Minutes of the Proceedings of the Village Council
of the Village of Brooklyn Center in the
County of q!= tw and State of Minnesota
November 13, 1961
The Village Council met in regular session and was called to order by
Mayor William Super at 7:40 p.m.
Roll Call: Mayor William Super, Clifford Wellman, Henry Dorff and
Howard Heck were present.
Motion by Howard Heck and seconded by Henry Dorff to approve the Minutes
of the meeting of October 9, 1961, as recorded. Motion carried.
Motion by Clifford Wellman and seconded by - Howard Heck to approve the
Minutes of the meeting of October 16, 1961, as recorded. Motion carried.
Motion by Howard Heck and seconded by Henry Dorff to approve the Minutes
of the meeting of October 23, 1961, as corrected to include the Roll Call.
Motion carried.
Trustee Carl Carlson arrived at the meeting, 7:55 p.m
Motion by Howard Heck and seconded by Henry Dorff to approve the Minutes
of the meeting of November 4, 1961, as recorded. Upon vote being taken thereon
Howard Heck, HOXWY DOrff and Clifford Wellman voted in favor thereof; Carl
Carlson and William Super abstained from voting.
Motion by Carl Carlson and seconded by Clifford Wellman to approve the
Minutes of the meeting of the Canvass Board of November 7, 1961, as corrected.
Motion carried.
The Mayor annouwaed that the meeting was open for the consideration of
proposed Street improvement.No. 1 9 6 1 -53•
The Clerk produced an affidavit of publication of notice of hearing on
the proposed improvement showing two weeks' publication thereof in the official
newspaper, the last publication being on October 19, 1961, which affidavit V " examined and found satisfactory and ordered placed,on file.
The Mayor then called upon all property owners present to present argumentE
,either for or against the proposed improvement. After hearing and considering
all objections, and the property owners appearing not to be in favor of said
impro'v'ement, member Carl Carlson introduced the following resolutions and moved
its adoption:
RESOLUTION DECLARING HEARING LWAVORABLE
FOR THE CONSTRUCTION OF STREET wROVEMENT
No. 1961 -53
WHEREAS, the majority of the property owners present, who are to be
assessed for Street ,Improvement 1961 -53 are not in favor of the construction
of Street Improvement 1961 -53 at this time,
NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, that the hearing for the construction of Street
Improvement No. 1961 -53 is declared unfavorable.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote bring taken thereon the following voted in
favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and
Clifford Wellman; and the following voted against the same: None; whereupon
said resolution was declared duly passed sad adopted.
Motion by Carl Carlson and seconded by Clifford Wellman to uphold the
recommendation of the Planning Commission and grant a special Use Permit to
Edward E. Kauftlsann to construct one 4 -unit apartment building on the west

1/2 of the North one acre of` the Hort 15 of the East 1/4 of the Sri! 1/4 of
the SW 1/ of Sectl:c 1 18 re commonly known as 11

Motion by Howard Heck a cl pcom*d by Henry Dorf' to uphold the recom-
mendation of the Planning Com�i #pion and VM the request for a Special Use
Permit by Kenneth Bergstrom to construct too Seven -plex and one eleven -plea
apartment on property located at 62nd and Unity Avenges. Motion carried.
Application No. 61258.
Motion by Carl Carlson and seconded by Clifford Wellman to uphold the
recommendation of the Planning Commission and grant a Variance to D. R.
DuSchane, President, Ryan Lake Properties, by waiving the requirements of
the Building Code requiring 2 exits from each apartment on Lot 7, Ryan Lake
Terrace, more commonly known as 3501 47th Avenue. Motion carried. Applica-
tion No. 61255.
Motion by Carl Carlson and seconded by Clifford Wellz=, upon the
recommendation of the Village Engineer, to approve a new Registered Land
Survey of Tract H RIB #952, subject to the posting of a bond for water,
storm sewer, sanitary sewer, and street surfacing; and upon dedication of
Tract L of the new R.L.S. for street purposes. Motion carried.
Motion by Howard Heck and seconded by Carl Carlson to uphold the
recommendation of the Planning Commission to grant a Variance to Dallas
Holm in the construction of Dusharme Product building by altering the ratio
of the building area to the lot area from .40 to .46, provided public access,
sewer and water utilities are provided. Motion carried Application No. 61265.
Motion'by Carl Carlson and seconded by Howard Heck to uphold the recom-
mendation of the Planning Commission and approve for one year the construction
of three site signs on temporary locations in the Brookdale Shopping Center.
Motion carried.
Motion by Howard Heck and seconded by Carl Carlson to retain Community
Planning & Design Associates to submit a master plan for the northeast sector
of the Village; payment for said lan to be made from Surplus and said plan
to be completed by December 6, 1A . Motion carried.
Member Howard Heck introduced the following resolution and moved its adoption;
RESOLU`PION AUTHORIZING PAYMEItI'I` TO
DON4D PROULX FOR CONSTRUCTION OF
WATER MAIN ON OSSEO ROAD
WHEREAS, in July of 1961 an 8 inch water main was constructed in
Osseo Road from 69th Avenue North to a point approximately 3 feet
south of 69th Avenue North, and
WHEREAS, said 8 inch water main was constructed to serve the property
at 6846 Osseo Road, also known as Pilgrim Cleaners, and
WHEREAS, said water main was constructed by and the cost borne by one
Donald Proulx; the owner of 6 846 Osseo Road, and
WHEREAS, said water main has been incorporated into the Village water
distribution system,

