Council of the Village of Brooklyn Center
in the County of Hennepin and State of
Minnesota
November 14 1960
The Village Council met in regular session and was called to
order by Mayor William Super at 7 :30 P,M.
Roll Call: Mayor William Super, Carl Carlson and Wayne 0ageby
were present, In the absence of Clerk Russ Jones, Administrator A. J. Lee
recorded the minutes.
Motion by Carl. Carlson and seconded by Wayne Gageby to uphold
the recommendation of the Planning Commission to grant the special use
permit to Mrs. Harold Fleischer, 6424 Perry Avenue North, for -a weight
reducing salon in the basement of her dwelling in R -1 ,zone. Carl Carlson
and Wayne Gageby voted in favor thereof, and William Super voted against
the same. Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson to uphold the
recommendation of the Planning Co=Issbn`to deny a special use permit to
Colonial Builders, 5408 Girard Avenue North, for construction of a four
unit apartment at 5649 Girard Avenue and a double bungalow at 56+5 Girard
Avenue Motion carried,
Motion by Carl Carlson and seconded by Wayne Gageby to request
the building inspector to prepare a report concerning the number of
multiple swellings and their legal status in the area bounded by S3rd
Avenue, France Avenue, Oak Street and Twin Lake, =d to report to the
PAa - ming Commission and Village Council to assist them in the consideration
of the petition of Carl Johnson for a special use permit for a multiple
family dwelling of 5225 Prance Avenue North. Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson to uphold
the recommendation of the Planning Commission to approve the preliminary
plat of Gunderson's Addition and to grant a variance on the corner lot
of 68th and Aldrich Avenue from the required width of 90 feet to 75 feet.
Motion carried.
Motion by Wayne Gageby and seconded by Carl Carlson: to uphold
the recommendation of the Planning Commission to approve the preliminary
plat of Busse- Erickson 3rd Addition and to grant a variance on Lots 3'
and 4, Block 1, and Lots 3 and 4, Block 3 . , due to the location of the
sewer lines on 70th Avenue and that a vacation and easement proceeding
take place at the corner of 70th and Camden Avenue as proposed by the
village engineer. Motion carried.
Motion by Carl. Carlson and seconded by Wayne Gageby to approve
the special assessments on that portion of Project No. 1960 -11 on
Bryant Avenue from 53rd Avenue to 55th Avenue and on 53rd Avenue West
of Bryant Aven-ze with the exception that those lots which can not be
divided shall haze an assessment not to exceed $500.00, Motion
carried.
Trustee Clifford Wellman arrived at this point.

The Mayor announced that this was the time and place for
receipt of bids for the purchase of $768,000 Improvement Bonds in
accordance with the resolution adopted October 24, 1960.
The Clerk presented an affidavit showing publication of Notice
of Sale in Commercial Uost, a financial paper published in Minneapolis,
Minnesota, which affidavit was examined and foimd satisfactory and ordered

placed on file, together with a satisfactory affidavit of publication in
the Brooklyn Center Press, the official village newspaper.
The Clerk then presented the sealed bids which had been received,
which were opened and examined*and` found to be as follows:

After due coasi'.eration of the bids for $768,000 Improvement Bonds,
member Carl Carlson introduced the following resolution and moved its
adoption:
BE IT RESOLVED by the Tillage Council of the Village of Brooklyn
Center, Minnesota, that the tid of Kalman & Company, Inc, &
Associates to purchase $768,000 Improvement Bonds bearing interest
rate of 4.50% on all bonds maturing on January 1, 1962 to 1967,
inclusive; 4.20jo on all bonds maturing January 1, 1968 to 1978
inclusive; 3.00% on all bonds maturing January 1, 1979 to 1981
inclusive, together with an additional coupon of 1.50fa on all bonds
for the period of from January 1, 1961 to January 1, 1963, and to
pay therefor the sum of $768,000.00, is hereby found, determined
and declared to be the most favorable bid and is hereby accepted.

The motion for the adoption of the foregoing resolut on was duly seconded
by member Clifford Wellman, and upon vote being tat:en thereon the following
voted in favor thereof: William N. Super, Clifford Wellman, Carl Carlson
and Wayne Gageby; and the following voted against the same; None;
whereupon said resolution was declare. a .1y passed and adopter.

