The Village CouAoii met in Regular session and was called to order
by Mayor William Super at 7 : P M.
Ron Can: Mayor William Super, Curl Carlson, Henry Dorff, Howard
Heck and Clifford Wellman were present.
Motion by Howard Heck and seconded by Carl Carlson to approve the
Minutes of the Regular meeting of March 27, 1$61, on deleting from the
Resolution on page 6 thereof reference to Improvement Nos. 1961 -1 And
1961 -2. Notion carried.
Motion by Carl Carlson and seconded by Henry Dorff to uphold the
recommendation of the Planning Commission to rezone from R -1 to B -1
property located at 69th and Humboldt Avenues!,North described as Lots 49,
50, 51, Aud. Sub. 310, except the south 150 of Lot 49. Motion carried.
Motion by Clifford Wellman and seconded �y Carl Carlson to uphold
the recommendation of the Planning Commission, to grant a special use
Permit to Busse- Erickson for construction of o gas station at the southeast
corner of 69th and Humboldt Avenues North as shown on the sketch filed
with the Building Inspector subject to approval of the Village Engineer
to insure proper access and exit driveways. Motion carried.

Motion by Carl Carlson and seconded by Howard Heck to uphold the
recommendation of the Planning Commission to grant a Special Use Permit
to Joe Sentry2, 5050 Osseo Road, for construction of a duplex according
to plans submitted to the Planning Cammissionlat 5100 Osseo Road and to
grant a variance on the lot area. Motion carried.
Motion by Clifford Wellman and seconded by Howard Heck to uphold
the recommendation of the Planning Comnission',to approve the proposed
plat of Busse - Erickson 3rd Addition with a var granted on the widths
of Lots 3 and k, Block 1; Lots 3 and h, Block 3; Lot h, Block 2; Lots 1
And 8, Block 4. motion carried.
Motion by Howard Heck and seconded by Clifford Wellman to uphold
the recommendation of the Planning Cammission'',to grant a variance to
Homedale Builders, Inc. to construct one models house on Lot 1, Block 2;
and one model house on Lot 2, Block 2, Busse - Erickson 3rd Addition, prior
to filing of said p1a3 a Transfer of title to be made after filing of
final plat of Busse - Erickson 3rd Addition. Motion carried.
Motion by Carl Carlson and seconded by Howard Heck to uphold the
recommendation of the Planning Commission to deny the request of American
Legion Duoos Bros. Post 7 ~630 for a variance to construct a metal building
at 4307 - 70th Avenue North. Motion carried.
Potion by Carl Carlson and seconded by Howard Heck to uphold the
recommendation of the Planning Commission and approve plans for a ware-
house and office building for M.I.A.G.', North America, Inc., on Tract A,
R.L.S. „`981. Motion carried.
Member Howard Heck introduced the following resolution and moved
its adoption:

WBEREAS, it is proposed that there be constructed an improvement
consisting of

ON WILLOW LANE FRMI 65th AVENUE NORTH TO 900

WHMMS, the Village Engineer has made a preliminary report advising
that said proposed improvement is feasible and that it can be constructed
at an estimated cost of $4o,63o.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, Minnesota, as follows:
1. The council proposes to proceed under authority granted by
chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held at
the Village Hall in the Village on Monday, the 8th day of May, 1961, at
8 :30 O'clock P.M., and the clerk shall publish notice of the time and
place of hearing by two weeks' publication in the official newspaper of
the Village.
3. The area proposed to be assessed for said improvement is as
follows:
ALL LOTS AND PARCELS OF PROPERTY ABUTTING ON THE ABOVE NAM
STREETS AND BENEFITS THEREBY.
4. This proposed improvement shall be designated Water Improvement
No. 1961 -32.

BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows:
1. The plans and specifications for the following improvement,
prepared by Minder Engineering, are hereby approved and ordered filed
with the Clerk:
STORM SEWER LATERALS to serve the area from 69th Avenue North to
73d Avenue North and from the west line of Hipp's East Palmer
Lake Terrace Addition and Halek's Addition to 180 feet east of

constructed at an estimated cost of $24,200.00,

1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended,

at the Village Hall in the Village on Monday., the 24th day of April,
1961, at 8:30 O'clock P.M., and the clerk shall publish notice of the

BE IT FURTHER RESOLVED BY THE Village Council of the Village of Brooklyn
Center, Minnesota, that it is hereby determined that the properties which
will be served by hater improvement No. 1961 -25 when said improvement
is completed, V1-11 also be benefitted by Water Improvement No. 1956 -19
and 1960 -1, which properties were not initially assessed for lister Im-
provement No. 1956 -19 and 1960 -1, and that as to expenditures made for
Water Improvement No. 1956 -19 and 1960 -1 from general ad valorem tax
levies or other sources and funds in addition to special assessments
heretofore made for said improvement,: the Village shall be reimbursed
therefor by adding $10,590.00 to the assessments to be levied for Water
Improvement No. 1961 -25 and the Village Clerk shall cause notice that
such additional amounts will be assessed to be included in the notice
of hearing in the making of said Water Improvement No. 1961.25.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the
following voted in favor thereof: Carl Carlson, Henry Dorff, Hovard
Heck, William Super and Clifford Wellman; and the following voted against
the same: None; whereupon said resolution was declared duly passed and
adopted.

