Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center in
the County of Hennepin and State of Minnesota
August 14, 1961
The Village Council met in Regular Session and was called to order
by Mayor William Super at 7 :40 P.M.
Roll Call: Carl Carlson, Clifford Wellman, William Super, Henry
Dorff and Howard Reek were present.
Motion by Howard Heck and seconded by Clifford Wellman to accept
the report of Suburban Engineering regarding sewage capacities in the Brooklyn
Center sanitary sewer interceptor system and authorize the Administrator and
Village Engineer to contact the City of Minneapolis to determine whether or
not it is permissible for the Village of Brooklyn Center to contract for
sewer service with the Village of Brooklyn Park and to advise the Village of
Brooklyn Park that sewage capacity is available when it has been determined
that the Village can contract with the Village of Brooklyn Park. Motion
carried.
The Mayor announced that the meeting was open for the consideration
of proposed Water Main Improvement No. 1961.39•
The Clerk produced an affidavit of publication of notice of hearing
on the proposed improvement showing two weeks' publication thereof in the
official newspaper, the last publication being on August 10, 1961, which affi-
davit was examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections, and the property owners appearing in favor of
said improvement, member Clifford Wellman introduced the following resolution
and moved its adoption:
RESOLUTION ORDERING CONSTRUCTION OF WATER
MAIN 114PROVEMENT N0. 1961 -39 AND OR==
PREPARATION OF PLAN AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,
Minnesota, as follows:
1. It 1s hereby determined that it is necessary and for the best
interests of the Village and the owners of property specially benefited
thereby that the following improvement shall be constructed.
CONSTRUCTION OF WATER MAIN ON la=M AVENUE NORTH
FROM 62ND AVENUE NORTH TO TRUNK HIGHWAY 100,
ADJACENT TO TRUNK HIGHWAY 100 FROM XERXES AVENUE
NORTH TO 53RD AVENUE NORTH AND OSSEO ROAD, AND ON
COUNTY TRUNK HIGHWAY 10 FROM XEMMS AVENUE NORTH
TO A POINT APPROXIMATELY 1000 FEET EAST OF XEFIXES
AVENUE NORTH.
2. The plans and specifications for said improvement shall be
prepared by the Village Engineer.
The motion for the adoption of the foregoing resolution was duly seconded
by member Howard Heck, and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, William Super and
Clifford Wellman, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Motion by Clifford Wellman and seconded by Howard Heck to defer the
assessment for construction of water main under Project No. 1961 -39 along
Xerxes Avenue from 62nd Avenue to the south line of Grimme's 2nd Addition for
a period of five (5) years. At the end of five (5) years, an assessment of

$380 shall be certified for a period of 20 years for each building site
abutting the above described street. In the event any of the above pro-
perties wish to connect to the water system subsequent to this five -year
period, an additional assessment of $130 per building site shall be levied
in the year in which they connect. If any of the above properties wish to
connect to the water system within the above described five -year period, an
assessment of $490 per building site shall be levied in the year in which
they connect. Motion carried.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID AND
APPROVING CONTRACT FORM
WSEREAS, the Village Administrator and the Village Engineer have
reported that on August 14, 1961, at 10:00 A.M., they opened and tabulated
bids received for Water Main Improvement Project No. 1961 -39, and that said
bids were as follows

NOW, THSREEFORE BE IT RESOLVED by the Village Council of the Village
of Brooklyn Center, that the bid of Petrowske & Ross, in the amount of
$69,500.05, as to furnishing all work, labor and material in connection
with Water Main Improvement Project No. 1961 -39, according to the plans and
specifications therefor now on file in the office of the Village Clerk is
deemed to be lowest and best bid submitted for said work by a responsible
bidder and said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Henry Dorff, and upon vote being taken thereon the following voted in

Clifford Wellman, and the following voted against the same: None; whereupon
said resolution was declared duly passed and adopted.
Trustee Clifford Wellman left the meeting at this point, 9:30 P.M.
Member Howard Heck introduced the following resolution and moved
its adoption:
RESOLUTION VACATING TRACT G, R.L.S.
NO. 546 AS A PUBLIC STREET
Whereas, a petition has been duly filed with the Village Council
of the Village of Brooklyn Center for the vacation of Tract G, R.L.S. 546
by Nathan W. and Lillian P. Simcoe, owners of all land abutting upon said
Tract G. R.L.S. 546 and
Whereas, a Notice of Public Hearing on said proposed vacation to