Member Carl Carlson introduced the following resolution and
moved its adoption:
BE IT RESOLVED by the Village Council of the Village of Brooklyn
Center, Minnesota, as follows;
1. The Village shall forthwith issue its negotiable
improvement bonds in the principal amount of $768,000, dated
December 1, 1960, being 768 in number and numbered l to 768
both inclusive, in the denomination of $1,000 each, bearing
interest at the rate of 4.50 percent per annum on all bonds
maturing January 1, 1962 to January 1, 1967, inclusive;
4.20 percent on all bonds maturing January 1, 1968 to
January 1, 1978, inclusive; 3.00 percent on all bonds maturing
January 1, 1979 to January 1 1981, inclusive; plus additional
interest at the rate of 1.50 percent for the period from
January 1, 1961 to January 1, 1963 to be represented by a
separate coupon, said bonds maturing serially in' the "years and
amounts as follows;
$48,000 on January 1, 1962
$50,000 on January 1 each year 1963 to 1966, inclusive,
$40,000 on January 1 each year 1967 to 1973, inclusive,
$30,000 on January leach year 1974 to 1981, inclusive,
with a prepayment option as follows:
All bonds maturing on January 1, 1972, and thereafter,
are subject to redemption in inverse numerical order on
January 1, 1966, or any interest payment date thereafter
upon payment as follows:
(1) if redeemed prior to January 1, 1971, at par plus
accrued interest plus a premium of 3% for each
bond redeemed;
(2) if redeemed on January 1, 1971, or thereafter,
at per plus accrued interest plus a, premium of 1%
for each bond redeemed.
2. Both principal and interest shall be payable at the main
office of the Northwestern National Bank of Minneapolis,
Minneapolis, Minnesota, and the Village shall pay the reasonable
charges of said bank for its services as paying agent.
3. The bonds and inteimt coupons to be thereto attached
shall be in substantially the following form:

KNOW ALL MEN BY THESE PRESENTS That the Village of Brooklyn
Center, Hennepin County, Minnesota, acknowledges itself to be
indebted and for value received hereby promises to pay to bearer
out of Improvement No. 1960 A & B Fund the sum of ONE THOUSAND
DOLLARS on the lst day of January, 19 , and to pay interest
thereon at the rate of percent ( %) per annum
together with additional at the rate of one and fifty
hundredths percent (1.50%) per annum for the period from

January 1, 1961 to January 1, 1963 or to prior maturity
represented by separate coupons, all interest payable
July 1, 1961 and semiannually thereafter on the 1st day
of January and the lst day of July in each year in
accordance with and upon presentation and surrender of the
attached interest coupons as they severally become due.
Both principal of and interest on this bond are payable at
the main office of the Northwestern National Bank of
Minneapolis, Minneapolis, Minnesota, in any coin or currency
of the U:ited States of America which at the date of payment
is legal tender for public and private debts.
All bonds of this issue maturing on January 1, 1972, and
thereafter, upon thirty (?0) days prior notice by mail to the
bank *where the bond: are payable and to the last known holder
are subiect to redemption in inverse numerical order on
January '1, 1966, or any interest payment date thereafter,
upox pn.yment at par plus accrued interest plus a premium of
$30.00 for each bond red -erred if redeemed prior to January 1,

This bond is one of an issue of bonds in the total principal
amount of $768,000, all of like date and tenor except as to
interest rates, maturity and redemption privilege, all issued
pursuant. to aad in fu .l conforml.t;,► !aita the Constitution and Laws
of the State of Mi wiesoba, including Minnesota Statutes, Chapter
429, as amended, foi: - ;,he purpose of defraying the expenses incurred
and to be incurred in special improvements of the Village, and is-
pcyable primarily f;:om special assessments to be levied against
property specially benefited thereby but constitutes a general
obligation of the Village, and to provide moneys for the prompt
and full payment of said principal and interest as the same become
due the full faith and credit or the Village is hereby irrevocably
pledged and the Village will levy ad valorem taxes if required for
• such purpose without limitation as to rate or amount.
IT IS HEREBY CERTIFIED AND RECITED That all acts, conditions
and things required by the Constitution and Laws of the State of
Minnesota to be done, to happen, and to be performed precedent to
and in the issuance of this bond have been done, have happened and
have been performed in regular and due form, time and manner as
required by law; and that this bond together with all other
indebtedness of thy: Village outstanding on the date hereof and the
date of its actual issuance and delivery does not exceed any
constitutional. or statutory limitation thereoxl.
IN WITNFSS WHEREOF, The Village of Brooklyn Center, Hennepin
County, Minnesota, by its Village Council, has caused this bond to
be signed by the Mayor and the Village ;Clerk and sealed with the
corporate seal of the village and the interest coupons hereto
attached to be executed and authenticated by the facsimile
signatures of said officers, all as of December 1, 1960.

