August 27, 1962 The Village Council met in Regular Session and was called to order by Mayor Gordon Erickson at 7 :40 p.m. Roll Call: Mayor Gordon Erickson, John Leary, Bogard Heck, Carl Carlson and Henry Dorf' were present. Motion by Carl Carlson and seconded by Howard Heck to approve the Minutes of August 20, 1962, as recorded. Motion carried. Member Henry Dorff introduced the following resolution: and moved its adoption: RESOLUTION ACCEPTING BID AND INSTRUCTING ATTORNEY TO PREPARE CONTRACT FORM W:iEREAS, the Village Administrator and the Village Engineer have reported that on August 27, 1962 at 10 :00 a.m., they opened and tabulated bids received for the furnishing of Rock Salt, and that said bids were as follows International Salt Company $14.40 per ton Cutler - Magner Company $15.40 per ton Cargill, Incorporated $15.40 per ton NCW, THFREF , BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the bid of International Salt Company for the furnishing of Rock Salt at a price of $14.40 per ton is deemed to be the best bid for the furnishing of Rock Salt and said bid is hereby accepted and that the Village Attorney shall prepare a contract that provides that the bid price shall be the maximum unit price for the furnishing of Rock Salt and that salt shall be delivered to the Village of Brooklyn Center at the prevailing price if the prevailing price at the time of ordering salt is lower than the bid price. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Caryoon and open vote being taken thereon, the following voted in favor thereof Gordon Erickson, Carl Carlson, John Leary, Howard Heck and Henry Dorff;and the following voted against the same, none; whereupon, . said resolution was declared duly passed and adopted. I The Mayor announced that the meeting was open for the consideration of proposed Grading and Street Surfacing Improvement No. 1962 -31. The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement shaving two weeks' publication thereof in the official newspaper, the last publication being on Augus 2 3, 1 962 s which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present against the proposed Improvement. After hearing and arguments either for or ago r pop �P considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION AIM CONSTRUCTION OF GRADn;G AND STREET SURFACIM IMPROVEMIEN].' N0. 1962 -31 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIOW. BE IT RESOLVED by the Villages Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby, that the following improvement shall be constructed: Grading and Street Surfacing Improvement No. 1962 -31 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Carl Carlson, Henry Dorff, John Leary, and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Street Surfacing D*rovement No. 1962 -14. The Clerk produced an affidavit of publication of Notice of Hearin on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on August 23, 1962, which affidavit was examined and found satisfactory and ordered p laced on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF STREET BURFAcING IMPROVE.' N0. 1962 -14 AND ORDERIM PREPARATION OF PLAN AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefited thereby, that the following improvement shall be constructed Street Surfacing on 53rd Avenue North from France Avenue North to T. H. 152 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. _2- 159 The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof. Gordon Erickson, Carl Carlson, Henry Dorff, Howard Heck, and John Leary; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Howard Heck and seconded by John Leary to award a contract to C. S. McCrossan, Inc. in the amount of $7,747.44 as to the furnishing of all work, labor and material in connection with the street surfacing project No. 1962 -11 and 1962 -14 in accordance with their bid received on July 16, and reported to the Village Council on July 23. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to authorize the Village Administrator to increase the number of hours of patrolling by the dog catcher, as needed, in order to effect the best control,of dogs in the Village of Brooklyn Center. Motion carried. Motion by John Leary and seconded by Henry Dorff to accept the award of $1100 by the Minnesota Department of Highways for the taking of right -of -way in front of the Village Hall, for the improvement of Osseo Road and authorize the Mayor and Clerk to execute an option for sale to the Minnesota Department of Highways. Motion carried. Member Howard Heck introduced the following resolution and moved its adoption: A RESOLUTION AUTHORIZING AND DIRECT33G EXECUTION OF DEED WMMM AS,, the Village of Brooklyn Center holds title to certain property near the intersection of Bryant Avenue and 72nd Avenue North; and WHEREAS, said property is no longer needed for a public purpose; and WHEREAS, the Village Council and the Park Board have agreed to convey said property to Homedale Builders, Inc. in exchange for a parcel of land of equal