Roll Call: Mayor William Super, Carl Carlson, Henry Dorff and Howard Beck were present. Motion by Howard Heck and seconded by Carl Carlson to approve the Minutes notes the S d ion of Special meet of June 1 1 as recorded, Mot � � 5, 96 , Nation by Carl Carlson and seconded by Howard Heck to uphold the recommendation of the Planning Commission to grant a Special Use Permit to Sears, Roebuck and Company to construct an automotive center in the south- west area of the Dayton, - Brookdale project according to the plot plan. Motion carried. Member Clifford Wellman arrived at the meeting at this point (7:55 P.M. Motion by Howard Heck and seconded by Henry Dorff to uphold the recommendation of the Planning Commission to grant a variance to James Olund, 5642 Emerson Avenue, to divide the west 1/2 of the following tract into two lots, one 65' x 135.65 with existing house and one 66.55' x 135.65 for a new building site, subject to easement for road purposes over the west 30' thereof: The NW 1 of the SW 1/ of Section 1, Township 118, Range 21, described as follows: Commencing at a point on the East line of said NW 1/4, distant 131 feet south of the HE corner of said NW 1/4; thence South 131.42 feet along said East line of said NW 1/4; thence West 331 .3 feet, plus or minus, to the West line of the East 1/4 of said NW 1 thence North 131.57 feet along said West line; thence east 331.37 feet,, plus or minus, to the point of beginning. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to uphold the recommendation of the Planning Commission to approve the plans of Dallas Holm, 6018 Halifax Avenue.. for a commercial building to be built on Tract D, R.L.S. 952, as submitted. Lotion carried. Motion by Carl Carlson and seconded by Howard Heck to instruct the Village Administrator to contact Mr. Frank Waite, owner of property abutting the Brook Park Baptist Church property at 63d Avenue and Perry Avenue, as to the cost of street and /or as to an agreement deferring payment for the cost of the east one -half of the street. Motion carried. Motion by Howard Heck and seconded by Henry Dorff to uphold the recommedation of the Planning Commission to approve the plans of Brook Park Baptist Church to build a temporary basement church on their property at 63d and Perry Avenues on the condition that the church provide screened plantings around the basement on the 63d Avenue and Perry Avenue sides and that they deed 9' of right -of -way for Perry Avenue with the intention of the church to secure title to the 1' outlot on Perry Avenue. Motion carried. Carl Carlson abstained from voting. t r 269 Motion by Henry Dorff and seconded by Howard Heck to uphold the recommendation of the Planning Commission to deny the petition of Marvin Gordon to rezone the northeast corner of 50th and Drew Avenues from R -1 to R -B. Motion carried. Motion by Carl Carlson and seconded by Henry Dorff to refer back to the Planning Commission the request of Brooklyn Center State Bank for a variance on the height of ion signs with instructions to et further Eh FY g approval from the Dayton Co., which presumably has control of signs on this property. Motion carried. Member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION VACATING A PORTION OF 70TH AVENUE NORTH FROM UMONT AVENUE NORTH TO EMERSON AVENUE NORTH wMamS, a petition has been duly filed with the Village Council of the Village of Brooklyn Center for the vacation of all that part of 70th Avenue North lying between Dupont Avenue North and Emerson Avenue North, and it appearing that said petition carries the name of Homsedele Builders, Inc., owner of not less than 51% in frontage of real property abutting on said portion of 70th Avenue North, and WHEREAS a Notice of Public Hearing on said proposed vacation to be held on June 12, 1961, was duly published on May 25, 1961 and June 1 1961, in the Brooklyn Center Press, and three copies of said notice were posted on June 1, 1961, in conspicuous places within the Village,, and WHEREAS, all parties having been heard and no one appearing in opposition thereto, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is deemed to be in the best public interest to, and the Village Council does hereby vacate all that part of 70th Avenue North lying between Dupont Avenue North and Emerson Avenue North, more particularly described as follows: The North 60 feet of the South 683.22 feet of Lot 49, Auditor's Subdivision 309, except that part lying within the following boundaries; Commencing at the southwest corner of said lot, thence easterly along the south boundary 327.148 feet, thence north 653.22 feet; thence west 327,~10 feet to a point on the west line 653,67 feet north of the southwest corner; thence to the point of beginning. 