HomeMy WebLinkAbout1961 06-05 CCM Special Session 33 Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota June 5, 1961 The Village Council met in Special session and was called to order by Mayor William Super at 7:40 P.M. Roll Call: Mayor William Striper, Carl Carlson, Henry Dorff and Howard Heck were present. Member Clifford Wellman was absent. Motion by Carl Carlson and seconded by Howard Heck to approve the Minutes of the Regular meeting of May 22, 1961, as recorded. Motion carried, The Village Council discussed the matter of dog control with a Mr. Decker and the dog catcher and instructed the administrator to check the amount of money collected in fees and licenses against the cost of dog control to determine whether or not it was possible to increase the number of hours of patrolling by the dog catcher. A land use and development map was presented to the Village of Brooklyn Center by the Area Development Department of the Minneapolis Gas Company. The Administrator was instructed to write a letter of appreciation to the Minneapolis Gas Company, The Mayor announced that the meeting was open for the consideration of proposed Sanitary Sewer Improvement No. 1961 -35. The Clerk produced an affidavit of publication of Notice of Hearing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on June 1, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ORDERING CONSTRUCTION OF SANITARY SEWER INff'ROVEMENT No, 1961 -35 AND ORDERING PREPARATION OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the Village and the owners of property specially benefitted thereby that the following improvement shall be constructed: Construction of Sanitary Sewer Lateral on 69th Avenue North from Oliver Avenue North to 325 feet west of Oliver Avenue North. 2. The plans and specifications for said improvement shall be prepared by Minder Engineering Company. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, William Super, Carl Carlson and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -1- 5 Member Carl Carlson introduced the following Resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED SANITARY SEWER 1WROV34EP T NO. 1961 -13 rnr ww r..wwr�.ro rrwrr�.�.rrrr.r r r Mrs.. i r. �� WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Sanitary Sewer on Bryant Avenue North from 65th Avenue North to 163 feet south of the center line of 64th Avenue North, and WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $5109.40, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shell be held at the Village Hall in the Village on Monday, the 26th day of June, 1961 at 8:00 P.M., and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: ALL LOTS AND PARCELS ABUTTING THE ABOVE DESCRIBED PROJECT 4. This proposed improvement shall be designated Sanitary Sewer Improvement No 1961 -1 The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, H -,nry Dorff, Howard Heck and William Super, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. By common consent, the Village Engineer and Village Administrator were authorized to negotiate a contract for a water study with Black and Veatch of Kansas City and Carter - Krueger & Associates of Minneapolis. The Village Administrator was instructed to prepare several possible layouts for the locating of the Street Department garage on Lot 50, Aud. Sub. 309, Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK {CONTRACTED BY DEVELOPS&) WHEREAS, Kenneth Bergstrom, a developer, has contracted to construct the following improvements within Bergstrom's Lynside Manor 4th Addition: Project No. 1960 -67 - Water Main on Major Avenue North and Noble Avenue North from 63rd Avenue North to the south terminus of each. WEEMS, Kenneth Bergstrom has satisfactorily completed the above improvements, -2- 37 NOW,, THEREFOR''., BE IT REWLVED by the Village Council of the Village of Brooklyn Center: 1. Upon recommendation of the Village Engineer and Suburban Engineering, Inc., the work completed is hereby accepted and approved. 2. The value of the work performed is as follows: $ 8,330.60 The motion for the adoption of the foregoing resolution was duly seconded by Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Henry Dorff, William Super, Carl Carlson and Howard Heck, and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION ACCEPTING WORK (CONTRACTED BY DEVELOPER) WHEREAS, Ryan Lake Properties, Inca a developer has contracted with Erickson Brothers to construct the following improvements within Ryan Lake Terrace Addition: Project No. 1960 -36 - Water Main on 47th Avenue North from France Avenue North to East Terminus. W8MMS, Erickson Brothers has satisfactorily completed the above improvements, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center: 1. Upon recommendation of the Village Engineer and Minder Engineering Co., the work completed is hereby accepted and approved. 