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn. Center that the Village accept a paid up water main assessment
for 6846 Osseo Road in the amount of $963.25, and that $2,177.50 be rebated
to Donald Proulx to cover the costs which he incurred over and above the
standard water main assessment. Said rebate computed as follows:

The motion for the adoption of the foregoing; resolution was duly secon4ed
by Clifford Wellman, and Upon vote being taken thereon the following voted
in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super,
and Clifford Wellman, and the following voted against the same: None;
whereupon said resolution was duly passed and adopted.
Motion by Carl Carlson and seconded by Henry Dorff to appoint A. J. Lee
as the Village's representative on an adjustment panel requested by the
International Union of Operating Engineers to negotiate salary adjustments
and changes in fringe benefits governing certain Village employees. Motion
carried.
Member Henry Dorff introduced the following resolution and moved its
adoption:
RESOLUTION URGING RECON13TPUCTION OP HIGHWAY 152
FROM HIGHWAY 100 TO THE NORTH VILLAGE LIMITS OF

WHEREAS, the population of the Village of Brooklyn Center has grown
very rapidly in the past five years in the area served by T.H. 152, and
WHEREAS, the year 1961 has seen increased commercial development in
the area served by T.H. 152, and
WHEREAS, there is rapid development of residential housing in the
Village of Brooklyn Park directly north of the Village of Brooklyn Center
which is also served by T.H. 152, and
WHEREAS, traffic conditions on T.H. 152 within the Village of Brooklyn
Center have become very difficult, and
WHEREAS, the Minnesota Department of Highways is in the process of
preparing plans and acquiring right -of -ray for the reconstruction of T.H.
152 within the Village of Brooklyn Center,
BE IT HEREBY RESOLVED that the Village Council of the Village of
Brooklyn Center requests that the Commissioner of Highways and the Minnesota
Department of Highways make every effort possible to make certain that T.H.
152 from Highway 100 to the north limits of the Village of Brooklyn Center
be reconstructed during the fiscal year 1963 with construction commencing
shortly after July 1, 1962.
BE IT FURTHER RESOLVED that copies of this resolution shall be certified
by the Village Clerk and transmitted to the Governor, Co missioner of Highways,
Chief Engineer of the Minnesota Department of Highways, and the District
Engineer of the Minnesota Department of Highways.
The motion for the adoption of the foregoing resolution was duly
seconded by member Howard Heck, and upon vote being taken thereon, the
following voted in favor thereof: Curl Carlson, Henry Dorff, Howard Reek,
William Super and Clifford Wellman, and the Following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.

following applications for licenses on the recommendation of the various

Motion by Clifford Wellman and seconded by Carl: &rlsoh to approve
the application for a Bingo Permit by St. Alp6nsus Church for November
19, 1961. Motion carried.
Member Howard Heck introduced the following resolution and moved its
adoption:
RESOLUTION AUTHORIZING RELEASE OF MORTGAGE
WHEREAS, the Village of Brooklyn Center is a mortgagee on a mortgage
on certain property at 1401 73rd Avenue North on which a Robert George
Thompson is mortgagor; and
WHEREAS, said property is also encumbered by mechanics liens which
have been foreclosed resulting in judgments totalling $14,706.61 and said
Property is worth less than $10,000.00; and
WHEREAS, the mortgage held by the Village of Brooklyn Center is
inferior to the other liens on the property; and
WHEREAS, the other lien holders have requested that said mortgage
be released in order to remove a cloud on the title to the property;
N06+1, THEREFORE, BE IT TWOLVED, by the Village Council of the Village
of Brooklyn Center:
1. That the public interest will be served by the release of the
above- described mortgage;
2. That the Mayor and the Clerk are hereby directed to execute a
release of said mortgage in behalf of the Village.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon, the following
voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William
Super and Clifford Wellman and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Carl Carlson and seconded by Howard Heck to reduce the street
bond of $1300 to $3 00 on Orville's Addition s on the recommendation of the
Village Engineer. Motion carried.
Member Clifford Wellman introduced the following resolution and moved
its adoption:
RESOLUTION AUTHORIZING THE MAYOR AND CLERK
EXECUTE AN AGRMOM FOR THE DIVISION OF COSTS
FOR GRADING, GRAVEL BASS,, BITUMINOUS SURFACING,
CONCRETE CURB AND GUTTER, AND TWO BRIDGES ON
COUNTY STATE AID HIGHWAY 30. 10 IN BROOKLYN CENTER
WHEREAS, the . Count of Hennepin and the Village of Brooklyn Center
contemplates the construction of Hennepin County Project 6125, S,A.P.27- 610 -02
on County State Aid Highway No. 10 within the Village of Brooklyn Center, and
WHEREAS, Hennepin County has submitted' an agre which specifies the
division of costs between Hennepin County and the Village of Brooklyn Center
for the construction of the above-designated project, and
WHEREAS, the Village Council of the Village of Brooklyn Center has con-
sidered the above agreement and determined that it is fair and equitable, and

