HomeMy WebLinkAbout1961 02-27 CCM Regular Session r Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota February 27, 1961 The Village Council met in Regular session and was called to order by Mayor William Super at 7:35 P.m. Roll Call: Mayor William Super, Carl Carlson, Henry Dorff, and Howard Heck were present. Motion by Howard Heck and seconded by Carl Carlson to approve the Minutes of the Regular meeting of February 13, 1961, and the Minutes of the Spedial meeting of February 21, 1961. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID FOR ONE POLICE CAR WHEREAS, the Assistant Village Administrator and the Village Engineer have reported that on February 27, 1961, at 2:00 p.m. they opened and tabulated bids received for the furnishing of a 1961 model police car and that said bids were as follows: Net Bidder Make & Model Delivery Date Bid Price River Motors Dodge 30 -45 days $1627.26 Osseo Motor Company Chevrolet 30 -45 days 1378.20 Broadway Automotive Plymouth 45 -60 days 1485.74 NOW, THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center, Minnesota, that the low bid of Osseo Motors in the amount of $1378.20 for the furnishing of a 1961 Police Car in accordance with the specifications is deemed to be the best bid submitted by a responsible bidder and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William Super; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Trustee Clifford Wellman arrived at the meeting at this point. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING BID FOR RUBBER -TIRED TRACTOR SHOVEL WHEREAS, the Village Administrator and Assistant Administrator have reported that on February 13, 1961, at 2 :00 p.m., they opened and tabulated bids received for the furnishing of a Rubber -tired Tractor Shovel and that said bids were as follows: Delivery Net Bidder Make & Model Date Bid Price Borchert - Ingersoll, Inc. Caterpillar 10 days 11,200.00 NOW, THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center, Minnesota, that the low bid of Eagle Equipment Co. in the amount of $9,9+1.00 for the furnishing of a Rubber -tired Tractor Shovel in accordance with the specifications is deemed, to be the best bid submitted by a responsible bidder and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super, and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Carl Carlson to approve the Village Carnival location as requested by the Brooklyn Center Junior Chamber of Commerce in a letter dated February 14, 1961, subject to liability insurance of $100,000 /300,000 and property damage insurance of $10,000 being in force as stated in subject letter. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman that the Village agree to finance the utilities and streets up to $250,000 by Special Assessments on the Dayton property, known as "Brookdale," for a period of 15 years. Motion carried. Member Clifford Wellman introduced the fallowing resolution and moved its adoption: RESOLUTION AUTHORIZING RELEASE OF EASEMENT WHEREAS, the Village of Brooklyn Center acquired a temporary easement for construction purposes upon the North 20 feet of the South 50 feet of East 20 rods of Northwest Quarter of Southeast Quarter of Section 26, Township 119, Range 21, to facilitate the construction of storm sewer and sanitary sewer facilities; and WHEREAS, construction of said sanitary sewer has been completed and a Certificate of Completion issued on December 7, 1960; and WHEREAS, the fee owner of the property affected by said easement has requested that the Village of Brooklyn Center release said easement; NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows; 1. That the Village Council finds that there is no longer a need for said temporary easement and the public interest would be served by its release. 2. That the Mayor and the Village Clerk are authorized and directed to execute a Quit Claim Deed releasing said easement. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super, and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Carl Carlson to appoint Allen S. Lindman as Special Health Officer for the year 1961. Motion carried. Motion by Clifford Wellman and seconded by Howard Heck to accept the Justice Report of John Wingard for the month of January, 1961. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION RENE4+IING CONTRACT WITH SUBURBAN HENNEPIN COUNTY RELIEF BOARD BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Contract heretofore submitted, signed and executed by the Suburban H= nnepin County Relief Board of the County of Hennepin for and during the year 1961 for the administration and supervision of poor relief in the Village of Brooklyn Center be, and the same is hereby accepted, ap- proved, renewed and extended for and during the year 1961 with the same force and effect as though said original Contract, above described, were redated and resigned and executed as of the date hereof. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, Howard Heck, William Super, Clifford Wellman and Carl Carlson; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Carl Carlson to request a letter from the State Highway Department giving the hourly traffic flow through the intersection of Highway 169 and Highway 100 for a full week's period, Monday through Sunday, and stating an opinion as to whether the operation of a go -cart track on the northwest corner of this intersection would constitute a traffic hazard. Motion carried. Mayor William Super introduced the following resolution and moved its adoption: RESOLUTION CONCERNING LEGISLATION TO PERMIT RESIDENTS OF THE CITY OF BLOOMINGTON TO VOTE ON THE QUESTION OF ESTABLISHING A MUNICIPAL STORE WHEREAS, the Council of the Village of Brooklyn Center is sympathetic with the desire of the City of Bloomington to be allowed to vote on the question of establishing a municipal liquor store, a right enjoyed and exercised by some 390 other Minnesota municipalities; and WHEREAS, the City of Bloomington has requested the Council of the Village of Brooklyn Center to support special legislation which would permit such an election; NOW.. THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center, Minnesota, that the Council support, and it does hereby, the passage of special legislation which would allow the electorate of Bloomington to vote on the ques- tion of the establishment of a municipal liquor store. -3- 129 BE IT FURTHER RESOLVED that executed copies of this Resolution be forwarded to the City of Bloomington. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon,,-the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted Against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Howard Heck to refer the letter from Northtown Finance Co. regarding Village property at 53rd and Osseo Road to the planning Commission for further consideration. Motion carried. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING MUNICIPAL STATE AID HIGHWAYS WHEREAS, it appears to the Village Council of the Village of Brooklyn Center that the streets hereinafter described should be designated Municipal State Aid Streets under the provisions of Minnesota Laws of 1.959, Chapter 500: NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the streets described as follows, to -wit: NO. STREET FROM TO 107 Dupont Ave. No. F.A.I. #94 County Road 130 (The above is an extension of Dupont Ave. No. from the Southerly Village Limits to T.H. 100, as resolved by the Village Council, September 12, 1960) 109 Shingle Creek Parkway County Road 130 Northerly Village Limits (The above is an extension of Shingle Creek Parkway from Junction of T.H. 152 & Xerxes Ave. No. to County Road 130, as resolved by the Village Council, September 12, 1960) be, and hereby is established, located and Aesignated Municipal State Aid Streets of said Village of Brooklyn Center, subject to the approval of the Commissioner of Highways of the State of Minnesota. BE IT FURTHER RESOLVED, that the Village Clerk is hereby authorized and directed to forward two certified copies of this resolution to the Com- missioner of Highways for his consideration, and that upon his approval of the designation of said streets or portion thereof, that same be constructed, improved and maintained as Municipal State Aid Streets of the Village of Brooklyn Center, to be numbered and known as Municipal State Aid Streets as indicated above. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The bills set forth on the schedule attached to these Minutes and made a part hereof entitled "The Bills Audited and Ordered Paid at the Meeting of February 27, 1961" were audited and ordered paid. Motion by Carl Carlson and seconded by Clifford Wellman to adjourn. Motion carried.
