HomeMy WebLinkAbout1961 10-09 CCM Regular Session R Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota October 9, 1961 The Village Council met in Regular Session and was called to order by Mayor William Super at 7:35 P.M. Roll Call: Carl Carlso.., Henry Dorff, Howard Heck and Mayor William Super were present. Trustee Clifford Wellman was absent. Motion by Howard Heck and seconded by Carl Carlson to approve the Minutes of the Regular meeting of September 25, 1961, as recorded. Motion carried. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZIM PURCHASE OF PROPERTY WHEREAS, the Village of Brooklyn Center has found it necessary to acquire lands for street and utility purposes described as, 1. Street Purposes - The east 33.0 feet of Lot 41, Auditors Subdivision 309, Hennepin County, Minnesota; 2. construction and Maintenance of Underground Utilities The south 60 feet of the north 363 feet of Lots 41 and 42 Auditors Subdivision 309, Hennepin County, Minnesota, except the east 33 feet thereof; 3. Construction and Maintenance of Storm Sewer - The north 10 feet of the south 21 feet of Lots 41 and 42 Auditors Subdivision 309 Hennepin County, Minnesota as measured along the east and west lines thereof, except the east 33 feet thereof; 4. Construction Purposes - The north 5 feet of the south 26 feet of the north 10 feet of the south 11 feet of Lots 41 and 42 Auditors Subdivision 309, Hennepin County, Minnesota, as measured along the east and west lines thereof except the east 33 feet thereof; owned by Margaret T. and Lester R. Carlson, and WHEREAS, owners Margaret I. and Lester R. Carlson have offered to convey said lands to the Village of Brooklyn Center for the consideration of $400.00 plus the moving of a garage now located on Lot 41 to a new location on Lot 41, complete with a concrete slab. Said consideration to be in lieu of the Village of Brooklyn Center proceeding with condemnation proceedings, NOW, THEREDORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center to authorize payment of $400.00 to Margaret I. and Lester R. Carlson for purchase of the above described lands and to further authorize the Village Engineer to arrange for the moving of the Carlson garage for a sum not to exceed $325.00. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof"-. Carl Carlson, Henry Dorff, Howard Heck, and William Super, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. - 1 - Member Carl Carlson introduced the following resolution and moved its adoption: RESO LUTION DIsma CONDEMNATION PROCEEDINGS WHEREAS, the Village of Brooklyn Center has initiated condemnation proceedings, August 7, 1961, to acquire land for street and utility purposes described as 1. Street Purposes - T.'ia east 33.0 feet of Lot 41 Auditors Subdivision 309, Ha=cpin County, Minnesota; 2. Construction and Maintenance of Underground Utilities - The south 60 feet of the north 363 feet of Lots 41 and 42 Auditors Subdivision 309, Hennepin County, Minnesota, except the east 33 feet thereof; ' 3. Carlson and the Village a of Brooklyn Center have arrived at a settlement involving the consideration of $400.00 and the moving of the Carlson garage. Said consideration being within the range of Village appraisals, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center to direct the Village Attorney to dismiss condemnation proceedings against the above described property. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl. Carlson, Henry Dorff, Howard Heck and William Super, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION REGARDING TRAFFIC INTERCHANGE AT F. A. I. 94 AND XERXES AVENUE NORTH WHEREAS, the Minnesota Highway Department has proposed a traffic interchange on F.A.I. 94 in the general vicinity of Xerxes Avenue North in the Village of Brooklyn Center, and WHEREAS, the Village technical advisors and the Village Planning Commission have made a study regarding the precise location of said interchange so as to best serve the future interests of the Village of Brooklyn Center, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: -2- The Village hereby requests that the Minnesota Highway Department locate the traffic interchange such that the centerline of the grade separation structure and F. A. I. 94 will at approximate right angles at a point apps -o ,A: i :rely 400 feet east of the east line of Section 34, !ownsb t 119, Range 21. Member Carl Carlson introduced the following ordinance and moved its adoption AN ORDINANCE AMMING SECTION 35 -743 OF THE VI LLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER ORDAINS AS FOLLOWS: Section 1. Section 35 -743 of the Village ordinances is hereby amended by adding thereto the following: The northeasterly 50.75 feet of Tract A, R.L.S. 1020. Section 2. This ordinance shall take effect from and after its legal publication. I The motion for the adoption of the foregoing ordinance was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William Super and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Trustee Clifford Wellman arrived at the meeting at this point, 8:1.5 P.M. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION RELATING TO PARTICIPATION IN THE RURAL HENNEPIN COUNTY NURSING DISTRICT WHEREAS, pursuant to Minnesota Statutes, Sections 145.08 and 145.12 provision has been made for a public health nursing district in that portion of Hennepin County outside the City of Minneapolis, and WHEREAS, pursuant to such authority such a public health nursing district has been organized and has been in operation for several years, and WHEREAS, it is deemed necessary to continue the operation of such nursing district and to provide it with adequa6e funds for its proper operation, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that this political subdivision continue to be included in the public health nursing district of rural Hennepin County, organized on January 4, 1952; that it participate in the benefits thereof; and that it agrees to support on an apportionment basis its pro rata share of the.cost of the administration of such district provided, however, that for the period January 1. 1962, through December 31, 1962, this cost shall not exceed $.25 per capita on the basis of the official 1960 Federal census. _3_ I BE IT FURTHER RESOLVED that this resolution shall be deemed an agreement to continue to participate in such nursing district on the basis bereinbefore specified with all other political subdivisions adopting similar resolutions. Member Hoi,-aL d Heck irr.