ing that said proposed improvement is feasible and that it can be con-
structed at an estimated cost of $11,851.18,

Village of Brooklyn Center, Minnesota, as follows:
1. The Council proposes to proceed under authority granted by
Chapter 398, Laws of Minnesota, 1953, as amended.
2. A public hearing on the proposed improvement shall be held
at the Village Hall in the Village on Monday the 8th day of May, 1961,
at 7:30 PM, and the Clerk shall publish notice of the time and place of
hearing by two weeks' publication in the official newspaper of the Village.

ing that said proposed improvement is feasible and that it can be con-

ing that said proposed improvement is feasible and that it can be con-
structed at an estimated cost of $4729.42,

amounts will be assessed to be included in the notice of hearing in the

RESOLUTION AUTHORIZING THE EXERCISE OF JOINT
POWERS FOR THE IMP omm OF SHINGLE CREEK
AND PALMER LAID; SO AS TO PROVIDE STORM NiAINAGE
FOR THE VILLA=S OF BROOKLYN PARK AND BR00KLYN
CENTER
WHEREAS, the matter of disposal of surface waters and storm drains
is of serious consequence to the residents and officers of the Villages
of Brooklyn Park and Brooklyn Center and other municipalities in the
Shingle Creek watershed; and
WHEREAS, the providing of adequate storm drainage by the use of
Shingle Creek requires the improvement of said Creek; and
WHEREAS, said improvement can best be done on a cooperative basis
by said villages; and
WHEREAS, it has been determined by the engineers for both the
said villages that the level of Shingle Creek in the area known as
Palmer Lake should be set at 839.5 feet Brooklyn Park datum; and
WERMS, authorization to exercise the right of eminent domain
for drainage is provided for said villages by M.S.A. Section 465.01,
within and without their corporate limits; and
WHEREAS, M.B.A. Section 429.021 provides for the construction,
reconstruction, extension, and maintenance of storm sewers by such
municipalities, within and without their corporate limits; and said
chapter provides the procedures for such improvements; and
WHEREAS, M.B.A. Sections 106.501 and 106.511 provide for the
improvement and use of county and judicial drainage districts; and
WHEREAS, M.S.A. Section 471.59 provides that: „ Two or more
governmental units, by agreement entered into through action of their
governing bodies, may ,jointly or cooperatively exercise any power ec:omnon
to the contracting parties or any similar powers, including those which
are the same except for the territorial limits within whici they may be
exercised. ";
NOW, THEBEFORE, BE IT RESOLVED by the Council for tie Village of
Brooklyn Center as follows:
1. This Council, on behalf of the Village, does hereby authorize
and make this agreement with the Council and the Village of Brooklyn
Park for the purpose of utilizing Shingle Creek and the Palmer Lake
basin for the drainage and storage of storm waters for both said
villages.
2. It is agreed that the level of Shingle Creek, in the area
known as Palmer Lake, shall be set at 8 39.5 feet Brooklyn Park Datum.
3• It is agreed that a lake level control structure shall be
constructed at the outlet of Palmer Lake at approximately 69th Avenue
North at a cost of approximately $16,000 to be shared equally by the
two municipalities.
4. It is agreed that any necessary lowering and improving of
Shingle Creek necessary to the Village of Brooklyn Park north of said
lake level control structure shall be done at the expense of the Village

of Brooklyn Park, and to pay such costs the Village of Brooklyn park
may levy special assessments only against lands within its own ter -
ritorial limits.
5. It is agreed that any necessary lowering and improving of
Shingle Creek south of said lake level control structure within Brooklyn
Center shall be done at the expense of the Village of Brooklyn Center,
and to pay such costs the Village of Brooklyn Center may levy special
assessments only against lands within its own territorial limits.
6. The Mayor and Clerk of this Village are hereby authorised
and directed to execute this resolution as an agreement pursuant to
M.S.A. Section 471.59 and to send a certified copy to the Village Council
of the Village of Brooklyn Park. It is agreed that when each Village
has adopted this resolution, the agreement shall be in effect.

The Village Council of the Village of Brooklyn Center ordains:
Section 1. The following new Section is hereby added to Chapter
27 of the Village ordinances, said section to read as follows:
Section 27- 203.1 PARKING RESTRICTED TO RESIDENTS. No person,
other than a resident or a guest of a resident of property abutting
streets or ortions of streets "
p tr ets designated 'Resident Parking Only by
resolution of the Village Council, shall park any vehicle upon streets
so restricted.
Section 2. This ordinance shall take effect and be in force
from and after its publication.
The motion for the adoption of the foregoing ordinance was duly seconded
by member Howard Heck, and upon vote being taken hereon, the following
