Reek were present. Mayor William N.. Super was absent. Motion by Howard Heck and seconded by Carl Carlson to approve the minutes of August 7, 1961. Motion carried. Motion by Carl Carlson and seconded by Howard Heck to approve the minutes of August 8, 1961. Motion carried. Member Carl Carlson introduced the following resolution and moved Its adoption, upon the recommendation of the Village: Engineer: RESOLUTION' APPROVING PLANS AND GRADES FOR THE REEffEMENT OF TRUNK HIGHWAY §24 WHAS the Commissioner of Highways has prepared plans, special PrOvisitms and specifications for the improvement of a part of Trunk Highway N 393 renumbered as Trunk Highway No. 694 withi the corporate limits of the Village of Brooklyn Center for Bridge No. 9321, T. H. 694 W. B. over Mississippi River; and WHEREAS said plans and special provisions are on file in the office of the Department of Highways, Saint Paul, Minnesota, being marked, labeled, and identified as S.P. 2787-9321 (T.H. 694 =393) Minn. Prof. 1 694- (20) 222; and WHEREAS said specifications are On file in the office of the Dapart- meut of Highways, Saint Paul, Minnesota, being marked, labeled and identified as s. P. 2787 -9321 (T.H. 6 9 4 =393), Minn. Pro3. I 694-5 (20) 222 which, to- gether with the Minnesota Department of Highways Specifications for Highway Construction, dated May 1, 1951, on file in the office of the Commis of Highways, constitute the specifications for said improvement of Trunk Highway Number 393 renumbered as Trunk Highway fiber 694. and WHEREAS, copies of said plans and special provisions as so marked, labeled and identified are also on file in the office of the Village Clerk; and WHERUS,the term "said plans and special provisions" as hereinafter used in the body of this resolution shall be deemed and intended to mean, refer to, and incorporate the plans and special provisions in the foregoing recitals particularly identified and described. i NOW, THEN, BE IT RESOLVED that said plans and special provisions for the improvement of Trunk Highway Number 393 renumbered as Trunk Highway Number 694 within the limits of the Village of Brooklyn Center be and are hereby approved. BE IT AMBER SOLVED that the elevations and grades as shown in said plans and special provisions be and they are hereby approved and consent is hereby given to any and all changes in grade occasioned by the construction of said Trunk Highway Number 393 renumbered as Trunk Highway Number 694 in accordance with said plans and special provisions. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Clifford Wellman, Henry Dorff and Howard Heck; and the following voted against the same: Nome, whereupon said resolution was declared duly passed and adopted. �. gg Member Carl Carlson introduced the following resolution and moved its adoption: RESOLUTION AMMIM NW TO PERMIT ENCROAMW UPON THE RIGHT OF WAY OF TRUNK HIGHWAY 694 WEWAS the Village of Brooklyn Center has approved the plans and specificati for the improvement of that part of Trunk Highway No. 393 re- numbered as Trunk Highway No. 694 within the corporate limits of the Village of Brooklyn Centex for Bridge No. 9321, T.H. 694 W.B. over Mississippi River; and WHl'' ';AS in order to obtain Federal Aid in the construction of said Trunk Highway No. 393 renumbered as Trunk Highway No. 694, the Bureau of Public Roads requires the assurance that the Village of Brooklyn Center will not suf- fer any encroachment of any nature or kind whatsoever on the right of way of said Trunk Highway No. 393 renumbered as Trunk Highway No. 694 within the cor- porate limits of the said Village of Brooklyn Center. Now THEN, BE IT RESOLVED that said Village of Brooklyn Center does hereby agree end covenant that it will never permit or suffer, within its cor- porate limits, any encroachment of any kind whatsoever, including curb gas Pumps and gas stations, billboards or other structures of any kind whatsoever, upon the right of way of Trunk Highway loo. 393 renumbered as Trunk Highway No. 694 and to the above end said Village of Brooklyn Center hereby agrees that it will never i ssue any license, permit, or grant or give any leave or liberty or any other consent of whatever form for the construction or maintenance of any encroachment whatsoever, including Curb gas pumps and gas stations, billboards or other structures of any kind whatsoever, upon said right of way; and that said Village of Brooklyn Center will cooperate insofar as possible to eliminate existing encroachments constituting traffic hazards and will further take any necessary action to eliminate any encroachment that may hereafter exist on said trunk highway right of way. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Clifford Wellman, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Henry Dorff to authorize the Village Administrator to take bids for the construction of a concrete block wall and chain link fence around the Street Department garage on Dupont Avenue at an estimated cost of $4,245.00. The money for this construction shall be appropriated from the liquor store surplus. Bids are to be received on September 11, 1961 Motion carried. Member Howard Beck Introduced the following resolution and moved its adoption: RESOLUTION R$QUESTIM ACCESS TO T.H. #100 AT XMW AVENUE NORTH WHEREAS, Minnesota Trunk Highway No. 100 is recognized as a limited access highway, and WHEREAS, Xerxes Avenue North between 59th Avenue North and Minnesota Trunk Highway No. 100 has officially been designated as Municipal State Aid Project No. 27- 110 -01, and WHEREAS, said Municipal State Aid Project 27- 110 -01 has been designed to ultimately connect with the northeast quadrant ramp of the future interchange at Minnesota Trunk Highways No. 100 and 152 and to also ultimately connect with the westbound traffic lanes of future Minnesota Trunk Highway No.100, WV, THEREFORE, BE IT RESOLVED by the Village Council of the Village Of Brooklyn Center that the Minnesota Highway Department be requested, through its Commissioner of Highways, to grant access to Minnesota Trunk Highway No. 100 at approximate westbound roadway Station 329 + 12 for said Municipal State Aid Project 27- 110 -01. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson, and upon vote being taken thereon the following voted in favor thereof: Carl Carlson, Clifford Wellman, Henry Dorff and Heard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. adoption: Member Howard Heck i0troduced the following resolution and moved its �. 98 RESSOLDTION PROVIDING FOR PUBLIC HEARMG ON DWROVEMEBT No. 1961 -45 WHEREAS, it is proposed that there be constructed Municipal State Aid Project No. 27- 110 -01, a street improvement consisting of the following: Construction of grading, base,and surfacing on Xerxes Avenue North from State Trunk Highway No. 100 to the south line of Gri:mnes 2nd Addition (Municipal State Aid Project No. 27- 110 -01), and W MEAS, the Village Engineer has made a preliminary report advising that said improvemnt is feasible and that it can be constructed at a total estimated cost of $69 : 742.18, NOW, FORE, BE IT RffiOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted under Chapter 398, Laws of Minnesota 1953, as amended. 2. A public hearing on the proposed improvement shall be held at the Village Hall in the Village on Monday the 25th day of September, 1961, at 8:00 P.M., and the Clerk shall publish notice of the time and place of hearing by two weeks' publica- tion in the official newspaper of the Village. 3. The area proposed to be assessed for said improvement is as follows: All parcels of property abutting on the above -named street where the project isto be constructed. 4. This proposed improvement shall be designated Street Improvement No. 1961 -45. The motion for the adoption of the foregoing resolution was duly seconded by member Henry Dorff, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Clifford Wellman, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. Member Howard Heck introduced the following resolution and moved Its adoption: RESOLUTION PROVIDING FOR PUBLIC HEARING ON PROPOSED CURB AND GUTTER IMP'ROt E ENT NO. 1961 -50 WH 2MAS, it is proposed that there be constructed an improvement consisting of the following Construction of curb and gutter on Xerxes Avenue North from Trunk Highway No. 100 to the south line of Grimmes 2nd Addition (Municipal State Aid Project No. 27- 110 -01), and WHEREAS, the Village Engineer has made a preliminary report advising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $17,712.80, NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minnesota 1953, as amended. 2. A public hearing on the proposed improvement shall be held -3- f at the Village Hall in the Village on Monday, the 25th day of September, 1961 at 8 :00 P.M., and the Clerk shall publish notice of the time and place of hearing by two weeks' publication in the-official newspaper of the Village. 3. The Clerk shall advertise for bids for such improvement by publication at least once in the official newspaper and in the Construction Bulletin, the date of first publication not less than three weeks prior to the date for receipt of bids. Said notice shall state that no bids will be considered unless sealed and filed and accompanied by a cash deposit, bid bond, cashier's check or certified check payable to the Clerk in the amount of not less than rive percent (5 %) of the bid. 3. Bid date is set for September 22, 1961, at 10 :00 A.M. 4. The Village Administrator and Village Engineer shall be authorized to open and tabulate the bids. Member Henry Dorff introduced the following resolution and moved its adoption: RESOLUTION PROVIDIAG FOR PUBLIC HEARING ON PROPOSED STORM SEWER IMPROVEMM NO. 161.4$ WHM3EAS, it is proposed that there be constructed an improvement consisting of the following: storm Sever Protect No. 1861 -48 _7- 94 To serve the area bounded on the north by 73rd Avenue North on the south by 70th Avenue North on the west by Ly3ndale Avenue North and on the east by the Mississippi River. WI3ERUS, the Village Engineer has made a preliminary report ad- vising that said proposed improvement is feasible and that it can be constructed at an estimated cost of $19,900.00. NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: L. The Council proposes to proceed under authority granted by Chapter 398, Laws of Minneesota, 1953, as . 2. The motion for the adoption of the foregoing resolution was duly seconded by member Howard Heck, and upon vote being taken thereon, the following voted in favor thereof: Carl Carlson, Clifford Wellman, Henry Dorff and Howard Heck; and the following voted against the same: None; whereupon said resolution was declared duly passed and adopted. The Mayor announced that the meeting was open for the considera- tion of proposed Water Main Improvement No.,1961 -41. The Clerk produced an affidavit of publication of notice of hear- ing on the proposed improvement showing two weeks' publication thereof in the official newspaper, the last publication being on Thursday, August 24, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement. After hearing and considering all objections, and the property owners appearing in favor of said improvement, member Howard Heck introduced the following resolution and moved its adoption: RESOLUTION MWING CONSTRUCTION OF WATER MAIN imovEMENT N0. 1961 -41 AND ORMING PREPARING OF PLANS AND SPECIFICATIONS BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. It is hereby determined that it is necessary and for the best interests of the village and the owners of property specially benefited thereby that the following improvement shall be constructed. WATER MAIN, SERVICES AND APPURTENANCES ON NORTH LILAC DRIVE FROM 65TH AVENUE NORTH SOUTHWESTWARD TO CAM= AVER NORTH -8- V44 2. The plans and specifications for said improvement shall be prepared by the Village Engineer. The motion for the adoption of the foregoing resolution was duly seconded !' by member Henry Dorff, and upon vote being taken thereon the following voted in favor thereof: Clif'f'ord Wellman, Carl Carlson, Beery Dorff ate. The Clerk produced an affidavit of publication of notice of hear- ing on the proposed improvement shoving two weeks' publication thereof in the official newspaper, the last publication being on Thursday, August 24, 1961, which affidavit was examined and found satisfactory and ordered placed on file. The Mayor then called upon all property owners present to present arguments either for or against the proposed improvement.
