BE IT FURTHER RESOLVED by the Village of Brooklyn Center, Minnesota, that the low bid of Midland Cooperatives Inc. in the mount of 11 per gallon for fuel oil; and 11.50 per gallon for diesel fuel oil in accordance with the specifications is deemed to be the best bid submitted by a responsible bidder and said bid is hereby accepted. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor.thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Howard Heck to uphold the recommendation of the Planning Commission to grant a variance to Harlan Harmes, 731 73rd Avenue North, to divide Lot 35, Aud. Sub. 309 into two parcels. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to uphold the recommendat ofo2e lanning Commission to grant a variance to Richard Dalin, `�Beard4venue North, to divide Lots 16 and 16A (located at 5940 Beard Avenue) into two equal lots of 63.5' x'135-87'. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to uphold the recommendation of the Planning Commission to deny the request of Donald Meighan to rezone from R -1 to B -3 the property located at 5637 Osseo Road. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to uphold the recommendation of the Planning Commission to grant a special use permit to Donald Brandvold of Colonial Builders to construct four apartment buildings at 6715 Humboldt Avenue North subject to the stipulation that there be no parking in the front yard setback and on the condition that Don Brandvold execute an agreement pertaining to proposed Irving Avenue as approved by the Village Attorney. Motion carried. Motion by Howard Heck and seconded by Carl Carlson to uphold the recommendation of the Planning Commission to approve a Special Permit for a temporary sign on the Dayton property at 5620 Osseo Road pertaining to the "Future Site of the Brooklyn Center State Bank ". Motion carried. Motion by Clifford Wellman and seconded by Howard Heck to uphold the recommendation of the Planning Commission to approve plans submitted by Dallas Holm$ 6018 Halifax Place, for two buildings to be located at 3415 48th Avenue and 3501 48th Avenue. Motion carried. -3- Q3T Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING RELEASE OF EASEAWT WHEREAS, the Village of Brooklyn Center acquired a utilities easement running from the southerly lot lines of Lots 7 and 10 and continuing in a northerly direction to the northerly lot lines of Lots 8 and 9 all in Block 2 of Pearson's Northport Addition, Hennepin County, Minnesota; and WHEREAS, the Cross of Glory Lutheran Church of Brooklyn Center desires to construct a building upon said easement; and WHEREAS it has been determined that said easement is not necessary for utilities purposes nor for drainage purposes; NOW THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center as follows: 1. That the Village Council finds that there is no longer a need for said easement and the public interest would be served by its release, 2. That the Mayor and the Village Clerk are authorized and directed to execute a Quit Claim Deed releasing said easement. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ESTABLISHING LOAD LIMITS ON THE STREETS OF BROOKLYN CMER BE IT RESOLVED by the Village of Brooklyn Center that the legal load limit on the streets of the Village of Brooklyn Center shall be four (4) tons per axle, beginning on the date that the Hennepin County Highway Department posts load limits on county roads and continuing until such time as Hennepin County shall remove load restrictions from county y roads, The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Howard Heck, Henry Dorff, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION REQUESTING EXTENSION OF BUS SERVICE IN THE VILLAGE OF BROOKLYN CENTER WHEREAS, the administrative offices of the Village of Brooklyn Center, Minnesota, have received numerous requests for the urging of increased and improved bus service in the Village of Brooklyn Center along the Osseo Road, NOW, THEREFORE,, BE IT RESOLVED that the Village Council of the Village of Brooklyn Center strongly urge the Twin City Rapid Transit Company to extend bus service along the Osseo -4- �_ 8TT r Road to the north Village limits and to increase the frequency of service; and to further provide service on Saturdays in the Village of Brooklyn Center. The motion for the adoption of the foregoing resolution was duly seconded by member Carl— Carlson, and upon vote being taken thereon, the following voted in favor thereof: Henry Dorff, Howard Heck, William Super,. Clifford Wellman and Carl Carlson; and the following voted against the same None; whereupon said resolution was declared duly passed and adopted.,. Motion by Clifford Wellman and seconded by Henry Dorff to approve the fir&I plat of