WHEREAS, the Village Attorney for the Village of Brooklyn Cente'r-bas
approved the above - titled agreement.,
BE IT HEREBY RESOLVED, that the Mayor and Clerk of the Village of
Brooklyn Center are authorized and directed to execute copies of,the above -
titled agreement.
The motion for the adoption of the foregoing resolution was duly isecohded
member Howard Heck, and upon vote being taken thereon, the following voted in
favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super, and
Clifford Wellman, and the following voted against the same: None; whereupon
said resolution was declared duly passed e6d adopted.
Motion by Carl Carlson and seconded by Howard Heck to approve the platb
and specifications of County Road 10 between Highway 152 and Highway 100; on
the recommendation of the Village Engineer. Motion carried.
Member Carl Carlson introduced the following resolution and moved its
adoption:
RESOLUTION SING THE 24UMW OF °WALTER JOHNSON,
ELECTRICAL INSPECTOR xgym THE RETnw=A= OF 65
WHEREAS, Walter Johnson, Electrical Inspector, has attained an age beyond
the retirement age of 65 years, and
WHEREAS, in the opinion of the Administrative Officer, it would be diffi-
cult to replace Walter Johnson as Electrical Inspector, and
WHEREAS, Walter Johnson possesses the qualifications to perform the
work of the Electrical Inspector in an excellent manner, and
WHEREAS, Section 17 -129 of the Ordinances of the Village of Brooklyn
Center provides that the Village Council may by resolution extend the employ
meat of any officer or employee beyond the age of 65, if in its judgment the
public welfare will be served by such continued employment,
BE IT RESOLVED that the employment of Walter Johnson be extended until
December 1, 1962.
The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon, the following
voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William
Super, and Clifford Wellman, and the following voted against the sauce: None;
whereupon said resolution was declared duly passed and adopted.
Motion by Howard Heck and seconded by Henry Dorff to terminate the
employment of Glen Jopp, to be effective at the end of the work day on
November 17, 1961. Motion carried.
Member Henry Dorff introduced the following ordinance and moved its
adoption:

VILLAGE ORD111ANCFS TO PROVIDE FOR A CHME
IN THE PROCEDURE FOR THE PYVOINTM=r
AND DISMISSAL OF VILLAGE EMPLOYEES
THE VILLAGE COUNCIL OF THE VILLAGE OF BROaMyN CENM ORDAINS AS FOLLOWS:
Section 1. Section 17 -102 of the Village Ordinances is hereby amended
by the deletion of the following sentence contained therein:
"'Appointing authority' shall mean the Village Administrative Officer."
Section 2. The first sentence of Section 17 -104 is hereby amended to
read as follows:
Section 17 -104. gUointmen Procedure. All appointments to
positions in the municipal service whi are provided for in the

budg4t'on s`perftnent ,basis shall be aside by the village Council
accordlbg'to merit and fitness and upon, the recaftwadAtion of the

Section 5. Section 17124 is hereby amended by deleting therefrom the
words "appointing authority" and substituting therefor the words "Village
Council."
Section 6. Section 17 -125 is hereby amended by deleting therefrom
the words "appointing authority" and substituting therefor the words
"Village Council."
Section 7. Section 17 -126 is hereby amended to read as follows:
Section 17 -126 tions. AAy.employsee maybe demoted by the
Village Council. upon the ndation of the Village Administrative
Officer for inefficient perforoeme of his duties, for disciplinary
reasons, or for good and sufficient reasons.
Section 8. The first sentence of Section 17 -127 is hereby amended to
read as follows:
Section 17 -127 Dismissals. Any officer or employee subject
to the provisions of this ordinance may be dismissed from the
municipal service by the Village Council upon the reconme ndation
of the Village Administrative Officer.
Section 9. This ordinance shall be in full force and effect from and
after its legal publication.
The motion for the adoption of the foregoing ordinance was duly seco$ded by
member Howard Reek, and upon vote being teakian thereon., the following voted
in favor thereof: Carl Carlson, Henry Dorff, Howard Hook, William Super
and Clif 6rd W 11ma and the followif voted against the same: Nolte;
whereupon said ordinance was declared duly passed and adapted.
The bilks set forth on the schedule attached tothese Minutes and

Meeting of November 13, 1951" were audited epd ordered p aid.