( x ot!aced the fallowing resolution and moved its adoption: RESCLUTION CER`�'iFYIW COST OF CERTAIN SHtW 11 TO THE M WIN COUNTY TAX ROLLS WHEREAS, certain sewer facilities on certain properties constituted a health hazard and the hardship applications for installation of certain sewer connections have been approved, and WEEREAS, Village Ordinance 7_309, and State Statute 412.221, Section 31, authorize the certification of the cost of said sewer installatinns to the County Tax Rolls for collection as a special assessment, and WHEREAS, the Village Council has established the policy that the special assessment for sewer installation shall be spread over a period of five years, at 6% interest, with the first year bearing 15 months' interest. THEREFORE, BE IT RESOLVED by the Council of the Village of Brooklyn Center as follows: 1. The Village Clerk, with the assistance of the Village Administrator, selected by the Council for such purpose, has determined the proper amounts to be specially assessed and has prepared and filed with the Village Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same as follows: Legal Description Amount Lot 3, Block 3, Meadowlark Gardens $340.00 Lot 4, Block 1, Reidhead's Addition 289.00 Lot 1, Block 2, Grandview Manor 329• Lot 10, Block 4, Hipp's 4th Addition 200.00 Lot 5, Block 4, Pearson's Northport 3rd Addn. 276.00 Lot 24, Block 2, Twin Lake Woods 2nd Addn. 220.00 2. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments was and is specially benefitted by said improvements in the amount of said proposed assessment set opposite the description of each such lot, piece, or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described. 3. Such proposed assessments are adopted and confirmed and the sums fixed and named in said proposed assessments are adopted and confirmed as the proper special assessments for each of said lots, pieces or parcels of land respectively. 4. Said assessments as adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereon be and constitute the special assessments for the payment of the above listed improvements. I i -4_ i 5. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 6% per annum. 6. Such assessments shall be payable in five equal installments beginning in the year 1962, payable on the lst day of January in each year and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor. 7• The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County, a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the lst day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Howard Heck and seconded by Carl Carlson to approve the Justice Reports submitted by Raymond Benson and John Wingard for the month of August 1961. Motion carried. Motion by Henry Dorff and seconded by Clifford Wellman to release the street bond in the amount of $2000 to Winston Bros., on the recommendation of the Village'Engineer. Motion carried. RESOLUTION APPROVING 1962 BUDGET AND AUTHORIZING A LEVY THEREFOR BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. There is hereby appropriated for expenditures in 1962 from General Taxes the following sums for the purpose indicated: Village Operations and Administration $342,418.00 Poor Relief 20,000.00 Firemen's Relief Association 19,4$0.00 Public Employees Retirement Association 23,635.35 County Parks 4,385.00 The foregoing does not include levies already certified to the County Auditor for the payment of outstanding loans which levies for the year 2962 are as follows: Certificates of Indebtedness 21,500.40 (Bonds & Interest) State Loan 1,567.50 i Park Bond Redemption 36 500.00 1 $ 59,567-50 Total expenditures for the year 1962 from General Taxes $469,485.85. 2. There is hereby levied upon all taxable property lying within the Village of Brooklyn Center, in addition to all levies heretofore certified to the County Auditor as indicated in paragraph.l hereof, the sum of $469,485.85, and the Clerk shall cause a copy of this resolution to be certified to the County Auditor, so that said sum shall be spread upon the tax rolls and will be payable in the year 1962. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION TO CANCEL LEVY PREVIOUSLY CERTIFIED TO THE COUNTY AUDITOR WHEREAS, at a Special meeting of the Village Council of the Village of Brooklyn Center held on June 17, 1958, a resolution was duly adopted providing in part that the sum of $8,600.00 be levied in the year 1961 for payment of principal and interest on bonds issued to finance Water Improve - went No. 1957 -28, and WHEREAS, said resolution was thereafter duly certified to the Auditor of and for Hennepin County, Minnesota, and WHEREAS, there is presently on band in Imprevement No. 1958 -B Fund sufficient money to pay any and all principal and interest on said bonds issued to finance construction of Water Improvement No. 195728, and at least five per cent in excess thereof, without the levy of said $8,600.00 in the year 1961, _7_ BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows; 1. It is hereby determined that the levy of a direct ad valorem tax on all taxable property in the village previously made and certified in the amount of $8,600.00 for the year 1961 in connection with the financing of Water Improvement No. 1957 -28 is unnecessary and may be cancelled, there being sufficient money on hand in Improvement No. 1958 -B Fund at the present time to pay any and all principal and interest, and at least rive per cent in excess thereof, on said bonds issued to finance said Water Improve- ment No 1957 -28, without collection of said direct ad valorem tax. 2. The Auditor of Hennepin County, Minnesot4 is hereby requested to cancel the said levy of $8,600.00 for the year 1961 previously certified pursuant to the provisions of Section 475.61, Minnesota Statutes, 1957• I � 3• The Village Clerk is hereby authorized and directed to transmit a certified copy of this resolution to said Hennepin County Auditor forthwith. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford. Wellman and the following voted against the same: None; whereupon the said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption; RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STREET ImpROVEMFNT N0. 1961 -53 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of 4 inch gravel base and 2 inch bituminous surface on North Lilac Drive from 65th Avenue North to approx. 1000 feet Southwestward (plus or minus). WHEREAS, the,,Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $3, 177.98• NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted by chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday, the 23rd day of October 1961, at 8 ;00 P.M. O'clock, and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed is as follows; ALL PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAMED STREET WHERE THE PROJECT IS TO BE CONSTRUCTED. 4. This proposed improvement shall be designated Street Improvement Project No. 1961 -53. -8- 1 The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor Hereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The bills set forth on the schedule attached to these minutes and made a part hereof entitled, "The Bills Audited and Ordered Paid at the Meeting of October 9, 1961" were audited and ordered paid.