Brookdale Manor submitted by Norman Chazin of Homedale Builders Inc. Motion carried.. Motion by Clifford Wellman and seconded by Howard. Heck to withdraw a "Resolution Providing for Public Hearing on Proposed Sanitary Sewer Improvement No. 1960 -661 which was passed on February 13, 196; Motion carried. Member Clifford Wellman introduced the following resolution and moved its,edoption: RESOLUTION PROVIDING FOR PUBLIC HEARING. ON PROPOSED SANITARY SEWER IWROWR= No. 1960 -66 I�Ir� sI. Ti4 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of sanitary sewer laterals and lift station to serve the following described property: The area bounded on the south by the Village limits; on the west by Twin Lake; on the east by the Village limits; on the north by the Soo Line Railroad tracks., and the following parcels north of the Soo Line Railroad tracks: Lots 7, 8, and 9, Block 5, Brooklyn Manor Addition; and Parcels 313 and 317, Section 10, Township 118, Range 21, which are those lots and parcels abutting France Avenue North from 50th Avenue North to the Soo Line Railroad tracks. WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $210,980.00, NOW. T'HEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center s Minnesota , as follows: 1. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Monday., the 27th day of March, 1961 at 8 :0o P.M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: All parcels of property within the above - described area and benefitted thereby. 4. This proposed improvement shall be designated Sanitary Sewer Improvement No. 1960 -66.. 5. Plans, specifications and estimates to be prepared by Minder Engineering Co. -5- \__ 094 T _ r The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Howard Heck, Henry Dorff, William Super and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Howard Heck to approve the following application for license: House Moving: Clarence Landwehr Heavy Moving Inc., 1528 9th Ave. S., St. Cloud, Minnesota Motion carried. Motion by Carl Carlson and seconded by Howard Heck to authorize the Village Administrator to purchase one radio for use in an Engineering Department automobile. Motion carried. Member Clifford Wellman introduced the following resolution and' moved its adoption: A RESOLUTION ESTABLISHING VOTING DISTRICTS FOR THE VILLAGE OF BROOKLYN CENTER Section 29 -101. The resolution establishing voting districts passed on the 8th day of September 1959 is hereby rescinded and in lieu thereof there shall be established eight voting districts in the Village of Brooklyn Cents, each district to be numbered as follows: DISTRICT ONE Bounded on the south by 53d Avenue North, on the west by Shingle Creek, on the north by a line beginning at Shingle Creek and Highway 100, thence running northeasterly along the center line of Highway 100 to its intersection with an extension of the center line of James Avenue North, thence south along the center line of James Avenue North to the intersection of 55th Avenue, thence easterly along 55th Avenue to its intersection with Camden Avenue; thence north along Camden Avenue to its intersection with 56th Avenue; thence east along 56th Avenue to the Mississippi River, on the east by the Mississippi River. DISTRICT TWO Bounded on the east by the Mississippi River, on the south by a line beginning at the intersection of the Mississippi River and 56th Avenue extended; thence west along 56th Avenue to Camden Avenue; thence south along Camden Avenue to 55th Avenue; thence west along 55th Avenue to James Avenue; on the west by the center line of James Avenue; and on the north by a line beginning at the intersection of James Avenue and Highway 100; thence northeast along Highway 100 to its intersection with Humboldt Avenue; thence north along Humboldt Avenue to its intersection with a line parallel with and 500' south of 64th Avenue; thence east along the above - described line to the Mississippi River. DISTRICT THREE; Bounded on the east by the Mississippi River, on the south by a line parallel with and 500' south of 64th Avenue; on the west by the center line of Dupont Avenue North extended; and on the north by 73d Avenue North. DISTRICT FOUR Bounded on the east by the center line of Dupont Avenue North extended; on the north by 73d Avenue North; on the west by Shingle Creek and Palmer Lake; on the south by the center line of Highway 100 from Shingle Creek to Humboldt Avenue; thence north along Humboldt Avenue to a line parallel with and 500' south of 64th Avenue; thence east along �he afore - described line to its intersection with Dupont Avenue extended. DISTRICT FIVE Bounded on the east by Shingle Creek and Palmer Lake; on the north by 73d Avenue North; on the west by the west Village limits; on the