Council of the Village of Bsooklyn Center

August 13, 1962
The Village Council met in Regular Session and was called to order
by Mayor Gordon Erickson at 7 :35 P. M.
Roll Call: Mayor Gordon Erickson, John Leary, Howard Heck and
Carl Carlson were present. Clerk Henry Dorff was absent. In the absence
Of Clerk Henry Dorff, A. J. Lee, Administrate recorded the minutes.
Motion by John Leary and seconded by Carl Carlson to approve the
minutes of the special council meeting of August 6th as recorded. Motion
carried.
Motion by Carl Carlson and seconded by John Leary to approve the
minutes of the regular meeting of July 23rd as corrected and the minutes of
the special meeting of July 30th as recorded. Motion carried.
Motion by Carl Carlson and seconded by John Leary to approve the
Proposed subdivision of lots 30 and 31 of Goulds Riverview Addition as
submitted by Gerald C. Beffa. Motion carried.
Motion by John Leary and seconded by Howard Heck to uphold the
recommendation of the Planning Commission in and deny application 62039
for a Special Use Permit to construct a 76 bed nursing home on property lying
North of Seth Avenue .and just West of June Avenue. Motion carried.
Motion by Howard Heck and seconded by John Leary to uphold the
action of the Planning Commission and deny application 62038 for a
Special Use Permit to construct a 76 bed nursing home as submitted by
George E. Hansom Motion carried.
Motion by Carl Carlson and seconded by Howard Heck to uphold the
action of the Planning Commission and approve application 62037 for a
Special Use Permit for a temporary sales office for Homedale Builders.
Motion. carried,
Motion by John Leary and seconded by Carl Carlson to uphold the
action of the Planning Commission and approve application 62034 for a
variance of 1000 square feet of lot area to permit the construction of a 7 unit
apartment building on portions of lots 24 and 25 in Garcelon Addition.
Motion carried.
Motion by Howard Heck to approve application 62036 to construct
a single family home on tract " A " R. L. S. #235 with the following variances.
A variance on the lot area requirement , a variance not requiring public street
access and Permitting a 20 foot set back. This motion lost for a lack of a
second.
Motion by John Leary and seconded by Carl Carlson to deny application
62036. Motion carried.
Member introduced the following ordinance and moved its
adoption:
AN ORDINANCE AMENDING CHAPTER 35 OF THE VILLAGE

Quarter (N. E. 1/4) of Section thirty -five (35), Township one hundred
nineteen (119) Range twenty -one (21) West in Hennepin County, Minnesota
described as follows, commencing at the point of intersection of the South `
right -of -spray line of 69th Avenue North and the West right-of -way line of
Humboldt Avenue} North; thence South one hundred ninety -five (195) feet

The motion for the adoption of the foregoing ordinance was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted
In favor thereof: Gordon Erickson, Carl Carlson, Howard Heck and John
Leary and the following voted against the same: None; whereupon said
,ordinance was declared duly passed and adopted.
Motion by John Leary and seconded by Carl Cerlb t to uphold the actior
of the Planning Commission and approve application 61244 for a Special Use
Permit to construct a service station and 2 apartment buildings on the
following cond itions;
1. A Certificate of Occupancy to operate the service station shall
not be issued until the apartments are at least 25`K completed.
2. The area shall be platted.
3. All construction shall conform to the plans placed on file August
9, 1962.
4. No building permits shall be issued until arrangement is made
to provide sanitary sewer
Motion carried.
Motion by john Leary and seconded by Carl Car 1 Carlson to uphold
the WKMmendation of the Planning Commission and approve application
62034 the approval of plans to construct three 18 unit apartment buildings
on Lot 2, Block 10 Northeate Addition submitted by Nordstrom -Odell on the
condition that no building permits be issued until the surface drainage
plan is approved and that the builder comply with the provisions for screening
*a submitted on the previous plan by Pearson Bros. Motion carried.
Motion by Carl Carlson and seconded by Howard Heck that t
request for the return of $2500.00 escrow money deposited by Burch and
,Anse for anticipated storm sewer on the Burch and Wise Park Addition be
denied because the storm sewer will be required in the future. Motion
carried.