be held on August 14, 1961, was duly published on August 3 and August 10, 1961,
in the Brooklyn Center Press, and three copies of said notice were posted on
August 3, 1961 in conspicuous places within the Village, and
Whereas, all parties having been heard and no oneappearing in
opposition thereto,
NOW, THEREFORE, BE 1T RESOLVED by the Village Council of the
Village of Brooklyn Center, Minnesota, as follows:
1. It is deemed to be in the best public interest to, and the
Village Council does hereby vacate all of Tract a, R.L.S. 546.
2. The Council proposes to proceed with said vacation under au-
thority granted by Minnesota Statutes, Section 412.851.
3. The Village Clerk is authorized herewith to certify a copy of
this resolution and cause said resolution to be recorded with
the Register of Deeds in and for Hennepin: County, Minnesota.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon, the following voted
in favor thereof: Carl Carlson, Henry Dorff, Howard Heck, and William Super,
and the following voted against the same: None; whereupon said resolution
was declared duly passed and adopted.
Member Carl Carlson introduced the following ordinance and moved
its adoption:
AN ORDINANCE CHANGING THE
DATE OF VILLAGE ELECTION
THE VILLAGE COUNCIL OF THE VILLAGE OF BROOKLYN aWTER ORDAINS:
Section 1. The following new section is hereby added to Chapter 29
of the Village ordinances, said section to read as follows:
Section 29 -401. DATE OF ELECTION CHAFED. Pursuant to the provisions
Of Minnesota Statutes�ection 205.07 the regular Village election of the Village
of Brooklyn Center shall hereafter be held on the first Tuesday after the first
Monday in November rather than on the first Tuesday after the first Monday in
December.
Section 2. This ordinance shall take effect from and after proper
notification of the County Auditor and the Secretary of State.
Passed by the Village Council of the Village of Brooklyn Center this
14th day of August 1961.
The motion for the adoption of the foregoing ordinance was duly seconded by
member Henry Dorff, and upon vote being taken thereon, the following voted in
favor thereof: Carl Carlson, Henry Dorff, Howard Reek and William Super, and
the following voted against the same: None; whereupon said ordinance was
declared duly passed and adopted.
Motion by Carl Carlson and seconded by Howard Heck to instruct the
Administrator to contract with Community Planning & Design Associates, Inc.,
for planning services on an hourly basis for the balance of 1961, fees for
said planning services to be paid from surplus S.S.D.A. funds. Motion carried.
Motion by Carl Carlson and seconded by Henry Dorff to approve the

Motion by Howard Heck and seconded by Carl Carlson to approve

Publication at least once in the official newspaper and in the Construction
Bulletin, the date of first publication not less than 10 days prior to the
date for receipt of bids. Said notice shall state that no bids will be con-
sidered unless sealed and filed and accompanied by a cash deposit, bid bond,
cashier's check or certified check payable to the Clerk in the amount of not
less than five per cent of the bid.
3. Bid date is set for September 7, 1961, at 10 :00 o'clock A.M.
4. The Village Administrator and Village Engineer shall be
authorized to open and tabulate the bids.

To serve the area bounded on the north by 73rd Avenue North on the south by
70th Avenue North on the west by Lyndale Avenue North and on the east by the
Mississippi River.
2. The Clerk shall advertise for bids for such improvement by publication
at least once in the official newspaper and in the Construction Bulletin, the
date of first publication not less than 3 weeks prior to the date for receiving
of bids. Said notice shall state that no bids will be considered unless sealed
and filed and accompanied by a cash deposit, bid bond, cashier's check or
certified check payable to the Clerk in the amount of not less than five per -
cent of the bid.
3. Bid date is set for September 14, 1961 at 10:00 A.M.
4. The Village Administrator and Village Engineer shall be authorized
to open and tabulate the bids.

member Carl Carlson, and upon vote being taken thereon the following voted in

was declared duly passed and adopted.
Motion by Howard Heck and seconded by Henry Dorff to approve the
Justice Report for the month of July, 1961 submitted by Justice Raymond Benson.
Motion carried.
Motion by Carl Carlson and seconded by Howard Heck to accept the
resignation of Wayne Ruud as police patrolman to be effective September 1,
1961. Motion carried.
Member Henry Dorff introduced the following resolution and moved
its adoption:
RESOLUTION RELATING TO SPECIAL ASSESSMENTS FOR
1M'PRCjVIIuMS FINANCED BY SALE OP $885,000
IMPROVEMENT BONDS DATED JULY 1, 1961
THE VILLAGE COUNCIL CF THE VILLAGE OF BROOKLYN CENTER RESOLVES AS FOLIM:
The Village Council on behalf of the Village of Brooklyn Center does
hereby covenant and agree that if any of the special assessments heretofore
levied by the Village of Brooklyn Center for payment of those improvements

recited in the resolution adopted June 15, 1961 authorizing the sale of bonds
In the amount of $885,000 shall be set aside or declared invalid by any court
or competent jurisdiction the Village will take such steps as are necessary
to reassess the cost of such improvement (or at least 20% thereof) against
benef fitted property in the manner prescribed by law.
The motion for the .adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon, the following voted

and the following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
Notion by Henry Dorff and seconded by Carl Carlson to approve the
expenditure of $30.00 as half payment for services of a 3 -man hearing board
appointed in the James Fischbach matter. Motion carried.
Motion by Carl Carlson and seconded by Howard Heck to adjourn.
Motion carried. The meeting adjourned at 11 :30 P.M.
