Roll Call: Mayor William Super, Carl Carlson, Henry Dorff and Howard Heck were present. Member Clifford Wellman arrived later in the meeting. Motion by Carl Carleton and seconded by Howard Heck to approve the Minutes of the Special meeting of April 25, 1961, as recorded. Motion carried. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1960 -64. The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 4, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: i RESOLUTION ORDERING CONSM=ION OF SANITARY SEWER IwROVE'NIENT N0. 1960 -64 AND ORDERING PREPARATION OF PLANS AND &WIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota. as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on: DREW AVENUE NORTH from 50th Avenue No. to 53rd Avenue No.; 53rd AVENUE NORTH from Ewing Avenue No. to 200 ft. east of Northport Drive; and NORTHPORT DRIVE from 53rd Avenue North to 53rd Place North. 2. The plans and specifications for said improvement shall be prepared by Donald G. Foss, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck,snd upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William Super; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1961 -31. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 4, 1961, which affidavit was examined and found satisfactory and ordered placed on file. -1- 243 The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION CRDIMING CONSTRUCTION OF WATE1( MAIN IMPROVEMENT N0. 1961 -31 AND PROVIDING FOR REDGMSE'MENT OF UNASSESSED COST OF WATER IMPROVEM W N0. 1956 -19 AND 1966 -1, AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS WHEREAS, the Village Engineer advises that it is essential to the betterment of the municipal water system that a 10" water main be constructed on 53rd Avenue from France Avenue to Osseo Road, and WHEREAS, the Village Council has initiated the construction of the above- described main, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Water Mains, services and appurtenances on 53d Avenue North from France Avenue North to Osseo Road. 2. The plans and specifications for said improvement shall be prepared by the Village Engineer, Donald G, Poss. 3. The amount of $490.00 per building site which would ordinarily be assessed for the construction of the above- described water main shall be deferred for a period of five years and then it shall be spread for a period of 20 years. 4. Any property owner desiring to connect to the above - described water main prior to the expiration of the Five -year period shall have his assessment spread from October 1 following the date of connection to the water main, The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Carl. Carlson, William Super, Howard Heck and Henry Dorff.. and the following voted against the same: None, whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 -15. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: -2- I 245 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on East Twin Lake Boulevard from 53rd Avenue North to Ekberg Drive. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William Super; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER impRomaT No. 1961 -21 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Beard Avenue No. from 60 feet south of 60th Ave. No. to 225 feet north of 64th Ave. No. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss., Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William Super; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Senitary.Sewer Improvement No. 1961 -280 The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 4, 1961, which affidavit was examined and found satisfactory and ordered placed on file. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER IMPROVEMENT N0. 1961 -28 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Halifax Avenue North from 70th Avenue North to 71st Avenue North, 2, The plans and specifications for said improvement r shall be prepared by Donald G. Pose, Village Engineer. i The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William, Super; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted, The Mayor announced that the meeting was open for the consideration of proposed Water Main Improvement No. 1961 -29. After hearing and considering all objections, and the property owners appearing in favor of said improvement., member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN IwROVEMw N0. 1961 -29 AND PROVIDING FOR REIM- BURSEMT OF UNASSESSED COST OF WATER IMPROVEMENT NO. 1956 -19 AND 1960 -1, AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1, It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: CONSTRUCTION OF WATER MAINS, SERVICES AND APPURTENANCES ON HALIFAX AVENUE NORTH from 70th Ave. Igo. to 71st Ave. No. 2. The plans and specifications for said improvement shall be prepared by the Village Engineer, Donald G, Pose. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff! Howard Heck and William Super; -4- 249 and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman arrived at the meeting at this point. (8 :55 P.M.) The Mayor announced that the meeting was open for the consideration of proposed Water Mein Improvement No, 1961 -32, The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 4, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF WATER MAIN IMPROVEMENT N0. 1961 -32 AND PROVIDING FOR REIM BURSEMENT OF UNASSESSED COST OF WATER IMPROVEMENT NO. 1956 -19 AND 1960 -1, AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Water mains, services and appurtenances on; 65th AvenueNorth - from Girard Avenue North to Willow Lane and Willow Lane from 65th Avenue North to 900 feet north of 65th Avenue North. 2. The plans and specifications for said improvement shall be prepared by the Village Engineer, Donald G. Poss. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer improvement No. 1961 -2 (Amended). The Clerk produced an affidavit of publication of Notice of Amended Public Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on May 4, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoptions -5- 2 1 RESOLUTION ORDERING CONSTRUCTION OF SANITARY SVM DWROVFM N0. 