Minutes of the Proceedings of the Village
Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
October 10, 1960
The Village Council met in Regular Session and was called to order
by Mayor William Super at 8:00 P.M.
Roll Call: Mayor William Super, Carl Carlson and Clifford Wellman
were present. Wayne Gageby and Russ Jones were absent.
In the absence of Clerk Russ Jones, A. J. Lee, Administrator,
recorded the Minutes.
The Mayor announced that the meeting was open for the consideration
of proposed sanitary sewer Improvement No. 1960 -669
The Clerk produced an affidavit of publication of Notice of Hearing
on the proposed improvement, showing two weeks' publication thereof in the

affidavit was examined and found satisfactory and ordered placed on file.
The Mayor then called upon all property owners present to present
arguments either for or against the proposed improvement. After hearing and
considering all objections and the property owners appearing in favor of
such improvement, Member Carl Carlson introduced the following resolution
and moved its adoption:
RESOLUTION CLOSING PUBLIC BEARING ON SANITARY
SEWER IMPROVEMENT N0. 1960 -66 AND ORDERING
PREPARATION OF PLANS AND SPECIFICATIONS
BE IT RESOLVED by the Village Council of the Village of Brooklyn Center,

I. It is hereby determined that it is necessary and for the best
interests of the Village and the owners of property specially benefitted
thereby at plans and specifications y' ons be completed and bids secured before

making the determination that the project described below shall proceed:
CONSTRUCTION OF SANITARY SEWER LATERALS AND LIFT
STATION TO SERVE THE FOLLOWING DESCRIBED PROPERTY:
The area bounded on the south by the Village Limits,
on the west by Twin Lake, on the east by the Village
Limits and on the north by the Soo Line Railroad tracks.
2. The plans and specifications for said improvement shall be prepared
by Minder Engineering Company.
3. Upon the completion of the plans and specifications, bids shall
be taken for the proposed improvement, and upon receipt of the bids, the
Village Engineer shall prepare the proposed assessment rolls and notify the
property owners to be assessed for the improvement of a new public hearing
to consider the distribution

The motion for the adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon the following voted
in favor thereof: Carl Carlson, Clifford Wellman, William Super; and the
following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.

Member Clifford Wellman introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING BID FOR 10 -TON
TILTING TRAILER AND APPROVING CONTRACT FORM
WHEREAS, the Village Administrator and Assistant Administrator have
reported that on October 7, 1960, at 11 :00 a.m., they opened and tabulated
bids received for the furnishing of a 10 -ton tilting trailer and that said
bids were as follows:

Ruffridge- Johnson Equipment Co. 2 weeks 2
Ruffridge- Johnson Equipment Co. 2 weeks 1,795.00

The bid from Ruffridge- Johnson in the amount of $1,795.00 was for a trailer
which did not meet specifications.
NOW., THEREFORE, BE IT RESOLVED by the Village of Brooklyn Center,
Minnesota, thatthe low bid of McMullen Company in the amount of $1,890.00
for the furnishing of a 10 -ton tilting trailer in accordance with the
specifications is deemed to be the best bid submitted by a responsible bidder
for village purposes and said bid is hereby accepted.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon, the following voted
in favor thereof: William Super, Clifford Wellman, Carl Carlson.; and the
following voted against the same: none; whereupon said resolution was
declared duly passed and adopted.
Member Carl Carlson introduced the following resolution and moved 1
its adoption:
RESOLUTION TO CANCEL LEVY PREVIOUSLY
CERTIFIED TO THE COUNTY AUDITOR
WHEREAS at a Special Meeting of the Village Council of the Village
of Brooklyn Center held on June 17, 1958, a Resolution was duly
adopted providing in part that the sum of $8,800.00 be levied in
the year 1960 for payment of principal and interest on bonds issued
to finance Water Improvement No. 1957 -28, and
WHEREAS said Resolution was thereafter duly certified to the Auditor
of and for Hennepin'County, Minnesota, and

WHEREAS there is presently on hand in Improvement No. 1958 -B Fund
sufficient money to pay any and all principal and interest on said
bonds issued to finance construction of Water Improvement No. 1957 -2$,
and at least five percent in excess thereof, without the levy of said
$8,800.00 in the year 1960,
Be it Resolved by the Village Council of the Village of Brooklyn Center,
Minnesota, as follows:
1. It is hereby determined that the levy of a direct ad valorem
tax on all taxable property in the village previously made and certified
in the amount of $8,800.00 for the year 1960 in connection with the
financing of Water Improvement No. 1957 -28 is unnecessary and may be
cancelled, there being sufficient money on hand in Improvement No.

interest, and at least five percent in excess thereof, on said bonds
issued to finance said Water Improvement No. 1957 -28, without
collection of said direct ad valorem tax.