2. The Council proposes to proceed with said vacation under authority granted by Minnesota Statutes, Section 412.851. 3. The Village Clerk is authorized herewith to certify a copy of this resolution and cause said resolution to be recorded with the Register of Deeds in and for Hennepin County, Minnesota. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Howard Heck, Henry Dorff, William Super and Clifford Wellman; and the following voted against the same: None; where- upon said resolution was declared duly passed and adopted. Motion by Clifford Wellman and seconded by Howard Heck to approve the final plat of Brooklyn Manor subject to the posting of a street bond. Motion carried. -2- r 271 Member Howard Heck introduced the following resolution and moved its adoption. RESOLUTION APPROVING PLANS AND SPECIFICATIONS FOR WATER MAIN IMPROVEMENT NO. 1961 -25, SANITARY SEWER DwROVkfi9m NO. 1961 -26, STORM SEWER IMPROVEMENT NO. 1961 -27, AND DIRECTING ADVERTIMM FOR BIDS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The plans and specifications for the following improvement, prepared by Suburban Engineering are hereby approved and ordered filed with the Clerk: PROJECT NO. 1 -25 WATER MAIN STREET FROM TO Dupont Avenue North 69th Avenue North No.line of Brookdale Manor Emerson Avenue North 69j Avenue North No.line of Brookdale Manor Fremont Avenue forth 70th Avenue North No.line of Brookdale Manor 691 Avenue North Dupont Avenue North Emerson Avenue North 70th Avenue North Emerson Avenue North Fremont Avenue North PROJECT N0.1961-26 SANITARY SEWER To serve the following described'erea: Bounded on the south by 69th Avenue North, on the north by 73rd Avenue North, on the west by Humboldt Avenue North, on the east by Camden Avenue North, excluding the southeast and southwest 10 acres thereof; also, an area bounded on the north by 69th Avenue North, on the west by a line 165 feet west of the centerline of Girard Avenue North extended, on the south by 67th Avenue North extended and on the east by a line 165 feet east of Colfax Avenue North extended. PROJECT NO. 1961 -27 STORM SEWER To serve the following described area: Beginning at the centerline of Humboldt Avenue North and 73rd Avenue North, thence southerly to a point approximately 530 feet north of 70th Ave. No., extended, thence easterly to the centerline of Girard Avenue North extended, thence southerly to the rear lot line between Emerson Avenue North and Fremont Avenue North extended, thence southerly to a point approximately 970 feet south of the centerline of 69th Avenue North, thence easterly to the rear lot line between Dupont Avenue North and Emerson Avenue North extended, thence northerly to a point approximately 660 feet south of the centerline of 69th Avenue North, thence easterly to the centerline of Colfax Avenue North extended, thence northerly to proposed 722 Avenue North, hence westerly to the centerline of Dupont Avenue North extended, thence northerly to the centerline of ?3rd Avenue North, thence westerly to the point of beginning. 2.. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than three weeks prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than five percent of the bid. 3. Bid date is set for July 13, 1961, at 10 :00 O'clock A.M. 4. The Village Administrator and Village Engineer shall be authorized to open and tabulate the bids. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Clifford Wellman, William, Super, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. -3- 273 Motion by Henry Dorff and seconded by Carl Carlson to approve the final plat of Wangstad's Brooklyn Terrace 5th Addition subject to the posting of a street bond. Motion carried. Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION PROVIDING FOR PUBLIC AEARING ON PROPOSED STREET SURFACING INPROVNWT N0. 1961 -36 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of 4 inch base and 2 inch bituminous street surface on Kyle Avenue North from 65th Avenue to 300 feet north of 61st Avenue. WEEMSp the Village ll ge engineer has made a relimina report P x'Y advising that said proposed improvement is feasible and that it can be III constructed at an estimated cost of $7,930.00, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as.follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Monday, the 26th day of June, 1961, at 8:00 O'clock P,M., and the clerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. The area proposed to be assessed for said improvement is as follows: All parcels of property abutting on the above named street. 