary to uphold the action of the Planning Commission in approving application #62026 for the proposed plat of the Edling Addition subject to the platting regulation and adding that before the final plat is approved that the necessary easements for the extention of June Avenue be acquired. Motion carried. Motion by John Leary and seconded by Henry Dorff to uphold the action of the planning commission in denying application #62025 for the proposed plat of the Twin Lake Oaks Addition because of deficencies according to the platting ordinance. Motion carried. Motion by Henry Dorff and seconded by Carl Carlson to uphold the action of the Planning Commission in approving application #62017 for a Special Use permit to build a Drive - In Restaurant subject to approval of the complete architectural drawings and that such approval be conditioned upon the maintaining of the access to the property South of the drive -in thru the driveway shown on the proposed plan. Motion carried. Motion by John Leary to repeal the rabies requirement of Chapter one of the Ordinances of Brooklyn Center. Motion died for want of the second. Motion by Carl Carlson and seconded by Henry Dorff to discuss the provisions of Chapter one of the Ordinance of Brooklyn Center requiring rabies vaccination and to have the representative of the Publich Health Department present for the discussion on July 9, 1962. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to accept the audit report of Village Accounts for the year ended December 31, 1961. Motion carries. -2- Motion by John Leary and seconded by Carl Carlson to retain Hodne Associates as Village planner on a month to month basis. Duties to include completion of the present Urban Communities report and both Hodne Associates and the Community Planning and Design Associates sign the report. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON P ROPOSED SANITARY SEWER IMPROVEMENT NO. 1962 -21 WHEREAS, it is proposed that there be constructed an improvement consisiting of the following: Sanitary Sewer Lateral on Camden Avenue North from 61st to 62nd Avenues WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimeted cost of $7,798.00. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted by Chapter 3 Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 25th day of June, 1962, at 8 :00 o'clock P.M. and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: ALL LOTS AND PARCELS ABUTTING THE ABOVE NAMED STREET 4. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1962 -21. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon the following voted in favor thereof: Gordon Erickson, Carl Carlson, John Leary and Henry Dorff, and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER IMPROVEMENT NO. 1962 -22 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Sanitary Sewer Lateral on Humboldt Avenue North from 70th Avenue to a point approximately 600 feet south of 69th Avenue WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed an estimated cost of $14, 249. 00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: -3- 135 1. Member Carl Carlson introduced the following Resolution and moved its adoption: RESOLUTION COMBINING CERTAIN BOND FUNDS INTO A COMMON BOND FUND TO BE KNOWN AS BOND FUND NUMBER 1 WHEREAS,certai.n probable inequities have occurred in prior years tax distributions and accounting procedures, and WHEREAS, Bond Fund 1953 AB has a deficit cash balance at the present time and WHEREAS, certain other bond funds have unappropiated surpluses, and WHEREAS, the combining of these certain bond funds will facilitate accounting and tax distribution procedures, and has the approval of the Village Attorney and the Village Auditor, now therefore BE IT RESOLVED, that the Storm Sewer Number 1 Fund, Sanitary Sewer Number 1 Fund , 1953 AB Fund, 1954 A Fund and 1954 C Fund be combined in a common bond fund to be known as Bond Fund Number 1. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taken thereon the following voted In favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff and John Leary, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The bills having been audited, motion was made by Henry Dorff and seconded by Carl Carlson to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried. Motion by John Leary and seconded by Carl Carlson to accept the audit report of Brooklyn Center Fire Department Relief Association accounts for the year ended December 31, 1961.