south by the center line of 69th Avenue North to its intersection with the center line of Osseo Road; thence southeasterly along the center line of Osseo Road to its intersection with the proposed freeway along 66th Avenue North; thence easterly along the center line of the proposed freeway to Shingle Creek. -6- DISTRICT SIX Bounded on the east by Shingle - Creek; on the north along the center line of the proposed freeway to its intersection with the center line of Osseo Road; thence northwesterly along the center line of Osseo Road to its intersection with 69th Avenue North; thence west along the center line of 69th Avenue North to the west Village limits; on the west by the west Village, limits; and on the south along the center line of 65th Avenue North to its intersection with Lee Avenue North; thence south along the center line of Lee Avenue North to its intersection with 63d Avenue North; on the south by the center line of 638 Avenue.North extended easterly to Shingle Creek. DISTRICT SEVEN Bounded on the east by Shingle Creek; on the north by the center line of 63d Avenue North extended; thence west along 63d Avenue to its intersection with Lee Avenue North; thence north along the center line of Lee Avenue North to 65th Avenue North; thence west along the center line of 65th Avenue North tQ the west Village limits; bounded on the west by the west Village limits; on the south by the center line of 61st Avenue North, extended, easterly to Osseo Road; thence along the center line of Osseo Road to its intersection with 57th Avenue North; thence easterly along the center line of 57th Avenue North to Shingle Creek. DISTRICT EIGHT: Bounded on the south by the south Village limits; on the west by the west Village limits; on the north by a line beginning at the intersection of the west Village limits and 61st Avenue North, extended; thence running east along the center line of 61st Avenue North to its intersection with Osseo Road; thence southerly along tbe center line of Osseo Road to its intersection with 57th Avenue North; thence east along the center line of 57th Avenue North to Shingle Creek; on the east by Shingle Creek. Section 29 -102. The new voting districts shall be in full force and effect sixty days after posted notice thereof as prescribed by law. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; thereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved its adoption. RESOLUTION REQUESTING GRADE SEPARATION AT DUPONT AVENUE NORTH AND SCHEDULING IMPROVEMENT OF DUPONT AVENUE NORTH BETWEEN 57th AVENUE NORTH AND 65th AVENUE NORTH WREAS, it is considered essential to proper community planning that free exchange be provided between neighborhood units within a community, and WHEREAS, a high school presently under construction on the north side of FAI 94 will chiefly serve students living south of FAI 94, and WHEREAS, the best interests of safety would not be served with the intermingling of local and regional traffic on Trunk Highway 100 and Trunk Highway 169,. NOWa THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Village Administrator and Village Engineer be and hereby are directed to make a formal request to the State of Minnesota Department of Highways for a vehicular- pedestrian grade separation on Dupont Avenue North at FAI 94, and BE IT FURTHER RESOLVED by the Village Council of the Village of Brooklyn Center, that the Village Engineer be and hereby is directed to -7- r schedule the improvement to State Aid Standards of Dupont Avenue North between 57th Avenue North and 65th Avenue North, such that said improve will be accomplished prior to or during construction of F'AI 94,. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, William Super, Clifford Wellman, Carl Carlson and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson left the meeting at this point (10:25 PM). Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION URGING LEGISLATURE TO ESTABLISH SALARY FOR MUNICIPAL JUDGE WHEREAS the Village Council of the Village of Brooklyn Center has determined that it is in the public interest to prepare for the organization of a municipal court within and for the Village of Brooklyn Center, and WHEREAS.. it is desirable that the State legislature enact legislation establishing the salary for the judge of said municipal court, NOW, THEREFORE, BE IT RESOLVED that the Village Council of the Village of Brooklyn Center urge,and it does heeeby� that the legislature.of the State of Minnesota enact legislation establishing an annual salary of $4200. for the judge of the Municipal Court for the Village of Brooklyn Center. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: Howard Heck, Henry Dorff, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted.