value; NOW, THEREFORE, BE IT RESOLVED, by the Village Council of the Village of Brooklyn Center, that the Mayor and the Clerk are authorized and directed to execute a Warranty Deed conveying to Homedale Builders, Inc. the following described property: That part of Lot 37 Auditor =s Subdivision No. 309 Hennepin County, Minnesota described as beginning at a point on the East line of said Lot 37 distant 660 feet North of the Southeast corner of said lot; thence South 1 12' -05" East (said bearing is assumed) along said East line for a distance of 137.91 feet to a point on a curve convex to the Northwest and having a:xadius of 681.41 feet, a tangent of said curve at last ,described point has a bearing of S60 27 -29" W; thence Southwesterly along the last described curve for a distance of 22.13 feet, thihi a South 58 35' -43" West along a line tangent to the last.deseribed curve for a distance of 97.16 Feet; thence "Southweste'rly along.,a, tangential curve to the left with a radius of- :1415.54 'feet for a distance of 72.46 Feet more or less to intereection` with the West line of the East 165.0 ` feet . of said Lot . 37 : es measured along the North and South lines of said Lot 37,• thence 'Nort along said West line to its intersection with `a line; which, is parallel with the South line of said 'lot ` and drawn through the point of beginning; thence East along the last described' line a distance of 165.0 feet to the point of beginning.. The motion for the adoption of the foregoing resolution was duly seconded by member John Leary, and upon vote being taker, thereon, the following voted in favor thereof: Gordon Erickson, Carl Carlson, John, Leary, Howard Heck, and Henry Dorff; and the following voted against the same:` None;`whereupon_said resolution was declared duly passed and adopted. Member John Leary introduced the following ordinance and moved its adoption: AN ORDINANCE TO PROMOTE AND COESERVE THE PUBLIC SAFETY ON PRIVATE ROADS AND DRTVE11AYS AND PARKIIM LOTS WITHIN T$E VIUAGE The Village Council of the Village of Brooklyn Center, Minnesota, ordains: Section I. Chapter 27 of the Ordinances of the Village of Brooklyn Center is hereby by adding thereto a new Section to read as follows: "Section 27 -102. Application to Private Pr rt . All provisions of this ordinance app icab a to pedestrians or the drivers of vehicles or bicycles upon the streets, highways or sidewalks of the Village shall apply except where clearly inapplicable, to pedestrians and the drivers of vehicles and bicycles on private roads and driveways of the Village including off- the- street parking areas in or adjacent to shopping centers parking lots and other commercial developments. The Village Council may from time to time establish the maximum speeds at which vehicles and bicycles may be driven in such off - the - street parking areas. Such speed limits may vary from parking area to parking area and shall be based on the requirements of safety in the parking areas affected. Each such speed limit shall be established in writing, filed with the Village Clerk and shall become effective as an absolute speed limit on being sign-posted at each entrance to the parking area affected thereby and no personal shall drive a vehicle or bicycle on such parking area at a speed in excess thereof." Section 2. Section 27 -102 of the Ordinances of the Village of Brooklyn Center is ereby re- numbered Section 27 -103 - Section 3. This ordinance shall be in full force and effect from and after is publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Carl Carlson and upon vote being taken thereon, the following voted in favor thereof: Gordon Erickson, Carl Carlson, John Leary, Howard Heck, and Henry Dorff and the following voted against the same.. None; whereupon said ordinance was declared duly passed and adopted. Motion by Henry Dorff and seconded by Howard Heck to authorize the Mayor and Clerk to execute an agreement with Moen & Penttila for the conduct of the annual audit of Village accounts for the year 1962. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to authorize the Village Administrator to purchase equipment for the application of scotch light to traffic signs. Motion carried. Motion by Howard Heck and seconded by John Leary to authorize the transfer of $200 escrow money posted by Moretini Construction Company for certain clean up Mork on project No. 1960 -1c and said money to be a transfer to the General fund. Motion carried. Motion by John Leary and seconded by Carl Carlson to approve the following licenses: 165 Electrical License A. A. Electric Company 5025 France Ave. So. St. Louis Park Electric Co. 6+13 Goodrich Ave., Mills. Plumbers License Nils Nygards 7318 Taylor St. N.E. Motion carried. The bills having been audited, motion was made by Henry Dorff and seconded by Carl Carlson to order paid the bills set forth in the schedule attached to these minutes and made a part thereof. Motion carried. Motion by Howard Heck and seconded by John Leary to adjourn. Motion carried.