2. The Auditor of Hennepin County, Minnesota, is hereby requested
to cancel the said levy of $8,800.00 for the year 1960 previously
certified pursuant to the provisions of Section 475.61, Minnesota
Statutes, 1957•
3. The Village Clerk is hereby authorized and directed to
transmit a certified copy of this resolution to said Hennepin County
Auditor forthwith.
The motion for le adoption of the foregoing resolution was duly seconded by
member Clifford Wellman, and upon vote being taken thereon, the following
voted in favor thereof: William Super, Clifford Wellman, Carl Carlson; and
the following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
Merpber Clifford Wellman introduced the following resolution and
moved its adoption:
RESOLUTION APPROVING 1961 BUDGET
AND AUTHORIZING A LEVY THEREFOR
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center as follows:
1. There is hereby appropriated for expenditure in 1961
from general taxes, the following sums for the purpose indicated:
Village Operations and Administration $322,699.40
Poor Relief 3,000.00
Firemen's Relief Association 18,570,00
- Parks 18,570.00
Public Employees Retirement Association 18,137.88
County Parks 4,374.72 '

The foregoing does not include levies already certified to the
County Auditor for the payment of outstanding loans which levies
for the year 1961 are as follows:

State Loan 1,600.00
Park Bond Redemption 36 400.00

Total expenditures for the year 1961 from general taxes $454,952.00
2. There is hereby levied upon all taxable property lying
within the Village of Brooklyn Center, in addition to all levies
heretofore certified to the County Auditor as indicated in paragraph 1
hereof, the sum of $454,952.00, and the Clerk shall cause a copy
of this resolution to -be certified to the County Auditor, so that
said sum shall be spread upon the tax rolls and will be payable in the
year 1961.
The motion for the adoption of the foregoing resolution was duly seconded by
member Carl Carlson, and upon vote being taken thereon the following voted
in favor thereof; Carl Carlson, Clifford Wellman, William Super; and the
following voted against the same: None; whereupon said resolution was
declared duly passed and adopted.
Motion by Carl Carlson and seconded by Clifford Wellman that the
Village Council adopt a policy of accepting petitions until April l of each
year for construction of special improvements during that year. Petitions
received after April 1 of any year will be held for consideration of
construction the following year. Motion carried.
Motion by Clifford Wellman and seconded by Carl Carlson to accept
the Justice Report for September. Motion carried.

Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION REQUESTING ROADSIDE PARK AND
BOAT LAUNCHING RAMP
WHEREAS, a strip of land south of the Highway 100 bridge and extending
southward along the Mississippi River appears to exist as unused Highway
Department property upon the completion of construction of the Interstate
Highway, and,
WHEREAS, a roadside park and public access to the river do not now
exist in Brooklyn Center, and
WHEREAS, said unused property offers potential scenic and recreational
values for tourists and local citizens,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of Brooklyn Center,
Minnesota, as follows:
1. The Village Council, upon the recommendation of the Park Board of
the Village of Brooklyn Center, requests that the Minnesota Department of
Highways explore the possibility of developing and maintaining a roadside parl.
and boat launching ramp on the aforementioned property and to provide the
necessary access thereto.
The foregoing resolution was duly seconded by member Clifford Wellman and
upon vote being taken thereon, the following voted in favor thereof:
Carl Carlson, Clifford Wellman, and William Super; and the following voted
against the same: none; whereupon said resolution was declared duly passed
and adopted.
Motion by Carl Carlson and seconded by Clifford Wellman to appoint
persons as Election Judges for the General Election on November 8, 1960 as
set forth on the list attached to these minutes. Motion carried.
Motion by Carl Carlson and seconded by Clifford Wellman to approve
the following application for license:
Heating License - Domestic Heating Co., 1920 W. 78th St.
Motion carried.
The bills set forth on-the schedule attached to these Minutes and
made a part hereof entitled "The Bills Audited and Ordered Paid at the
Meeting of October 10, 1960" were audited and ordered paid.