1961 -2 (amended) AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of sanitary sewer lateral on 67th Avenue North from 5th Street North to 175 feet east of 5th Street North. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No, 1961 -19. The Clerk produced an affidavit of publication of notice of hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27, 1961 which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing not to be in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION DECLARING HEARING UNFAVORABLE FOR THE CONSTRUCTION OF SANITARY SEWED IMPROVEMENT NO. 7.961 -19 WHEREAS, the majority of the property owners who are to be assessed for Sanitary Sewer Improvement No. 1961 -19 are not in favor of the construction of sanitary sewer at this time due to the cost of acquiring right-of-way., NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the hearing for the construction of Sanitary Sewer Improvement No. 1961 -19 is declared unfavorable. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Henry Dorff, Howard Heck, William Super, Carl Carlson and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 -18. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on Bryant Avenue North from 65th Avenue North to 67th Avenue North. 2. The plans and specifications for said improvement shall be prepared by Donald G. Poss, Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. After hearing and considering all objections, and the property owners appearing not to be in favor of said improvement, member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION DECLARING HEARING UNFAVORABLE FOR THE CONSTRUCTION OF SANITARY SEWER IMPROVEMENT NO. 1 61 -20 rM r WHEREAS, the majority of the property owners who are to be assessed for Sanitary Sewer Improvement No. 1961 -20 are not in favor of the construc- tion of sanitary sewer at this time, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, that the hearing for the construction of Sanitary Sewer Improvement No. 1961 -20 is declared unfavorable. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Henry Dorff, Howard Heck, William Super, Carl Carlson and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting as open for the consideration of proposed Sanitary Sewer Improvement No. 1960 -43• The Clerk produced an affidavit of publication of notice of hearing -7- 2� on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on April 27, 1961 which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing not to be in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION DECLARING HEARING UNFAVORABLE FOR THE CONSTRUCTION OF SANITARY SEWER IM2ROVFMOU 1960 -43 WEEMS, the majority of the property owners who are to be assessed for Sanitary Sewer Improvement No. 1960 -43 are not in favor of the construc- tion of sanitary sewer at this time, NOW, THEREFORE, BE IT RESOLVED by 1he Village Council of the Village of Brooklyn Center, Minnesota, that the hearing for the construction of Sanitary Sewer Improvement No. 1960 -43 is declared unfavorable. The motion for the adoption of the foregoing resolution was duly seconded by member Clifford Wellman, and upon vote being taken thereon, the following voted in favor thereof: Henry Dorff, Howard Heck, William Super, Carl Carlson and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Mettion by Carl Carlson and seconded by Howard Heck to uphold the recommendation of the Planning Commission to grant to H. W. Burton a variance to combine the west 75' of Lots 5 and 6, Block 3 Brooklyn Manor, to create a lot with a 69 -foot front width and 160 feet deep. Motion carried. Motion by Clifford Wellman and seconded by Howard Heck to uphold the recommendation of the Planning Commission to grant a variance to Dale Wesson to build an attached gara at 6013 Halifax Avenue (Lot 9, Block 9, Pearson's Northport 3rd Additionr3' from the south property line. Motion carried,. Motion by Howard Heck and seconded by Henry Dorff to uphold the recommendation of the Planning Commission to grant a variance to David Yen, 2906 Nash Road, to build an attached garage 316* from the east line of Lot 16, Block 8, Garden City 1st Addition, by reason of the property line running at an angle from the street line. Nation carried. Motion by Carl Carlson and seconded by Howard Heck to u�hold' the recommendation of the Planning Commission to deny the request of John H. Heinen, Osseo, Minnesota, to rezone property located at 6236 Osseo Road from R -1 to R -B. Motion carried. Motion by Clifford Wellman and seconded by Henry Dorff to uphold therecommendation of the Planning Commission to grant a Special Use Permit to Campion Realty to construct one four -unit apartment building on property located at 5500 Bryant Avenue, described as S 1/2 of Lot 46 lying west of East 200 feet thereof, Garcelon's Addition. Motion carried. Motion by Clifford Wellman and seconded by Carl Carlson to refer to the Village Attorney the question of whether or notthe Special Use Permit issued to Sinclair Oil Company on November 18, 1958, for a service station location on the northeast corner of 63d and Osseo Road is still in effect; and that the Village Attorney report to the Village Council on May 22, 1961. Motion carried. Member Clifford Wellman left the meeting at this point. (1:00 A.M.) Motion by Howard Heck and seconded by Carl Carlson to uphold the recommendation of the Planning Commission to deny a variance to Shoppers' City to construct an addition to the east end of the existing building. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to uphold the recommendation of the Planning Commission to approve Gregor's Addition subject to the petitioner obtaining a Quit Claim Deed in favor of the Village for the north 30 feet of George ".am- property for street purposes. Motion carried.