8. The estimated collection of special assessments
for the payment of said bonds will produce at least five
percent in excess of the amount needed to meet, when due, the
principal and interest payments on the bonds. The Clerk shall
deliver a certified copy of this resolution to the County
Auditor of Hennepin County and obtain his certificate as
required by Section 475.63, Minnesota Statutes.
9. The said bonds, when fully executed, shall be delivered
by the Treasurer to the purchaser thereof upon receipt of the
purchase price, and the said purchaser shall not be obligated
to see to the proper application thereof.
10. The Clerk and Treasurer are authorized and directed to
prepare and furnish to the purchaser and to the attorneys
approving said issue certified copies of all proceedings and
records relating to the issuance of said bonds and to the
right, power and authority of the Village and its officers to
issue the same and said certified copies and certificates
shall be deemed the representations of the Village as to all
matters stated therein.
The motion for the adoption of the foregoing resolution was duly
seconded by member Clifford Wellman, and upon vote being taken thereon
the following voted in favor thereof: William N. Super, Clifford
Wellman, Carl Carlson and Wayne Gageby; and the following voted
against the same: None; whereupon said resolution was declared duly
passed and adopted.
Member Carl Carlson introduced the following resolution and moved
its adoption:
RESOLUTION ACCEPTING WORK
(CONTRACTED BY VILLAGE)
WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Lametti & Sons Construction Co.
has satisfactorily completed the following improvement in
accordance with said contract:
Sanitary Sewer area interceptor on 61st Avenue North
from Main Interceptor east of Lyndale Avenue No. west
to Fremont Avenue No. - Project No. 1960 -3.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. The work completed under said contract is hereby
accepted and approved upon recommendation of the Village Engineer.
2. The value of work performed exceeded the original
contract amount by $689.16 because of moving the line from Lyndale
Avenue to the Mississippi River and laying additional line, which
was included in a supplemental agreement.
3. The Village Officials are hereby directed to issue
proper order for final payment on said contract, taking the
contractor's receipt in full. The total amount paid for said
improvement project being $38,372.45.
The motion for the adoption of the foregoing resolution was duly seconded
by member Wayne Gageby, and upon vote being taken thereon the following
voted in favor thereof: William Super, Clifford Wellman, Carl Carlson
and Wayne Gageby; and the following voted against the same: None;
whereupon said resolution was duly passed and adopted.

4. The Village has agreed to furnish the approving legal
opinion of Messrs. Howard, Peterson, LeFevere, Lefler and Haertzen
to the purchasers and such opinion is hereby requested. The
clerk is authorized and directed to cause a copy of such opinion
to be printed on each of such bonds and to certify on each bond
to the fact that such cpinion is on file in his office prior to
the delivery of such bonds.
5. The Clerk is directed to cause said bonds to be prepared
and the Clerk and Mayor are authorized and directed to execute the
same and affix the Village seal thereto and to cause the interest
coupons to be executed and authenticated by the printed facsimile
signatures of said officers.
6. On October 24, 1960 the Village Council determined that
the total cost of Sanitary Sewer Improvement No. 1959 -19 was in
the amount of $768,000. It now appears that said improvement as
proposed at the public hearing held thereon was limited to only
a portion thereof at the time the Village Council determined to
proceed with the construction of said improvement. However, the
balance of the proposed construction under Sanitary Sewer
Improvement No. 1959 -19 was completed through Sanitary Sewer
Improvement Nos. 1960 -5 and 1960 -6. Therefore, the aggregate
cosh; of Sanitary Sewer Improvements Nos. 1959 -19, 1960 -5 and
1960 -6 is in the amount of $768,000 and as heretofore determined
a cost of $750,000 has already been incurred by reason of
contracts let for the construction of.said improvements
and the sum of $18,000 is the estimated cost for the completion

