Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and state of
Minnesota
March 27, 1961
The Village Council met in Regular session and was called to
order by Mayor William Super at 7 :40 p.m.
Roll Call: Mayor William Super, Carl Carlson, Henry Dorff,
Howard Heck and Clifford Wellman were present.
Motion by Clifford Wellman and seconded by Howard Heck to
approve the Minutes of the Regular meeting of March 13, 1961, and the
Special meetings of March 20, 1961 and March 21, 1961, on correcting the
address on page 3 of the Minutes of March 13, 1961, from 5930 Beard
Avenue North to 5950 Beard Avenue North. Motion carried.
Motion by Clifford Wellman and seconded by Howard Heck to
determine that the term of the proposed contract between the Village
of Brooklyn Center Park Board and the Brooklyn Lions Club, Inc., shall
be a term of five years from and after the signing of the Agreement.
Motion carried.
Motion by Clifford Wellman and seconded by Howard Heck to
amend paragraph 6 of the proposed Agreement between the Brooklyn Center

Park Board and the Brooklyn Lions Club, Inc., to read as follows:
"6. The second party hereby agrees to indemnify and
hold the first party harmless from azy claims against the
first party which might arise by reason of the improvement
or development of the property of the first party, and /or
by the provisions of paragraph 2 of this Agreement, by the
second party in connection with its project."
Motion carried.
The Mayor announced that the meeting was open for the con-
sideration of proposed Sanitary Sewer Improvement No. 1960 -66.
The Clerk produced an affidavit of publication of Notice of
Hearing on the proposed improvement showing two weekst publication
thereof in the official newspaper, the last publication being on March
231. 1961, which affidavit was examined and found satisfactory and
ordered placed on file.
The Mayor then called upon all property owners present to
present arguments either for or against the proposed improvement.
After hearing and considering all objections; and the property owners
appearing in favor of said improvement, member Carl Carlson introduced
the following resolution and moved its adoption:
RESOUITION ORDERING CONSTRUCTION OF
SANITARY SEWER IMPROVEHM NO. 1960 -66
BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows
1. It is hereby determined that it is necessary and for
the best interests of the Village and the owners of property specially
benefited thereby that the following improvement shall be constructed:
CONSTRUCTION OF SANITARY SEE LUWWLS AND LIFT STATION TO SERVE
THE FOLLOWING DESCRIM PROPERTY

The area bounded on the south by the Village Limits; on the
on the west by Twin Lake; on the east by the Village Limits;
on the north by the Soo Line Railroad tracks, and the fol-
lowing parcels north of the Soo Line Railroad tracks:
Lots 7, 8, and 9. Block 5, Brooklyn Manor Addition; and
Parcels 313 and 317, Section 10, Township 118, Range 21,
which are those lots.and parcels abutting France Avenue
North from 50th Avenue North to the Soo Line Railroad
tracks.
2. The plans and specifications for said improvement have
been prepared by Minder Engineering Company.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon, the fol-
lowing voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck,
William Super, and Clifford Wellman, and the following voted against
the same None; whereupon said resolution was declared duly passed and
adopted.
Member Carl Carlson introduced the following resolution and
moved its adoption:,
RESOLUTION ACCEPTING BID AND
APPROVING CONTRACT FORM
WHEREAS., the Village Administrator, Assistant Administrator, and
the Village Engineer have reported that on March 23, 1961 at 2:00 o'clock
p.m., they opened and tabulated bids received for Sanitary Sewer Improve -
ment Project No. 1960 -66, and that said bids were as follows

NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center that the bid of Swanson Excavating Co. in the
amount of $151,279.8o (Gasket Alternate and a lift station at a cost of
$21 as to furnishing all work, labor and material in connection
with Sanitary Sewer Improvement Project No. 1960 -66, according to the
plans and specifications therefor now on file in the office of the Village
Clerk is deemed to be the lowest and best bid submitted for said work by
a responsible bidder, and said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded
by member Henry Dorff, and upon vote being taken thereon, the following
voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William
Super and Clifford Wellman, and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.