4. This proposed improvement shall be designated street surfacing improvement No. 1961 -36. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super, and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman introduced the following resolution and` moved its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED STREET SURFACING IMPROVSKM NO. 1961 -4 WHEREAS, it is proposed that there be constructed an improvement consisting of the following: Construction of 2 inch bituminous street surfacing on Janet Lane from June Avenue North to 800 feet east. WHEREAS, the village engineer has made a preliminary report advising that said improvement is feasible and that it can be constructed at an estimated cost of $1,195.00, NOW, THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota, 1953, as amended. -4- 275 2. A public hearing on the proposed improvement shall be held at the Village Hall in the village on Monday, the 26th day of June, 1961, at 8:00 O'clock P.M., and theclerk shall publish notice of the time and place of hearing by two weeks' publication in the official newspaper of the village. 3. Motion by Carl Carlson and seconded by Clifford Wellman to instruct the Village Attorney to prepare a Bottle Club Ordinance in accordance with the laws of the State of Minnesota and providing for a license fee of $100. Motion carried. Motion by Carl Carlson and seconded by Clifford Wellman to authorize the Mayor and Clerk to execute a liquor store lease with The Dayton Company subject to changing the occupancy date not to exceed February 1, 1963, and Including in the lease agreement a clause pertaining to the referendum on municipal liquor. Motion carried. Olson Plumbing Company 5102 49th Avenue North Wenzel Plumbing & Heating Company 1845 County Road 7, St. Paul Zahler Plumbing & Heating Company 5211 France Avenue North Motion carried. -5- 277 Member Clifford Wellman introduced the following resolution and moved its adoption: RESOLUTION AUTHORIZING THE MAYOR AND CLERK TO EXECUTE A QUIT CLAIM DEED IN FAVOR OF THE NORTHWESTERN BELL TELEPHONE COMPANY ON 65TH AVENUE NORTH WHEREAS, the Village of Brooklyn Center has on record a street deed for the North 40 of that part of Lot 1, Guilford Outl*s, lying East of a line which runs from a point on the North line of said Lot 1 310.10 feet East of the Northwest corner thereof to a point on the South line of said Lot 1 310.20 feel; East of the Southwest corner thereof, and WHEREAS, it has been determined that the South seven feet (79 of the above - described property is not required for the improvement of 65th Avenue North, and WHEREAS, the South seven feet (7') of the above - described deed creates a cloud on the title of the Northwestern Bell Telephone Company, NOW, THEREFORE BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Mayor and Clerk of the Village are hereby authorized to execute a Quit Claim Deed for said South seven feet (7') in favor of the Northwestern Bell Telephone Company. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, HF Dorff, Howard Heck, William Super and Clifford Wellman, and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Carl Carlson introduced the following resolution and moved its adoptbn: RESOLUTION AUTHORIZING THE MAYOR AND CLERK TO EXECUTE WATER STUDIES CONTRACT WHEREAS, a contract for a comprehensive engineering study of the Brooklyn Center water system has been satisfactorily negotiated by the Village Engineer and the Village Administrator with Black and Veatch of Kansas City, Missouri, and Carter, Krueger and Associates of Minneapolis, Minnesota, NOW, 'FORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center that the Mayor and Clerk are hereby authorized to execute said contract,, The motion for the adoption of the foregoing resolution was duly seconded ty member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and Clifford Wellman; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Clifford Wellman left the meeting at this point (11 :45 P.M.) The bills set forth on the schedule attached to these Minutes and made a part hereof, entitled "The Bills audited and Ordered Paid at the Meeting of June 12, 1961" were audited and ordered paid.