2. The value of the work performed is as follows: $ 6,213.96 The motion for the adoption of the foregoing resolution was duly seconded by Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: William Super, Carl Carlson, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was duly passed and adopted. Motion by Howard Heck and seconded by Carl Carlson to extend for one year the permit to Shoppers' City for two directional signs located along Highway 100, on the condition they are properly maintained. Motion carried. Member Carl Carlson introduced the following ordinance and moved its adoption: AN ORDINANCE TO REGULATE THE CARRYING OF PISTOLS OR REVOLVERS AND AMENDING CHAPTER 19 OF THE VILLAGE ORDINANCES THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN CENTER DO ORDAIN AS FOLLOWS: Section 1. Chapter 19 of the Village Ordinances is amended by adding thereto the following new sections: �I -3- r 39 Section 19.801, DEFINITIONS. As used herein the words "pistol" or revolver shall mean a ny firearm with a barrel less than twelve inches in length. Section 12 -802 MINORS. No person within the corporate limits of the Village of Brooklyn Center shall carry a pistol or 'revolver upon his person.or in any vehicle who is not a citizen of the United States, or who is not twenty -one years of age, except those under the age of twenty-one years who are active and regularly enrolled members of an adult target shooting, pistol club, or sportsmen's club, which is duly authorized to purchase or receive weapons from the United States, provided such members of such club are at, or are going to or from their places of assembly or target practice. Section 19 -803. PERSONS CONVICTED OF CRIMES. No person within the corporate limits of the Village of Brooklyn Center shall carry a pistol or revolver upon his person, or in any vehicle who has been convicted of a felony by the courts of this state or any other state, or by the Courts of the United States, or who has been convicted anywhere of acts which, if comaitted in Minnesota, would constitute assault in the first or second degree, larceny, theft, unlawful entry, extortion, buying or receiving stolen property, using, and carrying or possession of burglar tools or weapons, escape, or who has been convicted in any other country of acts which, if done in Minnesota, would be a felony or would constitute any of the other offenses specified above or has been adjudged mental Incompetent* pe , 1 Y p Section 19 -$04 PERSONS UVDER :CMUENCE OF LIQUOR OR NARCOTICS. No person within the corporate limits of the Village of Brooklyn Center who is under the influence of intoxicating liquor or narcotic drugs shall carry a pistol or revolver upon his person or in any vehicle. Section ,19 -805 PENALTY. Any person violating the provisions of this ordinance shall, upon conviction thereof, be punished by a fine not to exceed 0000 or by imprisonment not to exceed 90 days. Section 2. This ordinance shall take effect from and after its legal publication. The motion for the adoption of the foregoing ordinance was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck and William Super, and the following voted against the same: None; whereupon said ordinance was declared duly passed and adopted. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION OF TEWORARY CANCELLATION FROM SIN COUNTY TAX ROLLS - SPECIAL ASSESSMENTS FOR SANITARY INTERCEPTQR AND STORM SEWER ON PARCEL 2200 LOT 19, AUD. SO. #302, PLAT ¢89104 WHEREAS, the property, Parcel 2200, Lot 19, Aud. Sub. x}309, Plat 89104, owned by Arthur Paulson is unusable as building sites until such time as an old storm sewer is removed, and WHEFMS, the storm sewer is located on this property without an easement, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, to cancel from the Hennepin County Tax Rolls the special assessments for Sanitary Interceptor and Storm Sewer on said property until such time as the storm sewer is removed and the lots become usable, _4_ 41 THEW.7011E, the County Auditor is authorized and directed to cancel from the Tax Rolls the following special assessments, including the current installment: Total 1960 /61 Unpaid Le Assessment Installment Balance San. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, William Super, He Dorff and Howard Heck; and the following voted against the same: lone; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Henry Dorff to accept the Justice Report for the month of April 1961 submitted by Raymond Benson. Motion carried.
