HomeMy WebLinkAbout1961 10-02 CCM Special Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota October 2, 1961 The Village Council met in Special session and was called, to order by Mayor William Super at 7:45 P. M. Roll Call; Mayor William Super, Carl Carlson, Clifford Vellman, Henry Dorff and $award: Heck 'were . prresent. The Mayor announced that the meting was open for consideration of objections to any of the assessments for the following improvements: Sanitary Laterals No. 1961 -6, 1 -13, 1964-32, 1960 -49, 1960 -64, 1960 -66, 1961-1, 1961 -2, 1961-3, 1961 -7, 1961 -8, 1961 -9, 1961 -10, 1961 -11, 1961 -12, 1961 -13, 1961 -15, 1961 -16, 19961-17, 1961 -18, 1961 -21, 1961 -23, 1961 -28, 1961 -35, and Sanitary Sewer Interceptor and Lift Station No. 1960 -66, and Storm Sewer No. 196144, and Water Improvement Nos. 1960 -63, 1961 -5, 1961 -14, 161 -22, 1961 -29, 1961.39 and Public Utilities Water Nos. 1960 -S3, 196o -67, anal Street Surfacing Nos. 196o -58, 1961 -34, and Street Improvement No. 1960 -56, and Sewer Connections and Water Hookups, The Clerk produced affidavits of publication of Notice of Hearing on the assessments showing two weeks' publication thereof in the official newspaper, the Publications being on September 7 and September 14, 1961, which affidavits were examined and found satisfactory and ordered placed on file. The Clerk produced an affidavit of mailing notices: of the special assessment bearings to the benefitted property owners and affidavit of diligent search on those properties to be assessed for which no mailing addresses could be disclosed, which affidavits were examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present their objections to the above assessments. After all persons desiring to speak thereon had been heard, it was determined to close the hearing on certain assessments. as indicated in the following motions: Motion by Howard Heck and seconded by Carl Carlson to close the F hearing on the special assessments for Sanitary Lateral Project No. 1960 -13 in the amount of $387.97 per building site. Motion carried. I II Motion by Carl Carlson and seconded by Clifford Wellman to t close the hearing on the special assessments for Sanitary'Lateral Project No. 1961 -1 in the amount of $262.93 per building site. Nation curried. 4 Motion by Clifford Wellman and seconded by Henry Dorff to Close the hearing On the special assessments for Sanitary Lateral Project No. 1961 -2 in the amount of $285.63 per building site. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to close the bearing on the special assessments for Sanitary Lateral Project 4 No. 1961 -7 in the amount of $472.41 per building site. Notion carried. Motion by Howard Heck and seconded by Clifford Wellman to close the hearing on the special assessments for Sanitary Lateral Project k No. 1961 -8 in the amount of $246.12 per building site. Motion carried. -1- Motion by Carl Carlson and seconded by Henry Dorff to close the hearing on the special assessments for Sanitary Lateral Project No. 1961 -9 in the mount of $276.71 per building site. Motion carried. Motion by Clifford Wellman and seconded by Howard Heck to close the bearing on the special assessments for unitary Lateral Project No. 1961 -10 in the amount of $246.41 per building site. Motion carried. Motion by Henry Dorff and seconded by Carl Carlson to close the bearing on the special assessments for Sanitary Lateral Project No. 1961 -11 in the amount of $238.93 per building site. Motion carried. Motion by Howard Heck and seconded by Carl Carlson to close the hearing on the special assessments for Sanitary Lateral. Project No. 1961.12 in the amount of $262.73 per building site. Motion carried. Motion by Henry Dorff and seconded by Howard Heck to close the hearing on the special assessments for Sanitary Lateral Project No. 1961 -13 in the amount of $299.88 per building site. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to close the hearing on the special, assessments for Sanitary Lateral Project No. 1961 -16 in the amount of $533.00 per building site. Motion carried. Motion by Clifford Wellman and seconded by Henry Dorff to close the bearing on the special assessments for Sanitary Lateral Project No. 1961 -17 in the amount of $264.29 per building site. Motion carried. Motion by Henry Dorff and seconded by Clifford Wellman to close the heari on the special assessments for Sanitary Lateral Layrovement No. 1961-19 in the amount of $286.29 per building site. Motion carried. Motion by Howard Beck and seconded by Clifford Wellman to close the hearing on the special assessments for Water Improvement Project No. 1961 -14 in the amount of $380.00 per building site plus cost of service on Humboldt Avenue from 65th to 69th; and $490.00 per building site on Girard Avenue from 65th Avenue to the Freeway. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to close the °hearing on the special assessments for Water Improvement No. 1961 -29 in the amount of $490 per building site on the east side of Halifax Avenue from 70th to 71st; and $380 on the west side of Halifax Avenue from 70th to 71st. Motion carried. f Motion by Clifford Wellman and seconded by Howard Heck to close the hearing on the special assessments for Sanitary Lateral Project No. 1961 -28 in the amount of $212.74 per building site. Motion Carried. Motion by Henry Dorff and seconded by Carl Carlson to close the hearing on the special assessments for Sanitary Lateral No. 1960 -64 in the amount of $466.93 per building site. Motion carried. Motion by Howard Heck and seconded by Clifford Wellman to close the hearing on the special assessments for Sanitary Lateral Project No. 1961 -3 in the amount of $232.90 per building site. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to close the hearings on the special assessments for Sanitary Lateral Project No. 1961 -15 in the amount of $391.66 per building site. Motion carried. Motion by Clifford Wellman and seconded by Henry Dorff to close the hearing on the special assessments for Sanitary Lateral Project No. 1961 -21 in the amount of $326.97 per building site. Motion carried. _ 2 Motion by Carl Carlson and seconded by Howard Heck to close the hearing on the special assessments for Sanitary Interceptor Project No. 1960 -66 in the amount of $669.06 per acre cr $2.07 per one hundred square feet where applicable; and For Sanitary Laterals as follows: Residential area, $514.97 per building site; 48th Avenue east of France, $5.93 per front foot; 47th Avenue east of France, $1104.22 per lot with the exception of two lots which shall be assessed $1077.42 per lot; France Avenue north of the Soo Line Railroad tracks, $365.73 per building; site with the exception of one site which shall be assessed $300.13. Motion carried. Motion by Clifford Wellman and seconded by Henry Dorff to close the hearing on the special assessments for Sanitary Lateral Project No. 1960 -32 in the amount of $648.06 per building site. Motion carried. Motion by Howard Heck and seconded by Clifford Wellman to close the hearing on the special assessments for Street Surfacing Project No. 1960 -56 in the amount of $1.358 per front foot. Motion carried. Motion by Henry Horff and seconded: by Howard Heck to close the hearing on the special assessments for sewer connections to the East Side interceptor in the amount of $392.50 per building site; and to the West Side interceptor in the amount of $374.90 per building site. Motion carried. After all persons desiring to speak thereon had been heard, member Carl Carlson, introduced the following resolution and moved its adoption: RESOLUTION CONFIRMING ASSESSNMM FOR SANITARY LAT9RALS NOS. 1961 -6, 1960 -13, 1960 -32, 1960 -49, 1960 -64, 1960 -66, 1961 -1, 1961 -2 1961 -3, 1961 -7, 1961 -8, 1961 -9, 1961 -10, 1961 -11, 1961 -12, 1961 -13, 1961 -15, 1961 -16, 1961 -17, 1961 -18, 1961 -21, 1961 -23, 1961 -28, 1961 -35, AND SANITARY SEWER INTERCEPTOR AID LIFT STATION N0. 1960 -66, AND STORM SEWER. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: _ 3 _ G 1. The Village Clerk has, with the assistance of the Engineer heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the improvements known as the improvements listed above of said Village against every assessable lot, piece or parcel of land in accordance with the provisions of law, and has prepared and filed with the Village Clerk tabulated statements in .duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as eequired by law that this Council would meet in regular session on Monday, September 25, 1961 and in special session on Monday, October 2, 1961, to pass on the proposed assessments. 3. Said proposed assessments have at all times been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessments, or to any item thereof. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments was and is specially benefitted by said improvements in the amount of said proposed assessment set opposite the description of each such lot, piece, or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pienes or parcels of land therein described. 5. Such proposed assessments are adopted and confirmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special assessments for each of said lot, pieces or parcels of land respectively. 6. Said assessmento as adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereon be and constitute the special assessments for the gayment of the above listed improvements. 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 6% per annum. 8. Such assessments shall be payable in equal installments beginning.in the year 1962, payable on the lst day of January in each year and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor, as follows: A. Sanitary Sewer Laterals Nos. 1961 -6, 1960 -13, 1964 -32, 1960 -49, 1960 -64, 196o -66, 1961 -1, 1961-2 1961 -3, 1961 -7, 1961 -8, 1961 -9, 1961 -10, 1961 -11, 1961 -1.2, 1961 -13, 1961 -15, 1961 -16, 1961 -17, 1961 -18, 1961 -21, 1961 -23, 1961 -28, 1961 -35, in twenty equal annual installments. B. Sanitary Sewer Interceptor and Lift Station No. 1960 -66, in twenty equal annual installments. C. Storm Sewer No. 1961 -24, in twenty equal annual installments. D. Water Improvements Nos. 1960 -63, 1961 -5, 1961 -14, 1961 -22, 1961 -29, and Public Utilities Water Nos. 1960 -53, 1960 -67, in twenty equal annual installments. E. Water Improvement No. 1.961 -39, in fifteen equal annual installments. F. Street Surfacing Nos. 1960 -58, 1961 -34, in three equal annual installments. G. Street Improvement No. 1960 -56, in five equal annual installments. -4- o H. Sever Connections and Water Hookups, in twenty equal annual installments. I. One Water Hookup - Lot 8, Block 4, Soderholm Addition, in fifteen equal annual installments. 9. The Village Clerk is hereby directed to make up and file in the Office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the lst day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by Member Howard Heck and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.
