Roll Call: Mayor William Super, Carl Carbon, Henry Dorff, and Howard Heck were present, Member Clifford Wellman arrived later in the meeting. The Mayor announced that the meeting, was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 - The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: PX69M TION WDEEM CONSTRUCTION OF SANITAIDC SEWER iwROVIIm N0. 1961 -7 ; AND ORDRUX PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the 'Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on 55th Avenue North from 4th Street North to the east 225 feet. 2. The plans and specifications for said improvement shall be prepared by Donald G. Foss, Village Engineer. The motion for the adoption of the foregoing resolution was dul seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, Howard Heck, Carl Carlson and William Super; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Humboldt Avenue North from 65th Avenue North south to Freeway property. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss., Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor than called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWFR impRovEmEn NO. 1961 -9 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Girard Avenue North from 65th Avenue North south to Freeway property. 2. The plans and specifications for said improvement shall be prepared by Donald G. Pass, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Howard Beck, William Super., Carl Carlson and Henry Dorff; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman arrived at the meeting at this point. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best intemts of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Fremont Avenue North from 65th Avenue North south to Freeway property. 2. The plans and specifications for said improvement shall be prepared by Donald G. Pass, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, William Super., Clifford Wellman, Carl Carlson and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: -3- r ?01 Construction of Sanitary Sewer Lateral on Emerson Avenue North from 65th Avenue North south to Freeway property. 2. The plans and specifications for said improvement shall be prepared by Donald G. Pose, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 -12. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary sewer Lateral on Dupont Avenue North from 65th Avenue North south to Freeway property. 2. The plans and specifications for said improvement shall be prepared by DonaldG. Poss, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, William Super, Clifford Wellman, Carl Carlson and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No, i 1-i3- The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27, 3961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections and the property owners owning the majority of the property appearing not to be in favor of said improvement, member -4- s 203 Carl Carlson introduced the fallowing resolution and moved its adoption: RESOLUTION DECLARING HEARING UNFAVORABLE FOR THE CONSTRUCTION OF SANITARY SEWER IWROVEMENT N0. 1 61 -1 WHEREAS, the majority of the property owners who are to be assessed for Sanitary Sewer Improvement No. 1961 -13 are not in favor of the construction of sanitary sewer at this time, NOW, TMKWORE,, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the hearing for the construction of Sanitary Sewer Improvement No. 1961 -13 is declared unfavorable. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon,, the following voted in favor thereof Henry Dorff, Howard Heck, William Super, Clifford Wellman, and Carl Carlson, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Water Mein Improvement No. 1961 -i4. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN IMPROVEMENT NO. 1961 -14 AND PROVIDING FOR REIM- BURSEMENT OF UNASSESSEDODST OF WATER WROVIMM NO. 1956 -19 and 1960 -1 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: CONSTRUCTION OF $" WATER MAIN ON THE FOLLOWING STREETS: SZRENT FROM TO Humboldt Avenue North 69th Ave. No. 65th Ave. No 65th Avenue North HumboldtAve. No. Girard Ave. No. Girard Avenue North 65th Ave. No. NO.line of F.A,T. 94 2. The plans and specifications for said improvement shall be prepared by the Village Engineer, Donald G. Poss. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, Howard Heck, William Super, Carl Carlson and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -5- 905 The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 -16. The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IlmROVmm NO. 1961 -16 AND ORDERING PREPARATION OF PLANS AND SMIFICATTONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on North Lilac Drive from 65th Avenue North to 970 feet southwest of 65th Avenue North. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss, Village Engineer. The motion for the adoption of the foregoing resolution was duly ;seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof; Henry Dorff, William Super, Clifford Wellman, Carl Carlson and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 -17. The Clerk produced an affidavit of publication of Notice or Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER iwROVEMENT NO. 1961 -17 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: -6- 207 Construction of Sanitary Sewer lateral on Humboldt Avenue North from 65th Avenue North to 675 feet south of 69th Avenue North. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, William Super, Clifford Wellman, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, Motion by Clifford Wellman and seconded by Carl Carlson to declare the hearing on Sanitary Sewer Improvement No. 1961 -18 unfavorable. Motion and second were subsequently withdrawn. Motion by Clifford Wellman and seconded by Howard Heck to continue the hearing on Sanitary Sewer Improvement No. 1961 -18 until May 8, 1961. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to continue the hearing on Sanitary Sewer Improvement No. 1961 -19 until May 8, 1961 at which time we shall have appraisal of the property belonging to Russ Jones. Motion carried. Motion by Clifford Wellman and seconded by Howard Heck to postpone the hearing on Sanitary Sewer Improvement No. 1961 -20 until May 8, 1961, in order to allow notice of increase in amount of estimated assessment to all petitioners involved and to notify all property owners in the area to be served by this improvement that their absence from the meeting on May 8, 1961, Will Indicate an affirmative vote for the improvement. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1968 -13. The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27, 1961, which affi- davit was examined end found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER iwROVEMENr NO. i96e -13 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Camden Avenue North from N.S.P. easement to 59th Avenue North, and on 58th Avenue North from 220' west of Camden Avenue North to 312' east of Camden Avenue North. 2. The plans and specifications for said improvement shall be prepared by Donald G. Pass, Village Engineer. -7- 209 The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, Howard Heck, William Super, Clifford Wellman and Carl Carlson; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Howard Heck and seconded by Clifford Wellman to continue the hearing on Sanitary Sewer Improvement No. 1960 -43 on May 8, 1961, so that the property owners involved may be notified that the estimated assess- ment exceeds by more than 10% the original assessment estimate.
