Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
May 28, 1962
The Village Council met in regular session and was called to order
by Mayor Gordon Erickson at 7 :40 P. M.
Roll Call: Mayor Gordon Erickson, john Leary, Henry Dorff, Howard
Heck and Carl Carlson.
Motion by Carl Carlson and seconded by john Leary to approve the
minutes of the Council meeting of April 30, 1962 as recorded. Motion carried.
Motion by Howard Heck and seconded by Carl Carlson to approve the
minutes of the Council meeting of May 14, 1962 as recorded. Motion carried.
Motion by Henry Dorff and seconded by John Leary to approve the
corrected minutes of the Special Council meeting of May 7, 1962 and order the
corrected copy filed in the official minute book with the original approved
minutes. Motion carried.
The Mayor announced that the meeting was open for the consideration
of proposed Water -Main Improvement 1962 -19.

The Clerk produced an affidavit of publication of Notice of Hearing on
the proposed improvement showing two weeks' publication thereof in the
official newspaper, 1962 the last publication being on May 24, , which

affidavit was examined and found satisfactory and ordered p laced on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of
said improvement, member Carl Carlson introduced the following resolution
and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN
IMPROVEMENT NO. 1962 -19 AND ORDERING PREPARATION
OF PLANS AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. It is hereby determined that it is necessary and for the
best interests of the Village and the owners of property
specially benefited thereby, that the following improvement
shall be constructed:
Water Main, Services, and Appurtenances on Willow Lane
from 65th Avenue North to a point approximately 1000
feet South of 65th Avenue North
2. The plans and specifications for said improvement shall
be prepared by the Village Engineer
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, John Leary, Howard Heck, Henry
Dorff and Carl Carlson, and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.

Member Carl Carlson introducted the following ordinance and
moved its adoption:
AN ORDINANCE AMENDING SECTION 23 -803 OF THE VILLAGE
ORDINANCES
THE VILLAGE. COUNCIL OF THE VILLAGE OF BROOKLYN CENTER
TO ORDAIN:
Section 1: Section 23 -803 of the Village Ordinances is hereby
amended by deleting the following sentence:
No person licensed hereunder shall carry on the vending operations
except between the hours of 1 :00 P. M. to 4 :30 P. M. and 6 :30 P. M.
to 9:30 P. M.
And substituting for the previous sentence the following:
No person licensed hereunder shall carry on the vending operations
except between the hours of 1 :00 P. M. to 5 :00 P. M. and 6:30 P. M.
to 9 :30 P. M.
Section 2 : This Ordinance shall be effective from and after
its publication.
Passed by the Village Council by the Village of Brooklyn Center this
28th day of May, 1962.

The motion for the adoption for the foregoing Ordinance was duly seconded
by member John Leary; and upon vote being taken thereon, the following
voted in favor thereof: Gordon Erickson, John Leary, Henry Dorff, Carl
Carlson and Howard Heck and the following voted against the same: None;
whereupon said ordinance was declared duly passed and adopted.
Motion by Howard Heck and seconded by John Leary to employ Thomas
Schany at a salary of $560.00 per month as Field Engineer in the Engineering
Department. Motion carried.
Motion by John Leary and seconded by Howard Heck to accept the
recommendation of the Village Administrator and increase the salary of Leona
Fignar to $310.00 per month and the salary of Mary Rosenau to $2.21 per hour.
Motion carried.
Member Howard Heck introduced the following resolution and moved
its adoption:
A RESOLUTION CORRECTING COST FIGURES OF CERTAIN
IMPROVEMENTS
WHEREAS, on April 2, 1962 , the Village Council adopted a resolution
determing the total cost of certain improvements and authorizing the issuance
and sale of $595,'000 Improvement Bonds; and

WHEREAS, the figures contained in said resolution as representing the
total cost of the various improvements were incorrect;
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, That notwithstanding any previous
resolution or action by the Village Council, it is hereby determined that the
total cost of each improvement is as follows:

upon said resolution was duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING WORK
(CONTRACTED BY VILLAGE)
WHEREAS, pursuant to a written contract signed with the Village of
Brooklyn Center, Minnesota, Farr Plumbing Co. has satisfactorily completed
the following improvement in accordance with said contract:
Water Main Project No. 1962 -4 and
WHEREAS, the Village Engineer recommends the acceptance of the
work.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved.
2. The value of work performed is less than the original
contract amount by $377.00 because of overestimating the
quantities on the proposal form. The total amount of said
improvement being $2,874.75
The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and upon vote being taken thereon the following
voted in favor thereof: Gordon Erickson Henry Dorff, Carl Carlson John
Leary and Howard Heck, and the following voted against the same: None;
whereupon said resolution was duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED STORM SEWER IMPROVEMENT NO. 1962 -20
WHEREAS, it is proposed that there be constructed an improvement
consisting of:
Storm Sewer Laterals to serve the area described as follows:

Beginning at a point 660 feet south of the centerline of 69th
Avenue North and 330 feet west of the centerline of Humboldt
Avenue North, thence easterly to a point midway between
Fremont Avenue North and Emerson Avenue North extended,
thence southerly to a point 970 feet south of the centerline
of 69th Avenue North, thence easterly to a point midway
between Dupont and Emerson Avenues North extended, thence
northerly to a point 660 feet south of the centerline of 69th
Avenue North, thence easterly to a point midway between
Colfax and Dupont Avenues North extended, thence northerly
to a point approximately 370 feet south of the centerline of
69th Avenue North extended, thence easterly to a point midway
between Bryant and Colfax Avenues extended, thence southerly
to the north line of Frank Burch's 4th Addition, thence westerly
along the North line of said Addition to a point midway between
Colfax and Dupont Avenue North, thence northerly to a point
330 feet south of 65th Avenue North, thence westerly to a .
point 330 feet west of the centerline of Humboldt Avenue North,
thence north to the point of begining
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
constructed at an estimated cost of $67,140.00,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on Monday, the 25th day of June 1962, at
8 :00 o'clock P. M. and the Clerk shall publish notice of the time and
place of hearing by two weeks' publication in the official newspaper
of the Village.
3. The area proposed to be assessed for said improvement is as
follows:
All lots and parcels within the above described area
4. This proposed improvement shall be designated Storm Sewer
Improvement No. 1962 -20
The motion for the adoption of the foregoing resolution was duly seconded by
member Henry Dorff, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, Carl Carlson, John Leary, Henry Dorff
and Howard Heck, and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Howard Heck and seconded by John Leary to accept the
Justice Report for the month of April. Motion carried.

attached to these minutes and made a part thereof. Motion carried.
Motion by John Leary and seconded by Howard Heck to authorize the
payment of up to $350.00 to Community Planning and Design Associates for
the making of certain changes in the final report of the Urban Community
Development Plan, as requested by the University of Minnesota. Motion
carried.
Motion by Howard Heck and seconded, by Henry Dorff to disallow the
claim of E. J. Jackman at 4717 Azelia Avenue North regarding the damage
to a wire fence located on the boulevard of the street, said damage being
caused by the Village snow plow. Motion carried.
Motion by Henry Dorff and seconded by Carl Carlson to adjourn.
Motion carried. The meeting was adjourned at 12:20 A. M.
