Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota

The Village Council met in Special session and was called to order
by Mayor William Super at 1:05 P.M.
Roll Cali: Mayor William Super, Carl Carlson, Henry Dorff, Hurd
Heck and Clifford Wellman were present.
Member Carl Carlson introduced the following resolution and moved
Its adoption:
RESOLUTION IXITHORAWING SUBMISSION
OF CHARGE AND REVOKING
AUTHORITY OF ARBITRATION BOARD
WHEREAS, a three-man arbitration board composed of Chester
L. Carlock, Theodore B. Miksza, and John T. Nordberg has been
appointed pursuant to the procedure established in M.S.A.
Sec. 197.46 to hear charges in the matter of the dismissal
of James Fischbach as manager of Liquor Store No. 1, located
at 6445 Lyndale Avenue North; and
WHEREAS, it appears that said statute does not authorize a
hearing prior to removal from the position of liquor store
manager; and
WHEREAS, the Village Council of the Village of Brooklyn Center
has removed said James Fischbach from said position of liquor
store manager;
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. That the submission of said charges to said arbitration
board is hereby withdrawn; and
2. That any and all authority vested in said arbitration
board by virtue of previous action of the Village Council
is hereby revoked.
The motion for the adoption of the foregoing resolution was duly seconded by
member Howard Heck, and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Henry Oorff, Howard Heck, William Super, and
Clifford Wellman; and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Notion by Carl Carlson and seconded by Howard Heck to adjourn.
Motion carried.