Member Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION ACCEPTING BID FOR
FURNISHING BITUMINOUS OIL
WHEREAS, the Village Administrator and Assistant Administrator
have reported that on March 27, 1961, at 2 :00 p.m., they opened and tabu-
lated bids received for the furnishing of bituminous oil and that said
bids were as follows:

cations is deemed to be the best bid submitted by a responsible bidder and
said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck, and upon vote being taken thereon, the following
voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William
Super, and Clifford Wellman; and the following voted against the same
None; whereupon said resolution was declared duly passed and adopted.
Member Howard Heck introduced the following resolution and
moved its adoption:
RESOLUTION AUTHORIZING CORRECTION
OF SEWER LATERAL 60 A & B ASSESSMENT
ON LOT 1Z, GOULD'S RIVERVIEW ADDITION
WHEREAS, Lot 17, Gould's Riverview Addition, was assessed for
two units of lateral and should have been assessed for only one unit be-
cause of the location of the house on the lot,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, to authorize the correction of Levy
2416, sewer lateral 60 A & B, from $833.16 to $416.59, on Lot 17, Gould's
Riverview Addition, and direct that the County Auditor's office be so
notified.
The motion for the adoption of the foregoing was duly seconded by member
Clifford Wellman, and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super,
and Clifford Wellman, and the following voted against the same: None;
whereupon said resolution was declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and
moved its adoption:
RESOLUTION AtnVORIZING THE INSTALLATION
OF "RESIMW PARKING ONLY" SIGNS
WHEREAS, the parking of vehicles along the south side of
70th Avenue North from Major Avenue to the western extremity of 70th
Avenue by persons using the Willow Lane Park does cause undue incon-
venience to the abutting property owners;

NOW., THMMRE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, that the erection of two signs
limiting parking to residents only is hereby authorized.
The motion for the adoption of the foregoing resolution wits duly seconded
by member Howard Heck, and upon vote being taken thereon, the following
voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William
Super and Clifford Wellman; and the following voted against the same:
None; whereupon said resolution was declared duly passed and adopted.
Member Clifford Wellman introduced the following ordinance
and moved its adoption:
AN ORDINANCE PROHIBITING DOOR TO DOOR SOLICITATION
WITHOUT INV17ATION AS A NUISANCE AND
PROVIDING A PENALTY FOR VIOLATION THMEOF
Section 19 -701 The practice of going in and upon private
residences in the Village of Brooklyn Center by solicitors, peddlers,
hawkers, itinerant merchants and transient vendors, not having been
requested or so to do by the owner or owners, occupant or
occupants of said private residences, for the purpose of soliciting
orders for the sale of goods, wares, merchandise, or services of any
kind, or for the purpose of peddling the same, is hereby declared to
be a muisance.
Section 19 -702 PENALTY. Anyone violating any provision
of this ordinance, upon conviction thereof, shall be punished by a
fine not exceeding $100.00 or by imprisonment for a period not exceeding
ninety days.
This ordinance shall be in full force and effect from and
after its publication in the official newspaper.

by member Howard Heck and upon vote being taken thereon, the following

Motion by Howard Heck and seconded by Carl Carlson to accept

Scott & Goldie M. Scott, husband and wife; and John A. Halloran and
Bette Ann Halloran, husband and wife; which cover Tract G, R.L.S. 981
Motion carried.

accept the Justice Report of Raymond E. Benson. Motion carried.
Motion by Clifford Wellman and seconded by Howard Heck to
approve the plat of Princess Addition submitted by Northwestern Bell
Telephone Co. Motion carried.
Member Clifford Wellman left the meeting at 10:30 p.m.

