HomeMy WebLinkAbout1960 10-17 CCM Special Session Minutes of the Proceedings of the Village Council of the Village of Brooklyn Center in the County of Hennepin and State of Minnesota October 17, 1960 The Village Council met in special session and was called to order by Mayor William Super at 8:00 P.M. Roll Call: Mayor William Super, Clifford Wellman, Wayne Gageby, Carl Carlson and Russ Jones were present. The Mayor announced that the meeting was a continuation of the public hearing begun on October 6 1960, to consider objections to the assessments being levied in 1960. Property owners being assessed for sanitary Sewer Lateral Project No. 1960 -41 on Bryant Avenue from 61st Avenue to Lilac Drive were heard. Motion by Clifford Wellman and seconded by Carl Carlson to adjust the assessment for sanitary sewer on Project No. 1960 -41 from $500 per build- ing site to $460 per building site because the $460 figure was the amount specified in a notice sent to the property owners on August 10, 1960. Motion carried. The property owners being assessed for Project No. 1960 -22 on Dupont Avenue from 61st Avenue to Valley Drive were heard. Motion by Carl Carlson and seconded by Wayne Gageby to adjust the assessment on sanitary sewer lateral Project No. 1960 -22 to $495 per building site instead, of $500 because the $495 figure was the amount specified in the notice sent to the property owners on August 10, 1960. Motion carried. The Mayor then called upon all property owners present to present their objections to the above assessments. BE IT RESOLVED by the Village Council of the Village of Brooklyn Center, Minnesota, as follows: 1. The Village Clerk has, with the assistance of the Engineer heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for the improvements known as the improvements listed above of said Village against every assessable lot, piece or parcel of land in accordance with the provisions of law, and has prepared and filed with the Village Clerk tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed and the amount calculated against the same. 2. Notice has been duly published as required by law that this Council would meet in special session on Thursday, October 6, 1960, to pass on the proposed assessments. 3. Said proposed assessments have at all times been open to inspection and copying by all persons interested, and an opportunity has been given, to all interested persons to present their objections, if any, to such proposed assess- ments, or to any item thereof. 4. The changes in the proposed assessments as set out in the minutes are hereby rdered made in said Y i assessment rolls. 5• This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessments as amended was and is specially benef- ited by said improvements in the amount of said proposed assessment set opposite the description of each such lot, piece, or parcel of land, and that amount so set out is hereby levied against each of the respective lots, pieces or parcels of land therein described, -', 6. Such proposed assessmentsfas amended are affirmed adopted and con- firmed, and the sums fixed and named in said proposed assessments are affirmed, adopted and confirmed as the proper special assessments for each of said lot, pieces or parcels of land respectively. 7. Said assessments as(amended and so affirmed adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereon r on be and constitute the special assessments for the payment of the above listed improvements. 8. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 6% per annum. 9. Such assessments shall be payable in equal installments beginning in the year 1961, payable on the 1st day of January in each year, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectible during said year by the County Auditor, as follows: A. Water Improvements Nos. 1960 -29, 1960 -37, 1960 -47, 1960 -59,- and Public Utilities Water Nos. 1959-27 and 1959-52 in twenty equal annual instal- lments. E. Oil Stabilizing No. 1959 -30 in five equal annual installments. F. Sewer Connections and Water Hookups in twenty equal annual installments. 10. The Village Clerk is hereby directed to make up and file in the Office' of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the lst day of January in each year. The motion for the adoption of the foregoing resolution was duly seconded by member Carl Carlson and upon vote being taken thereon, the following voted in favor thereof; Mayor William Super, Clifford Wellman, Wayne Gageby, Carl Carlson and Russ Jones, and the following voted against the same: none, where+.- upon said resolution was declared duly passed and adopted. Motion by Carl Carlson and seconded by Wayne Gageby that the Village Adminis- trator be instructed to proceed with a study and survey concerning desirable truck routes, load limits and speed limits in the Village of Brooklyn Center.
