Roll Call; Mayor William Super, Carl Carlson, Clifford Wellman, Henry Dorff, and Hobrard seek were present. Motion by Howard Heck and seconded by Re ary Dortf to approve the Minutes of the Regular meeting or November 13, 1961, as recorded. Motion carried. Member Carl Carlson introduced the following resolution watt moved its adoption; RESMUTItNZ ACCEPTING WORK CoomACTED BY VILLAGE WHEREAS, pursuant to a written contract signed with the Village of Brooklyn, Center, Minnesota, N'odland Construction Ctmepany, Inc have satis- factorily completed the following improvements in accordance with said contract sanitary Sewer Project, Nos. 1960 -49, 1961 -6, 1961 -23, 19$1 -35 Water Main Project Nae, 1961 -5 1961 -22 Storm Sewer Project No. 1961 -24 NOW, 't'MLI+'t'? .. AN IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby accepted and approved upon the reoommendation of Minder Engineering Company and the Village Engineer. 2. The value or work performed is less than the original contract amount by $882.60 because of overestimating of quantities on the proposal form. 3. The Village Officials are hereby directed to Issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement projects being $178,785.65 The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and 'upon vote being taken thereon, the following voted in favor thereof; Carl Carlson, Henry Dorff, Howard Heck, William Super, WA Clifford Wellman; and the following voted against the same: None; where- upon said resolution was duly passed azd adopted. Member Howard. Heck introduced the following resolutiom and moved Its adoption: RSSOLUTION ACCEPTING WORK C00TRACTED BY VILLAGE WHRREAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota., Crystal Excavating Company have satisfactor completed the following improvements in accordance with said coutract; Water Mein Project Nos. 1961 -39, 1961 -41 NOW, THEEF00, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contmet is hereby accepted and approved, upon the recamnendation of the Village Engineer. _ I- 2. The value of wort performed is less than the original contract amount by $743.30 because the quantities on the proposal form were overestimated. 3• The Village Officials are hereby diroet*d to issue proper order For final payment on esid contract, taking the contractor's receipt in full. The total swum paid for said improvement Projects being $32,961.30. The motion for the adoption of the foregoing resolution wea duly seconded by member Carl. Carl oon., and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry borft, Howard Heck, William Super, and Clifford Wellman; and the following voted against the same; Xone; whereupon said resolution was duly passed and adopted. Member Clifford Wellman introduced the followUg resolution and moved its adoption: RESOLUTION ACMPTW WOPK BY VIE WHEN, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Swenson Excavating Company have satisfactorily completed the following improvement in accordance with said contract: Sanitary Sever Project No. 1964 -66 NOW, TMWFM, BE IT RESOLVED by the Village Council of the Village of Brooklyn; Center: I. The work completed under said contract is hereby accepted and approved upon reconaamendation of Minder Engineering Company and the 'Village Ragi,nser. 2. The value of work performed is less than the original contract amount by $9,,551.58 because of general, overestimating of quantities on the proposal form and the substitution of a less expe give lift statioul 3• The Village Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said :improvement project being $145,728.22. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof; Carl, Carlson, Henry Dorff, Howard Heck, William Super, and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Henry Dorff introduced the following resolution and moved its adoptions RESOLUTION ACCEFTIM WORK {Ct?VMCTED BY VILLAGES WHEFMAS, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, Phelps -Drake Co., Inc. have satisfactorily completed the fallowing improvements in accordance with said contract; Sanitary Seven Project Nos. 1960 -64, 1961_3, 1961 -15, 1951 -21 and 1961 -28 and Water Main Project Nos. 1964 -63, 1961 -29, and 1961 -31 P W TiEREPOPE, IM IT RBSOLVID by the Villager Council of the Village of Brooklyn Center: 1. The work a4tpl.eted under said contract Is hereby accepted and appmved upon the recommendation of the Village Engineer. -2- 2. The value of the work performed tMeeded the original contract amount by $2,095.86 because there was a largor amount of peat to be removed on Project Nos. 1960 -64, sad 1961- 3l'tMA was estimated on the proposal form. 3. The Villagi Officials are hereby directed to issue proper order for final payment on said contract, taking the contractor's receipt in full. The total amount paid for said improvement projects being $70,003.18. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super, and Clifford Wellman, and the following voted against the sae: Hone; whereupon ! said resolution was dully passed and adopted Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ACCEFTM WORK C CNMC'M BY VIE W$E`,RE l5, pursuant to a written contract signed with the Village of Brooklyn Center, Minnesota, C. S. McCrossan, Inc. have satisfactorily com- pleted the following improvement in accordance with said contract: Street Surfacing Project No. 1961 -52 NOW, THMS701M., N IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. The work completed under said contract is hereby Accepted and approved upon the recommendation of the Village Engineer. 2. The value of work performed exceeded the original contract amount by $82.32 because of underestimating the quantities on the proposal form. 3. The Village Officials are hereby directed to issue proper order for final payment on said contract:, taking the contractor's receipt in full. The total amount paid for said improvement project being $1037.32. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and i;pon vote being token thereon, the following voted in favor thereof: Carl. Carlson, Henry Dorff, Howard Heck William Super, and Clifford Wellman, and the following voted against the samet. None; whereupon said resolution was duly passed end adopted. Motion by Clifford Wellman and seconded by Howard Beck to release the cash escrow in the amount of $180 for the Busee- Erickson Additit , on the recommendation of the Village Engineer, Motion married. Motion by Howard Reek and seconded by Henry Dorff to transfer Richard Schwab from Public Utilities to the Street Department.. effective immediately. Motion carried. Motion by Carl. Carlson and seconded. by Howard, Heck to rotor back to the Planning Commission the ordinance amending Chapter 35 ,tor review of Section 35 -233 and all Special Use Permits outstanding at this time. Motion carried. Member Carl Carlson introduced the following ordizaaft ead.moved its adoption: AN ORDINANCE REPEALING CHAPTER 33 OF THE CMDMN= OF THE VIUACM OF BROaMYN CENTER, SAID CHAP'T'ER BS1 KNOWN AS "CHAPTER 33 - WATERS AND WATERWAYS" Section 1.. Chapter 33 of the Village ordineac+es is hereby repealed. _3_. 83 Section 2. This ordinance shall take *Met free and after its legal publication. The motion for the adoption of the foregoing ordinance vas duly seconded by member Clifford Wellman and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard look, William Super, and Clifford Wellman., and the following voted against the same: Nome; whereupon said ordinance was declared duly passed and adopted. Motion by Carl Coulson and seconded by Reward Heck to authorise the Assistant Administrator to prepare specifications sad advertise for three Police gars, bids to be opened on January 15, 1962. Motion carried. Motion by Heyward Beck and seconded by Clifford Wellman to authorize the Purchasing Agent to purebase a radio for the Park Ord truck in an amount not to exceed $300, funds to be taken equally from the Park Board and ?Fire Department. Carl Carlson, Clifford Wellman►, Henry Dorff and Reward Heck voted in favor of the motion; Mayor William Super voted against the same. Motion. carried. Motion by Carl Carlson and seconded by Howard Reek to approve the Mayor's appointment of the following people to serve an the Madustrial Commission Study Cosmaittee Dallas tAvreence, Chairman Pro Tam, 7200 W. Twin Fake Blvd. and, further; to approve the following objective of they Committee, among others, to-wit: To determines the objectives of the Industrial Commission and to make the ocmanittee's findings available to the Villages Council in the recormmendations to be submitted to the Council on or before the Council's first meeting in April, 1962. Motion carried. Motion by Clifford Wellman and seconded by Howard Heck to appoint Henry Dorff and Carl Carlson to work with the Village Administrator in pre- paring proposals regarding the Police Department operation. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson to inform Dusharme Products, Inca, that the Council has no objection to use of the street names4 "nusharme Drive." Motion carried. The bills set forth on the schedule attached to these Minutes sad made a part hereof entitled, "The Bills Audited and Ordered Paid at the Meeting of November 27, 1961," were audited and ordered paid.