2. The Clerk shall advertise for bids for such improvements by
Publication at least once in the official newspaper and in the Construction
Bulletin, the date of first publication not less than 3 weeks prior to the
date for receipt of bids. Said notice shall state that no bids will be
considered unless sealed and filed and accompanied by a cash deposit..
bid bond, cashier's check or certified check payable to the clerk in
the amount of not less than five per cent of the bid.
3. Bid date is set for April 27, 1961, at 10 :00 O'clock a.m.
4. The Village Administrator and Village Engineer shall be
authorized to open and tabulate the bids.

WHEREAS, the Village Engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed at an
estimated cost of $141,086.89.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of
Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under' authority granted by Chapter
398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
Earle Brown School in the Village on Wednesday the 3rd day of May, 1961, at
8:00 p.m., and the Clerk shall publish notice of the time and place of hearing
by two weeks' publication in the official newspaper of the Village.
3. The area proposed to be assessed for said improvement is as follows:
All lots and parcels abutting on the above -named streets.
4. This proposed improvement shall be designated Sanitary Sewer Im.
provement Nos. 1960 -13, 1 960 -43, -.1M, 4 001M , 1961-7, 1961 -8, 1961 -9, 1961 -
1961 -11, 1961 -12, 1961 -13, 1961 -16, 1961 -17, 1961 -18, 1961 -19, 1961 -20
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson and upon vote being taken thereon, the following voted in

Member Howard Heck introduced the following resolution and
moved its adoption:

WHEREAS, it is proposed that there be constructed an improve-
meut consisting of the following:

Construction of 8" water main on:
Humboldt Avenue North from 69th Avenue to 65th Avenue North;
65th Avenue North from Humboldt Avenue to Girard Avenue North;
and Girard Avenue North from 65th Avenue forth to north line
of P.A.I. 94 .
WHEREAS, the Village Engineer has made a preliminary report
advising that said proposed improvement is feasible and that it can
be constructed at an estimated cost of $42,315.00,
NOW, THEREPORE, BE IT RESOLVED by the Village Council of
the Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted
by ZhWW398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be
held at Earle Brown School in the Village on Wednesday the 3rd day
of May, 1961, at 8 :00 p.m., and the Clerk shall publish notice of
the time and place of hearing by two weeks' publication in the
official newspaper of the Village.
3. The area proposed to be assessed for said improvement
is as follows:
ALL LOTS AND PARCELS ABUTTING ON THE ABOVE NAMED STREETS.
4.• This proposed improvement shall be designated
Water Improvement No. 1961 - 14.
WIT FURTHER RESOLVED by the Village Council of the Villade
of Brooklyn Center, Minnesota, that it is hereby determined that the
properties which will be served by Water Improvement No. 1961 -14
when said improvement is completed, will also be benefitted by
Water Improvement No. 1956 -19 and 1960 -1, which property was not
initially assessed for Water Improvement No. 1956 - 19 and 1960 -1
from general ad valorem tax levies or other sources and funds in
addition to special assessments heretofore made for said improvement
the Village shall be reimbursed therefor by adding $1j19500 to the
assessments to be levied for Water Improvement No. 1961 -14, and
the Village Clerk shall cause notice of such additional amounts to
be assessed to be included in the notice, of hearing in the making
of said Water Improvement No. 1961 -14.
The motion for the adoption of the foregoing resolution was duly
seconded by member Carl Carlson and upon vote being taken thereon,
the following voted in favor thereof; Carl Carlson, Henry Dorff,
Howard Heck and William Super; and the following voted against the
same: None; whereupon said resolution was declared duly passed and
adopted.
Motion by Carl Carlson and seconded by Henry Dorff that Truman
Nelson continue as Acting Manager of the Liquor Stores at a salary of
$550.00 per month and that Leonard LeValle continue as Acting Assistant
Manager at Liquor Store No., 1 at a salary of $415.00 per month.
Motion carried.
The bills set forth on the schedule attached to these Minutes
and made a part hereof entitled "The Bills Audited and Ordered Paid
at the Meeting of March 27, 1961" were audited and ordered paid.
Motion by Carl Carlson and seconded by Hdi&rd Heck to
adjourn. Motion carried.