Member Carl Carlson introduced the following resolution and
moved its adoption:
RESOLUTION PROVIDING FOR PUBLIC HEARING ON
PROPOSED STREET SURFACING IMPROVEMENT NO.
1962-
WHEREAS, it is proposed that there be constructed an improvement
consisting of the following:
Street surfacing on 53rd Avenue North from France Avenue
to T. H. 152
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can be
structed at an estimated cost of $6,861.56,
NOW THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on Monday,, the 27th day of August, 1962,
at 8 :00 0' clock P. M. , and the Clerk shall publish notice of the time
and place of hearing by two weeks' publication in the official newspaper
of the Village.
3. The area proposed to be assessed for said improvement is as
follows:
ALL LOTS AND PARCELS ABUTTING THE ABOVE NAMED STREET
4. This proposed improvement shall be designated Street Surfacing
Improvement No. 1962 -14.

by member John Leary, and upon vote being taken thereon the following voted
in favor thereof: Gordon Erickson, John Leary, Carl Carlson and Howard
Heck, and the following voted against the same: None; whereupon said

reported that on August 8, 1962, at 10 A. M. , they opened and tabulated
bids received for Storm Sewer Project No. 1962 -24 and Water Main Project
Nos. 1962 -25 and 1962 -26, and that said bids were as follows:

connection with Storm Sewer Project No 1962• -24 and Water Main Project
Nos. 1962 -25 and 1962 -26, according to the plans and specifications
therefore now on file in the office of the Village Clerk is deemed to be the
lowest, and best bid submitted for said work by a responsible bidder, and
said bid is hereby accepted. _

call for bids for 500 water meters more or less. Motion carried.

adoption:

72nd Avenue North from Lyndale Avenue to Riverdale Road
South one -half of 73rd Avenue North from Lyndale Avenue
I` to Willow Lane
Dallas Road from 70th Avenue to 73rd Avenue
Riverdale Road from Dallas Road to 73rd Avenue
Willow Lane from 70th Avenue to 73rd Avenue
WHEREAS, the Village Engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed at
an estimated cost of $46,117.00.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of
the Village of Brooklyn Center, Minnesota as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday, the 27th day of August,

Member Howard Heck introduced the following resolution and moved

FOR: GRADING AND STREET SURFACING IMPROVEMENT
NO. 196231 AND DIUCTIKQ ADVE=EhZNT FOR OWS
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following improvement,
prepared by the Village Engineer, are hereby approved and ordered filed with

2. The Clerk shall advertise for bids for such improvemerA by
publication at least once in the official newspaper and in the Construction
Bulletin, the date of first publication not less than ten (10) days prior to
the date for receipt of bids 4 Said notice shall state that no bids will be
considered unless sealed and filed and accompanied by a cash deposit,
bid bond, cashier's check or certified check payable to the Clerk in
the amount of not less than five percent of the bid.
3. Bid date is set for August 27, 1962 at 10:00 o' clock A. M.
4. The Village Administrator and ;Village Engineer shall be
authorized to open and tabulate the bids.

by member John Leary, and upon vote being taken thereon the following votes

resolution was declared duly passed and adopted.
Motion by John Leary and seconded by Carl Carlson to authorize the
Mayor and the Clerk to execute an easement to Northern States Power
r Company for the construction of a pole line over the south 10 feet of the
following described property:
The south 135 feet of the north 755 feet of lots 34 and 35 of
subdivision 216. According to the map or plat thereof on file
In the record of the office of the register of deeds in the foresaid
Hennepin county, Minnesota. Motion carried.
Motion by Howard Heck and seconded by Carl Carlson to authorize
the Village Engineer to negotiate prices for the surfacing of Dupont Avenue
F from 69th Avenue to 71st Avenue. Such prices to be submitted to the Village
f Council for their approval. Motion carried.

Motion by Howard Heck and seconded by Carl Carlson to authorize the i
Mayor and the Clerk to execute the agreement with Homedale Builders Inc.
relative to the extending the water mains and the construction storm sewer
lateral's into the area known as Northland Estates Addition. Motion carried.

VILLAGE PARK PROPERTY, DESCRIBED AS THE S 660
FEET OF LOT 36, AUD. SUB. #309, PLAT 89104 PARCEL

WHEREAS, the Village Council of the Village of Brooklyn Center has
established the policy of accounting for payment of Special Assessments -on
Village property through the Village Finance Office; and
WHEREAS,. the above listed property was acquire, through condemnation
proceedings initiated in 1959; and
WHEREAS, the Village is obligated for the share of special assessments
applicable to Park property from the initial date of the legal proceedings,
BE IT RESOLVED, by the Village Council of the Village of Brooklyn
Center to cancel from the Hennepin County Tax Rolls the special assessments
f , for Storm Sewer and Sanitary Sewer improvements, together with all interest
and penalties on the aforementioned property,
THEREFORE, the County Auditor. is authorized and directed to cancel