The Bost of said improvements as recited above has been assessed
against the benefited property owners, and said assessment roU
has been certified to the Auaitor of Hennepin County in tote
manner provided by law.
7. The bonds issued hereunder shall be payable from
Improvement No. 1960 A & B Fund. If any payment of principal or
interest on said bonds shall become due when there is not
sufficient money in said fund to pay the same, the Treasurer
shall pay such principal or interest from the general, fund Of 'the
Village and such fund shall be reimbursed for such advances out of
proceeds of assessments for said improvement when collected,

NOW THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Cater:
1. The work completed under said contract is hereby
accepted and approved upon recommendation of the Village
Engineer.
2. The Village Officials are hereby directed to issue
proper order for final payment on said contract, taking the
contractor's receipt in full. The total amount paid for said
improvement project being $1,944.00.
The motion for the adoption of the foregoing resolution was duly
seconded by member Clifford Wellman, and upon vote being taken
thereon the following voted in favor thereof: William Super,
Clifford Wellman, Carl Carlson and Wayne Gageby; and the following
voted against the same: None; whereupon said resolution was duly

Member Wayne Gageby introduced the following resolution and
moved its adoption:

WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Chicago Bridge & Iron Company
have satisfactorily completed the following improvement in
accordance with said contract:
1 MMG Elevated Water Storage Tank, Project 1960 -1A
NOW., THEREFORE, BE IT RESOLVED by the Village Council of
the Village of Brooklyn Center:
1. The work completed under said contract is hereby
accepted and approved upon recommendation of the Village
Engineer.
2. The value of work performed exceeded the original
contract amount by $71.00 because of the increased size of
casting.
3. The Village Officials are hereby directed to issue
proper order for final payment on said contract, taking the
contractor's receipt in full. The total amount paid for said
improvement project being $175,321.
The motion for the adoption of the foregoing resolution was duly
seconded by member Carl Carlson, and upon vote being taken thereon
the following voted in favor thereof: Clifford Wellman, William
Super, Wayne Gageby and Carl Carlson; and the following voted against
the same: None; whereupon said resolution was duly passed and
adopted.

Member Carl Carlson introduced the following resolution and
moved its adoption:

WHEREAS, pursuant to a written contract signed with the
Village of Brooklyn Center, Minnesota, Peter Lametti
Construction Co. has satisfactorily completed the following
improvement in accordance with said contract:
Storm Sewer Interceptor Line on 70th Avenue No.,
Project No. 1960 -7
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1, The work completed under said contract is hereby
accepted and approved upon recommendation of the Village
Engineer.
2. The value of work performed exceeded the original
contract amount by $1,322.75 because more pipe had to be jacked
than was oilginally estimated.
3. The Village Officials are hereby directed to issue
proper order for final payment on said contract, taking the
contractor's receipt in full. The total amount paid for said
improvement project being $198,780•59•

seconded by member Wayne Gageby, and upon vote being taken thereon

Member Clifford Wellman introduced the following resolution and

WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Petrowske & Ross Construction
Company has satisfactorily completed the following improvements
in accordance with said contract:
Sanitary Sewer Lateral Project Nos. 1959-45, 46, 47, 46,
49 and 50.
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. The work completed under said contract is hereby
accepted and approved upon recommendation of the Village Engineer,
2. The value of work performed exceeded the original
contract amount by $2,256.00 because of extension into park
property not included in estimate, plus additional pipe and a
manhole not included in the estimated quantities.
3• The Village Officials are hereby directed to issue proper
order for final payment on said contract, taking the contractor's
receipt in full, The total amount paid for said improvement
projects being $59,

Member Carl Carlson introduced the following resolution and
moved its adoption:

WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Petrowske & Ross Construction
Company has satisfactorily completed the following improvements
in accordance with said contract:
Sanitary Sewer Lateral Project Nos. 1960 -24 35, 44 & 45•
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved upon recommendation of the Village ]Engineer.
2. The value of work performed is less than the original
contract amount by $99$.50 because less material was needed than
was estimated.
3. The Village Officials are hereby directed to issue proper
order for final payment on said contract, taking the contractor's
receipt in full.. The total amount paid for said improvement
projects being $43,702.00.
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upcavote being taken thereon the
following voted in favor thereof: Carl Carlson, Wayne Gageby, William
Super and Clifford Wellman; and the following voted against the same:
None; whereupon said resolution was duly passed and adopted.
Member Clifford Wellman introduced the following resolution and
moved its adoption:

WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesota, Petrowske & Ross Construction
Company has satisfactorily completed the following improvements
in accordance with said contract:
Sanitary Sewer Lateral Project Nos. 1960 -37, 38, 46 & 47•
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn Center:
1. The work completed under said contract is hereby accepted
and approved upon recommendation of the Village Engineer.
2. The value of work performed is less than the original
contract amount by $1,559.00 because of excessive estimating of bid
items on proposal form.
3. The Village Officials are hereby directed to issue proper
order for final payment on said contract, taking the contractor's
receipt in full. The total amount paid for said improvement
projects being $56,660.25.
The motion for the adoption of the foregoing resolution was duly seconded
by member Carl Carlson, and upon vote being taken thereon the following
voted in favor thereof, Carl Carlson, Wayne Gageby, William Super and

Member Wayne Gageby introduced the following resolution and
moved its adoption;

WHEREAS, pursuant to a written contract signed with the Village
of Brooklyn Center, Minnesotaj Peter Lametti Construction Co.
has satisfactorily completed the following improvements in
accordance with said Contract:
Sanitary Sewer Lateral Project 146s. 1959-53, 1960 -81 9,
16, 17, 18, 19, 20, 21, 23 and 30.
NOWp THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Brooklyn denter:
1. The work completed under said contract is hereby
accepted and approved upon recommendation of the Village Engineer.
2. The value of work performed is less than the original
contract amount by $8,371.02 because of the deleting of 531
feet of pipe and appurtenances on North Lilac Drive and
excessive estimating on the proposal farm.
3. The Village Officials are hereby directed to issue
proper order for final payment on said contract, taking the
contractor's receipt in full. The total amount paid for said
improvement projects being $118,595.07•
The motion for the adoption of the foregoing resolution was duly seconded
by member Clifford Wellman, and upon vote being taken thereon the
following voted in favor thereof: Carl Carlson, Wayne Gageby, William
Super and Clifford Wellman; and the following voted against the same:
None; whereupon said resolution was duly passed and adopted.
Member Carl Carlson introduced the following resolution and

has satisfactorily completed the following improvements in

AN ORDINANCE RELATING TO THE ISSUANCE OF BAD CHECKS AND
PROVIDING A PENALTY THEREFOR
The Village Council of the Village of Brooklyn Center ordains:
Section 1. Sections 19.601 and 19.602 are hereby added to
the Village ordinances and shall read as follows:
Section 19.6 01. ISSUANCE OF CHECKS WITHOUT SUFFICIENT FURDS
PROHIBITED. Every person, firm, or corporation who shall issue any
check, draft, or order upon a bank or other depository for the payment
of money in payment of wages to any laborer or employee without having
sufficient funds in, or credit in, such bank or other depository for
the payment of such check, draft, or order in full upon its presentation,
shall be guilty of a misdemeanor. Every person, firm, or corporation who
shall issue any check, draft, or order upon a bank or other depository
for the payment of money for any purpose other than in payment of wages
to any laborer or employee without having sufficient funds in, or credit
in, such bank or other depository for the poyment of such check, draft,

or order in full upon its presentation shall be guilty of a misdemeanor,
unless within ten days after the issuer shall have received written
notice of dishonor by the holder in due course, he shall deposit with

session of such check, draft, or order sufficient money to constitute
payment in full.
The provisions of this section shall not apply to a check, draft, or
order dated subsequent to the date of issue.
Secti 19.602 PENALTY. Any person convicted of a violation
of Section 19.601 may be sentenced to imprisonment not to exceed 90 days
or a fine of not to exceed $100.
Section 2. This ordinance shall take effect from and after
its publication.
